    Why was Devarion Gross found dead in a bin in the closet?

    Detectives in Garner are investigating the death of a toddler found in a box in a closet, according to two search warrants made public this week.

    The documents do not say how long Devarion Gross had been dead when his body was discovered or what led to his death.

    Devarion, born in March 2007, was found in his mother's apartment by concerned family members.

    Garner police were contacted by Child Protective Services on Nov. 3 because a caller had "expressed concern that Devarion Gross had not been seen by anyone since Labor Day, 2008."

    A detective tried to set up a meeting with the child's mother but was told by a relative that the woman, Sherita McNeil, had been acting strangely about the child and didn't want certain people to see her son.

    On Friday, family members went to McNeil's home because they hadn't been able to contact her.

    The family members, who are not named in the warrants, let themselves into the house with a key and found Devarion in a gray plastic bin in an upstairs bedroom closet.

    A family member also reported that while visiting with McNeil last Wednesday, McNeil came downstairs with her other child, a 2-year-old daughter, and said she had to leave. McNeil didn't have Devarion with her, the family member said.

    McNeil had "stopped eating" and had acted withdrawn, a relative told police.

    According to the warrants, Garner Police have met with McNeil since the discovery of her son's body.

    She has not been charged with any crime, said Sgt. Joe Binns. "We're still waiting on the medical examiner's report to come back," Binns said. "No one has been labeled a suspect at this point."

    McNeil's other child is staying with family members, he said.

    Police have seized sheets, children's clothing, a diaper, hair, numerous bottles of kitchen and bath cleaners and other items from McNeil's home.

    The warrants say the fathers of both of McNeil's children are currently incarcerated.

    Garner detectives investigating the death of a toddler found in a box in his mother's closet have searched his father's jail cell.

    According to a search warrant made public Friday, investigators found letters in the apartment from Eric Chambers to Sherita McNeil, the mother of the dead child.

    "In the letters, Chambers repeatedly threatens Sherita and her other baby's father," wrote S.J. Selvek with the Garner Police Department. "He also expresses concern about Sherita getting rid of their son, the deceased child."

    In the most recent search warrant, investigators wrote that Devarion had not been seen by family members for more than a month. The toddler's body was in a white plastic garbage bag in a plastic container, with sheets. Someone had poured bleach over the linens to mask the smell.

    Investigators sought permission to search Chambers' cell in the Wake County jail. They seized nine letters and four pieces of paper with writing on them.

    Chambers has a lengthy criminal history, with convictions for felony larceny, probation violations and weapons charges. He was charged with murder two years ago, but the case was dismissed in January when witnesses wouldn't come to court.

    McNeil has not been charged with a crime, a Garner police spokesman said this week. The department has said it is waiting for the medical examiner's report before it decides how to proceed. McNeil's other child, a 2-year-old daughter, is staying with family members.

    GARNER -- Police have filed a murder charge against the mother of a child found dead in the woman’s closet in November.

    Sherita McNeil, 23, was arrested today, Garner police said in a news release. She faces one count of first degree murder, and another of concealing the death of a person.

    Garner police have scheduled a news conference for 9 a.m. Friday. They refused to release any information about the cause of the child’s death.

    Sherita McNeil killed her 19 month old son and hid his body for 6 weeks in apt.

    Garner, N.C. — A 19-month-boy likely had been dead for six weeks before family members found his body in his mother's apartment in mid-November, Garner police said Friday.

    Sherita Nicole McNeil, 23, was charged Thursday afternoon with first-degree murder and concealing the death of a person in connection with the death of DeVarion Montrell Gross.

    An autopsy found the boy had suffered multiple injuries of violence in the months preceding his death, Police Chief Tom Moss said.

    "We know that Sherita McNeil, upon DeVarion's death, which we believe occurred in early October of this past year, concealed his body in her residence for a period of approximately six weeks, using bleach to mask the smell, until he was discovered by family members," Moss said.

    Family members found DeVarion in a sealed white plastic garbage bag in a closet, according to court documents and 911 calls released in the case. The bag was underneath sheets inside a plastic container.

