    U.S. Attorney Nora Dannehy announced Thursday that Douglas Perlitz, 39, founder of the Project Pierre Toussaint school in Cap-Haitien, was indicted by a federal grand jury on numerous counts. Perlitz founded the school and raised money for its operation when he lived in Connecticut.

    "This defendant is alleged to have used his position of power to manipulate and sexually abuse vulnerable boys for nearly a decade," Dannehy said.

    Perlitz was arrested at his home in Eagle, Colo., on Wednesday, a day after the grand jury in Bridgeport, Conn., indicted him. A U.S. magistrate ordered him detained pending a hearing Friday in federal court in Denver.

    The indictment lists seven counts of traveling outside of the United States with the intent to engage in sexual conduct with minors and three counts of engaging in sexual conduct in foreign places with minors.

    Perlitz's lawyer, federal Public Defender Matthew Golla, did not immediately return a phone message Thursday. There was no public phone listing for Perlitz.

    Authorities say Perlitz, who lived in the Connecticut cities of Bridgeport, Stamford and Fairfield, enticed children into sex acts by promising food, shelter and items including cash, cell phones, electronics, shoes and clothing. Prosecutors say Perlitz would sometimes withhold benefits or threaten to expel the boys if they refused to have sexual relations.

    The indictment said Perlitz received funding from a religious organization to found Project Pierre Toussaint in 1997. The program initially served mostly street children as young as 6 years old, and later expanded to include a residential program for high school-aged children. Children were offered meals, sports, classroom instruction and access to running water for baths.

    The indictment alleges that minors were sleeping in Perlitz's bedroom in a two-story house known as "Bel Air." When others questioned Perlitz about it, he tried to hide the sexual abuse by saying it was common in Haiti for children and adults to sleep together, the indictment alleges.

    Volunteers and staff members were scared to come forward with the allegations, the indictment says, because Perlitz controlled the school's operations and "utilized the fear of unemployment and the difficult economic situation in Haiti."

    The arrest should be a warning to child sex predators who think they can get away with victimizing children outside the U.S., said John T. Morton, assistant secretary of the Department of Homeland Security for U.S. Immigration and Customs Enforcement.

    Each count in the indictment carries up to 30 years in prison and a $250,000 fine.

    The investigation continues and the U.S. embassy in Port-au-Prince has set up a hot line for people to call with information pertinent to it. Dannehy said federal immigration agents and State Department officials stationed in Haiti also worked on the case.

    A federal law passed in 2003 aims to prosecute Americans who travel overseas — beyond the reach of U.S. law — to have sex with children.

    Indictment tossed, prosecutors look to file new sex-abuse charges against Perlitz
    NEW HAVEN -- Hours after dismissing the sexual abuse indictment against Douglas Perlitz, a federal judge Wednesday ordered the 2002 Fairfield University commencement speaker kept in custody at least until July 23 as prosecutors move swiftly to file new charges.

    This allows the prosecution team to file charges in federal court in Brooklyn, N.Y., alleging that Perlitz flew from Kennedy International Airport to Haiti with the intention of sexually abusing young boys in that impoverished country. It also gives U.S. Attorney David Fein time to discuss with his supervisors at the Justice Department in Washington the feasibility of appealing the dismissal.

    The 25-page ruling by U.S. District Judge Janet Bond Arterton, who found there is no evidence that the Fairfield University graduate committed any criminal act in Connecticut, set off a six-hour flurry of meetings, conference calls and court filings all intended to release or keep Perlitz behind bars.

    "If I were a gambling man," said Jeffrey Meyer, a former assistant U.S. attorney here who headed the appellate division, "I would expect the government to file a criminal complaint" in Brooklyn. "That way, they could easily move the whole prosecution team there."

    He said appealing the dismissal "might help clarify the law," but could delay what was expected to be an Oct. 1 trial for more than a year.

    "I tend to doubt they would want to do that," said Meyer, now an associate professor at Quinnipiac Law School.

    But New York is not the only state that may come into play. Investigators have evidence that Perlitz also boarded flights in Florida and Colorado to travel to Haiti.

    "Perlitz may have won the battle," said Alex Hernandez, a former assistant U.S. attorney who supervised the Bridgeport office before going into private practice, "but in the long term may lose the war."

    If the government is inclined, it could indict Perlitz in several states, a move that could drain his defense fund.

