    OZARK - Military officials are looking into the death of an infant whose case has been investigated since November, according to authorities.

    Dale County Coroner Woody Hilboldt said 5-month-old Dedrick Fisher of Fort Rucker was pronounced dead on Monday morning at Dale Medical Center.

    The manner and the cause of death are pending an autopsy report,” which could take time, Hiboldt said. “There could be all kinds of circumstances.”

    Military authorities said Dedrick’s case had been investigated since he was first taken to a hospital in November, though no other details were released.

    No charges in his death had been filed as of 3 p.m. Tuesday, according to federal court records. Dedrick is the son of Fort Rucker soldier Spec. Dedrick Fisher Sr.

    “The investigation will continue and circumstances surrounding this tragic loss will be released as information becomes available,” according to a press release from the Fort Rucker Public Affairs Office.

    Pre-court-martial hearing held for Fort Rucker soldier

    Fort Rucker, AL- Investigating officer Cayla Slusher heard testimony Wednesday in the involuntary manslaughter case of U.S vs Specialist Dedrick Fisher.

    Article 32 hearing is a precursor to a general court-martial, one that Fisher would have to face later this year, if the investigating officer feels there was enough evidence to show he played a role in the death of his five-month old son.

    There were four witnesses in Wednesday hearing, two appeared and were actually sworn in over the telephone.

    Fort Rucker Criminal investigation Division Chief Raymond Massey testified that in Fishers sworn statement last November he indicated that he had shaken the baby.

    Birmingham physician and child abuse expert at Children's Hospital, Melissa Peters, said when she examined young Dedrick Fisher Jr. that his injuries were consistent with that of severe inflicted brain trauma, something that can happen when shaking a baby.

    After testimony Wednesday the investigating officer over the hearing Cayla Slusher will make a final report once she hears more testimony and gets a final autopsy report from the Department of Forensic Sciences.

    The military does not have minimums on sentences it's only determined off of the maximum and the maximum on involuntary manslaughter is 10 years.

    FORT RUCKER, Ala. — Fort Rucker officials charged Spc. Dedrick Fisher Sr. with manslaughter Wednesday in connection with the death of his son, 5-month-old Dedrick Fisher, who died Monday, in Dale County Medical Center.

    In early November, the Criminal Investigation Division and Fort Rucker Military Police initiated a federal investigation due to the infant’s hospitalization.

    Nov. 11, Specialist and Mrs. Fisher transported the infant to the military police station here, after the infant allegedly choked during a feeding and stopped breathing. When the MPs’ resuscitation efforts yielded no results, Dedrick was rushed to Dale County Medical Center where he was revived and then med-evacuated to the Birmingham Children’s Hospital for further care.

    As a result of the preliminary investigation, Fisher was charged with assault on a child under 16. Since November, Spc. Fisher has been under a no contact order with the family and was under direct supervision by his chain of command.

    Dale County Department of Human Resources were notified and worked with the Fisher Family since November. Additionally, Fort Rucker officials continue to provide support and assistance to the Family through Army sponsored services. SPC Fisher was only allowed to see his son as part of DHR supervised visits.

    Fort Rucker officials are seeking pre-trial confinement pending trial.

    The next step in the General Court-Martial process is an Article 32 investigation. The purpose of the Article 32 investigation is to inquire into the truth of the matter alleged in the charge, consider the form of the charge, and to make a recommendation as to the disposition of the charge.
    U.S. Army Aviation Center of Excellence Commanding General Maj. Gen. James O. Barclay III serves as the general court-martial convening authority. He will make the final decision regarding whether this case proceeds to Court-Martial.

    Funeral arrangements are still being coordinated and will be made public upon completion.

    Fort Rucker officials wish to thanks to all Wiregrass and Army service providers for their assistance to the Fisher Family and to community members for their calls of concern in this matter. Since November we have been working closely with the Dale County authorities and DHR and would like to thank them for their cooperation and support with this case.

    I live in Ozark, this has been a huge deal because we don't get alot of crime. The Ft. Rucker base is located within our little bitty town. I used to live in Dayton, Ohio. Its a big difference from here. About 7 years ago there was also a case of a guy, the moms BOYfriend of course (have a hard time saying man ) killed her toddler. Slammed him into walls, the driveway , etc. It was made into a big deal because stuff like that does not happen here. Theres also a cold case of two teenage girls who got lost going to a party and were found up the road with bullet wounds to the head in their car. We have had alot of cable shows come here for it. Everyone has came to the conclusion that it was a city officials son. I'll post all the info in cold cases , hope yall read it and give me your opinion.

    There being pretty stingy about case info in this one and I cant find anyone blogging about it. Since it happeend on the base they seem to be the ones handling the case so far.

    The town sheriff is pretty torked off, Dedrick shook his 5-month-old son in November, they go to the Dale Medical Center ( no one calls the cops ), they say the boy is brain dead ???, and the boy goes back home with the parents??? then there is a new shaking event and the boy dies and the sheriff just finds out about it a couple of months later??. They just took the other kid out of the house this week. Thats the way I am reading this story, What ever happened its fucked up.



    The incident began back in November, however, Dale County Sheriff's department did not find out about it until Monday when the infant was brought to Dale Medical Center, where he was pronounced dead due to shaken baby syndrome. There are a lot of questions that we're not getting answers for.

