Green County home robbed during owner's funeral
The Greene County Sheriff's office says the break in the case came from an unrelated call for a fight next door, it involved Michael Lane and his uncle Wayne Goldsby, who live in separate houses and as officers tried to break up the dispute, Michael's sister Megan Lane attacked a deputy and all three were arrested.

November 20, 2009

"The window knocked out of my dad's van and some stuff taken." Jack Christenberry says he was shocked to find the damage left behind from the burglary, including another car with a busted out window, but says he was quickly relieved the suspects were arrested next door.

"It's just a blessing that they figured it out so quick, so that it wasn't more aggravating for us to never know who did such a thing."

Officers didn't connect the fight with the burglary until Michael and Megan Lane were taken down the jail for booking. At that point they had Megan empty her pockets and in addition to finding US dollars, they found foreign currency that matched that missing from Christenberry's home. They even found a bill with his name written on it.

According to paper work, the three later admitted to breaking in on the day of the funeral, because they were looking for pills to steal... they also reportedly admitted to being high on the prescription drug Xanax.

"Surprised but not surprised."

Jack says his father James had told him about concerns with his neighbors before he died, and Jack says the funeral would have presented them with an opportunity.

"They knew when the funeral was going to be happening and they knew where the family would be."

Jack says the family is still in shock that anyone would break in during a funeral, especially because he says his father, lived a simple life and would have likely given them whatever they were seeking.

"All they had to do was ask. He would have given anybody anything."

"So I don't know how they can even face themselves, let alone face me or my family knowing that they did such a thing."

More than 800 pounds of marijuana nestled among a load of cantaloupes was discovered inside a truck Thursday at a Marion County weigh station on Interstate 75, according to officials.

The truck's driver, Richard Garfield Coulton, was arrested by Department of Transportation officials and charged with trafficking marijuana.

A handcuffed Coulton, dressed in a red-and-white jail outfit, appeared via video link before County Judge Robert Hodges on Friday from the Marion County Jail.

On the arrest affidavit, bail for the 31-year-old Orlando man, who is originally from Jamaica, was set at $500,000. Assistant Public Defender Samantha Shealy asked the judge to reduce the amount - which Hodges did, to $50,000.

Coulton told the judge he makes $600 a week.

Asked about any prior record, Coulton told the judge he had been arrested for receiving stolen goods, but the charge was later dismissed.

Coulton told the Star-Banner he did not know anything about the marijuana, and that no one had access to the truck.

"I was shocked" when authorities discovered the drug, he said.

Coulton said he had left Arizona and was on his way to Miami when the truck's brakes began to falter, which caused a tire blowout on Interstate 10. He said an FDOT official - who was nearby when he stopped the vehicle - was hit in the face with a small piece of tire.

He said he gave the FDOT official his driver's license and other documents. He then fixed the tire problem and continued his journey.

While driving through Marion County on I-75, Coulton said, FDOT officials pulled him over and said he did not provide them with any paperwork on the previous stop.

The truck, from Starcom Logistics Inc. out of Orlando, was then taken to the weigh station to be examined.

An FDOT official, who noted in his report that Coulton was acting in a strange manner, asked permission to search the truck.

Coulton denies that he was behaving strangely.

After receiving permission to search, authorities went inside the trailer. On top of a load of cantaloupes, toward the front, they allegedly found two pallets containing brown paper packages. One was open, exposing a green leafy substance.

A police dog was called to the scene and reportedly indicated a positive response for drugs on the trailer doors and the package. Other packages containing the same substance, which tested positive as marijuana, also were found.

A rural Seneca man was charged Friday with sexual abuse of a 4-year-old boy, who this week was taken to a hospital after complaining of an injury.

The Newton County prosecutor’s office filed a charge of first-degree statutory sodomy against Relinx C.G. Clinton, 21, following an investigation by the Newton County Sheriff’s Department.
[...]

