Elisa and Shaun Green thought a bath seat was a good babysitter

A young Tucson mother and father are behind bars for the drowning death of their one-year-old daughter.

Elisa and Shaun Green are both charged with one count of negligent homicide, and three-counts of child abuse for the Fourth of July incident.

Police say Rachael Green was left in a bathtub with her 2-and-3-year-old siblings.

Police say she was in a bath seat, but slipped under water unsupervised.

She was rushed to the hospital, and placed on life support, but died five days later.
    [...]

"With all the evidence it looks like the parents were negligent, and leaving the child for one in the bathtub, but there were other factors that were factored into it and they've been charged with negligent homicide," said Sgt. Diana Lopez with the Tucson Police Department.
    [...]

Shortly after Rachael's death her father did speak to NEWS 4.

"Don't trust what you are led to believe, would keep your children safe, and you never know what's going to happen," said Green.
    [...]

The couple's 2-and-3-year-old children are now in CPS custody.

I am pretty sure these type of products have warnings all over them similar to DO NOT LEAVE CHILD UNATTENDED IN THE BATHTUB. They have that for people who lack common sense.

I would worry about any of the kids those ages drowning each other just in play. Little kids can't figure out that they can't breathe under water, much less that their siblings can't.

That they do, and they have since day one of their production.

This happened to someone that my ex-sister-in-law knew many years ago (mid-late 90s). When she was telling me about it, the last thing she said was "If I were them, I'd sue the company". I said "But they can't. It specifically says that it's not a safety device and not to leave your child unattended." Then I made a comment about it not being rocket science, that the only thing holding it to the bottom of the tub was a couple of suction cups. That pissed her off, and she didn't say anything else to me about it. Probably because she'd left her own son in one unattended many times.

People just don't pay attention or use common sense. When it ends like cases like these; that's neglect. In the case I mentioned, that particular couple didn't get arrested. In the years since though, LE has begun to crack down on death by parental carelessness. I say it's about time.

I never liked those bath seats, and didn't use them. Once a child is old enough to sit up in the tub, get 'em in, get 'em washed, play a couple of minutes and get out!

I can't imagine why you would ever leave your little one in a seat like that by itself. When my niece was alone in the baby tub that was set inside a big bathtub. (my husband's grandmother who is in her 60's left her in there) and she was like 3 years old. I was so angry about it and told my SIL... When we left Itty Bit with his Grandmaw, I straight out told her to NOT give her a bath... To not offend her, I told her it was my "special time" for the bathtime... It's amazing how many people did this and still do it...

Those seats have a tendency to flip over if they come unstuck at all from the bottom of the tub. Once flipped it is almost impossible for a baby to get back up. I saw this happen with my own child when she was young. Luckily I was right there and could sit her back up, but I never used it again. They seem more trap than help.

omg this makes me cry that the other kids were there when she died and were patting her and saying baby.... omfg

A couple arrested in the drowning death of their 1-year-old daughter have an extensive past with state Child Protective Services, court records show.
Elisa and Shaun Green, both 24, are facing negligent-homicide and child-abuse charges in connection with the death of their child, Rachael Green.
The couple had their children removed from their custody for failure to thrive, according to court documents released Tuesday. They completed required parenting classes and a family CPS plan, and their children were returned to them in 2008.
After the children's return, the parents continued to neglect the kids, court documents say. CPS has filed to sever their parental rights.
Their daughter Rachael died on July 8 after she was left unattended in a bathtub with two siblings — both under the age of 4. Her mother was "multitasking" and her father was watching a movie, according to an interim complaint.
The children got dirty with ketchup, so their mother decided to bathe them, the complaint said. Elisa Green placed Rachael in a safety seat that was hooked to the tub and left the children alone.
The mother then went to get a baby blanket to dry the kids off and spoke to her husband about their Fourth of July plans before she began making pancakes, the interim complaint said.
When she no longer could hear the kids making noise, she went to check on them and found Rachel face-down in the water with the other children patting her on the back and saying "baby." Elisa Green took Rachael out of the tub, but the child was unresponsive. Rachael was taken to a hospital, where she died.
Police said the father knew his wife was giving the kids a bath and did not offer to help because he was watching a movie, the interim complaint said.
Elisa Green told police that Rachael was able to get out of the safety seat, either on her own or by her siblings pulling her out.

The parents of a 1-year-old girl who drowned in their bathtub pleaded guilty to negligent homicide and child abuse Wednesday and will spend time in prison.

Elisa and Shaun Green, both 25, are both eligible for probation on the child abuse charge, but face mandatory prison time on the homicide charge. The maximum sentence either of them could receive is 7.5 years in prison.
    [...]

On Wednesday, both Greens were required to tell Judge Howard Fell of Pima County Superior Court what they did that made them guilty of the charges.

Elisa Green was crying so hard, most of her statement was unintelligible.

A subdued Shaun Green told the judge, “I didn’t help my wife with what she needed help with.” He also acknowledged he knew the kids were in the tub at one point.

Deputy Pima County Attorney Anita Simons told Fell both parents knew Rachael could get out of the safety seat.

The child abuse charges pertained to the “filthy” conditions of their home, which put their other children’s health at risk, Simons said.

Child Protective Services was aware of the Green family prior to the baby’s death.

The couple had their children removed from their custody for failure to thrive, according to court documents.

They completed required parenting classes and a family CPS plan, and their children were returned to them in 2008.

After the children's return, the parents continued to neglect the kids, court documents say. CPS has since filed to sever their parental rights.

The pair will be sentenced April 17.

I hate those seats, piece of shit they are. Damn and they suck big time for baby boy's. My SIL used one with her kiddo even after I said its not safe and he'll hurt his sweeties. Sure enough he got hurt with that bar shit in the middle that does nothing to secure a child.

Poor baby Rachael left to die that way and her siblings having to lose all they know. I mean the parents sucked but damn, their entire family is gone and baby sister dead. FUCK, I'd be bawling my eyes out too. I don't know how these parents can live with themselves especially mama. She may never get her kiddo's back and sure as hell not Rachael.

So sorry sweet one, rest in the heavens.

The parents of a Tucson baby who drowned in a bathtub have both been sentenced to 2 ½ years in prison and 15 years probation.

Pima County prosecutors say Elisa and Shaun Green pleaded guilty to negligent homicide and child abuse in February. The Greens - both 25 - could have received as much as 7½ years in prison when they were sentenced Friday.

Bathing THREE children under the age of FOUR in a bathtub at the same time IS multitasking! Bathing three children under the age of four, having a long conversation with another person, and cooking all at the same time isn't multitasking--it's asking for trouble.

And why in the hell did "daddy" feel like it was okay to sit on his butt while his kids were taking a bath and his wife was cooking? Prior to being arrested, tried, and sentenced for his role in Rachael's death, was he one of those guys who figured that the responsibilities were "women's work," and his obligations ended when he ejaculated? While I know a good amount of devoted dads, I know far too many who claim the title "daddy" when they do very little for their children. Some don't even work, but they still expect their wives/girlfriends to put the kids in daycare while they work, then take care of the children by themselves when they get off from work.

They were both terribly irresponsible, and the sentences they received were a joke.