    Authorities say in November the child was taken to UAB in Birmingham after the first shaking incident occurred.

    Investigators say doctors determined the baby was brain dead and he eventually returned home with his parents to Fort Rucker. Officials say there was then apparently a second incident, that's when he boy was taken to Dale Medical Center where he died.

    Sheriff Wally Olson tells News 4, the first time his office heard of the situation was Monday, when he and his deputies met with Fort Rucker officials and MP's at the hospital.

    Investigators say the father, Specialist Dedrick Fisher Sr., did admit to shaking the baby, but are now retracting that statement.

    Sheriff Olson says the father has previous charges, but the details of that are not being released pending a court martial.

    Currently, authorities are looking to see if the incident happened in an exclusive area on post. If it happened in a non-exclusive area, dale county authorities could be involved in prosecuting the case.

    "They've got their policies that they have to go by and you know I'm not familiar with all of their policies and procedures, I'm familiar with our criminal justice system and that's what I'm accustomed to so I've explained to the military that's be willing to help them in any way you know if they need a place to house him you know that will be fine... I will take care of that," says Sheriff Olson.

    Despite our repeated requests for information, this three line press release is all that we received from the public affairs office at Fort Rucker. It makes no mention of any charges fisher faces and it doesn't even imply that a crime may have been committed. Fisher is currently in the custody of military police.

    Another child in the home, a two years old girl is in state custody tonight. Sheriff Wally Olson says if fisher is charged outside of the military court system, he could face murder charges.

    GREENVILLE - Graveside services for Dedrick Lamar Fisher Jr., 5 months, of Fort Rucker, Ala., will be at 2 p.m. Monday in Oaklawn Memorial Gardens, Greenville. He died Feb. 2, 2009, at Dale County Hospital, Ozark, Ala. Byas Funeral Home, Greenville, has charge of arrangements.

    Survivors include his parents Dedrick Lamar and Eliana Arias Fisher Sr. of Fort Rucker, Ala.; paternal grandparents Elnora Fisher of Greenville, and Allen (Marilyn) Fisher of Summerville, Texas; maternal grandparents Miguel (Maricela) Arias of Sylmar, Calif.; a sister Eldiana Fisher of Fort Rucker, Ala.; and a host of aunts, uncles, cousins, other relatives and friends.

    Visitation will be Monday from 10 a.m. until 1 p.m.

    I am no medical doctor, but if you are brain dead, wouldn't you stop breathing? And you'd probably need a feeding tube? I could be wrong here, but I really think that is a misquote by the paper.

    Autopsy results in.

    A recently completed autopsy of a 4-month-old Fort Rucker boy by state medical examiners showed the boy died from a non-accidental head injury.

    The autopsy revealed multiple injuries about the head. Paredes said the baby spent three months in the hospital before he died from his injuries.

    “I think several shaking episodes or blunt trauma to the head,” Paredes said. “I think it was an inflicted head trauma.”

    Civilian defense attorney Victor Kelley patted the back of Spec. Dedrick Fisher on Thursday after what Kelley said was the most important day in the rest of Fisher’s life.

    Perhaps it was, as the Fort Rucker soldier walked away a free man after a six-soldier panel unanimously acquitted him in a general court martial of all charges relating to the death of his infant son, Dedrick Fisher Jr., according to Fort Rucker Public Affairs Officer Lisa Eichhorn.

    Kelley said expert testimony in the three-day trial showed there was no way shaking could have caused the degree of injuries from which baby Dedrick died.

    Kelley used testimony by Virginia neurosurgeon Dr. Ronald Uscinski.

    “You’ve heard Dr. Uscinski say ‘this was a case of subdural injury created by a birth trauma,’ and that he did not agree with the government’s case … that shaking did not cause Dedrick’s death,” Kelley said.

    “Everybody is sorry they lost a son, but there’s nothing we can do to make it better. What could (have) made it worse was to convict an innocent man.”

    Fisher’s case included testimony from both he and his wife, Eliana.

    Prosecutors maintained the bleeding baby Dedrick’s brain suffered was not caused by a baby choking and that Fisher had admitted at least twice to shaking his son, who military prosecutor Capt. Shawn Tate said Fisher referred to using an explicative.

    Tate said Fisher also claimed other reasons as to how his child died.

    “We (were) here for baby Dedrick. He doesn’t get a second chance. He’s not here to tell us what happened … (but) only one story makes sense, and that is that Dedrick Fisher Jr. died from abusive head trauma,” Tate said.

    “Spec. Fisher lost a son. He was a good soldier, but no matter how good he has been, he made a mistake that day. He messed up.”

    According to presiding military Judge James Pohl, Fisher was able to go home after the case.

    The case will not appear in his record and there have been no other arrests in the case, according to Eichhorn.

    On the face of it, I totally disagree but I was not in the courtroom to hear all the evidence. Sadly "more likely than not" is not the same as "beyond a reasonable doubt".

    No. Your brain does not control your breathing or your beating heart..these are involuntary actions..you donthave to tell yourself to breath or tell your heart to beat..conversely you can't tell your heart to stop beating but you can tell yourself to stop breathing..point being, the brain doesnt control respiration..

    WTF, it took two months for "birth trauma" to kill him? His "birth trauma" was in various stages of healing? With everything else to consider, this looks like the army prevented a civil trial and wants to avoid bad press.