    According to a timeline released Friday, DeVarion was last seen alive Oct. 3 when he was picked up from day care. On Oct. 6, police said McNeil told the day care the boy was staying with his godmother.

    I do not understand how a mother can kill her own child. Maybe its not for me to be able to understand. I have a special bond with my son that I can't understand. Maybe its just me but I thought all momma's to little boys had that bond with their son's. But good golly how can someone not notice a little boy missing for two months?

    Wake County Child Protective Services had heard from two individuals concerned about the welfare of a 19-month-old Garner boy found dead in his home in mid-November.

    Social workers concluded, however, that neither report included information about child abuse or neglect that would give them grounds to intervene, according to a statement the agency released Monday.

    Garner police went to McNeil's home on Nov. 14 after DeVarion's grandmother reported finding his body inside a trash bag in an upstairs-bedroom closet. It had been drenched with bleach in an effort to conceal the smell.

    According to Warren Ludwig, child welfare administrator for Wake County, social workers received reports from two sources on Nov. 3 about DeVarion's well-being. They had had no prior contacts concerning him or his mother.

    The first source reported suspecting that McNeil might have been lying about DeVarion's whereabouts. Authorities referred that person to police and suggested the individual seek legal advice.

    The second person was worried that the boy might have been harmed or given to somebody and alleged that McNeil never wanted the child and was having financial difficulties, Ludwig said.

    Both sources told Child Protective Services that prior to DeVarion's birth, McNeil had arranged for a friend to raise him, but reclaimed him when he was 8 months old.

    "The information provided by the second person was screened by an intake social worker and supervisor, according to the structured intake policy used to determine if CPS has legal jurisdiction to conduct an assessment," Ludwig said.

    Those people decided it did not, he added, but Child Protective Services sent a letter detailing the information to the Garner Police Department for review.

    According to a time line that police released Friday, police tried contacting McNeil four times after that and had a Nov. 13 appointment with her. McNeil, however, missed the meeting.

    Although police did not give a motive for the crime, search warrants suggest they suspected McNeil might have wanted to get rid of her son.

    Investigators searching the home uncovered letters from DeVarion's father, Eric Chambers, expressing concern over McNeil getting rid of their son, according to a Dec. 3 search warrant.

    Chambers, who was in the Wake County jail at the time on habitual-felon charges, has been cooperative with police, investigators said, and they do not believe he had any involvement in his son's death.

    Raleigh, N.C. — Jury selection began Monday in the murder trial of a Garner mother who is accused of killing her young son.

    Sherita Nicole McNeil, of 1852 Spring Drive, faces charges of first-degree murder and concealing the death of a person – her son, DeVarion Gross.

    How DeVarion died is a mystery. His autopsy showed the child, about 19 months old, was subject to “undetermined homicidal violence” and may have suffered abuse.

    DeVarion's grandmother called police after she found his body in a trash can at McNeil’s house in November 2008. Investigators have said that they believe the boy had been dead for weeks.

    A search of McNeil’s home on Nov. 14 revealed DeVarion’s body, wearing only a diaper, wrapped in two plastic bags in a trash can that had been drenched with bleach.

    Raleigh, N.C. — The former co-worker of a Garner woman on trial in the death of her 19-month-old son testified on Wednesday that the woman said she would punch the child.

    "I asked her, 'Why would you do that?'" Ashley McNair said of a conversation with co-worker Sherita Nicole McNeil. "She would say, 'So, he would be quiet.'"

    McNair, who also lived in the same apartment complex as McNeil, said McNeil mainly talked about her daughter and not DeVarion.

    "She didn't like him. She didn't love him the way she loved her daughter," McNair said.

    After finding out about DeVarion's death, McNair said, she talked to McNeil, who she said sounded normal and showed no emotion.

    McNeil's ex-boyfriend, Gregory Baines, said he also spoke to McNeil after the boy's body was found.

    "She said what happened was an accident," Baines said.

    The exact cause of DeVarion's death remains unclear.

    An autopsy showed he was subject to “undetermined homicidal violence” and may have suffered abuse. The medical examiner said the child had three rib bone fractures.

