    LOL No way! Mostly because of the distance.

    However, I still have not seen anything that said they did an incomplete job or missed anything.

    Common sense tells us that the child was being abused, hindsight and all that. BUT if the abuse that happened in the 15 days after the initial contact had never occurred, how would we know? Has CPS said they closed the case at that point or indicated they continued the investigation?

    If this had been just an article about the first contact and nothing else happened, there was no hidden boyfriend, and all she had was herpes, this would be a whole different discussion. That is my point. I don't want them to have the power to start yanking kids from homes without proof. "Maybe", "could have", and "once upon a time" are not good reasons.

    Before Lucas Coe was accused of inflicting the injuries that may have killed 4-year-old Emma Thompson, there were at least five chances to keep him behind bars in two different counties.

    The last opportunity came just three months before Emma turned up in a Houston area emergency room, sexually abused and fatally beaten. Both Coe, 27, and his girlfriend, Emma's mother, Abigail Young, 33, have been charged with injury to a child in Emma's June 27 death. No trial date has been set.

    But a closer look at Coe's criminal history reveals some troubling facts — any of which might have altered the turn of events that led up to the Spring girl's homicide.

    While Coe was serving six years probation for a 2002 Harris County aggravated assault, records show, he was convicted for DWI, pled guilty to a Montgomery County assault, failed to meet with a probation officer, got behind in his restitution to the Harris County victim and was indicted on a child abuse charge in Montgomery County.

    Four motions to revoke his probation in the Harris County case were made: two in 2005 and two in 2008.

    Two of those were overruled by state District Judge Marc Carter. Two others were dismissed by the judge at the request of prosecutors in the case.

    At least twice in that period, Coe was jailed for violating the terms of his probation.

    But his probation was never revoked, which could have forced him to serve the remainder of his sentence in prison.

    And when he missed a Montgomery County court date on a 2007 charge of injury to a different child, his bond was not revoked in that case — it was reinstated. Turns out he missed court because he was in the Harris County Jail serving time for violating terms of his Harris County probation.

    Yet this overlapping criminal history, which had Coe ping-ponging from one county to the next, was not enough to keep him from being released from his probation in March when Carter signed the form announcing Coe had “satisfactorily fulfilled the conditions of supervision imposed by the court.”

    CPS officials examined the investigator's work in Emma's case, and although they determined she did nothing wrong, the agency has issued new guidelines.

    “The review identified additional steps that could be taken in future cases where the only evidence is a sexually-transmitted disease of unknown origin,” said Patrick Crimmins, CPS spokesman in Austin. The recommendations from the review will be given to all caseworkers.

    If a suspected child abuse victim tests positive for a STD, all children in that victim's household will be tested as well. Any child who tests positive will have a sexual abuse exam and a more thorough “forensic” interview with child abuse specialists at a Children's Assessment Center.

    A forensic interviewer, according to the center's Web site in Houston, is someone “specifically trained in working with sexually abused children and skilled in obtaining information necessary” for police, child safety and prosecutors. The interviews are videotaped.

    Emma was originally scheduled to be examined at Children's Assessment Center but no interviewer was available. Instead, CPS and the child's pediatrician referred her to Texas Children's Hospital.

    Also, investigators have been told to aggressively pursue potential witnesses by interviewing neighbors in cases where a child tests positive for a STD. The CPS investigator in Emma's case did not.

    Testimony at a hearing last month revealed that Young had also recently contracted genital herpes, but CPS officials did not know that, nor did they interview any of Emma's neighbors about whether any other adult was living in the girl's house or if they noticed Emma having any problems. Young, a registered nurse, never disclosed she had a new boyfriend, Lucas Coe.

    Young and Coe have been charged with injury to a child and await trial. Young is out on bond. Coe remains jailed. Emma's two sisters have been placed with grandparents.

    Attorney Bert Steinmann, Coe's lawyer, said his client “vehemently” denies causing any of Emma's injuries and also denies he is the source of Emma's genital herpes.

    Steinmann said he's confident the case “will exclude Lucas as the source of Emma's STD, determine the mother's actual role and/or knowledge of the child's injuries, and correct the so called facts and innuendos in Lucas' case.”

    The Magnolia man arrested in connection with the death of 4-year-old Emma Thompson had his bond reduced to $100,000 Thursday morning by a Harris County District judge.

    Lucas Ruric Coe, 27, has been in the Harris County Jail without bond since he was booked into the jail on Aug. 11. Bert Steinmann, Coe’s attorney, petitioned 232nd District Judge Mary Lou Keel for the bond reduction.

