    Repeat sex offender Michael McGill says he'll offend again, is being released anyway

    Soon-to-be-freed sex offender wrote that he'll abuse again

    A convicted sex offender due to be released Saturday from prison after serving 11 months warned in letters that if set free, he would reoffend, even against children. In the letters, Michael McGill begged authorities to keep him locked up for life.

    "Please throw the book at me ... I'm harmful to others I should be locked up for life," he wrote in block letters that resemble a child's writing. "I will sexual abuse men. Do this for the safe (sic) of others then I be able not to hurt anyone else. Judge I'm begging you to put me away."

    In another place he wrote that he had told his two 7-year-old male victims, "I will do more sex crimes with boys 4 to 14.I will molest with boys 15 to 18."

    Neither the Polk County attorney's office, which prosecuted McGill and distributed his letters to other agencies, nor the Iowa Board of Parole, nor the attorney general's office, which handles civil commitments for sexually violent predators, says it can do anything to prevent McGill's release.

    McGill will at least initially be housed at the community-based Fort Des Moines Correctional Facility, which he won't be allowed to leave without an officer's escort. He is supposed to wear an electronic monitoring bracelet at all times and be under maximum supervision for 10 years. But is that enough?

    His letters, spanning 22 pages, were obtained Thursday by The Des Moines Register. It's unclear whether he was addressing anyone in particular. They were written at some point after his latest arrest, in April 2008. Assistant Polk County Attorney Jeff Noble got them June 13, 2008, and sent them days later to officials at the Des Moines Police Department, the Iowa Board of Parole and the Iowa Department of Correctional Services. McGill, 50, wrote that his sexual offenses date to 1976 and that there were 15 victims.

    Noble got McGill convicted of his latest offense, intent to commit sexual abuse. McGill tried to grab the penis of a 21-year-old man in a restroom at Valley West Mall on April 30, 2008. In a letter attached to McGill's letters, Noble wrote that in the very week that McGill was arrested for that crime, he had also been arrested for "viewing or attempting to view" under the stalls in a public men's room using a mirror. He pleaded guilty to criminal trespass and criminal mischief and was fined $100.

    "He apparently maintained his position - that he is a danger to others and intends to reoffend - even after he was incarcerated," Noble wrote.

    "Obviously," wrote Noble, "these letters are relevant to placement, treatment, parole, supervision, civil commitment and possibly further investigation into other crimes."

    McGill's letters acknowledge both of the April 2008 incidents. McGill also wrote that among other incidents he:

    • Was banned in 1990 from the "Gallery book store" for soliciting sex with young men.

    • Was banned from "Younkys" downtown for having sex in a restroom with another man.

    Used a compact mirror in 1990 to look at the genitalia of a child in the next stall, then crawled underneath and had forcible sex with him.

    Approached a boy from behind at a urinal at Merle Hay Mall and molested him in the mid-'90s.

    The accounts are sickening and scary.

    In one letter, McGill writes: "The reason why I molest boys. It give me the thrill to be in control of their penises and tell them what to do. ..."

    Yet all those involved in his case say they have no choice but to let him out.

    The Iowa Board of Parole had no choice but to approve him for a parole release because he completed the 11 months required on a special 10-year sentence created by the Iowa Legislature, according to executive director Clarence Key Jr. That sentence dictates the supervision he will get after release. Iowa law provides for civil commitment for certain sexually violent predators who have completed their criminal sentences but are considered too dangerous to be out in society.

    A five-member Prosecutors Review Committee, appointed by the attorney general, and the county prosecutor who handled the case decide whether to pursue a civil-commitment hearing, according to Bob Brammer, spokesman for the Iowa attorney general's office.

    Brammer said the committee referred McGill's case to a psychologist who examined McGill and reviewed his records and determined he did not meet the criteria for a civil commitment. He said without the psychologist finding the need for civil commitment, the committee cannot proceed with it. A multidisciplinary team appointed by the director of the Department of Correctional Services reached the same conclusion, Brammer said.

    Among the criteria, the person must suffer from a mental abnormality that makes him or her likely to engage in predatory acts, and must have been charged with or convicted of a sexually violent offense. Brammer said McGill's record contains three other arrests, one for indecent exposure.

    Brammer said the psychologist, whom he did not name, was aware of McGill's letters.

    Beth Barnhill heads the Iowa Coalition Against Sexual Assault and sits on the multidisciplinary committee. She said the civil-commitment law is written so narrowly that few sex offenders meet the criteria. "Yes, I think the public is at risk," she said of McGill's release.

    Barnhill says there is more leverage for holding someone like McGill longer if the original charge is for a higher-level offense or more than one offense.

