    53 year old Babysitter Brenda Caringer kills 9-month-old boy (skull fracture)

    A Willard baby-sitter was charged today in the Jan. 6 death of 9-month-old Lucas Theede-Bennett.

    Brenda Jean Caringer, 53, is charged with second-degree murder and child abuse resulting in death. The charges were filed alternatively, meaning jurors could find Caringer guilty of either crime — or neither — if the case goes to trial.

    “Both of these offenses are class A felonies,” punishable by 10-30 years in prison, Greene County Prosecutor Darrell Moore said at a 10 a.m. news conference at the Willard Police Department.

    Willard police were looking for Caringer today but had not yet arrested her at the time of the news conference.

    The charges filed against Caringer allege the woman either shook Lucas or caused his head to be struck — the probable cause statement says an autopsy determined the boy suffered a number of internal injuries to his head, including a skull fracture and retinal hemorrhages.

    The probable cause document, written by Willard Police Sgt. Shannon Shipley, includes explanations Caringer gave for the boy’s condition.

    When she first called 911, Caringer told a dispatcher the baby “fell and hit his head and she could not keep him awake,” the statement says.

    She later told police and Lucas’s paternal grandmother that the boy had been crying. She laid him down for a nap but found him not breathing when she went to check on him.

    In another statement to police, Caringer allegedly said the boy bumped his head on a coffee table and fell backwards. Afterwards, she attempted to comfort and feed the “screaming” baby when he “went limp,” the statement says.

    “Caringer said she picked Lucas up, shook him and blew in his face to get him to breathe,” the statement says.

    OMG..he is so beautiful! RIP little man
    Ya know...people often wonder why I am such a homebody...and choose to stay home with my children....rather than "go out".

    On the rare occassion...my Mom will come over and watch them for a while....but never ever for bedtime. Thats OUR time (me and hubby) with our kids. I wont let anyone put them to "night nights".

    We would always be home by 9...so what ...who cares??? We had our party days...and now we are a family...and I never ever want this family to be incomplete because of some stupid fucking "babysitter" who either kills them or lets them get abducted. No fucking way! Not me...not my kids.

    I feel ya there! I only leave mine with my sister-and that is rare. She has sleptover at my sister's house once since she was born in Dec 07. There is no one else I would trust for any period of time. My niece maybe-she has one of her own a few months older than my baby. But my husbands family-NOT! There is not one person that I would leave her with on that side. Much to his dismay- I'm certain.

    She does go to daycare, but her daycare provider has taken care of her since she was 2 months old-and my buggy loves her. She loves my buggy like her own-and I trust that completely. My buggy never hesitates to go to her...

    Seriously, I'd have this baby killer's head. Had she taken my precious angel, and in such a vicious way, I'd fuckn' kill her. You'd all be here blogging and posting on my story...you'd get some great pics too with her head on my sword!

    I can't imagine how the mother and family are coping. You just can't fathom that you'd leave your precious in ones care then come back to a dead baby.....
    no, hell no, retribution for damn sure!

    Caringer, 54, faces charges of second-degree murder and child abuse resulting in death for allegedly shaking the baby or "causing his head to be struck."

    The charges were filed alternatively, meaning jurors could find Caringer guilty of either crime -- or neither -- if the case goes to trial.

    "Both of these offenses are class A felonies," punishable by 10 to 30 years in prison, Greene County Prosecutor Darrell Moore said during a news conference at the Willard Police Department.

    Submitting both gives prosecutors some flexibility, he said, because the standard of proof required by each charge is different.

    Second-degree murder requires prosecutors to prove beyond a reasonable doubt that Caringer knowingly intended to kill the boy, he said.

    To prove child abuse resulting in death, prosecutors only must show she inflicted "cruel and unusual punishment" that ultimately killed the child.


    Mayor Jamie Schoolcraft said Lucas's death has deeply affected the Willard community. "Our thoughts and prayers are with the family -- we all know them and are friends with them," Schoolcraft said.

    Lucas was the son of Amanda Theede and Sean Bennett and the grandson of Don Bennett, the longtime owner of Springfield motorcycle shop D-C Cycle.

    Dozens of local bikers joined the funeral procession when the baby boy was buried at Clear Creek Cemetery near Willard.

    No family members attended the news conference Wednesday. McClain said the family had asked that their privacy be respected and "balanced with the public's right to know" about the case

    Poor little guy. This is terrible.

    I think there needs to be billboards nationwide that say "Doctors Can Easily Tell When You've Shaken a Baby to Death. Even If You Lie You Will Get Caught." In large black block letters on a white background. Maybe with a picture of a closed casket underneath.

    Trial begins today in Willard infant death
    A Willard woman’s trial begins today in Greene County court on charges that she abused an infant she was babysitting.

    Brenda Caringer, 55, has been charged with second-degree murder, with the alternate charge of felony child abuse.The jury will have the option of which charge to convict her of, or neither.

    Lucas Theede-Bennett was nine months old when authorities responded to Caringer’s home for a child not breathing.He was pronounced dead a short time later.

