Christopher Mack, on probation for child endangerment, beats his nephew to death

When Lacy-Lakeview officials arrested Christopher Mack in the beating death of his 5-year-old nephew, the 22-year-old Mexia man was serving a probated sentence on a March child endangerment conviction.

Officials said Sincear Kirven had been dead for an hour when Mack brought the boy to the Providence Health Center emergency room just before midnight Sunday and told doctors that his nephew had collapsed at his girlfriend’s apartment in Lacy-Lakeview.

However, investigators believe that Sincear had been beaten to death by Mack, who struck the boy and his 3- and 4-year-old brothers repeatedly with a belt, according to an arrest warrant affidavit.

Mack’s girlfriend, 24-year-old Andrea Shante Thomas, was also inside the apartment at the time of the beating and did nothing to stop the act, contact police or seek medical attention for the boys, an arrest warrant affidavit states.

A preliminary autopsy report released Tuesday reveals that Sincear died of blunt force trauma. He and his 3-year-old brother had “extensive visible injuries” including “bruises, abrasions and lacerations to his head, arms, front and back torso and legs” an arrest warrant affidavit states.

A 4-year-old brother was not injured badly enough to require hospital care, but was also a victim of the assault, said Marissa Gonzales, a spokeswoman with Child Protective Services.

Gonzales said Mack was watching Sincear, his 3- and 4-year-old brothers, and 7-year-old sister Sunday, and had taken them from their Mexia home to Thomas’ apartment. The children live with their mother, Brandi Mack, and their great-grandmother, Gonzales said.

After the alleged assault, the two surviving brothers and their sister were taken into foster care while CPS investigators evaluate the decision-making skills of the children’s mother and great-grandmother, Gonzales said. A hearing will be held in two weeks to determine where the children will live.

Sincear, police determined, had been beaten until “he passed out and was not moving,” the affidavit states.

According to Limestone County court records, Mack was arrested in Mexia on May 17, 2007, on charges of felony endangering a child and evading arrest. ... The child was not one of the four children he was watching Sunday. On March 12, Mack pleaded guilty on both charges, and was sentenced to two years of probation.

Wearing a T-shirt in memory of her slain 5-year-old son, Brandi Mack found out Thursday that she would have to wait another month to try to regain custody of her surviving children.

Retired State District Judge Sam Bournias heeded the advice of Child Protective Services officials in granting only supervised visits to Mack, the mother of 5-year-old Sinsear Jaywon Kirvin, his 7-year-old half-sister, and 3- and 4-year-old half-brothers, until CPS concludes its investigation. Another hearing is set for Aug. 13.

Mack, who was wearing a T-shirt bearing Sinsear’s picture and the quote, “The Lord giveth and the Lord taketh away,” also was ordered to take a drug test.

The four children were living in a three-bedroom house in Mexia with their mother, grandmother, great-grandmother and their mother’s boyfriend, 31-year-old Craig Bender. Bender is the father of the 3- and 4-year-old boys, according to testimony.

CPS officials testified that when the 4-year-old boy was taken into their custody, he also had physical evidence of having been beaten but that it was unclear whether the abuse was sustained by Christopher Mack.

A judge in Limestone County ruled Thursday that the three siblings of a 5-year-old Mexia boy who was beaten to death with a belt at a Waco-area apartment complex should remain in the custody of state child welfare authorities for the time being.

The younger boys and a 7-year-old child have been in the custody of the Department of Family Protective Services since a hearing in July, during which their mother, Brandi Mack was ordered to undergo drug testing before they would be allowed supervised visits with the children.

Mack passed the drug test and she, her mother, grandmother and great grandmother had a two-hour visit Wednesday with the children, said Chris Van Deusen of the Department of Family Protective Services.

During the hearing Thursday, Van Deusen said the state told the judge the long-term goal is to place the children with family members.

An autopsy report on the boy, received last week by Justice of the Peace Kristi DeCluitt, shows that he died of multiple blunt force trauma. The boy suffered at least 10 rib fractures and the right lobe of his liver was "pulpefied," according to the autopsy.

Also, the autopsy revealed numerous contusions to his face, arms, legs and front and back torso, a contusion to the right side of his brain and extensive internal injuries and bleeding.

The psychologist's report is not surprising. What is surprising is that something like this didn't happen a long time ago.

... an eight-page report compiled by Dr. Lee Carter from the Waco psychologist's seven-hour evaluation of Mack on Sept. 21. The report lists Mack as high risk to commit violent acts in the future because of an aggressive, antisocial personality disorder.
[...]In his report, Carter writes that Mack, who is on felony probation in Limestone County for endangering a child and evading arrest, was born in Hubbard and has lived in Falls County and McLennan County most of his life.

He is the third of seven children born to his mother by seven fathers, and he had no involvement with his father, who was in and out of prison most of his childhood, according to the report. Mack's mother had her first baby when she was 14 and he lived in poverty with his mother and grandmother, neither of whom worked much, the report states.

Mack was a poor student with a flash temper and caused trouble. With an IQ of 86, which is at the low end of normal, he told Carter that the last grade that he completed in public school was sixth grade. His siblings and other students reported that they feared him and reports indicate that he pointed a gun at his sister's head when he was 14 because she would not get off the phone.

The longest job Mack ever had was three months working at a McDonald's, according to the report. He was fired after being caught stealing from the cash register.

He had a long string of juvenile arrests for a variety of offenses, including improper sexual conduct with a child and drug offenses, according to the report.

At 14, Mack was sent to a Texas Youth Commission facility in Mart, but was transferred to a facility in Crockett for emotionally disturbed offenders after he was involved in a riot at the Mart facility, the report says.

Mack served a total of about three years during two stints at TYC facilities, during which he was cited 182 times for rules violations. After his release, he was arrested several times as an adult, but the charges were dismissed in many of those cases, the report says. He remains on felony probation.

"His presentation is marked by considerable anger control problems, relationship instability, willful rule violations, absence of empathy and a willingness to violate others' rights and needs to fulfill his personal desires," Carter writes in the report.

Andrea Thomas thought this was a good choice for a boyfriend? Brandi Mack thought this was a good choice for a babysitter? I can't relate to a life where this guy would be considered even remotely close to "normal".

This Mack person was on probation that which included violence towards a child, wtf do you need to understand about that?? Stupid, complaisant behavior on part of the adults, and this woman Andrea Thomas, spit on her, she's a heartless, vile person. She was there when this happened and did NOTHING!! This child's liver was pulpefied for Christ sake! She should get the same charges thrown at her for being useless, wasteofspace. A violent, repeat offender against children should be given the death penalty, at least a life term. What a precious lil boy Sinsear was. So many people failed this child from the mom who thought it was a good idea to leave her children w/him to the judge that gave him probation on earlier charges. Wtf could have been so important to the mom that she left her precious children in his care?!! No excuse is acceptable!! I want both this putrid animals to spend every fucking day of the miserable lives feeling the pain this baby felt. How he could beat these children and hear their screams and not stop makes my blood just boil to no end.

I have a 5 year old, and when I have to discipline him, I hurt inside. I have to do what I need to, to make sure he grows up with respect. Thankfully I don't use physical punishment because it was used on me in a horrible way, so it's not my choice for disciplining. I always think that one day you will get so angry that you can potentially hurt a child. So that is a risk I don't ever want to take.
