    Jessica Cummings was charged with manslaughter after her niece died in her carseat.

    Kailee Hundley ended up dying in a car seat after she'd been sucking on a bottle loudly and crying.

    The 13-month-old's slurping of soy milk bothered Jessica Cummings' sister, Tiffanie Williams. Williams was trying to sleep after working late at a restaurant, then going to her boyfriend's house.

    It was also disturbing napping infants in other parts of the house where Cummings ran a day care for six months.

    Cummings partially strapped Kailee in a car seat, and the toddler strangled on a strap while being unsupervised for 2 ˝ hours.

    Now, Cummings faces more than 2 ˝ years in prison after a jury found her guilty of involuntary manslaughter Wednesday in Sedgwick County District Court.

    Cummings, 27, sobbed after hearing the verdict, which followed about five hours of deliberations. Kailee's family members also dabbed tears from their eyes.

    "Hopefully, if any good comes out of this, it will get people to realize the risks to children by leaving them unattended in a car seat," Assistant District Attorney Shannon Wilson said

    I'm from this ladys town so let me give you the low-down. What makes this case even more odd, two weeks before the death of this toddler, the childs mom was arrested on first degree murder charges for the death of her 2 year old step-daughter. There was a big article in the Wichita Eagle about the two fathers who have somehow bonded together after their daughters died 2 weeks apart from each other in such tragic ways.

    Ok, and one more twist. Apparently, the mother of Kaylee was out on bail on murder charges of her own while she was 6 months pregnant, then tried to kill herself, and lost another baby:

    "His ex-wife Katie Cornejo-Robertson is charged with killing two year old Daytona, her stepdaughter. Tommy Robertson says complaints of abuse were made to SRS, but nothing was done.

    Then, his one year old stepdaughter was found dead at an in-home day care. The day care provider is charged with involuntary manslaughter.

    And now his son is dead too after Cornejo tried to commit suicide while 6 months pregnant. Robertson says he notified police of a suicide note he says Cornejo had written."

    But Wednesday under cross-examination, Cummings also said she knew what was expected of her as a licensed day care provider, including regulations that a child under 18 months should sleep in a crib or a playpen. "Not a car seat, not an infant carrier, not a stroller attachment," Wilson told the jury in her closing arguments.

    Tiffanie Williams had worked the late shift at Fox & Hound restaurant and had been napping at her sister's house. She testified she woke to find Cummings frantic, after discovering Kailee couldn't breathe.

    Lemon noticed some vomit on the floor, where Cummings told him she'd tried to resuscitate the toddler before calling for help.

    Cummings said Kailee's fussing had disturbed Williams' nap, so she put the toddler in a car seat and placed her in the bathroom. Lemon said the bathroom was about three steps from where Cummings said she'd been preparing lunch for a few other children she was watching that day.

    When she went to check on Kailee, the baby's lips were blue and she wasn't breathing. Cummings tried to resuscitate her.

    But Cummings hadn't checked on the girl for 2 ˝ hours. She told police she'd put Kailee in the car seat at about 10 a.m. and she discovered the girl not breathing at 12:30 p.m.

    A medical examination concluded that Kailee was too big for the car seat. But if Kailee had been strapped into the seat correctly, she wouldn't have slipped and suffocated.

    Cummings, in tearful testimony later Tuesday, told Stang she thought Kailee was sleeping and didn't want to disturb her. She said she couldn't have anticipated that Kailee would slip in the seat and strangle on the strap.

    2 year old Daytona Robertson also died this past February. Family members say Daytona was dropped off at her father's home, who had shared custody of the girl. The father then left for work, leaving Dayton in the care of her step-mother, Katie Cornejo-Robertson. That's when prosecutors allege Cornejo-Robertson severely beat Dayton. The 2 year old later died from head trauma. Cornejo-Robertson will begin her jury trial on November 3rd.

    Katie Cornejo-Robertson had a biological daughter that died in an un-related case. Last March, one year old Kailee Hundley was dropped off by her father at a Wichita daycare. Authorities say daycare provider Jessica Cummings put Kaillee in a baby carrier that was too small for her, causing her to choke to death. Cummings will start her jury trial on October 27th.

