    Both parents were only 16 when it happened. WTF!!

    There trying his sorry ass in Adult court but Xzavier' wants, to move it back to juvenile court. Yeah right, he would do less than a year for murdering his own flesh and blood, 26 day old baby.

    The 17-year-old father accused of killing his infant son wants to be tried in juvenile court.

    Xzavier Posey is charged in adult court with first-degree murder in connection with the death of his son, Xzavier Posey Jr., who died Nov. 15.

    “This is as grave as charges get,” said Phil Ramirez, Posey’s attorney, during a hearing Wednesday on the matter. However, he said Posey appears to have taken advantage of juvenile court services previously when required, and could be eligible for services if placed in a residential facility until the age of 19.

    Sheri Flack, a juvenile court officer, recommended Posey remain in adult court due to Posey’s age and the nature of the crime.

    “With the charge being as it is, I don’t see how we could ... sufficiently rehabilitate him in that time,” she said of the months before Posey turns 18.

    Judge Bobbi Alpers said she will issue a written ruling shortly.

    According to police, baby Xzavier was taken to the hospital after his father called 911 from his house on the morning of Aug. 31. Posey reported his son was not breathing, police said. The child was then transferred to University Hospitals in Iowa City for treatment of his injuries.

    He died shortly after he returned to his mother’s home from the hospital, as the result of the “original injuries,” police said.

    An autopsy on the baby confirmed he died from the blunt force trauma injury he suffered on Aug. 31, when he was 26 days old.

    Documents filed with an application for a search warrant indicate the baby had rib fractures, brain bleeding and severe brain damage, and that officials determined the trauma was “the result of shaken baby syndrome.” Police also took photos of damage done to the apartment due to Posey’s “anger problems.” The photos included punched walls and a door damaged by slamming.

    At his funeral, the pastor talked about how baby Xzavier’s life would serve to spread awareness about the devastating consequences of shaken baby syndrome.

    I don't have a clue why they sent that poor baby back home with these two 16 year olds. the baby had rib fractures, brain bleeding and severe brain damage. Mommy has 36 picts posted of the baby after they got back from the hospital. Poor little thing. He was BUG eyed in every image and in obvious pain, kind of looks like he was scared of every one there.

    Shaunticia looked like she was a pretty good mom and she loved Xzavier Jr.

    Dear God, this is horrible.

    Contrast the photo of little Xavier with his 'daddy' with the ones of him after being returned to hell from the hospital. You can clearly see the poor little mite is just.....gone.

    Nothing but horror in those little eyes.

    Poor, poor little sweetheart. Absolutely heartbreaking.

    Hope your 'daddy' suffers hugely and constantly for the rest of his miserable, worthless life. Bastard.

    He absolutely devastated baby Xzavier. In the pictures you first see this perfect little soul, then after the life was near shaken out of him, you see a broken, terrified little body. If anything, these pictures show the terrible and tragic results of SBS.

    His father and mother both very young, but very aware that a little life is so fragile. He was to be protected, loved and cherished, instead he had his precious life stolen. I wish he'd never been returned home. Although, during that time, I hope it was then that a difference was made...I suppose, as this mother did seem to love him, she was granted a bit more time with him and baby Xzavier deserved to know love from his mother.

    So very sorry baby Xzavier that you were handled in such a brutal way. I know now that your body is once again perfect and your soul at peace....kisses sweet one.

    She is pretty good about friending people if you want to see more photo's.

    I had a real hard time looking at them. She is pretty clueless about SBS and didn't understand what was happening right in front of her eyes. What that poor little guy was going through. They thought he was just making faces and acting stoned. In reality his brain was swelling inside his head trying to push out through his eyes because it was the only place left to go.

    I know SBS is something, I never in my life wanted to know about.

    I wonder if the dad was just acting stupid and didn't realize how much damage he was causing? Not that it excuses anything, as it's already been said on here babies need to be handled gently.

    I remember learning about SBS many years ago during that case where the au pair shook an American couple's baby to death. I think it might have even been a new type of official death back then. But that was such a long time ago that those 16 years might not have even been born, or would have been very young. They might not have known anything at all about the dangers of shaking babies, or how shaking is just like being in a car collision in terms of damage to the brain. High schools should have a required course in prenatal and infant development in order for seniors to graduate, that way hopefully most of these young parents can get some information before they get pregnant.

    I cant say what was in the dads heart when he was shaking the baby, but from all the damage he did to the rest of the apartment, he clearly had anger issues. He was probly worked up about something and took it out on the baby. You have to remember or look at the photo of the 2 of them. The baby wasn't even a month old and probly weighed 12 lbs at most. He was squeezing it and shaking it like a paint can . That gives intent to harm and shows to me he ment to hurt the baby. Maybe he wasn't trying to kill it but he was trying to hurt it and make it suffer for what ever reason.