During the interview, authorities say, the boy said that Clinton had sexually abused him. The boy told investigators that Clinton promised to get him ice cream the next day, the affidavit states.

The boy reportedly complained about his injury to his mother when she was giving him a bath and told her how he had been hurt. The affidavit states that the mother spoke with Clinton about the matter the next day and decided to take her son to the hospital.

A 15-month-old girl who died of traumatic brain injury more than a year ago died at the hands of her father, who slapped her head into a highchair repeatedly because she wouldn't stop throwing food on the floor, according to court documents.

Wasilla resident Clayton Phillip Allison, 26, was charged this week with manslaughter and criminally negligent homicide in the death of Jocelynn Renee Allison, who died Sept. 24, 2008, at Providence Alaska Medical Center.

According to Alaska State Troopers, Allison claimed Jocelynn sustained the fatal injuries in a fall down the stairs. Troopers, however, say the injuries could not have been caused by falling down eight carpeted stairs, which were guarded with a baby gate, in the split-level home...

Though Allison initially denied wrongdoing, he later told investigators he had been slapping the girl because she refused to eat, according to an affidavit filed in court by troopers investigator Sherry Ferno.

"Clayton stated he was slapping his daughter over a period of time, and began striking (Jocelynn) harder with time," Ferno wrote. "Clayton stated he was not angry with (Jocelynn), he just could not get her to eat otherwise."

According to the affidavit, earlier in her life, Jocelynn had been considered "failure to thrive" because of her low weight and muscle development. The girl could not stand on her own, her mother told troopers.

The day she died, Jocelynn and her father had been doing physical therapy in the living room while her mother and Allison's wife, Christiane Allison, was at work. Clayton Allison initially told troopers he clogged up the toilet and was working to clear it when he heard Jocelynn screaming and crying at the bottom of the stairs.

The injured child was flown by helicopter to Anchorage, where doctors found blood around her brain, a bruised lung and two dislocated vertebrae. The girl died that night.
[...]

In January, Clayton Allison told investigators Christiane would come home from work and weigh Jocelynn, asking if the girl had been eating well. Clayton Allison told investigators he tried to feed the girl oatmeal and peas to put weight on her but Jocelynn would throw it on the floor. He told investigators he felt like a failure as a father.

To stop her from throwing the food, Allison began slapping her, knocking Jocelynn's head against the back of a plastic highchair, according to troopers.

"Clayton said that at that time her head would snap forward striking the tray table," Ferno wrote. "The other blows would be a forehand slap followed by a backhanded slap causing her head to strike the side of the chair."

Charges were more than a year coming because infant death cases can be difficult to prove and require time to gather autopsy results, medical records and expert opinions, troopers spokeswoman Megan Peters said.

WESTMINSTER, Colo. - A Westminster Police officer remained hospitalized Friday after being wounded in a dramatic shootout that left two bank robbery suspects dead.

The robbery happened at a First Bank location at 120th Ave. and Sheridan Blvd. in Westminster shortly before noon when the suspects, both armed with handguns, took an undisclosed amount of cash.

Westminster Police say the suspects sped away in a silver sedan which was spotted near 104th Ave. and Federal Blvd. where police began the pursuit. The suspects were weaving in and out of traffic and firing at officers, police said.

"Any time you have a pursuit that involves a suspect that escalates to not just running from the police, but actually firing a gun from the vehicle, it's a very dangerous situation," Westminster Police spokesman Trevor Materasso said. One male suspect was killed in the gun battle. A female suspect was critically wounded and later died at Saint Anthony Central Hospital in Denver. Their names were not immediately released. The silver sedan was riddled with dozens of bullet holes.

Officer Sean Chandler, an 11-year veteran of the Westminster Police force, was transported to Saint Anthony Central with non life-threatening wounds. Deputy Chief Tim Carlson, a 21-year veteran, sustained minor injuries and did not require hospitalization.http://www.kdvr.com/news/kdvr-bank-r...,2994055.story

Amy Jones faced up to 7 years in prision for killing three-month-old child, Jaci Morgan Rogers in January of 2008.
The mother and grandmother testified and the GBI said it was a "classic case of shaken baby syndrome"

Jones had lots of character witnesses including her pastor.

