Police arrested a driver and a passenger Saturday after finding both of them to be intoxicated while two young children rode with them, according to a probable cause affidavit.
Joshua Daniels, 22, and Micky Page, 22, both of Evansville, are each being held in the Vanderburgh County Jail. Page is facing preliminary charges of child neglect and public intoxication while Daniels is preliminarily charged with operating while intoxicated and operating without a license.
An Evansville Police Department officer stopped Daniels' sport utility vehicle about 9:15 p.m. after spotting it traveling eastbound on Franklin Street near Fulton Avenue without a visible license plate light.
Police say Daniels admitted having several drinks before agreeing to take field sobriety tests, which he failed. He was then taken to jail, where an intoxication test revealed a blood-alcohol level 0.12, according to the affidavit.
Page - the mother of a 3-year-old and a 5-year-old who were in the SUV - admitted she was drunk and gave the keys to the vehicle to Daniels so he could drive, according to a probable cause affidavit filed in her case.
"The defendant stated she didn't think Mr. Daniels was nearly as 'drunk' as she," Officers Steve Hicks and Shawn Smith wrote in the affidavit. "In her intoxicated state, the defendant could not properly care for her dependent children."
The children were released to Page's father.
Bond for Page was set at $500 cash while Bond for Daniels was set at $2,000 cash. His operating while intoxicated charge was upgraded to a class D felony because children were in the vehicle, police said.