    Asked why McGill's two April 2008 offenses weren't combined for a higher-level offense, Noble said that criminal mischief and criminal trespass are simple misdemeanors, which are nonindictable.

    Is he concerned about McGill's release?

    "Any sex offender in the community is a concern, some more than others," is all Noble would say.


    this is just fucking ridiculous. a sexual predator can tell the parole board that he's planning on reoffending, and he's still getting out? there's nothing that can be done about a dangerous predator who says he'll do it again the next chance he gets, according to the state of Iowa. however, i'm sure the next time some 15 year old Iowan txts her boyfriend a naked pic and gets caught, they'll both be charged for making child porn. does anyone else think that's fucked up?

    yeah, so it's not that simple. unfortunately, this is one of those pedos who gets away with all the worst crimes for many years. that happens far too often. 30+ years of offending and 15 victims that he admits to, and he only gets caught for one of the lesser offences and gets off easy. so he gets a bullshit sentence. the whole thing seems fucking unfair.

    is community based correction some kind of a halfway house? that's what it sounds like. if it is, then i believe he'll be expected to find a job. so they say he won't be allowed away except for approved reasons, but those approved reasons could still give him entry into the community. it looks like he knows how to take advantage of any opportunities he can get to find victims.

    plus, how long will he be in this place anyway? once he's out, that tether won't necessarily keep from his molesting
    ways. that's been proven by some of the stories here. wasn't there even a GPS wearing sex offender who made it onto the FP for that? and even if he's there for years, sadly he will not be too old to get at it. these child molesting assholes can keep offending well into their 70's.

    imo, the worst thing here is that the psychologist didn't even think this was worthy of a civil commitment hearing. he just didn't seem to be too concerned about this, which is absurd. anyone who admits to molesting a 7 year old boy in a public restroom should be a concern, one would think. if someone like this sick fucker is not the kind of pedo they had in mind for civil commitment, then perhaps the laws should be rewritten to encompass a broader range of perverts to keep away.

    i'm going to look up the Iowa laws that cover this, but somehow i don't think my opinion will change too much on this. if this fucking perv was begging to stay in prison, let him stay. yeah, the legal system might not work that way, but wasn't civil commitment supposed to be that loophole to keep sex offenders locked up without all the fuss?

    this whole situation shows just how spectacularly the system can fail sometimes. this disgusting assclown has gotten away with far too many crimes i'm sure. and thanks to a combination of bad laws and idiots in charge making bad decisions, someday not too long from now he'll be doing it again. this pervy bastard will surely continue to be a danger to the public, just like he said he would. gg iowa!

    and if he was begging to be locked up for life and it doesn't work out, does that mean he'll do the right thing and fucking kill himself? that would be setting a great example for other pervs, and the most useful thing he could do for the community.

    Surely with all the loopholes in the laws there is one that will keep this monster behind bars. This is outrageous. He should be locked up for life. Grrrr.

    Absolutely mind-blowing that these two incidents were not reported! Im fairly certain that both kids would have been distressed to say the least, and yet nothing was picked up on? Jeez. Can they not put out an appeal of some sort for possible victims to come forward, and then charge this sick fucker with the crimes, a harsh enough sentence to grant him his wish of life behind bars?

    Another thing I find amazing is, why can they not have a flexible sentencing system for paedo's. One which can be added to as more crimes are discovered. So, for instance, he was originally given a slap-on-the-wrist sentence for intent to commit sexual abuse. Then it has obviously become very clear that he is capable of far worse (and has committed far worse by his own admission). He is now seen as a severe danger to the public. Therefore there should be flexibility in the sentence that allows for him to be kept in for far longer than the original. Especially as he has fucking TOLD them he is GOING to offend again!!!

    Its too fucking late to lock him up for life AFTER the next innocent little life has been destroyed!! How would that fucking psychologist feel if it was his child/grandchild/nephew that was this twats next victim?

    If someone is convicted of sexual assault, the punishment ought to be immediate castration. That would stop many repeat offenders, and help save more victims. The system sucks, and it sucks that one or several more young boys will have to suffer this man’s abuse because he “did not meet the criteria for a civil commitment.”
    I hope that psychologist can sleep at night. Maybe Mr. McGill ought to target a young individual in that psychologist’s family and when he’s caught say “I told you so.”
    I’m sure we’ll be hearing about Mr. McGill again as he’s already told us that.

    yeah, i fully support anyone doing this. of course, don't be surprised with the usual government response: nothing, or a form letter that basically says nothing. this could be a whole tangent, but with everything else my state and federal government is screwing up, i don't have much faith in things getting fixed any time soon.

    Aide: Culver can't block release of sex offender

    Gov. Chet Culver can't block a potentially dangerous sex offender from being released from prison on Saturday, even though the inmate has warned he will reoffend, a Culver aide said today.