    According to court documents, authorities found Lucas wearing only a jacket and lying on the floor. They also found a bloody bottle near where he was found.

    An autopsy performed on the boy showed abusive head trauma with bleeding on the brain. The injury Lucas sustained was determined to most likely have been inflicted within the two hours before he died.

    A Willard woman charged in connection with the 2009 death of a nine-month-old boy she was babysitting has decided not to be tried by a jury.

    In a hearing before the start of the trial Monday of Brenda Jean Caringer, defense attorneys filed a motion to waive a jury trial and have their client tried by Circuit Judge Calvin Holden.

    The prosecution has rested. Defense starts today. Closing arguments are expected tomorrow.

    The paternal grandmother of a little boy who died last year in the care of his babysitter in Willard took the witness stand on Friday. Shelly Bennett’s two hours of emotional testimony highlighted two major issues during the third day of the trial of Brenda Caringer.

    Bennett remembered the events leading up to Lucas' death.

    "She (Caringer) was telling me that Lucas wasn't breathing, that she had tried to reach Amanda (Lucas’ mom) and that she had called 911."

    Prosecutors are going after the different stories told to Bennett by Caringer.

    "’I went to put him down for a nap and went to check on him and he wasn't breathing,’” Bennett recalls Caringer telling her shortly after she arrived at Caringer’s home.

    Later that day, prosecutors say, the story changed. Caringer said Lucas had possibly fallen in the living room while Caringer was in the kitchen getting him a bottle.

    "She was going to change him, and he had a seizure, and he stopped breathing,” Bennett recalled Caringer saying after Lucas was taken to a hospital by an air ambulance.

    In cross-examination, the defense focused on what happened two days before Lucas died, when he was at his grandmother's house, getting ready to go to church. Lucas fell and hit his head.

    "He was playing with those buttons and he got his weight off balance and he slid off the toy,” Bennett told defense attorney David Back and Circuit Judge Calvin Holden, who’s hearing the case after Caringer waived her right to a jury trial.

    "He had a little red spot (after the fall),” Bennett said.

    “What part of the head was the red spot on?” the defense attorney asked.

    “Right on the side, up towards the top above the temple,” said Bennett.

    At the time, Bennett said, she thought nothing of the red spot, and decided not to mention it to Lucas' mother.

    "Did you say, ‘I still thought there was every possibility that Lucas' fall at my house could have caused his injury?’ Back asked.

    “I'm sure I said that but I don't recall when,” said Bennett.

    Both sides are picking apart what was said, when it was said, and how things happened.

    The prosecution wrapped up the day by calling in an investigator on the case, along with DNA experts. The issue on hand there is the blood found on the baby's bottle, and how it got there.

    The defense argues it’s from a tear on the lip during CPR, which does often happen. The prosecution said it got there before the CPR even happened at the hands of Brenda Caringer.

    A Willard woman sobbed loudly on Thursday in a Greene County courtroom after a judge ruled she killed an infant in her care.

    Baby sitter Brenda Jean Caringer, 55, was found guilty of felony child abuse that led to the January 2009 death of 9-month-old Lucas Theede-Bennett.

    Although the prosecution asked Circuit Judge Calvin Holden to consider a murder charge, he decided the evidence pointed more toward abuse.

    The judge said although Caringer didn't mean to kill the infant, the blow was not an accident.

    How anyone, ESPECIALLY a grandmother, could hurt a little one with a face like that is completely beyond me! Even if she didn't murder him intentionally, I can't imagine striking that precious, sweet face at all, no matter what. What a cunning angel he must make, poor swee'pea!

    A woman from Willard got a 15-year prison sentence with no probation for the death of a 9-month-old boy who was in her care in January 2009. Greene County Circuit Judge Calvin Holden sentenced Brenda Caringer in a packed courtroom on Friday afternoon after he found her guilty of child abuse resulting in death last November.

    Holden issued his sentence after two hours of testimony from relatives of the boy who died and Caringer's supporters, plus arguments from prosecutors and defense attorneys. Defense attorneys argued for a suspended prison sentence with probation. Prosecutors sought a 20-year sentence. The range of prison sentences for child abuse resulting in death is 10 to 30 years (life).

    Prosecutors say Caringer will have to serve at least 85 percent of her sentence, or nearly 13 years, before being eligible for parole.

    Caringer broke down in tears after Holden issued his sentence.

    After Friday's sentencing, KSPR spoke to Lucas' family. Family members were hoping Caringer would get the maximum 30-year sentence, and were upset that she only received half of it.

    During the sentencing hearing, it was revealed by one witness that Caringer had already had two children removed from her care after allegations she was abusing them.

    I don't even know what to say about what you put in bold text. doesn't no probation for 15yrs mean cancel out the "13 years, before being eligible for parole".

    Parole and probation are two different things. She was sentenced to 15 years with no probation, and she can't be eligible for parole until she serves at least 85% of her sentence.

    As I understand it, if you get out on parole, you are still under the jurisdiction of the prison system until your sentence finishes. Example: If she gets out in 13 years, she would still have 2 years of parole (total 15yrs). If she had been assigned probation, it would kick in after that.