    R.I.P lil one. Those pictures were heartbreaking. He was a cute lil boy. He got that from his mom, now his piece of shit dad. That poor lil guy's eyes were popping out of his head. The dad was old enough to think he was grown and have a kid, he should be tried as an adult for taking that child's life. What that baby had to go through in just his short life time. I hope he gets his ass kicked .

    Can I get a WTF here???!!!! Why in the world would the hospital send the baby home with his parents, one of whom is accused of abusing him to death, basically? If daddy dearest couldn't handle a normal, healthy 26 day old, how do they think he's going to handle a sick, injured baby? Was this just a cost cutting measure by the hospital? The kid was going to die anyway, may as well let him go home?? I am furious!

    He was not sent home with the parents. His "dad" is being held on $1 million bond and isn't going anywhere soon. I would assume that it was just his mom or her and her parents.

    It is possible that the hospital did not think he would die. They may have thought they were sending home a severely handicapped child. Because of the age of the mother, if they had services in place, there would be no need to keep the baby in the hospital.

    Another possibility that it was a hospice situation. There may not have been anything more the hospital could do and the family may have wanted it that way. No one probably thought the end would be that soon.

    Dakota- Thanks for that. I was almost puking thinking the poor baby went home only to be "finished off" or because it cost too much for the hospital to care for him for the remainder of his days! I freaking hate baby killers.

    Thoughs are pretty good questions, I do know there wasn't any picts of the dad that night in her picture folder, just 2 or 3 females. The news article says they went to the moms house not a hospice.

    I can try and ask her about it.

    I don't know about other places, but here hospice is frequently done at home. There are centers for those that need skilled medical care, or nurses that may come into the home. I have a friend who is a hospice nurse that visits her clients once a day although some have around the clock care. And at times the care needed may be limited to feeding and meds, so the family does it themselves. For me, a hospice situation can mean any variation of those.

    Dakota was right, He was on Hospice when he went home. He was pretty big in some of the later picts for only being 25 days old so it could be true what she says about him being in the hospital for over a month. Probly not much they could do for him at that point.

    She says she is going to try and speak out about SBS and they even did at the funeral, so I see no reason to dought her sincerity. For only being 17 she seemed to be a good mom and from what I can tell a good person. I hope and pray she can save many children from ending up like this.


    THEY DIDN'T SEND HIM HOME SOON! THE NEWSPAPER JUSS DOESN'T TELL EVERYTHING N IT HAS A LOT OF ERRORS IN IT! HE WAS IN THE HOSPITAL FOR OVER A MONTH...N WHEN HE WAS SENT HOME HE WAS ON HOSPICE...HE DID GOOD AT HOME. WE ALL TOOK VERY GOOD CARE OF HIM N I WAS WITH HIM ALL THE TIME. I GAVE HIM ALL HIS MEDS N HE DID FINE. HE CAUGHT PNEUMONIA BUT HE GOT RID OF IT. I GUESS GOD JUST WANTED HIM TO COME HOME.

But im not, im very mature 4 my age n i appreciated jr very much. Even tho his time here was short i cherished every moment. But ya the doctors in iowa city were amazing. They were very welcoming and they comforted us the whole time. We are going to send them a nice gift because they were truely amazing. My jr couldn't have bn in better care. N yes i now kno that sbs is very serious and complex. It saddens me that not very many ppl know the terrible pain it can cause everyone. That is y i plan to speak out about it no matter how painful, so i can make sure that something good comes out of this tragedy. It's hard 2 think that could ever happen but i kno it can and i plan to dedicate myself to helping others. If u know of any way i can help please let me kno.

    Well she is only 17 and it looks like she is learning from her mistakes, hopefully that will be one of them. You will have to ask her that.

    He will be behind bars for a long time, so she willl have lots of time to grow up before then.

    I am trying to hook her up with "Debbie Dycus" , Cofounder of the "National Shaken Baby Coalition" she helped to raise "Taylor Nicole Rogers" who just passed way after 9 years from complications of SBS. I am hoping they can help point her in the right direction. They all pretty much started out in the same place Shaunticia is in right now. Loving and supporting the person who shook there baby.

    Xzavier Posey of Davenport pleaded guilty to child endangerment causing death in Scott County District Court Dec. 3.

    Before pleading guilty, he faced a first-degree murder charge that, if found guilty, would have put him away for the rest of his life.

    Unless a person live under a rock, even if they are sixteen, they know about SBS. This guy with an "anger management problem" scrambbled his son's brain and remorse? None. All he wanted was to get his murdering ass out of prison when he turned 21.

    I wish that manditory sterilization was law in cases like this!

    I think you are over-estimating the intelligence of people, seriously. May I point your attention to one of the role models of this decade, who didn't know if tuna was fish or chicken? There are some seriously stupid people in this world.