    "If the government should obtain a warrant from a court in which it believes there is proper venue, Mr. Perlitz is prepared to plead not guilty, just as he did in Connecticut," said William F. Dow III, who with David Grudberg is representing Perlitz. "It's somewhat surprising that the government would have overlooked a basic element of the case in its indictment."

    No matter what route the prosecution takes, it will have to bring evidence and witnesses before a new grand jury in a new state. When and if prosecutors obtain new indictments, the legal process starts all over again with an arraignment, a request for bond and new motions to dismiss.

    Until Wednesday, Perlitz, 39, a former Fairfield and Bridgeport resident, was charged with 24 counts of traveling from the U.S. to Haiti with the intention of engaging in sexual conduct with 18 underage boys.

    However the project's luster dimmed in August 2007 when several students complained to a Haitian journalist that they were being sexually abused by Perlitz.

    This led to an investigation by the Haitian National Police and the United Nations, which in January 2009 sought a warrant for Perlitz's arrest. But by then he had returned to the U.S. So Haiti and the U.N. appealed to the U.S. to prosecute him.

    In September, Perlitz was indicted and arrested. Since then, he has been detained without bond in Rhode Island.

    In April, Arterton heard arguments from Perlitz's attorneys seeking a dismissal of the indictment.

    They claimed that Congress overstepped its bounds by extending federal prosecution of sex crimes committed in a foreign country, claiming the indictment did not specify all elements of the alleged crime, and claiming no criminal act occurred in Connecticut.

    But Arterton focused on the Connecticut criminal connections and vigorously questioned both sides.

    Assistant U.S. Attorneys Krishna Patel and Stephen Reynolds explained most of the donations for Perlitz's project were raised in Connecticut and then wired from here to his Haitian bank account. They pointed out that most of his flights were booked in Connecticut and he usually drove from Connecticut to Kennedy Airport.

    But on Wednesday, Arterton ruled that wasn't enough.

    She pointed out that "Perlitz is not alleged to have traveled in foreign commerce or engaged in any illicit sexual conduct while in Connecticut." As a result, she said both the Constitution and the Federal Rules of Criminal Procedure "prohibit the government from prosecuting him for those crimes in Connecticut."

    She did not rule on any of the defense team's other claims.

    Despite dismissing the indictment, Arterton gave the prosecution an out. She ruled that "the dismissal for improper venue does not prohibit the Government from seeking an indictment against Perlitz ... in the states where the said crimes shall have been committed."

    Still her dismissal set off an outcry from advocates for victims of sexual abuse like the Survivors Network of those Abused by Priests and Paul Kendrick, a founding member of Voices of the Faithful's Maine Chapter.

    Douglas Perlitz pleaded guilty in U.S. District Court in New Haven on Wednesday to one count of travel with intent to engage in illicit sexual conduct, a charge that carries up to 30 years in prison. Sentencing was set for Dec. 21.

    Perlitz is a former Fairfield County resident who now lives in Eagle, Colo. He was charged last year with enticing boys at the Project Pierre Toussaint School in Cap-Haitien into sex acts by promising them food, shelter and other items.

    Prosecutors say Perlitz also withheld benefits and threatened to expel the boys if they refused his wishes.

    Perlitz founded the school in 1997 when he lived in Connecticut.

    American gets nearly 20 years for sexually abusing Haitian boys
    (CNN) -- An American school founder who young Haitian men once hailed as a savior was sentenced Tuesday to nearly 20 years in prison for sexually abusing them.
    Douglas Perlitz, 40, was sentenced in federal court in New Haven, Connecticut, to 19 years and 7 months behind bars for abusing the Haitian men when they were boys under his care, said Bruce Foucart, special agent in charge of the U.S. Immigration and Customs Enforcement (ICE) Office of Homeland Security Investigations in Boston.

    "We're very pleased with the sentence," he said. "He was brought to justice and I hope it sends a strong message to people who are doing that or who are even thinking about doing that."
    Judge Janet Bond Arterton imposed the sentence, which includes 10 years of supervised release.

    Perlitz arrived in the northern Haitian city of Cap-Haitien in 1997. There, he opened a charitable school called the Project Pierre Toussaint (PPT). He got homeless boys off the streets and gave them shelter, food and education.

