Harrell faces molestation, child pornography charges

GREEN COVE SPRINGS -- Clay County investigators charged Jarred Mitchell Harrell with molesting a young child and 12 related child-pornography counts Wednesday, hours after the unemployed laborer was ordered held on $1 million bail in another child-porn case.

The new charges involve the production of a dozen images of child pornography and the molestation of that child, an arrest report said. The charges are lewd and lascivious molestation of a child younger than 12 years old and 12 counts of producing/promoting a sexual performance by a child.

Details such as the sex and age of the child and the time frame were not available in the redacted arrest warrant, which was served on Harrell in jail Wednesday.

"These new charges are even more serious than the possession of child-pornography charges he already faces."

While in Mississippi, he spoke twice on the phone to a person assumed by Lauderdale County, Miss., Sheriff Billy Sollie to be his mother, who told him, "keep your chin up, keep your mouth shut and get an attorney."

Harrell told her on the calls that he never signed anything when he was booked, saying the officials in the jail forgot.

According to Harrell's arrest warrant involving the molestation and production of child porn charges, detectives seized a digital camera belonging to the 24-year-old at his home in Callahan, Fla.

Police described thepictures as that of "a partially nude, white female child between the ages of 3- to 5-years old."

According to the warrant, the little girl was asked to "...place herself in different positions during recording."

It states Harrell "...was also seen on the recording taking his hand and spreading" the little girl's body parts in order to expose her genitals.

The warrant said the child's mom identified the girl as her daughter.

Police said the pictures were taken between August and November 2008, when the child was 3.

The mother also told police the video of her daughter was taken in Harrell's bedroom, in his Orange Park home, at 1152 Gano Ave.

The girl's mother was able to identify the room by looking at other pictures on Harrell's camera, which were taken at the same time as the video, police said.

In addition to the molestation and production of child porn charges, Harrell is also charged with 29 counts of possession of child porn.

Just released court records show the ages of the girls in those pictures, which police said were found on Harrell's computer, are from under 10- to 18-years-old.

Jarred Harrell, named a person of interest in the 2009 death of 7-year-old Somer Thompson of Orange Park, has been charged with premeditated murder.

Harrell, 24, already in the Clay County Jail on child pornography charges, was arrested anew Thursday. He also was charged with sexual battery on a victim under 12 and lewd and lascivious battery, according to a Sheriff's Office listing released early today of Thursday arrests.

The listing did not say who Harrell was accused of killing, but the Sheriff's Office said in a news release early this morning that it would announce a "major development" at a press conference at noon about the Somer Thompson case.

A Middleburg woman whose daughter was a one-time roommate of Harrell and who said she has known him and his family for years described him as a recluse who enjoyed playing computer games.

Lisa Buchanan said Harrell spent at least some time alone in his mother’s home at 1152 Gano Ave., at the time of Somer’s disappearance.

The home, which is a block from where Somer was last seen and along her route home from Grove Park Elementary School, was later searched by Clay deputies and FBI agents.

Even before Diena Thompson laid eyes on the man accused of killing her 7-year-old daughter Somer Thompson, the mourning mother was overwhelmed with anxiety and grief at the moment she'd come face to face with him.

When it came time for Jarred Harrell to enter the courtroom for a pretrial hearing Wednesday afternoon, the 24-year-old sat down and never looked back.

Even though Thompson had been preparing for this moment for months, nothing could ready her for the real thing. She was emotional before, during and after the hearing, and Clay County Sheriff Rick Beseler sat by her side through the proceedings.

"It was hard to keep myself in the seat and not say anything to him," Thompson said. "He's such a coward. He couldn't even turn around and face the mother of the child he murdered."

In court Wednesday, defense attorneys asked the judge to preserve text messages sent between the deputies who transported Harrell from Mississippi to Florida. The defense also asked that authorities preserve all their notes and memorandums, even though more than 11,000 documents and 35 video tapes have already been entered into evidence.

"I've never seen motions like this," the judge said.

The motions were denied, leaving Thompson with a small sense of victory with more difficult days ahead.

A few years back, a guy around here tried to kill himself with a pen while in custody. He failed. We figure it was because he missed. The target was small. He tried to get to his brain by sticking the pen in his eye.

There was a pre-trial hearing for the man accused of killing a girl in Orange Park in 2009, but his absence at the hearing raised the ire of one person.

Diena Thompson, the mother of Somer Thompson, believes Jared Harrell should have been at the hearing in Clay County court this morning, rather than just his attorney.

Diena Thompson has been in court for every pre-trial procedural hearing, though Harrell hasn't been there since April.

She said she doesn't fully understand the court system, but feels that Harrell should "stand up there like a man and face it like a man."

She also wants to make sure Harrell sees plenty of her when he does appear in court.

"He will have nothing but my beautiful face to look at for the rest of the time that he's in the Clay County court system," she said.

Harrell's next hearing is set for March 1.

