Jessica Smith accused of raping teen

"He is totally withdrawn and does not talk to anyone anymore," said the mother of the alleged rape victim.

Concerned about changes in her 16-year-old son, the Bullitt County mom's questions got some disturbing answers.

"She worked for me. She was my best friend," the teen's mother said.

26-year-old Jessica Darcy Smith was supposed to be watching the then 15-year-old and his brothers. But police say in December 2007, the relationship changed from care giver to rapist.

"She knew everything emotionally about my son. She was my best friend, I shared everything with her. She knew that he was going through where he thought no girls liked him and she played on that by asking my son sexual questions and asking if he would like to have sex," said the teen's mother.

Smith faces three charges of rape and one of sodomy. 16 is the age of consent in the Kentucky. The boy was 15, but age was not the only concern.

"His mentality would not be that of a normal 15-year-old and I think she used that to take advantage of him. It appears in this case," said Det. Scotty McGaha of the Bullitt County Sheriff's Dept.

The teen's mother says her son's brain does not work like a 16-year-old.

"I'm just worried she is messing up her kids life like she messed up my son's life. I don't believe we owe anybody anything, but she'll get what she needs to get," the teen's mom said.

There is one more part to this story that may complicate matters. Jessica Smith is pregnant and police say the timeframe indicates the victim could be the father. DNA tests later will be used to determine that at a later time.

It's definitely possible that this kid has a cognitive disability yet he still worried about never having a girlfriend. He would just experience that fear on a more immature level than most 15 year olds would.

Autism is really broad in the levels one is affected. Most look normal and seem normal but most common in those on that side of the spectrum is anxiety and social immaturity.

Then on the other side of the spectrum, they may not even talk.

It's a fair question, and as others have said autism runs a wide gamut than what people normally think. I have a cousin who is 20 now, and he has cerebral palsy, and he is always talking about girls. Mentally, he's about 9 or 10. I don't think he's mature (or perverted) to have sexual thoughts about them, at least not serious ones, but he does have a crush on some local gospel singer chick, so much so that he has had my aunt (not his mom, his aunt too) buy him transparency paper and white t-shirts so he can make shirts with her on it. He's gone so far as to make other shirts with printed pics taken from his digi cam of him with other girls. I know it's wrong but I find it hilarious, I laugh every time I see him wearing one and tease him I'm going to make a shirt with his face on it.

Not necessarily. My sister has the mental capacity of a 12 year old (she's 41) and she talks all the time about "boyfriends" and that she is going to steal our husbands. She has no clue what that actually entails but society does make her aware that "men" are generally a normal part of a woman's life.

Most mentally handicapped people are not so socially obtuse that they're unaware of what their peers are doing, and would like be be part of the same social scene. Jessica Smith appeared in front of a judge facing charges of third degree rape and sodomy. Her attorney entered a not guilty plea on her behalf.

The lead detective in the case said there's one piece of evidence that could prove Smith is guilty.

Smith was pregnant when she was arrested in December. She has now given birth and police are investigating whether the 15-year-old might be the baby's father.

"We wanted to get a sample of that baby's DNA and be able to compare it along with her sample and the victim's sample to make sure that the baby, to see if that baby could have been the victim's," said Lt. Scotty McGaha. "If the DNA comes back and it matches up with our victim, then it will be very unfortunate for her."

McGaha said the DNA results could be key in the case moving forward to trial.

The case is expected to head to trial this summer.

SHEPHERDSVILLE - A woman entered a guilty plea to an amended charge of having an unlawful transaction with a minor.

Jessica Darcy Smith, 28, of Louisville, entered a guilty plea Thursday in Bullitt Circuit Court.

Originally charged with rape and sodomy, prosecutors agreed to amend the rape charge to unlawful transaction with a minor. The sodomy charge was dismissed.

Smith was indicted last February after an investigation was conducted by the Bullitt County Sheriff’s Department.

Raley and defense attorney Ken McCardwell agreed that there could be some issues with the evidence as a reason for the plea agreement. Baby not his?
