    Aarin Cratty made the baby brain dead and plain dead

    Aarin Paul Cratty, 20, was charged with Class B felony abuse or neglect of a child.

    South Central District Judge Bruce Haskell set bond for Cratty at $10,000 cash on Thursday. If released, he is not allowed contact with the baby.

    According to an affidavit from Bismarck Police responded to a apartment on Tuesday for a report of an unresponsive child. Cratty told them the boy was not breathing.

    Metro Ambulance transported the child to St. Alexius Medical Center, where Dr. Patricio Fernandez examined him and determined he had a bleed in his brain and retinal hemorrhages - both of which the doctor said are signs of shaken baby syndrome.

    Fernandez, a pediatric cardiologist and neonatologist, said the baby may be brain dead, though more tests will be completed, the affidavit said.

    Burleigh County Assistant State's Attorney Lloyd Suhr said he could not comment on the baby's condition, as the case remains under investigation.

    Betz wrote in his affidavit that Cratty said he shook the baby on Tuesday, and the child's head struck his knee. He said he was frustrated when the baby would not stop crying.

    It takes a LOT less effort to lay the baby down and walk away than to shake them like this!

    That was a beautiful baby boy and this is sad.

    We should take this asshat and shake him till his brain rattles out of his head. Oh wait, That would imply he even has a brain, which he obviously doesn't. Anybody with a brain knows you don't shake a baby to comfort them. First if they aren't hungry you check their little diaper, then snuggle them and gently rock them to comfort. Hell my 8 year old niece knows this and she's way to young to have a baby.

    Sorry guys, I'm not having a good day when it comes to these baby killers today. I seem to be crying over every story and asking "why can these people have children and I can't. Life is just so unfair sometimes.

    Poor little thing. People need to be even more aware of what not to do than they already are. Put baby down and walk away needs to be a mantra that is repeated over and over and over. I imagine these people's issues may be compounded because the babies may suffer from drug and alcohol exposure. Maybe they cry more? Then couple in the fact of unemployment, ongoing drug and/or alcohol abuse and it's a recipe for disaster.

    A Bismarck man accused of shaking his infant son has been charged with murder in the death of the 3-month-old.

    Aarin Cratty, 20, was charged with the Class AA felony on Thursday. A previously filed Class B felony abuse or neglect of a child charge has been dismissed. His bond was increased to $100,000 cash from a bond of $10,000 set when the original child abuse charge was filed.

    If convicted, Cratty could face up to life in prison without parole and would be required to register as an offender against children.

    WTF???

    Whatever happened to innocent until proven guilty? Not one of you people knows the whole story here, only the lies that the reporter printed in the paper. That baby was in the custody and care of several different aunts when his parents were at work. Aarin was working two jobs trying to support not only his own family but to cover extra expenses for the several sisters and their 8 or 9 kids who were always there demanding things from them, and as a results was hardly ever at home. It's highly possible that someone else caused the injuries; they blame Aarin because he was the last one to hold the baby before he went limp. If you don't know the whole situation you have no right to judge or to be making the comments that you are making in these forums, as if he's already been convicted when the likelihood is that he didn't do anything at all, he's just being blamed and prosecuted because he was the last one to hold the baby.

    I feel sorry for people like you who have nothing better to do than latch on to someone else's misfortune and make judgments regarding situations that you really know nothing about.

    By the way, the picture of the baby that you have posted is copyrighted to the baby's grandmother. You have no right to use it without her permission. I will alert her to the fact that you have it posted here along with the libelous statements that are being made about the baby's father.

    "innocent until proven guilty" is a legal concept for a court of law. Last I checked, this is not a court. Maybe a court of public opinion and in that case, we had to work with what we were given... the media report.

    Dakota is 100% right-this is a forum of public opinion. We base our opinions on what "facts" are given to us at the time. The article says that the father admitted to being frustrated and shook the baby and his head hit his knee - hence we voice our opinion on the given report at this time. If the reports were to change and we find that out to be false - then our opinion would then again change. Bottom line is a 3 month old baby boy is dead, that should be the main concern here - not what you think of our opinions- because again - they are just opinions, but the fact remains that a little baby boy died tragically.

