REXBURG - A Rexburg man was sentenced to two to five years in prison for physically abusing his then 6-week-old son.
Kurt David Gum was sentenced Wednesday morning on two counts of felony injury to a child after he hit, struck and then slammed his baby's head into a doorway and into a couch. The couch was worn down so the baby's head made contact with the wood beneath.
The infant suffered a fracture to the back of his head.
In court, Gum's wife gave a victim impact statement. She also asked the judge for no jail time and probation. She said her husband had shown a lot of remorse.
The judge said no to her request but opted to keep jurisdiction of the case and will review it after 120 to 180 days. Gum will also have to enter into an anger management program and take parenting classes.
Gum was arrested April 4. Police said he lied to them during his first interrogation about how the baby got hurt. When police discovered his story was not lining up with the evidence, they interviewed Gum a second time when he finally confessed to harming the child.
Because he was not completely truthful, the judge ordered prison time instead of the defense's 10 years of probation and time already served when Gum spent 46 days in jail.