He has the right to appear, but is not required to do so as long as he is represented by an attorney. Thompson would like to see that changed.

"We're going to make a difference in this and we're going to change how this works," she said.

Harrell pleads guilty to murdering Somer

Jarred Harrell pleaded guilty Friday to murdering 7-year-old Somer Thompson in October 2009.

The 26-year-old admitted to kidnapping, molesting and killing the Orange Park girl.

He also pleaded guilty in two other cases, including child molestation of a 3-year-old girl and possession of child pornography, a total of 59 charges.

Harrell was sentenced to life in prison, an agreement prosecutors and defense attorneys came to for Harrell to avoid the death penalty in a trial.

Harrell admitted that he confined Somer, sexually assaulted her, lewdly touched her in private areas and strangled her. He admitted that he then put her body in a container and then put the container in a Dumpster.

Just released video evidence shows Jarred Harrell initially told Clay County detectives he blocked memories from the day of Somer Thompson's slaying.
But more than an hour-and-half after the start of questioning, Harrell admits to molesting the 7-year-old girl after he killed her, according to video Times-Union staff reviewed.
One of two detectives shown in the video tells him they found DNA in her private areas. Harrell said it’s possible he may have touched her and DNA could have been transferred.
“Something happened that we haven’t talked about yet,” a detective says. “Maybe it was something that you’ve put out of your mind and put in a box and put away. But right now, while we’re talking and we can do something to explain it, we need to get it out of the box and look at it and figure out what it is.”
Moments later, Harrell admits to removing all of Somer's clothes. He said he did it after she was dead.
"Honestly, I didn't remember this until now," Harrell says.
Video shows Harrell's mother, Annis Dailey, joining her son in the room as the detectives leave. When she asks him how he’s doing, he says he’s not worried about himself and asks about her. Then he tells her about the interview.
“I just went ahead and told them what they wanted to hear,” he said.
He later says he was honest with the detectives and that he hoped to get psychological help.
“I just miss seeing you,” he tells his mother as they embrace. He then weeps for the first time since the interview tape began.
You’ll be OK,” his mother whispers.
The beginning of the footage shows Harrell initially telling detectives how he killed Somer and disposed of her body. The story, primarily how Somer was attacked, would later change from a victim killed in an abrupt moment of surprise to include how she was the victim of an attempted sex attack.
It includes Harrell's descriptions of Somer's height — about half his 6 feet, 2 inches — and him saying he thought she was possibly 8 or 9.
Harrell says child pornography turns him on but that he feels guilty after watching.
"When I'm looking at it, [it] doesn't really register that it's wrong," Harrell says.
The four-hour video is among a large volume of records released today by the Clay County Sheriff's Office and State Attorney's Office in the case, which ended when Harrell pleaded guilty Feb. 3.
He is serving four life sentences in the case after being convicted of first-degree murder, kidnapping, sexual battery and lewd and lascivious conduct.
The interview in the video was done in February 2010 after detectives returned to Clay County with Harrell, who was arrested in Mississippi on unrelated child pornography charges.
When he was arrested in a CVS drug store parking lot in Meridian, detectives talked to Harrell about links they had between him and Somer and asked how he would rate himself on a scale of one to 10 with 10 equating a monster.
"I am going to be a 10," he told them.
At a public rest stop near Dothan, Ala., during a break in the trip from Mississippi to Florida, Harrell smoked a cigarette at a picnic table and faced the topic of Somer’s murder. Asked if he has seen her the day she disappeared, he said, “yes.”
She appeared in the kitchen of the house, he said. She began to scream, he said, so he grabbed her and held his hand over her mouth.
Later, he said he’d held his hand over her mouth too long.
In the video, Harrell, at least appearing mild-mannered at first, recounts the confession he gave to detectives in the ride back to Clay.
Harrell initially told detectives he was in his mother's Gano Avenue home on Oct. 19, 2009, when Somer appeared in a doorway of his home looking for his dog. He doesn't say how she got inside.
He said he put one hand over her mouth and the other behind her head, which he demonstrated for detectives Ken West and Stephen Coyne. He said it occurred in the kitchen area of his home.
"She kind of went limp," he told two detectives in a small room at the Clay County Sheriff's Office. "I kind of noticed that through all the panic and everything, I noticed she wasn't moving. At that point I realized she was probably dead."
Harrell said he panicked and "didn't really know what to do." He put her body in a Rubber Maid box, put the box in his car and put it in a Dumpster behind Beauty and the Beef, a Fleming Island restaurant from where he had been fired. The garbage was hauled away the next day.
He put her book bag, lunch box, shoes and some books in the trash behind his house, where they remained for two weeks until he took the garbage to the road for pickup.
About 40 minutes into the interview, he begins to add more to the story.
"Is it possible you moved her clothes to be able to see some stuff before you put her in the box?" one detective asked.
"I didn't do it purposely and if it's something more than that, I've blocked that out," Harrell said.
Previously released records show once Harrell got her inside the home, he took off her clothes, fondled her and then tried to rape her. He initially told detectives he didn't remove her clothes.
He said his mother came to the home a short time later and they later went out to eat. He said he believes he was acting "pretty normal" when he saw his mother.
"At that point, I started already closing myself off to it," Harrell said. "As bad as it sounds, it wasn't in my head."

