    James Charles broke the baby

    A North County man was in custody Tuesday for allegedly shaking his 3-month-old son and repeatedly dropping him on the floor, leaving him with serious brain trauma, a sheriff's official reported.

    A child-abuse detective arrested 29-year-old James Charles of Poway at his Olive Meadows Place home about 1 p.m., Sgt. Hank Turner said.

    On Dec. 19, Charles and the baby's mother brought him to Rady Children's Hospital, where he underwent emergency surgery. The infant since has been transferred to the custody of social-services personnel.

    "The parents initially had no explanation for their child's injuries," Turner said.

    During two subsequent interviews with sheriff's investigators, Charles allegedly admitted to shaking his son more than 30 times and dropping him multiple times, according to the sergeant.

    Charles was booked into county jail on suspicion of felony child abuse.

    It was not immediately clear if the infant was expected to fully recover from his injuries, or whether the child's mother might also face legal action.

    Cooper (Deputy District Attorney Nicole Cooper) called the child's injuries "significant" and said doctors don't know yet if he will have permanent brain damage or vision impairment.

    According to Cooper, the baby's mother got pregnant two months after meeting Charles, who then went off to Iraq and married her upon his return. As a result, the couple had lived together for only several months, she said.

    The prosecutor said the baby was born Sept. 17. The complaint alleges the defendant shook or dropped the child on Oct. 18, Dec. 5 and a third time between Dec. 14 and Dec. 16.

    Cooper said the baby is out of the hospital and in foster care.
    Because of an investigation by Child Protective Services, Charles moved out of his home and moved in with a fellow Marine in Lakeside, Bajaj said.
    Charles is charged with three counts of child abuse, including one that alleges he caused great bodily injury. He faces 14 years and four months in prison if convicted.

    Wells scheduled a bail review for Wednesday, a readiness conference for Feb. 25 and a preliminary hearing for March 25.

    The baby, named Owen, was first taken to a doctor in mid-October, when he was about a month old, with bruises under his armpits and bleeding in the eyes consistent with shaking, Cooper told the judge.

    The baby had bruising on the forehead when he was seen again early last month, the prosecutor said.

    In mid-December, the child's head was swollen and he was diagnosed with bleeding on the brain and a skull fracture, possibly from being dropped onto the floor, Cooper said. The baby also had a broken finger that his parents couldn't explain, the prosecutor said.
    Why wasn't the babies injuries reported by the doctor back in October?...am I missing something here? This baby appears to have been abused since day one...I'd bet money on in it. I also believe the mother was aware of the baby being abused...how could she not? even more so, she may have played a part in the abuse...

    This is one strong baby. To be shaken, dropped, beat that resulted in bruises, broken bones and severe brain injuries, it is beyond me how he survived.

    Recover completely little Owen. You deserve happiness, and I have feeling you were meant to live and be more than the baby that was beaten by his father.

Owen's mother, Megan Charles, said she took Owen to Children's Hospital earlier this month because he didn't look well. Doctors reported the incident to the San Diego County Sheriff's Department, and detectives eventually arrested the baby's father.

    Investigators said Charles admitted dropping and shaking Owen more than 30 times.

    Megan said James has not been the same since get he returned from a deployment to Iraq.

    "I just think that it happened so fast -- him coming home from Iraq, getting married having a child -- the stress and pressure was too much for him," Megan said. "He's a good man. He really is. It's just too much for one person to handle."

    Owen is in protective custody. Detectives said the infant may have suffered brain damage.

    Is the system that broke where they could not have followed up on this case?
    If so we need to get rid of bogus agencies(Northwest Clean Air Agency) that want to get rid of my lawnmower and woodstove. Take that money and put it into child protective services.

    Ok , I got it, the baby had a pre-existing physical issue, an abnormal enlargement of the cranium.

    owen had surgery for is completely seperate from any of this. He had surgery for what is beleived to be a genetic disorder. This disorder causes the fluid in a childs brain to stop draining. Its called Hydrocephlus. A shunt is put in to help drain the fluid from the brain.