    “The (Harris County) District Attorney had not filed a letter requesting that he (Coe) be held without bond,” Steinmann said. “He (Coe) has made all of his previous court appointments, and I told the judge I needed him during his case.”

    While Coe was granted a bond reduction, Steinmann said there was no guarantee his client would make the bond.

    Coe and his girlfriend, Abigail Young, were charged last month with one count each of felony injury to a child. Thompson died June 27 in Montgomery County from blunt force trauma to the abdomen, according to an autopsy conducted in Conroe.

    One of the suspects in the injuries leading to death of a 4-year-old Spring girl is back in jail today after he failed to take a urine test.
    I am pretty happy he is so ignorant and egotistical, to think that he was above giving a urine test!!
    Coe posted his $100,000 bond last Friday but was brought back before state District Judge Mary Lou Keel this morning, apparently to have more conditions placed on his release, said Bert Steinmann, Coe's attorney.

    But before Keel could place those conditions on Coe, he was ordered by the judge to submit to a urine test.

    “She never got to it,” Steinmann said of this morning's hearing. “She ordered him to go down and do a UA (urine analysis).

    Because Coe could not or would not provide a sample, Keel revoked his bond and ordered him back into the Harris County jail.

    “His failure to urinate caused her to revoke his bond,” Steinmann said.
    Steinmann said his client has a medical condition that prevents him from urinating on command. He said his client would be glad to submit to other forms of drug and alcohol testing.

    “Blood, hair, whatever,” Steinmann said. “He wasn't afforded that right.”

    There was nothing specified by the court that Coe refrain from alcohol or drugs and Keel even denied a prosecutor's motion that he submit to medical testing to determine whether he had genital herpes.

    I'm with penelopejo on this one. Herpes did not kill this baby, a beat down did with no explainations. What's up with that? How can you bring your kid to the ER with the injuries this little girl suffered and not explain a damn thing. Smells like momma knows what's happening and is covering for her penis.

    The attorney for a Magnolia man accused in connection with the death of a 4-year-old girl will seek to have his client’s bond reinstated after a private drug screening came back negative this week.
    Steinmann said a urine sample was obtained from Coe Sept. 17 by Davis Investigation Services of Conroe, and was shipped to the Redwood Toxicology Laboratory in Santa Rosa, Calif., for analysis. A copy of a report provided by Dawn Nobles – Steinmann’s forensic trial strategist – showed Coe’s test was negative for alcohol, barbiturates, cocaine and other illegal substances.

    The screening came back positive for the presence of creatinine and benzodiazepines. Creatinine is a metabolic by-product of muscle metabolism. Benzodiazepines are among the most commonly prescribed depressants in the the United States, according to the University of Maryland’s Center for Substance Abuse Research.

    “The testing came back showing what we thought it was,” Steinmann said.

    Coe’s bond hearing is scheduled for Oct 2.

    “We’re simply going to ask that his bond be reinstated,” Steinmann said.

    Harris County Prosecutor Colleen Barnett said she doesn’t have any information that Coe had any alcohol or cocaine in his system after making bond.

    “I have not seen the defense attorney’s report, so I don’t have any comment,” she said.

    Nobles said Coe has been prescribed Lexapro and Atarax at the Harris County Sheriff’s Office Medical Clinic. Lexapro is used to treat depression and certain types of anxiety. Aratax is an antihistamine that is also used to treat anxiety.

    Coe also has been prescribed Diazepam, used to treat anxiety. The prescription was issued from a Montgomery County pharmacy, Nobles said.

    The HCSO’s Medical Clinic, pharmacies and Coe’s family physician have been subpoenaed to testify about Coe’s medication history, Nobles said.

    “This is all relevant to the bond proceeding,” Steinmann said.

    WOW! Ok ok so the poor thing had herpes and CPS did not take her away - but the bottom line here is that the little girl ended up dead shortly afterwards - a torn pancreas and bruises? She obviously was abused, and someone knows a hell of alot more than what they are letting on. Sure that girl was being abused when CPS interviewed her and so the little girl "fibbed" when asked by CPS, most abused kids are "coached" to keep secrets - but aren't the "professionals" suppose to know better? Bottom line is there is a poor little baby girl dead...

    A new bail was set on Friday for a Magnolia man who is one of two people charged in the abuse death of 4-year-old Emma Thompson.