    Katie Cornejo's first cousin says:
    Tommy Robertson came into Katie's life in October of last year. After a whirlwind romance, they married in January. Tommy had 6 children and Katie was his fourth wife. He is 33 years old.
    When Tommy and Katie were dating, Daytona would end up with bruises on her. I myself saw some of these bruises at Christmas. Tommy and Daytona's biological mother began filing complaints against each other with SRS...there was never a complaint filed against Katie while Daytona was alive. I witnessed Tommy threaten to spank Daytona numberous times during our family Christmas weekend for very minor things...things that every child does because they are a child. At one point, Tommy Robertson DID remove Daytona from the room. What happened in the other room I can not say because I was not there to witness it. What I DID witness is that it was Katie who sat at the dinner table with Daytona on her lap helping her eat dinner. That is not a child who is afraid of someone (as Tommy tries to say he saw signs of in one article above).
    Tommy Robertson has also had charges of domestic violence against him.
    There are so many things that have not yet come to light about Tommy Robertson and this case. He was actually not seeing some of his older kids because their mother didn't like the way he disciplined them (spanking). This was not a legal thing, just a mother saying I'm not going to let you see the kids.
    I also wanted to clarify that at Katie's bond hearing, the judge DISMISSED the violation of parole. He did not find that Katie was guilty of that as the article above incorrectly states. Tommy was saying that Katie was stalking him however, her GPS records proved that was not the case.
    As far as Katie trying to commit suicide and the baby dying, there is also more information on this, however, since the autopsy results have not been publicly released I do not feel I should comment on what was in them.
    I don't know what happend to little Daytona that day because I was not there. But I do think it's important for people to realize that head injuries can sometimes take days for the brain to swell to the point that they cause siezures. In the days prior to daytona's seizures she was at the daycare (where a month later Katie's biological dauther, Kailee Hundley, died of strangulation from an improperly used carseat), she was in the care of her biological mother (and the mother's court ordered "supervised" visitations where overseen by Daytona's maternal grandmother) and she was also in the care of Tommy Robertson.

    3 Children are dead, and it's hard to discern all the facts about the circumstances involved.

    Baby Daytona, based on the evidence, I believe the stepmother, Katie Cornejo-Robertson did it. Even if the father Tommy Robertson, who is supporting efforts against child abuse; it has also been implied he could have abused Daytona too. If the facts are that he was not physically around Daytona the day of her death, I'm inclined to believe it was the stepmother. The cousin even goes on to say how head injuries can come to light days after inflicted. Days earlier Daytona was in the care of her biodad and the daycare...still I believe it was the stepmother.

    Baby Kailee, well, hell. The daycare, specifically Jessica Cummings was entirely responsible for little Kailee's death. She may have not meant to cause grave harm to Kailee, however, she was neglectful in placing her in a car seat that was improperly harnessed AND she left her unattended for 2.5 hrs....yeah, very guilty.

    Baby Daylee, he wasn't even born yet and brought into the bullshit world of adults. He was murdered by his crazy mother Katie. Because of her callous and uncaring behavior in attempting suicide while pregnant, I'm just thinking she's so damn selfish. Off your self bitch, just do it after the baby is out of your pieceofshit body.

    It brings me to tears thinking how these 3 children were subject to inexcusable, selfish, neglectful, violent behavior. At the end of this entire nightmare, there are 3 dead children. Circumstances are different but one theme runs the same...adults who put children last.
    Evey single child here depended on the adults around them to do the right thing and make decisions for them to keep them safe and happy...they ALL failed miserably.

    Rest in peace sweet babies, Daytona, Kailee, and baby Daylee...

    Sorry for all the info, but this case is deeply intertwined with the other case. Jessica Cummings AKA "the worst babysitter in the whole fucking world", happened to also be "Daytona Robertson" daycare provider. She saw Daytona covered in bruises and took photo's of it but did absa-fucking nothing about it, by daycare rules, she was suppose to call the cops and report it. So she is responsible for 2 children dieing not one.

    I just posted a bit of the article, if any one wants to read it I made a PDF file of it and posted the link.

    "An SRS worker came to her home and stayed about 10 minutes a few weeks before Daytona died, she said. "She seemed like she was in a hurry." The parents blame the system for their daughter's death, but a judge says limited information can affect decisions.

    In the months and weeks before 2-year-old Daytona Robertson became a homicide victim, her divorced parents, her day-care provider (Jessica Cummings) , a judge and SRS suspected she was being abused.

