Boise police arrested two 21-year-old Treasure Valley men accused of urinating on a sleeping man Wednesday night in Downtown Boise.
Jonathan W. Marks of Boise and Michael B. Swift of Meridian are both charged with misdemeanor counts of public urination. Swift is also charged with misdemeanor resisting arrest.
Both men were booked into the Ada County Jail and released after posting bond late Wednesday
Police were called to the 600 block of West Main Street at 9:42 p.m. Wednesday after witnesses said they saw two men urinating on a sleeping man in the area.
By the time police arrived moments later, the two men involved were being detained by bouncers from a nearby bar.
Police talked to the victim in the case, who said he did not want to press charges, but Swift and Marks were arrested based on the testimony of several witnesses, according to reports.
Police officials said Swift briefly attempted to physically resist arrest but was taken into custody without injury.
Information on where the man was sleeping and why he was there were not available Thursday morning.
The charge of public urination is punishable by up to six months in jail and $1,000 fine. The same possible penalties apply to Swift for the resisting arrest charge.