    State District Judge Mary Lou Keel set bail for Lucas Coe at $300,000.

    Last month, Keel set bail for Coe at $100,000, with one restriction: no contact with children. But she revoked the bail a few days later after Coe failed to take a court-ordered urine test.

    Coe, who had said a medical condition kept him from providing the sample, eventually complied, and on Friday, his bail was reset to $300,000, an amount his attorney says will be tough to meet.

    “I have no reason to believe he'll make that bond,” said Bert Steinmann, Coe's attorney.

    Nearly half of all Texas children killed by abuse belonged to families previously investigated by Texas Child Protective Services — a statistic that has shown no improvement since 2004 despite efforts to save more children, records show.

    Each year, about 200 children die of abuse or neglect in Texas — at least 1,227 since 2004, according to records obtained by the Houston Chronicle.

    Such deaths continue to occur despite a $248 million infusion to CPS in 2005, which brought in 2,500 additional caseworkers and support staff, along with better equipment like digital cameras and more laptop computers, so workers could enter information about a child in a more timely fashion.

    But the number of families with previous CPS histories has consistently increased from 40 percent of all abuse deaths investigated by the $1 billion-a-year agency, to 48 percent today, the agency's records show.

    Since 2004, that's 516 Texas children who died who came from families with CPS histories.

    They include Kati Earnest, 5. Dead on July 4, from a beating.

    Darrell “Tre” Singleton III, 3, left unattended for hours in a car on Sept. 3. Dead from exposure to 95-degree heat.

    Emma Thompson, 4, sexually abused. Dead on June 27 from a beating.

    These child deaths, just three among the hundreds statewide, are made more horrific by the fact that prior visits to their families and homes by CPS investigators failed to detect potentially fatal warning signs.

    “They are worrisome to me,” state Sen. Carlos Uresti, D-San Antonio, a member of the Senate Committee on Health and Human Services, said of the increase in child deaths among families with CPS histories. “They should be worrisome to anybody.”

    In San Antonio, four children have died of suspected abuse in the past couple of months: Scott Westley Bucholz Sanchez in August; Jade de la Rosa in September; and Jazlynn Garcia and Keegan Sharkey in October.

    Even though CPS was called twice during the three months Sharkey was alive, caseworkers were unable to prevent his death because the baby's parents successfully deceived them about his injuries.

    On their face, the numbers of these troubled families with deadly outcomes seem to point to a worsening problem for CPS, one the agency hopes to get a handle through a better realignment of its work force in four regions of the state.

    About 700 caseworkers and support staff in San Antonio, Houston, Dallas and the Rio Grande Valley will be reassigned to more critical jobs within CPS' investigative force and Family Based Safety Services or FBSS, the department charged with monitoring troubled families once they come to the agency's attention.

    It's this department that works with families where a CPS investigation indicates potential problems, but doesn't merit removing children from the home.

    “Obviously, our goal is to bring those numbers down,” said Anne Heiligenstein, commissioner of Texas Department of Family and Protective Services, which includes CPS. “That has to be our goal.”

    The deaths among repeat CPS complaints represent less than 1 percent of the 165,000 child abuse investigations completed by the agency each year. However, the growing incidence of child deaths coming from families with prior CPS histories, has prompted a review in Houston and in Dallas of child abuse investigations.

    Lawmakers also are looking for more answers about why certain families can't be located more quickly before a child is killed.

    The additional money, equipment and staff did reduce the agency's crippling investigation case load. The number of investigations per worker fell from 43 in 2004 to 22 cases today.

    But the reforms, aimed at improving child abuse investigations, have done little to break chronic households from a cycle of abuse that ends tragically.

    “The fact CPS had previous contact with the family doesn't automatically mean that CPS could have prevented that death,” said Patrick Crimmins, spokesman for CPS.

    Ultimately, the person who killed the child — and in 77 percent of Texas cases, that's a parent — is responsible for these deaths.

    After going through this forum, I have read several things:
    1. That CPS did an investigation where it was determined that Emma had herpes.
    2. That TWO medical exams did NOT show any signs of sexual abuse. Nor was there any other signs of abuse.
    3. That two weeks later, Emma was murdered. The autopsy showed that she had been sexually abused.

    Now, I am probably way off base here, but isn't it possible that Emma was not penetrated until AFTER the CPS investigation? Yes, I agree, she most likely was sexually abused before the investigation, but maybe there was no penetration/was oral. It could be possible that the abuse did not escalate to penetration until AFTER the CPS investigation had taken place. In which case, the medical examinations would not have shown the abuse.