    Earlier Wednesday, DeVarion's grandmother Kay Washington testified that her son, Eric Chambers, and McNeil stayed at her home from November 2007 until spring 2008. During that time, Washington said McNeil "very rarely" interacted with the child, who was nicknamed “Poodie.”

    After Chambers, McNeil and DeVarion moved out, Washington said she would still spend time with the boy. On one visit, Washington said she noticed DeVarion had a large scar on the top of his head. Chambers said McNeil told him the child had fallen down, Washington said.

    In his final visit with her, Washington said, DeVarion was crying a lot. She felt that he was sick.

    Becoming concerned, Washington started calling to check up on the boy, but McNeil said he was with her co-worker, Latracey Gross, who had also been DeVarion's first guardian.

    In fall 2008, Washington said, she contacted Gross, asking to see DeVarion, but was told the boy was not living with Gross.

    The call prompted Gross to contact Child Protective Services and Garner Police. The CPS sent Gross a letter saying there was nothing they could do.

    Washington was also growing frustrated.

    "I said, 'Where is he? Can't nobody tell me?'" Washington said. "On several occasions, me and some of my friends would actually go there (McNeil's home) looking for Poodie, but they would never let me come no further than the front door."

    When DeVarion's body was found, McNeil's mother, Angie Harding, called Washington with the news.

    "When she said that, I just started screaming and hollering," Washington said.

    In opening statements Tuesday, public defender Bryan Collins said DeVarion fell into a coffee table. McNeil shook the child, but he did not respond.

    Believing he was dead, McNeil picked up the phone to call for help but changed her mind, Collins said. McNeil feared Chambers would kill her if he found out, he told jurors.

    On Wednesday, McNair said she would often hear Chambers yelling on the phone at McNeil. McNair said McNeil told her she was not afraid of him.

    Baines testified that he had sex with McNeil in the bed a few steps from the closet where DeVarion's body was being kept. He said he didn't know the child's body was inside the closet, but he noted that there was a strong odor in the apartment. He thought the smell was possibly trash.

    Despite everything, Washington said she isn't mad at McNeil.

    "I'm not to judge Sherita – only God can do that," she said.

    Raleigh, N.C. — A day care worker cried Thursday as she recalled DeVarion Gross, a child she remembered as “very smart” and a “good kid.”

    Kathy Williams told jurors she cared for DeVarion when he was about 8 months old.

    “He liked playing with his friends, his cousin, and he was just happy,” she said.

    She recalled being concerned that DeVarion may have been abused. She said he arrived at day care one day with a busted lip. Another time, when she changed his shirt, Williams recalled seeing another injury.

    “When I took it off, I noticed he had a mark on his back. It was made by a belt,” she testified.

    She added that McNeil had a red belt that she wore all the time.

    Also Thursday, Garner Detective Christine Pappas testified about questioning McNeil after DeVarion’s body was found.

    “I asked her if she meant for him to die," Pappas said. "She didn't move, and she said, ‘I didn't do nothing.’"

    Raleigh, N.C. — Prosecutors on Friday showed videotapes of police interviews in which a Garner woman on trial for murder re-enacts how she claims her 19-month-old son died in 2008.

    During the five-hour interview recorded after her arrest, McNeil tells police that her son fell and hit his head on a coffee table. She holds a baby doll to re-enact the scene.

    "He's jumping like this and come, come down, and then went, 'boom,'" she says in the interview.

    "I was shaking," McNeil says in the recorded interview. Calling the child by his nickname, she says, "Poodie, Poodie, are you OK?"

    "His body just got real limp, like he was dead," she continues.

    McNeil cried for the first time at the trial when she watched the recordings of the police interviews.

    Prosecutors have argued that a medical examiner found that DeVarion's rib fractures proved that his death could not have happened the way McNeil said it did. Relatives and caregivers of the boy have testified that they suspected his mother of abuse and neglect.

    Defense attorneys, who have yet to present any witnesses, have said that McNeil took the boy back under pressure from his father, who is serving time as a habitual felon.

