    2nd-grade teacher, Kathleen Borgia, gets a DUI on the way to work

    An elementary school teacher recently reinstated to her job after an unsuccessful attempt by the Bristol Warren Regional School District to fire her was charged with drunk driving Monday morning on her way to work at the Colt Andrews School.

    Kathleen Borgia, 43, was charged with driving under the influence and refusal to submit to a chemical test shortly after 9 a.m. Monday. Bristol Police Lt. Steve Contente said a detail officer working a construction site on Hope Street noticed Ms. Borgia’s white Ford Mustang swerving, and police also received a call about an erratic driver from a witness...

    After refusing to submit to a chemical test, Ms. Borgia was booked and transferred to Sixth Division District Court in Providence for arraignment. Termed a violator — she had recently violated the terms of parole from an earlier charge — she was released on bail.

    This is not the first incident involving Ms. Borgia, who the school committee tried unsuccessfully to fire last September for a series of alcohol and domestic abuse incidents on and off the job dating back to 2005.

    In response to an appeal of the termination filed by her union, arbitrator John J. Pendergast III ruled in June that the district did not have cause to terminate Ms. Borgia. He ordered the district to reinstate Ms. Borgia to her former position, and to pay her for earnings and retirement payments lost during her suspension without pay.

    Though school district officials subsequently appealed Mr. Pendergast’s decision to Superior Court, Superior Court Judge Michael Silverstein decided over the summer to uphold Mr. Pendergast's decision that she could return to the classroom.

    Borgia is a long-time educator who was named the school’s “Head Teacher” just prior to the school committee’s decision to terminate her in September 2008. Though she was viewed by many as an excellent teacher, court records indicate she also has a history of alcohol abuse and several arrests by local police. It was those incidents, and one from 2005 in which she was found to be under the influence on the job, that led the district to conclude last year that she was unfit to teach Bristol elementary school students and, ultimately, fire her.

    Borgia has violated her probation on an earlier charge, Contente said. Borgia pleaded no contest in the fall of 2008 to a charge of violating a restraining order, according to Contente and court records. That case was filed for one year on Oct. 8, 2008. She was ordered to undergo batterers intervention and to have no contact with the victim, according to court records.

    Borgia also pleaded no contest in August 2004 to a charge of felony domestic assault that was reduced to a charge of domestic simple assault, according to Contente and court records. She received a deferred sentence of five years and was ordered to undergo domestic-abuse counseling and alcohol counseling, according to court records.

    If you have to get drunk just to haul your ass to work, I think it's time you start looking for a new career

    When asked about her status Wednesday, Superintendent Dr. Edward Mara said Ms. Borgia is “absolutely not back in the classroom.” Though he said there is a legal process that must play out before he and the school committee determine the next step, she was almost immediately suspended when district officials found out about the arrest.

    “She was suspended Tuesday,” he said. “We would have suspended her Monday, but she was otherwise detained.”

    As for the decision to suspend her with pay, he said: “That’s normal operating procedure. We are not the judge and jury. Once the (case has been adjudicated), then we have options open to us.”

    A judge said Friday that a Bristol teacher caught driving under the influence on her way to school is dealing with such severe emotional and substance-abuse issues that he ordered her driver’s license suspended for six months, twice as long as usual for a first offender.

    “It was early in the morning,” said Magistrate Joseph Ippolito Jr., referring to the 9 a.m. arrest of Kathleen Borgia, 43. “This lady has serious issues with alcohol abuse. The court feels it cannot be dealt with in a three-month period.”

    But after Borgia pleaded no contest to driving under the influence and received her sentence, her lawyer, Michael Egan, said outside the courtroom that she denies drinking alcohol before getting in her car to drive to school on Sept. 28. Egan said, however, that she had been taking numerous drugs she had been prescribed for psychological problems and for pain from Lyme disease. He said that she has dealt with severe stress for several years related to difficult divorce proceedings and child-custody battles with her husband.

    “It’s an unfortunate situation. Obviously, Mrs. Borgia has some serious issues to deal with,” Egan said. “She needs some serious help. The court took that into consideration.”

    Borgia was ordered to receive substance-abuse counseling, to perform 10 hours of community service and to pay a $100 fine. In an unusual move, he ordered Borgia to report to the bail department’s pretrial services office to begin a substance-abuse monitoring program.

    Borgia, who appeared in court alone yesterday, did not speak other than to enter her plea and to say she understood she was giving up her right to a trial.

    I would say that is sad and I can't believe that a person would drink like that before or even during work..but I have a co-worker that does that. She blames her drunkeness on Xanax. While I aware that Xanax can make a person seem drunk it does not make them smell like booze.

    This is the sign on a person who has a drinking problem.
