4-month-old Enid girl died Friday afternoon at an Oklahoma City hospital, and her father has been charged with first-degree murder in her death.
Jazmine Kay-Lynn Moore died about 2:15 p.m. at OU Medical Center. The girl had been flown to the hospital Sunday after initially being treated at Integris Bass Baptist Health Center.
Neil Ryan Moore was arrested, and later charged with child abuse, when he confessed to police he’d shaken the girl after giving several versions of how the child’s injuries occurred.
Moore, 22, was arraigned for the second time Friday afternoon on the capital charge, which is punishable by death, life in prison without parole or life.
Special District Judge Paul Woodward denied bond for Moore at the state’s request. A bond hearing is scheduled for Monday. Moore, who has not retained an attorney, was provided with a court-appointed attorney for the hearing.
Assistant District Attorney Mike Fields had requested bond be denied as allowed by the state Constitution. Moore showed no emotion as the charge was read to him in court.
According to an affidavit filed in the case, police were called to Bass on a case of possible child abuse. Hospital staff said Jazmine Moore was being treated for symptoms commonly caus-ed by shaking.
The girl was ’poorly responsive
with obvious hemorrhaging in the eyes,’ the affidavit states.
She had swelling on the brain, with bleeding on the brain down to the spinal column.
Dr. Steven Mareburger told police Jazmine was suffering
from retinal hemorrhaging and a subdural hematoma, and showed signs of oxygen depravation and swelling to the brain, according to the affidavit. The doctor told police it was his opinion the baby had been shaken.
The girl had been in the care of her father, while her mother, Misty, was at work, according to the affidavit. Police spoke with Misty at the hospital, and she said she left for work about 10:45 a.m. Sunday and Jazmine was ’awake, happy and showed no signs of injury or distress.’
She said when she returned home about 4 p.m. she asked Neil Moore how the day had gone and he told her everything was fine. She said Neil said the baby had cried a lot, but he gave her a bottle and placed her down for a nap, according to the affidavit.
Misty said an hour later she went to get Jazmine and picked her up from the crib, but the baby’s arms and legs were limp and she appeared to be gasping for air, according to the affidavit. She said after getting no response they took Jazmine to the hospital.
When police spoke with Neil Moore, he gave several versions of events before admitting he had shaken the baby, according to the affidavit.
He initially told police Jazmine had started to cry after Misty went to work but he’d given her a bottle. He said he checked on her later and she was asleep. He said an hour after Misty returned from work Jazmine would not wake up. He said nothing else had happened while the baby was in his care, according to the affidavit.
While continuing to speak with police, Neil said he was washing dishes when Jazmine began to cry. He said he carried her into the kitchen with him and at one point had ’flopped her’ onto his right shoulder, according to the affidavit. He said he was irritated and could not take Jazmine’s crying. Neil told police after he put Jazmine over his shoulder he pulled her forward and her head had been forced back.
He said he gave the girl a bottle and put her in her crib, but she continued to cry and appeared to be hurt, the affidavit states. At that point police asked Moore to continue their discussion at the police station.
Moore was read his rights and agreed to continue speaking with police.
He said when he took her off his shoulder he pulled her forward using enough force to force her head back. He said when Jazmine’s head was forced back she went limp, the affidavit states. He said Jazmine was gasping for air, according to the affidavit, and when Misty got home from work and asked where Jazmine was he told her the baby was sleeping. He said he did not tell Misty what happened because he did not want to upset her.
Police told Neil the explanation he gave would not have caused the type of injuries Jazmine had suffered. He then told police he had put the girl over his shoulder then held her in front of him and shook her three to five times, the affidavit states. When police asked how hard Neil had shaken the baby, he said hard enough, according to the affidavit.
Neil used an infant doll to show how hard he had shaken Jazmine, which was hard enough to make the doll’s head move forcefully back and forth several times, according to the affidavit. Neil said he put Jazmine back in her crib two hours before Misty came home from work. He said Jazmine continually gasped for air from the time he shook her until the time Misty picked her up, according to the affidavit.
At the conclusion of the interview,
Neil told police he knew ’... that this was his fault and it kills him that he had done this,’ the affidavit states.
A bond hearing is scheduled for 11 a.m. Monday.