    On Friday, prosecutors played numerous audio files, including taped conversations between McNeil and the father of her older daughter, Ira James. He is in federal prison in South Carolina.

    "Nobody else do not understand how I feel about the child, so nobody make me like him," McNeil says in the tapes.

    On Tuesday, prosecutors read a letter from McNeil to James that police found: "I hated that baby and Eric the whole time. All I have for them is hate. ... I don't love him and I never will," the letter read.

    In the recorded conversations, James tries to prod McNeil to tell him what happened to DeVarion.

    "Did you do something to you son?" he asks.

    In response, McNeil mumbles, "I can't, I can't," then trails off.

    Oh GAWD!! It sounds like she took him back in order to kill him and get revenge for all the crap his dad was heaping on her to get him back!

    I feel so bad for the little guy. He was taken from a place where there was someone who cared about him and killed by an evil bitch that never even wanted him! Why didn't she just tell the baby's dad the truth? I'm sure it would have stopped him from pressuring her if he knew how she really felt about the situation!

    I also want to point out that day care workers are required to report even SUSPECTED abuse. They do not have to know 100% for sure that it's happening but 8 month old babies do not hit themselves across the back with belts.

    It really sounds like this monster was having issues with this baby and pregnancy. The fact she gave him up till he was 8 months old is sick when she suddenly wants him back. How the first guardian did not try to take legal action to keep him is beyond me.

    . . .Shekita had the witnesses recount the results of two forensic examinations completed shortly after the discovery of Devarion’s body.

    Both witnesses said his injuries suggest he suffered three separate instances of significant physical trauma in the month before he died. An autopsy by Dr. Maryanne Gaffney-Kraft of the North Carolina Office of the Chief Medical Examiner revealed that Devarion had three broken ribs in various stages of healing at the time of his death.

    Gaffney-Kraft acknowledged that injuries like Devarion’s could be caused in other ways — such as from being in a high-speed vehicle accident or falling from a great height — but said McNeil’s taped account of a fall of several feet is inconsistent with his injuries.

    “The force is not there,” Gaffney-Kraft said.

    Gaffney-Kraft brought in a bone expert for a second opinion on one of the fractures, believed to have occurred about a week or so before Devarion died.

    Dr. Ann H. Ross, Ph.D., an associate professor of anthropology at N.C. State University, testified that children’s bones are malleable and require greater force to fracture.

    Using a small toy doll, she role-played to the jury several scenarios in which a person could use his or her body weight to create similar rib injuries in a small child.

    “Generally if you see fractures at multiple stages of healing it is indicative of child abuse,” Ross said. . . .

    . . . On Tuesday, the jury heard closing arguments. McNeil's attorney said that she told police the child fell off the bed and hit his head on a coffee table. They say it was rough housing that caused bone fractures and ultimately the death of the toddler.

    But prosecutors say if it was an accident then why didn't McNeil call 911. The prosecution played part of the phone call where McNeil speaks with her daughter's father just three weeks before her baby was last seen alive.

    "I be beating his a** every day, like I be literally beating his a** like, he be having bruises all over his face, his back everywhere," said McNeil.

    "You gotta stop," answers Ira James.

    "I can't help it," McNeil said. "I look at him and I, I just slap him right in the face." . . . .

    LMAO her ass is grass and the judge and jury are gonna be the lawn mower!

    What a fucking idiot! I am SO glad ppl are stupid and do not think about the fact that all calls from the jail are recorded.

    I will say this: The dad should have pulled a CO aside and told them about the conversation when it happened because then the baby might still be alive. I am sure he probably feels that it wouldn't have helped, and I know he gave statements about the calls after the baby died, but just MAYBE they would have listened to the tape and reported her ass before it was too late if he would have told them. Hell, he could have requested mental health services and then I believe that the Dr. would have been mandated to report. Sounds like the dad just didn't know what to do to get the kid help from behind bars.

    "Nobody else do not understand how I feel about the child, so nobody make me like him," McNeil says in the tapes.
    Thank goodness she was found competent to stand trial. I'd say she speaks like a child, but my children never sounded like that.
