It was his family doing the arguing, especially as it concerned a possible plea deal with prosecutors.
Shifflett is charged with failing to register as a sex offender and sodomizing a nine-year-old boy. A three day jury trial was scheduled. But the court ended up letting Shifflett talk to his family about whether to fight the charges or not.
"My brother is innocent and the world knows that he's innocent, but he had to plead guilty today," said Shifflett's sister, Barbara Allen. ( yeah right FUCK YOU!!, Barbara , I dont belive it for a second and no one else does but your Tard ass. )
Shifflett entered a guilty plea in Albemarle Circuit Court Monday but says he did not sodimize the nine-year-old victim in the case. "There was no one here to witness him, to help him out," said Barbara Allen.
After spending more than three hours talking with family, who all had different ideas about whether Shifflett should proceed with a jury trial or enter a plea agreement, he took the deal. By doing so, he admitted the prosecution had enough evidence to make a case against him.
Albemarle County Deputy Commonwealth's Attorney Darby Lowe said, "Offenders abuse children when no one is looking so that would be the sole evidence in support of the actual offense itself."
But the Commonwealth said the decision to enter the agreement on their side was based solely on the best interest of the victim.
"Think about how it must be for a child to have to describe being victimized in such a way in front of a jury of people and for him to have to relate the clearly terrifying and shameful and difficult events of child abuse," said Darby.
The Commonwealth says justice has been served, and is thankful the victim can have closure. But Shifflett's family doesn't have the same faith in the way the case played out. Allen said, "There is no system, honey. There is no system."
Under the deal Shifflett was sentenced to 17 years in prison. If he had gone to trial and been found guilty he could have faced up to life in prison on the sodomy charge alone. Shifflett does have a previous sodomy conviction for which he has already served nine years.

Police have been looking for 45-year-old Shifflett since Friday. He is wanted on two felony counts of forced sodomy and a probation violation. Police say the two crimes were committed between 2004 and 2006 with a person under the age of 18.
Investigators say the last time someone has seen Shifflett was on Friday when police obtained the warrants. Shifflett's last known address is on the 1200 block of Simmons Gap Road in Albemarle County.
He is a registered sex offender and has been convicted of a separate forcible sodomy charge plus aggravated sexual battery back in 1995.
"He is a convicted sex offender, as you can see on the website, if you go to the Virginia State Police website he is on there. We take them all seriously -- any case involving a sexual offender, whether it was a first offense or a repeat offender," said Sergeant Tim Aylor with the Albemarle County Police Department.
Police are not able to say much about Shifflett's case yet because it concerns a minor. Shifflett's name may sound familiar. He has two brothers who have also been in trouble.
A year ago, officers shot Timothy's brother, Elvis, after a week-long manhunt stemming from an attempted shooting in Court Square.
A week later, police arrested another brother, Jeff, after a high speed chase on several breaking and entering charges.

The Daily Progress reports that he admitted yesterday to pulling a gun on his girlfriend, the incident that led to the chase.
Earlier, an investigation by State Police exonerated the officers who shot Shifflett, and in May Shifflett pled (using Alford pleas) to charges stemming from his flight from justice.
The Progress‘ Liesel Nowak reports, the still-recovering Shifflett appeared in court yesterday leaning on a walker as he pleaded guilty to pulling a gun on Linda Shifflett October 13, 2006 in Court Square.
Nowak reports that when sentencing occurs in October 16, Albemarle prosecutors intend to recommend that Shifflett receive a sentence of at least five years in prison.