    Some of them thought there was clear evidence -- pictures of extensive bruising. And yet no one prevented her death. To the parents, who had been in a custody battle over Daytona, it shows a failure by the judge and the state's system for protecting children.

    About two months before Daytona's death, her Wichita day-care provider (Jessica Cummings) took pictures of bruises on Daytona. Even though the day-care provider was required by law to report it, she said she did not because the bruising stopped.

    About a month before Daytona died, the state Department of Social and Rehabilitation Services began investigating the first of three reports alleging she was being abused, the agency says.

    SRS was "actively investigating" the abuse allegations until Daytona's death, said SRS Secretary Don Jordan. Mother faults judge. Natasha Paul, Daytona's mother, said that besides SRS, she faults District Judge Anthony Powell for a custody decision in January that took her daughter out of her home except for four hours of supervised visitation a week.

    Paul said Powell should have removed the girl from both her and Tommy Robertson's homes until investigators could sort out how the dark bruises, which covered Daytona's bottom, occurred. Told of Paul's criticism, Powell said he was disturbed by a photograph of bruises shown to him in court on Jan. 7 and that he had to make a difficult decision based on limited information. After he learned that Daytona had been fatally injured, Powell said, he cried and questioned whether he should have handled the situation differently.

    Daytona had been a flower girl in January at her father's and Katie Robertson's wedding. Now, Tommy Robertson says, he is seeking a divorce from his new wife, who is pregnant, according to court records. She was pursuing a teaching degree, he said.

    He said he first learned of the bruises late one night when he came home from working in his auto business. He said Katie told him not to be alarmed if he saw red marks on Daytona's bottom. By the next day, the marks had turned to "black-and-blue" bruises from the bottom of her back to the lower end of her bottom, and wrapping around her hips.

    "There was no white" showing, he said. He said that Katie told him she suspected Paul, his ex-wife and Daytona's mother.Paul says she never harmed her child and did not spank her. The bruises prompted Tommy Robertson to go to court the next day to file for a custody modification, he said. He kept Daytona for the next two weeks.

    Around Christmas, Daytona's day-care provider, Jessica Cummings, says she saw serious bruising on the girl and took pictures "I did think it was abuse," Cummings said. "I would not have thought that these were accidental. They were not just in one area; I took three pictures." She declined to say where the bruises appeared.

    But she didn't see any bruises after that and didn't report it because the bruising ceased, she said. "I assumed the court had handled it," she said.
    She said she didn't suspect Katie Robertson of abuse. Cummings told a detective about the pictures after Daytona's death, she said.

    The Eagle requested a report from the Kansas Department of Health and Environment, which licenses day-care homes, containing details about part of its investigation of Cummings..


    The agency furnished two documents, with names blacked out, saying: "Provider... took pictures of bruises on day care child... and did not report suspected abuse to SRS." A day care provider is required by law to report suspected abuse.

    Cummings says: "I think it's unfair to assume I could have prevented it."

    As he sentenced former daycare provider Jessica Cummings to prison Friday in the death of a 13-month-old girl in her care, Judge Joseph Bribiesca cited a mortality table.

    Bribiesca said the table showed that the remaining life expectancy for a 13-month-old girl is 80.2 years.

    "Eighty-point-two years was taken," Bribiesca said, referring to the death of Kailee Hundley.

    In comparison, his 32-month prison sentence for Cummings -- two months shy of the maximum sentence -- is a "small price to pay for the taking of this life," he said of Kailee.

    "She is gone forever."

    Now, Cummings -- a new mother herself -- is headed to prison. Minutes after the judge announced her sentence, deputies had Cummings remove her jewelry, then put her in handcuffs as she tearfully said goodbye to relatives.

    In December, a jury found Cummings guilty of involuntary manslaughter in Kailee's death on March 25, 2008.

    The investigation determined that Cummings partially strapped Kailee into a car seat. The toddler slid down in the seat and strangled on a strap while being left by herself for more than two hours in a laundry room at Cummings' Wichita home, where she operated a daycare.

    Prosecutors said the case had rested on the question of whether Cummings' actions were reasonable.

    Her lawyer, John Stang, said after the sentencing that he was disappointed that Bribiesca relied partly on the mortality table.

    Stang had argued "that there is no benefit to sending Ms. Cummings to jail, other than revenge or punishment."