    If people like this are "man" enough to shake an innocent baby then step up and admit to what you have done rather then trying to down play it. He violently shook his own son not played with him too rough...asshole!

    Would love to hear what TruthWins thinks now! Not to mention whoever his supporter is/was is too stupid to read the article that clearly stated in the affidavit that he admitted to shaking his own son.

    Cratty Sentenced to 10 Years for Infant Son`s Death
    A Bismarck man who pleaded guilty to murdering his 3-month-old son will go to jail for 10 years. Aarin Cratty is just a few days away from his 21st birthday.
    The sentencing hearing took about an hour. Prosecutors asked for 40 years in jail, and another 20 years suspended, but what Cratty will serve will be much less than that.

    Cratty pleaded guilty in June to murdering his 3 1/2-month-old son, Hank. But even prosecutors say this wasn`t a typical murder case.
    "Obviously this is not the usual murder case we see," said Richard Riha
    , Burleigh County State`s Attorney.
    Riha says Cratty shook the baby last October, resulting in the infant`s death. But Cratty`s attorney says he was playing with the child when the baby`s head struck his knee.

    "You have someone who by all accounts, according to all of the officers, if you listen to the tapes, the one thing that`s repeated was this was an accident," said defense attorney Travis Finck.

    Cratty`s parents both testified on his behalf before the judge handed down a sentence.

    "We visited and each time we visited, Aarin was your perfect picture of a father, as far as the doting father," said Cratty`s father Lance Cratty.

    "He`s not a bad person. He made a tragic mistake," explained Cratty`s mother Christie Cratty. "It was an awful accident and we`ve all been through hell because of it, but I don`t think he deserves to spend the rest of his life in prison for this."

    The most emotional testimony came from Hank`s mother.

    "I don`t think he should be in there,

    " said Lori Lyon, Cratty`s fiance. "He`s a good guy. He wouldn`t harm anybody."



    She said he didn`t believe Cratty posed a danger to anyone, and says she has been able to forgive him.
    Even Cratty himself says he`s sorry for what happened.
    "It was an accident.

    I`d never hurt my son on purpose," said Cratty. "I don`t think anyone would."
    Finck says even though state law requires child abuse that ends in a death to be regarded as murder, what happened in the case was similar to several recent manslaughter cases where defendants received five to seven years in jail.

    Finck said, "Sometimes in this profession you have to pull yourself away from the paper and look at people."

    Judge David Reich sentenced Cratty to 25 years with all but 10 suspended for five years. That means he will spend 10 years in prison, and because it was a violent crime, he will have to serve at least 85 percent of the sentence.
    Cratty will receive credit for nearly a year that he has already been in jail.

    So in reality, if he's a good boy in prison, he'll be out in about 7.5 years, his son only lived 90 days, it just doesn't seem right, does it?

    So he was playing with baby and his head struck his knee? 3 months old and "playing" that rough....with the damage baby sustained he had to be shaking baby pretty damn hard...playing or angry with him, either way baby lost everything. He, only 10 years if that.

    What a beautiful waste of life. Heaven's light little one...

    so the judicial system fails the ones that can't help themselves again. Your right with good behavior, he will be out in less than 7 years. That is the first time I have heard of having to register as an offender against children (interesting if it works) - but he will be out in time to procreate and kill again, we will see then.

    I feel sorry that you can't see what's in front of your face and think that the poor grandmother has time to worry about a copyrighted picture of a beautiful but now dead baby.

    Truly, save your outrage for those that deserve it. Not for those of us who stand witness to the crimes and horrors perpertrated on these poor beautiful babies.

    Beautiful perfect baby boy, Im just appalled that someone can beat or shake a baby, I want to invent a machine that will shake adults, put them in it and if shakes them at the same intensity and makes them brain dead...