    Question New Judge- Keel recused!

    A new judge will take over the child abuse trial of a former Brenham nurse and her boyfriend.

    Abigail Young and Lucas Coe are charged with causing the June 27 death of Young's 4-year-old daughter Emma Thompson.

    Coe's attorney requested the change after Judge Mary Lou Keel released Coe on a $100,000 bond, then changed her mind and ordered him back in court two days later to take a drug test. When he couldn't, he was taken back into custody. Administrative Judge Olen Underwood said Judge Keel was being recused to avoid any appearance of partiality and unfairness.

    Coe is charged with Emma's sexual assault and injury to a child. Young is charged with injury to a child. She was arrested at Trinity Medical Center after her first day at work in August.

    No trial dates have been scheduled and it is not known whether the couple will be tried together or separately.

    A Magnolia man charged last year in the brutal beating death of his girlfriend’s preschool age daughter in Harris County is now in the Montgomery County Jail in Conroe where he faces charges of injuring another child.

    On Tuesday, a Montgomery County Grand Jury reindicted 28-year-old Lucas Ruric Coe, of Magnolia on a Jan. 13, 2005 charge of first-degree felony Serious Bodily Injury to a Child, which is now paired with his indictment Sept. 27, 2007 for third-degree felony Bodily Injury to a Child. The victim in the Montgomery County case is a 7-year-old boy.

    Assistant District Attorney Sylvia Yarbrough will prosecute Coe on the two charges and said she sought the reindictment so she could try Coe on both counts at once. The case will be heard in the 221st District Court of Judge Suzanne Stovall.

    Coe made headlines last Aug. 10 when he and girlfriend, 33-year-old Abigail Elizabeth Young, were arrested for first-degree felony Serious Bodily Injury to a Child in the June 27 death of 4-year-old Emma Thompson.

    Yes I am questioning why he was free but I am absolutely dumbfounded that he had access to another child!!

    When will people realize that these kind of monsters are not miraculously cured when the object of thier rage and brutality is no longer there to be beaten on? That they will just go on to brutalize other children cause these cowards always have to beat on someone smaller than they are.

    4 year old with herpes dies 3 weeks later

    On June 27 of last year, Emma Thompson, 4-year-old daughter of Abigail Young, was rushed to the hospital when she stopped breathing. Mom's explanation was two falls, but Emma's 80 bruises, fractured ribs, severed pancreas, severe vaginal tear and vaginal hemorraghing, and skull fractures (which mom, a registered nurse, had tried to super glue) told a different story. The cause of death was blunt abdominal trauma. Oh, and did I mention Emma also had oral and genital herpes? If I didn't, I might have also forgotten to mention that CPS knew about the STD 3 weeks before she died, but she was still living in the home.

    Part of the reason Emma was still in the home was that mom forgot to mention she was living with Lucas Coe. She may have forgotten to mention that because Coe had already been indicted once on child abuse charges toward a different child, and had a criminal record. CPS might not have liked the way that looked, you know, with the herpes and all.

    Shortly after Emma died, neighbor Christine Frazier was trying to get some answers from Abigail Young. Abigail mentioned that Emma had bite marks on her stomach and said they were from Coe's daughter, another child living in the home. She said the child bit Emma because "She's kinky like her father." There are no words to describe my abject disgust and horror at reading that sentence. Both Abigail Young and Lucas Coe have been arrested, and check out this timeline with Lucas Coe's previous arrest history...

    Lucas Coe was sentenced in 2003 to six years probation for aggravated assault in Harris County. Despite violating probation repeatedly, it was never revoked.
    June 8, 2005:Motion to revoke is filed after Coe commits a DWI. Judge overrules it.
    Sept. 29, 2005: Motion to revoke is filed after he fails to report to probation officer. Judge overrules it.
    Feb. 20, 2008: Motion to revoke is filed, based on his child abuse indictment in Montgomery County. Motion dismissed.
    Dec. 12, 2008: Motion to revoke is filed based on Coe's failure to perform community service, indictment in abuse case, failure to pay restitution. Motion is dismissed.
    Feb. 9, 2009: Coe fails to show up in court in Montgomery County child abuse case because he is jailed in Harris County. Still, his bond is not revoked. In fact, the bond is reinstated.
    March 25, 2009: Lucas Coe's six- year probation ends.
    June 27, 2009: Emma Thompson is killed.