    He said she had been the one to call 911 when she found Kailee unresponsive, that she "felt awful" about the death, that she had cooperated with investigators and that she had no criminal history.

    Now that she is going to prison, he said, she will leave behind a husband, a young daughter and an infant son who is not yet four weeks old and was breast-feeding until she was taken into custody.

    Although her sentence is 32 months -- the maximum would have been 34 months -- she could be out of prison in about 27 months if she earns the so-called good-time credit.

    Kailee's father, Mike Hundley, said he was relieved that Cummings is going to prison. Her sentence should send a message, Hundley said.

    "Hopefully, other people will keep that in mind before they hurt babies and kids," he said.

    In the courtroom Friday, Cummings sobbed as she told Kailee's relatives that she was "truly sorry" for the death.

    She said her college education had focused on early-childhood development and that she had always wanted to work with children.

    She said she thought the death would be viewed as a "horrible accident" and that she was "shocked" to be charged with involuntary manslaughter and "dumbfounded" that she was found guilty.

    One by one, Kailee's relatives told the judge how devastated they felt by Kailee's death and that they wanted to see Cummings punished.

    Rhonda Cornejo, Kailee's maternal grandmother, said Kailee's death "stole my heart" and was no accident.

    Kailee's mother, Katie Cornejo-Robertson, recalled the joyful celebration of Kailee's first birthday. Now, she said the family has "only our memories and a headstone in the ground."

    Cornejo-Robertson said prison time would give Cummings "time to reflect on the outcome" of her actions.

    Cornejo-Robertson herself is awaiting trial April 13 on a charge of first-degree murder in the death of her 2-year-old stepdaughter, Daytona Robertson. An autopsy found that Daytona suffered severe head injuries from a beating.

    In court Friday, Bribiesca reminded Cornejo-Robertson that her comments were on the record and could be used against her.

    After Cornejo-Robertson spoke, Kailee's paternal grandmother, Diane Hundley, told the judge, "I don't know how to console my son" about Kailee's death. "He gave his entire heart to her."

    Diane Hundley told Cummings: "You had no right to treat her so badly."

    Mike Hundley then faced Cummings. He wore a pink tie and pink shirt in memory of his daughter.

    His voice broke as he sang part of the "Elmo" song his daughter enjoyed so much.

    He told Cummings she still has her children.

    A Wichita woman charged with first-degree murder in the death of her 2 1/2-year-old stepdaughter pleaded guilty this afternoon to a reduced charge of voluntary manslaughter.

    Katie Cornejo, 28, was charged with murdering Daytona Robertson in February of 2008.

    Cornejo stood trial for murder in April, but a mistrial was declared after a Sedgwick County jury was unable to reach a verdict. She had been scheduled for trial again next month.

    In court today, Cornejo entered an Alford plea, which means she didn't have to admit to guilt but accepted a sentencing deal offered by prosecutors.

    She will face 55 to 247 months in prison, depending on her prior criminal record, when she is sentenced on Dec. 4.

    If she has no prior convictions, prosecutors will recommend that she serve the minimum of 55 months.

    "We were never ever going to accept an offer that did not let her maintain her innocence. She was never going to say the words 'guilty' without some sort of stipulation that maintained she's innocent," explained TJ Cornejo, Robertson's brother.

    He says the plea decision came after much talking between Robertson and her family. They felt it was in her best interest to plea, and get prison time over with, than stay in jail while she waited for another trial.

    The plea deal also requires the state to recommend the shortest sentence possible for the new charge, 55 months.

    Daytona's father, Tommy Robertson, told Eyewitness News he's not happy with the short time Robertson will spend in prison.

    "I'll never have my daughter back. All I've got is memories of her."

    Robertson said he wasn't looking forward to going through another trial but would have done it for his daughter. He is, however, happy his family will be able to move on.

    That's not justice, that's a joke. Had she apologized, put her heart out for grief over this child, maybe I'd see different. But she will not even utter the words guilty. It's all about her, no real concern over taking the life of an innocent child. No justice, no honor. So sorry Daytona.

    fucking Kansas...i lived 50 miles away from the dead center of the middle of america for nine fucking months and the state is a hellhole. (think about a county of 2,000 people and the only industry is prisons, group homes, and churches)

    i feel sorry for anyone here that might be living in Kansas....i will help you escape if you need me to.....