The State Attorney records, obtained this afternoon by the Times-Union, includes stacks of files documenting evidence of everything from records seized in computers belonging to Harrell to DNA technology analyzed during the case.
Several things of note in the State Attorney files: Somer's autopsy shows that she died of asphyixiation, which has been noted by authorities before, along with new information about her also suffering blunt force injuries.
DNA swabs taken from Somer's body matched samples of Harrell's DNA profile, while eliminating 89 percent of the remaining population. Eleven other people investigators thought could be connected to the case were eliminated by the DNA findings. Other matches were just below the threshold of a match with Harrell.
Following Somer's disappearance, friends of Harrell said he began acting strangely. He lost weight, became reclusive and began growing facial hair, they told investigators.
Harrell also was prone to off-color sex-laced jokes about children and was known to say "I am not afraid to steal a child," when he saw one, the documents said.
In another he asks and answers: "What is worse than finding 10 babies in one trash bin? One baby in 10 trash bins."

It was the friend’s observations, made to a Clay deputy at Fleming Island High School on Dec. 8, 2009 that first pinpointed Harrell as someone who might be involved in Somer’s disappearance.

The two friends told the deputy they were concerned about his change in behavior. The three were riding in a car together when the radio began to broadcast information about Somer’s disappearance.

“They advised Jarred immediately told them he wanted to go home,” the supplemental police report said.

By then, Harrell had been kicked out of an apartment by roommates who found disturbing pictures on his computer and had determined he had stolen an iPod.

They turned the computer in to police, but he told his mother they were setting him up.

Detectives were told Harrell bought and took large amounts of pills for [filtered word] enlargement and was shy around girls.

Another document in the file includes some detail of a police interview with Harrell after his arrest in Mississippi. The report, among a series of supplement reports filed by Sheriff's Office investigators, documents the molestation by Harrell of a young niece and his discussion about enjoying child pornography.

"Harrell advised that he needed help for his addiction to child pornography," the report said. "Harrell advises that when he is looking at child pornography, it does not register that is wrong, but he is excited by the taboo aspect of it. Harrell advises that he feels bad afterwards and then deletes and destroys it. Harrell advises he gets aroused while looking at the images."

In his confession about Somer's killing, Harrell wondered if having killed Somer, he could get help with his child pornography problem.

"I want to get help, but I don't know if I can do it under the guise of Somer," he said. "I don't want it to be openly available that I'm getting help because I have a problem with child pornography."

The Sheriff's Office records include documents, videos and photos of a two-year investigation into the slaying of Somer, whose body was found in a Georgia landfill two days later, Sheriff's Office Spokeswoman Mary Justino said in an email.

She disappeared on the way home from Grove Park Elementary School in Orange Park after running off from her siblings.

Among tips detailed in the documents is an early one by someone who said Somer would be seen petting a large white dog on Gano Avenue near the school. Neighbors along the street said they had seen a white dog at the house where Harrell was later contacted.

Harrell's family told detectives they had a dog, and though Somer was never specifically seen, children on the way home from school would stop to pet it.

Also early in the investigation Somer's mother told a detective Somer would "get into a car with anyone, especially if they had a dog," according to the documents from the State Attorney's Office.

A friend of Somer's said she would pet the white dog at the house later identified as Harrell's. She called the dog "Buddy," the report said.

The day she disappeared, she was seen sitting under a palm in that yard and appeared to be upset, the documents said.

In his interview with detectives after being brought back from Mississippi. Harrell denies he lured Somer into the house.

"He advised he had not gone out looking for anyone and had not said, 'Hey come here, you want to see my dog?'" and account of the interview said.

Justino said the Sheriff's Office records will include four hours of audio/video of Harrell's questioning by police and his confession, all police reports, search warrants, evidence submission reports, lab reports and records from the Georgia Bureau of Investigation.

Justino said Clay investigators met with Somer's mother, Diena Thompson, this week to go over the records. Thompson could not be reached to comment this morning.

Clay County Circuit Judge Don Lester sentenced Harrell, 26, to four life sentences on Feb. 3 after he pleaded guilty to Somer's slaying and the molestation of a young niece in 2008. The plea allowed Harrell to escape the death penalty.

Lester also sentenced him to more than 35 years on separate child pornography charges. Lester called Harrell's crimes "inconceivable."

Harrell waived his right to appeal as part of the plea negotiations. The Feb. 3 court hearing included emotional victim impact statements given by Somer's family, including her mother, grandparents, twin brother and sister. Harrell said nothing to the family.