    A year after a suburban 4-year-old's gruesome death helped force a state review of child abuse investigations in Houston, there's little else to show that Emma Thompson passed through this world. She's buried next to a grandfather she never met and no formal headstone is placed on her tiny grave, which features a humble funeral home marker and half-dead petunias.

    That changes today as prosecutors begin jury selection in the first of two trials to determine how Emma — a sexually abused child found with 80 bruises, a severed pancreas and fractured skull - died on June 27, 2009, and if her mother, registered nurse Abigail Young, 34, failed to prevent the injuries that ultimately killed the preschooler.

    Julius Villarreal, who lives across the street, remembers the night well.

    Instead of ducking into her two-story home to grieve the loss of her youngest, he said a dry-eyed Young talked to investigators and then addressed the group of neighbors, almost as if she was trying to "set up" the story they would hear later of her daughter's violent injuries.

    Villarreal said Young told them in great detail that Emma had fallen off the toilet in the bathroom, cracking her skull and splitting her lip. She also told them how she theorized it was a diabetic seizure. She then talked about how there was a lot of bruising on the girl caused by CPR attempts by emergency responders. Young even told how there was bruising on the little girl's thighs because of the great force she used to pull Emma from the car once she passed out.

    Villarreal said he was struck by how everyday Young's demeanor was despite losing a child that night.

    "To me, she acted calm, like she had lost $5," Villarreal said.

    Young made a great show of telling the group that Coe was good to her and her girls, that he never harmed anyone, Villarreal said. And after investigators left, Young told neighbors they could come over to the house. There was nothing disturbing to see, she told them, because she had cleaned up the bathroom before she left for the hospital.

    "'I bleached the bathroom,'" Villarreal recalled Young telling them.

    Young's actions after her daughter's death could have been her way of grieving or perhaps altered by her own physical state, her attorney said.

    Jesus fuck. The dirty whore or her family couldn't afford the $500 for a gravestone? My stepmom and dad did this shit with my brother and i consider it letting your baby lie in an unmarked grave so i bought his headstone and had it installed. To bad somebody in Emma's family doesn't give a shit to do the same.

    A Texas woman on trial for failing to prevent the death of her 4-year-old daughter repeatedly lied to doctors and investigators about her relationship with a man now accused of raping the preschooler, prosecutors said Tuesday during opening statements.

    But a defense attorney for Abigail Young, 34, of Spring, told jurors that Young had her daughter tested for leukemia when she noticed her frequent bruising and consulted doctors. Her daughter, Emma Thompson, died last year after suffering from a severed pancreas and fractured skull.

    Young could face up to life in prison if convicted of injury to child by omission. Prosecutors must prove Young knowingly or intentionally denied medical attention, protection or adult supervision to her daughter.

    Texas Child Protective Services revamped its investigations into alleged sexual abuse after Emma died June 27, 2009. Investigators said the preschooler had genital herpes.

    Young's boyfriend at the time, Lucas Coe, 28, is set for trial in September on charges of aggravated sexual assault for raping the child. He also faces an unrelated child abuse charge.

    In an opening statement, assistant Harris County prosecutor Tina Ansari said Young was in the midst of a divorce when she began a romantic relationship with Coe, but lied about it to doctors, social workers and her former husband.

    When her daughter began showing bruises and she tested positive for genital herpes, Young told investigators there was no man in her life and the girl contracted the disease in a non-sexual manner.

    Defense attorney Julie Ketterman described Young as a caretaker who also consulted infectious disease doctors about how her daughter contracted herpes.

    In the weeks leading up to a Spring preschooler's violent death, her mother was in the midst of a divorce, had a new outlaw boyfriend in tow and Texas Child Protective Services knocking at her door, opening statements revealed today.

    There had been glaring warnings that Abigail Young's 4-year-old daughter, Emma Thompson, had been abused frequently and raped. Tests also proved the girl had genital herpes, prosecutors said during today's opening statements that began Young's trial on charges of failing to protect her child from harm.

    Despite those signs, Young, a registered nurse, lied about her illicit paramour's existence to doctors, CPS, and even told her soon-to-be ex-husband to do the same because it might cause them both problems, prosecutors said.

    "She was smitten by him,” assistant Harris County prosecutor Tina Ansari said of Young's blind devotion to 28-year-old Lucas Coe. She quickly would do anything and everything for him, prosecutors said.