    "When I met Mr. Douglas, he appeared to us like Jesus Christ himself come to rescue us," said Francilien Jean-Charles, who was only 12 when he was plucked by Perlitz and brought to the school.
    Over the years, PPT grew into a 10-acre compound with dorms, classrooms and a soccer field.
    Perlitz frequently flew back to Fairfield, Connecticut, to raise money. According to court documents, from 2002 to 2008, donors gave more than $2 million to help care for the kids. Perlitz's alma mater, Fairfield University, awarded him an honorary degree in 2002 for helping homeless boys in Haiti.

    But Perlitz was hardly the man he appeared to be.
    "I thanked God when I met Douglas," said Jean-Charles. "But when things started to turn bad, I realized it would have been better if I never came to PPT."
    Perlitz wore a watch that lit up and at night, he used it to seek out the boys, they said. Fredlin Legrand said he woke up to see Perlitz next to him.
    "He gave me a pill that made me fall asleep and when I woke up, I found my pants covered in sperm," Legrand told CNN.

    Jean-Charles and a dozen other boys told CNN they were routinely raped by Perlitz for years. But they were afraid to speak out against the man who had been such a boon for the city.

    Finally, in 2007, some of the boys approached their teachers and other adults. No one believed what they were hearing.

    Brian Russell, a donor for the school, said Perlitz was a miracle maker, not a pedophile.
    "There was no way that this man could have committed these things that people were accusing him of. It seemed utterly out of the realm of possibility," Russell said. "There was too much goodness. The heart was too big."

    The boys grew desperate. They painted graffiti on the outer walls of the school, most of which has been painted over. But one plea for help still exists: "Welcome, Haitian National Police."
    The police never came, but journalist Cyrus Sibert noticed the writing on the wall.

    "I told the boys, I will go to the end with you," Sibert said. "Are you ready?"
    But even after Sibert aired his interviews with the boys, Haitian authorities and American donors still did not believe the accusations.

    It was only after an American volunteer at the school relayed accusations of older boys raping younger ones that red flags went up. Russell said the volunteer demanded from the headmaster that something be done immediately.
    His response was: "Well, that's really hard because Douglas has been doing this for the last 10 years."

    Russell felt broken, betrayed.
    "I felt like all the money I had donated, the time that I had given, something that we had worked so hard for was gone."

    In September 2009, U.S. ICE agents picked up the case and arrested Perlitz. He denied the accusations, but in August, Perlitz pleaded guilty to one count of traveling with the intent to engage in illicit sexual conduct. He also admitted to engaging in sexual conduct with eight minors.
    The defense requested a delay in sentencing, contending Haiti's January earthquake, cholera outbreak and election-related street violence made it impossible to thoroughly review the prosecution's claims against Perlitz. The court denied the request.

    In addition, the defense maintained that Perlitz himself was a victim of sexual abuse. According to a defense memorandum, while he was at Fairfield University, "a priest began a relationship with Doug that ... ultimately took on a dark aspect, both physically and spiritually, that had a significant and long-lasting impact on him."

    The prosecution quickly responded, saying: "Perlitz's sexual abuse of minors, abuse which lasted for a decade or more, shows him to be nothing more than a wolf in sheep's clothing -- an American man who traveled to Haiti purporting to care for homeless children when in reality he preyed upon the desperation of these children so that he could sexually abuse them."

    Some of the boys, now young men, were in court Tuesday for the sentencing. They faced the man who abused them for years and spoke about their experience, bringing a sense of reality to the courtroom, said Foucart. They testified about how afraid of Perlitz they were and how he threatened to throw them out of the school and back on the streets if they spoke up.
    Paul Kendrick, an advocate for victims of abuse familiar with the case, was in court. He said Perlitz apologized to his victims at one point during the proceeding.

    A federal lawsuit has been filed against Fairfield University, the Society of Jesus and a Colorado man sentenced to nearly 20 years in prison for sexually abusing children at a school he founded in Haiti.
    One of the alleged victims of Douglas Perlitz of Eagle, Colo., filed the lawsuit Monday against Perlitz and others, seeking $20 million in damages against each defendant on each count they are named.
    The lawsuit accuses the defendants of negligence in hiring and supervising Perlitz.
    It accuses other defendants, some of them not named, of aiding Perlitz's efforts to cover up the abuse.
    Telephone messages were left for Fairfield University and the Society of Jesus, and an attorney for Perlitz.
