A former private Christian school teacher and convicted sexual offender is behind bars again after she used Facebook to contact minors, Port Orange investigators said.

Police on Tuesday arrested Cynthia Horvath, 45, on violation of probation charges.

Horvath had been sentenced in February to a year of house arrest, followed by seven years' probation for unlawful sex with a minor. She was labeled a sex offender for life and was allowed Internet access, but prohibited from contacting minors.

Port Orange police Capt. Frank Surmaczewicz said a student at Warner Christian Academy, Horvath's former employer, told her parents she discovered the sexual offender had befriended teenagers on the social-networking site.

An undercover agent, posing as a 16-year-old Port Orange high school student, requested that Horvath add him to her friends on Facebook on March 31. She agreed and replied with the message: "It's you isn't it? :)."

The agent contacted Horvath's probation officer that day and told her about the Facebook account. The probation officer did not tell Horvath she knew of the account, but restricted her Internet access.

Later that day, Horvath returned home and sent the undercover agent an e-mail saying, "I'm here!!!" An arrest warrant was issued and police arrested Horvath. She is being held without bail at the Volusia County Jail.

Records show that while Horvath taught English at Warner Christian Academy in 2008, she befriended one of her 17-year-old students and had a four-month intimate relationship with him.

She exchanged text messages under the alias "Madeline" and had sex with him under the Dunlawton Bridge in Volusia County and at several motels in Daytona Beach, police records show.

At one point, the pair was caught having sex in a Walmart parking lot by a Port Orange officer who let them go.

Horvath resigned from the private school the day before school officials contacted South Daytona police about the allegations.

Investigators with the Port Orange police said the recent charges against Horvath have been sent to the State Attorney's Office for prosecution.

Police say Cynthia Horvath, 45, a former Warner Christian Academy teacher, violated a judge’s order by chatting with teenagers on Facebook.

Horvath, 45, faced up to 15 years in prison for having a sexual affair with a 17-year-old student at the private South Daytona school, but was given eight years of strict probation under a plea agreement and labeled a sex offender.

On April 7 she was accused of violating her community control and placed under arrest for chatting with a child under 18. She actually was communicating with a Port Orange police detective posing as a minor. Investigators devised the ruse after a parent complained that Horvath may be trying to contact minors, police said.

Aaron Delgado, Horvath’s attorney, told a judge today that his client might have thought her teenage son who doesn’t live with her was trying to contact her on Facebook.

In court today, Circuit Judge J. David Walsh prohibited Horvath from using the Internet or having contact with any minors, with the exception of her 10-year-old daughter who lives with Horvath and her husband, Nicholas.

Walsh warned Horvath that she could face prison and she should be prepared. She faces up to 15 years if convicted of the probation violation.

A former teacher, branded as a "sex offender" for an unlawful affair with a teenage student, was cleared today on charges that she violated the terms of her probation by communicating on Facebook with a teenager, who was actually a Port Orange police officer using a fake identity.

Cynthia Horvath, a 45-year-old married mother of four, was allowed to return home and continue serving out her sentence of community control, a stricter probationary sentence which is akin to house arrest.

She could have been sent to prison for between four and 15 years if found guilty of violating community control.

Before leaving a Daytona Beach courtroom, she told the judge she would abide by the long list of restrictions. "I would just like to say the stipulations are more far-reaching than I realized. This has taught me to be careful with everything I do," she said.

Under the terms of her punishment, she isn't allowed any contact with any minor except her own children, she gave up her teaching license and is now a registered "sex offender," making her subject to a long list of special restrictions and making her photo and address available on the state's public database for sex offenders and predators.

Today, in a Daytona Beach courtroom, Chief Circuit Judge J. David Walsh listened to more than two hours of testimony and ruled that her activity on the social networking site Facebook wasn't a "willful" violation of the terms of her probation.

According to testimony, Port Orange police received a tip that Horvath was communicating with former students on Facebook. Officers found at least one teenager among her Facebook friends.

Port Orange police set up a fake Facebook profile for a "Steve Warren," listing him as a 16-year-old boy in Port Orange who attends Atlantic High School. On March 31, Horvath accepted a friend request from Steve Warren and communicated with him using the Facebook chat, according to testimony.

Her husband, Nick Horvath, testified that she thought Steve might have been her son Billy, from a previous marriage. Her ex-husband has restricted her from seeing her son since her arrest.

Her attorney, Aaron Delgado, argued that there's no proof that Horvath had checked the profile of "Steve Warren" before accepting the friend request and pointed out that she stopped the chat after realizing that Steve wasn't who she thought it was.

Horvath pleaded no contest to related charges last year, and was put on strict sexual offender probation, with curfews and lie-detector tests, for another eight years. The mother of four is prohibited during her probation from having contact with the student, or any children other than her own. She is no longer allowed to teach.

According to court documents, now that a risk assessment is complete, Horvath can be approved by the court to have supervised contact with children.

In court documents, Horvath is asking for permission to allow supervised contact with friends of her daughter, "so that the daughter may have friends over," or so "friends can attend events with the Horvath family."

A hearing date has not been set.

While I understand the significance of someone in a position of power engaging with a minor, the significance is minor. The statute is set up that way to prevent those with authority from leveraging that authority to manipulate minors. I get that, but that doesn't mean that's what happens in every case like this.

100% agree, there is a vast difference between a pedophile and what she engaged in. In my state, if she wasn't a teacher she would not have been arrested. And actually we did have a teacher arrested only to have charges dropped later because he was a twenty-one year old sub for the elementry and she was a seventeen year old highschool student. Same district, different schools.

My thing with the registries is that they should have age of victim (one state that I know of does) It is not uncommon for a state with age of consent of 18 to have a have a person arrested and charged, yet the "victim" in only a few months younger.

That is also why I think that states should adopt close age exemptions.

I had a child, a husband ( well he eventually became my husband) and bills including rent and a car payment (that we pd with no help from the state or anyone else) at age 17, if I was old enough to do all that then why shouldn't I also have had the right to be able to fuck who I want?

In Oregon I'm pretty sure there is a 3 yr range for sex with someone under the age of 18. as long as you aren't more than 3 yrs older than the minor then sex is legal.

Granted I did take a pretty big leap with the 17 year old boy and 11 year old girl, I can admit that.
The woman is a teacher, she's got to understand that sex with a minor is wrong and all the bad shit that will be rained down on her if she get it on with one.
My line of thinking is if 17 is okay, for her, why not a 16 or 15 year old too? They aren't THAT much different, after all.
