Toddler Found Shot To Death In Crib; Mother Arrested

"HOLLISTER, Calif. -- A Hollister woman was in jail Thursday on suspicion of murder charges after her 18-month-old daughter was found shot to death in the toddler’s crib, authorities said.

San Benito County Sheriff's Deputies were called to the ranch-style home of John and Cheryl Busch located near the Santa Clara-San Benito county lines on Wednesday morning. The couple greeted the deputies at the front door and let them into the home.

The body of the toddler was found in the crib with gunshot wounds to the chest and head, according to San Benito County Sheriff Curtis Hill.

Cheryl Bush, 39, was taken into custody on suspicion of murder and on a previous domestic violence charge of inflicting corporal injury on a spouse or inhabitant, Hills said. John Bush was questioned and released.

A .357 magnum was found outside the house, Hill said, and had been identified as the murder weapon."

Hill noted that Busch was still on probation from the November incident and his department wanted to make sure she would not be assigned bail, adding, "We have a concern as to her potential for suicidal behavior and we are currently holding her in a safety cell without bail."

Apparently the father, 52-year-old longtime San Benito County resident, John Busch, called the sheriff's office initially to report the shooting and was transferred to 911 dispatchers. He reported that he had been outside the home getting ready to leave for work and that "his attention was brought back to the residence," most likely by the sound of gunshots, Hill said. He entered the residence and saw the baby in the playpen already shot twice. The husband removed the weapon from the scene "in an effort to get it outside the scope of the scene," Hill explained.

San Benito County Sheriff Curtis Hill said there had been discord between Busch and her husband, who reported the shooting to police. "There had been some angst and disagreement in the relationship between the parents," he said. "That plays to motive and circumstance and timing."

Hill also noted today that firefighters had entered the house with a chainsaw shortly after the body's discovery to remove evidence.

The property includes a house, two barns and poultry-like pens. Cheryl's Chateau, a pet-grooming and boarding business, was run by Busch out of the residence and outbuildings.

here is a little bit of new news or more like clarification of old news.

Here is what we know — just the facts, ma'am — about the death of Donna May Busch. She was killed about 9:30 a.m. Wednesday in her playpen in her rural home north of Hollister.

Were there drugs involved? The sheriff says there were no immediate signs but that tests are pending. Where was the gun stored? That much hasn't been released.

What we do know is that John and Cheryl Busch haven't always had a happy marriage. A year ago, Cheryl was arrested on a charge of domestic violence against her husband. "She battered him,'' the sheriff said, and that was saying something: John has a background as a body builder. The case was whittled down to a misdemeanor.

We know John Busch made the call to the sheriff's department on a regular business line, not 911. We're told he was in the yard when the shooting took place and came in to take the gun away to an outbuilding. We know both parents were distraught when deputies showed up

A San Benito County judge has ruled the woman accused of killing her 19-month-old daughter in November 2008 is incompetent to stand trial, and authorities will place her at a state mental hospital until she gets to a point where she is fit to understand the proceedings.

Following a written recommendation from a doctor who examined 40-year-old county resident Cheryl L. Busch, Judge Steven Sanders at the Thursday afternoon hearing ruled she lacks the necessary competence to stand trial. In early December, Busch's attorney had requested the evaluation for the woman suspected of shooting her daughter, Donna, with a .357 Magnum on the family's Shore Road property.

The doctor conducted a "battery of psychological tests" before making the determination, said Gregory LaForge, her attorney and the public defender. She remained at the San Benito County Jail this morning yet and will be sent to a state hospital once bed space becomes available.

At the state hospital, she will go through a trial competency program in which the staff there will try to get her to "a level of competence where she can understand what happens in a court setting," said LaForge, who cited "privileged communication" with his client in declining to discuss what led him to seek the doctor's evaluation.

As for the potential time frame for Busch's stay at a mental hospital?

"It could take weeks. It could take months. It could take years," LaForge said.

Busch's next court date is March 4 for a status hearing. It doesn't necessarily mean she will be in attendance, though. LaForge said the point of such hearings is to ensure "people don't get lost in the system."

The first call came in from John Busch at 9:40 a.m., as the operator noted in the transcript he "thinks (his) wife shot child" for the first entry on the log released by the sheriff's office.

Busch then told the operator his wife was "in a grooming trailer on the property," the victim had remained in the playpen and that he had taken the firearm from her. Investigators later found a .357 Magnum used to kill the toddler.

The transcript notes that nearly a minute later, Cheryl Busch joined her husband on the porch.

The document reads: "Wife is just staring at male ... not doing anything."

And from there: "Male said he hid the gun but won't tell me where so the wife doesn't hear."

At that point, John Busch told the operator he had been "in the grooming trailer and didn't hear any shots," according to the transcript.

"RP (reporting party) said wife told him that she shot the daughter but RP says he can't think clearly," the transcript reads.

Poor husband/dad, feel so bad for him. That moment on the porch must have felt like an eternity to him...then finding his baby girl. christ. his heart is broke forever. Rest in peace baby Donna May Busch.

Is this a bit strange? He was either on the porch and heard the shots or he was in the grooming trailer and didn't hear the shots?

It can't be both.

I also have an issue with husbands who know that their wives are as mad as hatters, but as long as they are getting their jollies every night, they don't do a thing about getting help for them.

It does read kind of odd. . . confusing. He didn't hear shots? did she muzzle the shots? when did he actually find baby? did he not see her as he retrieved the gun from her at the "grooming trailer"?

My question was IF there was a prior history of craziness with this woman. Can't really blame the husband IF she suddenly acted out this way without any foreseen violent and or odd behavior. Some people are real good in hiding their crazy.
I have no idea what was going on with this woman, but clearly she was the one who choose to kill her child, she even confessed it. I'll refrain from talking ill of the husband unless we learn something new on the situation.