    Michael Lewis McGill, 50, is scheduled to be transported on Saturday from the Oakdale state prison near Iowa City to the Fort Des Moines Correctional Facility on Des Moines’ south side. He will remain there indefinitely under correctional supervision. Some community members have expressed fears he could still harm people.

    “Gov. Culver’s No. 1 priority as governor is ensuring public safety. Gov. Culver, however, does not have the authority under Iowa Code to keep individuals in prison once their term has expired,” said Culver spokesman Troy Price.

    “The Department of Corrections has assured our office that Mr. McGill will have constant supervision and will be monitored 24 hours a day upon his release. This is an unfortunate situation, but the state is doing everything possible under the law to keep this individual off the streets,” Price said.

    Iowa Attorney General Tom Miller is also doesn't plan any final efforts to prevent McGill’s release from prison, Miller’s spokesman Robert Brammer said today. He said McGill was examined by a psychologist and state officials have concluded he does not meet the criteria for civil commitment as a sexually violent predator.

    McGill has spent about 11 months behind bar for an aggravated misdemeanor conviction. The charge stemmed from an incident last April when he grabbed at 21-year-old man at Valley West Mall and told police he did it for sexual gratification.

    Additional fears about McGill were raised this week when letters McGill had written became public. He acknowledged having molested two children in public restrooms and of having sex with a young man in the restroom of a downtown retail store.

    He also wrote he had told his two 7-year-old male victims, “ I will do more sex crimes with boys 4 to 14. I will molest boys 15 to 18.”

    McGill’s prison sentence expires Saturday, and state officials “cannot legally or constitutionally continue to incarcerate him beyond his discharge date,” said Fred Scaletta, a spokesman for the Iowa Department of Corrections.

    McGill will be required to wear an electronic monitoring bracelet on his ankle at the Fort Des Moines facility, Scaletta said. He will not be permitted to leave the property, except for special circumstances, such as a medical appointment, when he will be accompanied by a correctional officer, the prison spokesman said. Under a special sentence, McGill could be required to remain at Fort Des Moines up to 10 years.

    i really don't know how things normally work in Iowa, but unless he's caught trying to molest someone i'm sure he's not going to be there for anything close to 10 years. i'll keep an eye out for anything else about this(his entry on their state registry site is not up yet either), and i would like to find out more about their civil confinement laws.

    my question is this. Why has the law not changed around the entire country that multiple child sex offences deserves a double life sentence with no possiblity of parole? That is the only way to keep our children safe. Once a sex offender always a sex offender.

    Here in WA, we've got a S.V.P. or "sexually violent predator" law that allows us to keep sex offenders we believe to still pose a threat incarcerated past the end of their sentence. Our state was the first to pass such a law, which authorizes the state to commit these offenders to state-run mental institutions within prison. 16 states total now have similar legislation.

    Because of dudes like this, all states ought to have a law like this on the books.

I wonder if he knew there was no way he could be kept in for any longer, and telling the parole board he WILL re-offend, and writing those letters, is his way of paving the way to be able to say ''I warned you! Its not my fault, its yours for not listening!!'' when he does rape or molest another child.

    Kind of justifying his actions in his own mind by blaming Iowa and its laws, the parole board etc. for 'allowing' him to be in a position to commit the crimes. After all, he has warned them.

    That's a possibility, certainly. Of course, should he reoffend, the state could very well be held liable in a civil suit, so it would probably behoove them to heed his warning.

    But it's also possible that he is genuinely concerned. See, pedophilia is a legitimate mental disorder. These people don't choose to be attracted to children and find themselves compelled to do what they do, even though they know it's wrong. That's why they have such high recidivism rates, because it's not something they can simply turn off. They are often uncomfortable with adult relationships like adults would be uncomfortable having a relationship with a minor.

    Society could be better served if we identified the true pedophiles floating around in our penal system, isolated them (like a specific facility for pedophiles) and kept them incarcerated for life while we continue to study treatment.

    Michael McGill back in prison


    DES MOINES, Iowa - A sex offender recently freed from prison has been transferred to the Polk County Jail.

    Department of Corrections spokesman Fred Scaletta says Michael Lewis McGill was jailed Wednesday night pending a parole violation hearing.

    McGill had been freed from prison last weekend and transferred to a lower-security facility in Des Moines.

    He was arrested in April 2008 and charged with assault with intent to commit sexual abuse after he grabbed a 21-year-old man at a mall. He also was arrested for indecent exposure in 1995.

    He was the subject of e-mails circulating from people worried about his release.

    McGill was returned to jail because of reported violations, including threats to several people.

    Scaletta says a report will be submitted to the parole board recommending that McGill be returned to the Iowa Medical and Classification Center for two years.