    The couple really didn't know each other that well, they had only been together for 2 months when she got preggers, He got shipped out and was gone the whole pregnancy, when he returned they got married. So far they have only really know each other for 4 or 5 months.

    I believe he only married her because she was pregnant and he was trying to do the right thing only it turned out to be the wrong thing. His son had physical deformities , he was stuck in a marriage he didn't want to be in. It all just got to him, not that thats an excuse for what he did , it was wrong and very sad. He should have just walked away from it if he couldnt handle it. The babys mother is a bit strange as well, her interview kind of creeped me out. I am sure she was 100% aware of what was going on and did jack shit nothing to stop it, afraid she would loose her Penis and catch of the day.

    San Diego Superior Court Judge Leo Valentine said during the preliminary hearing that prosecutors presented enough evidence for Charles to stand trial. The judge allowed the Marine, who is free on $500,000 bail, to remain out of county jail.

    Defense lawyer Vikas Bajaj argued in court the injuries may have been caused by an accident. The attorney said his client stated repeatedly he had grabbed the boy in early October, when the child was 16 days old, in an effort to save him from rolling off a bed.

    However, the judge called that explanation “absurd,” citing his own experience with his children and grandchildren. Valentine said a baby that young would not be able to roll off the bed, unless the bed was at an angle.

    Dr. Suresh had stated a similar opinion during her testimony.

    Charles pleaded guilty to felony child abuse causing great bodily injury on the day his case was set for trial.
    The defendant could have faced as much as 15 years behind bars if convicted at trial, said Deputy District Attorney Tracy Prior.
    "This is the right result for a baby who was irreversibly injured at the hands of his father," the prosecutor said.

    Charles was arrested in December 2008 after he took Owen to a hospital.

    During an earlier hearing, sheriff's Detective Leonel Gurrola testified that he interviewed Charles at the hospital and later at the defendant's Poway home. The detective said Charles admitted to tossing his son onto a hard surface about 30 times and to shaking the baby.

    According to court document prepared for trial, Charles repeatedly shook, tossed, slammed and hurt the boy from the time he was 16 days old until he was 3 months old.

    Owen's injuries included a skull fracture, hand fracture, bleeding in the eyes, bleeding in the brain, swelling in the brain and multiple bruises over time, the document states.

    The child will never get his eyes healed or vision restored to what it should be and will need aggressive eye therapy for the rest of his life. The toddler also lives with a metal shunt in his brain connected to seven feet of plastic catheter in his abdomen because of the inflicted injuries, according to the document.
    According to the prosecution, the child would have died without medical intervention to relieve massive pressure on his brain due to non-accidental trauma.
    The defendant said his wife returned to work eight days after Owen was born in September 2008, and the child was injured on his watch.

    The defendant told authorities that Owen rolled off the bed when he was 16 days old, according to the court document.
    On another occasion, Charles' wife said her husband told her that the baby hit his head on a picture frame when the defendant tripped over a pair of shoes while holding him.
    Defense attorney Vikas Bajaj told the judge that Charles has completed parenting and anger management classes as part of a Family Court order, giving the defendant the tools to become a better father in the future.

    This case is no paradox! IMO, it's real FUCKING SIMPLE! This person, I'll not call him a man, took an oath to basically defend all those who could not defend themselves. Fuck that "he served his country" BULLSHIT! He did not protect those closest to him! He, and others like him, make the rest of us former and present service men/women look like shit!

    I don't see any reason for his actions. I must infer from the sentencing that he was angry at the baby. That being the case, why make another one to stress himself with? Did he think it was a do-over? Did his idiot bitch of wife think so? "Oh, yeah, he damaged the first one, so I need another one to replace him?"

    Marriage will be hard to work out, once d***swinging b****** gets out, since I also infer that the restraining order does not end with his prison time. Or does it? Anyone know? (God, I hope not. That child should never have to see the man responsible for the damage done to him. And his brother should view Dad as the monster in the closet, and never have to meet him either.)

    The parenting classes scare me, too. Tools he needs to get on his life? They want to expose more children to this effluent sucking arachnid?