    Defense attorney Julie Ketterman, in her opening statement today, painted her client as a caretaker, a vocation thrust on her as the result of her father dying just before her 16th birthday. She became a labor and delivery nurse because of her own miscarraiges.

    Young, as she was divorcing, was busy working two jobs to make ends meet when her romance with Coe, a longtime friend, began in earnest, Ketterman said. All the while, Young was seeking answers as to why her daughter bruised so often, even having her tested for leukemia because of the concern and consulting infectious disease doctors about how her daughter contracted herpes.

    "This was not something she was trying to hide,"
    Ketterman said of Emma's illness.

    Following opening statements, Dr. Patricia Moore, the medical examiner for Southeast Texas Forensic Center in Conroe, testified how she performed Emma's autopsy, taking about 200 photos of body and internal injuries.

    "They are not pleasant," Dr. Moore said of the photos.

    At the defense table, Young began dabbing at her eyes with tissue as prosecutor Colleen Barnett introduced dozens of autopsy photographs into evidence, prompting a defense attorney challenge over whether the photos were duplicative and therefore, redundant.

    After several minutes, the judge finally approved a smaller set of photos for courtroom showing, and as Barnett placed the first on an overhead projector, the image of Emma's face - – closed eyes, bruises on her forehead and chin - sent Young into violent sobs.

    It was the first sign of emotion for Young
    who has sat stoically in the courtroom Monday during selection of her jury of nine women and three men.

    This bitch makes me sick. Lying about the boyfriend, telling the neighbors Emma fell off the toilet and fractured her skull. I don't know what anyone else would do but when I found out my girls were molested by their 11 year old cousin, first stop was the police, second was counseling, third me having a nervous breakdown in the doctor's office after contemplating running my car through his fucking house.

    How in the hell after finding out (for the sake of argument say she didn't know Emma was being sexually abused) that your kid is/was sexually assaulted can you act so fucking nonchalant? That's not even taking into account that your kid is DEAD on top of it! Yeah I know everyone grieves different blah blah blah, there is no book on grieving but shit there is a line drawn somewhere and lying about how your kid died to make yourself look less culpable definitely crosses it.
    I love my mom because she loves me and she is a great mom she loves me so much she bought me a psp that stands for playstation portable.

    Abigail Young's husband and sister had the same information, saw the same signs of possible abuse on the licensed nurse's 4-year-old daughter and had the same opportunities to alert authorities, but they did not, Young's defense lawyers said Friday.

    "There weren't red flags for them either," said defense attorney Julie Ketterman. "Her sister and her husband at the time had the exact same information that she did about everybody, including Luke, and they didn't voice any concerns either."

    That, her lawyers say, shows that Young should not be blamed in Emma Thompson's assault and rape — which authorities say was at the hands of her boyfriend, Lucas Coe, last summer.

    Prosecutors disputed Ketterman's assertion and said testimony showed that neither Young's former husband nor her sister knew as much as she did. They also elicited testimony in the two-week trial that Young lied to investigators and medical providers about dating Coe.

    "We feel we proved our case," said Assistant Harris County District Attorney Colleen Barnett.

    The prosecution rested its case Thursday. Young's attorneys began putting on her defense Friday and expect to finish Monday.

    At the heart of the allegations is whether Young lied to authorities about secretly living with Coe.

    Ketterman said she plans to remind jurors that Thompson suspected Young was dating Coe when he met with investigators from Texas Child Protective Services before Emma's death on June 27, 2009. However, she said, he did not broach the subject with the investigator.

    Young's sister testified that she had at least four occasions to talk to authorities about any suspicions she may have had about Coe.

    CPS was notified by Emma's pediatrician after she discovered the girl had tested positive for genital herpes, a sexually transmitted disease. Emma also told her doctor, "Luke holds me tight."

    However, because there did not appear to be signs of sexual intercourse and because in rare cases the disease is transmitted by nonsexual contact, CPS investigators did not remove the child from the home.

    Ketterman and her partner said they will argue that Young was confused because medical providers at Texas Children's Hospital did not seem concerned about the herpes. "The situation was confusing as hell," said attorney Colin Amann. "There are people saying 'sexually transmitted disease' and there are people saying they did a full medical exam and her daughter's OK. How would you deal with that conflict?"

    A social worker from Texas Children's Hospital testified Friday that when she examined the girl she was not concerned about abuse.

    However, she said, she would have been concerned if Young had told her about Coe or if she had known that Emma's doctor had seen unusual bruising around her waist.