She also has 4 year old twins and a daughter that will be 2 in Febuary.

She took an altered plea called an Alford meaning she was not pleaing guilty but the court would probably find her guilty.

"The defense brought in several court approved scientific and medical experts, who stated that shaken baby syndrome was untested, and that humans can't produce enough force to cause major brain trauma through shaking alone."

How many babies have we seen died because they were shaken to death?

She has sat for over a year and since she's in Georgia and has less than a year to serve she will never see a prision cell on this ,she'll just stay in her cozy jail cell and be out in January 2010.

I wonder if she'll ever get the chance to shake another baby to death again?
A 9-month-old Colorado Springs girl who was brought to Memorial Hospital in July with suspicious injuries is expected to survive but may never walk or talk, authorities said.

The girl’s parents, 22-year-old Amanda Marie Dolan and 23-year-old Jesse Lee Kaizen, were arrested Wednesday night on suspicion of child abuse. Prosecutors said they intend to charge them with attempted murder.

According to an arrest affidavit, the pair denied abusing the girl but admitted they waited to seek treatment, in part because of an outstanding warrant for Kaizen’s arrest in an unrelated matter. The pair also told police they abused methamphetamine and crack cocaine while caring for the girl, authorities said.
[...]

Doctors who examined the girl found injuries consistent with abuse, including fractured ribs, bruising on her face and body, and brain damage. Some of the injuries were partially healed while others appeared more recent.

Dolan told police that she noticed the injuries after periods when the girl was left in in Kaizen’s care, but that she didn’t seek medical help or contact police. She allegedly had month-old pictures on her camera documenting injuries.

According to court documents, Dolan waited 3 ½ hours before seeking treatment for the child after noticing the latest round of injuries. She admitted that she had gone on an errand to purchase meth before spotting the bruising that morning, and Kaizen told police the pair smoked the drug before she left for the hospital.

Doctors fear the baby could be blind and bed-ridden for life, authorities said.

Paraplegic Joseph Taye was found guilty today of first-degree murder for running into Michelle Smith of the Delaware City Fire Company on Dec. 20 2008 as Smith tended to an injured man lying on the side of U.S. 13.

By the end of a 10-day bench trial in October, there was no doubt that 29-year-old Taye had been driving the car -- using a stick to work the pedals -- that struck and killed Smith, 29, and defense attorney Joe Hurley had largely conceded that point.

The question that did remain for Superior Court Judge Jerome O. Herlihy to decide was Smith’s status at the time of the accident. If she was a firefighter, then Taye was guilty of first-degree murder, which carries an automatic sentence of life in prison. If she was best defined as an ambulance driver or emergency medical responder – or even a firefighter who was not “in the line of duty” when she was struck – then Taye was guilty of the lesser offense of manslaughter, which carries a minimum sentence of two years in prison and a maximum of 25 years.

In a brief proceeding this morning, Herlihy ruled that even though Smith was not riding on the fire truck that responded to the scene, and was not dressed as a firefighter that night, she qualified as a firefighter under the law because she had completed her training and had been designated a firefighter by the Delaware City Fire Company. In addition, Herlihy said the duties, and commonly accepted definition, of a firefighter go far beyond just fighting fires and include such things as responding to motor vehicle accidents.

The evidence in the case concluded five weeks ago and all sides had been waiting for the judge to render a verdict.

Several days ago it was announced that Herlihy would be announcing his verdict this morning, so the courtroom was packed to overflowing. Dozens of emergency services personnel from around the county, attending in dress uniform, had to wait in the hall because they could not fit into the courtroom.

When Herlihy read his verdict on the lead charge, a small cheer came from Smith’s family. Taye, who is in a wheelchair and was in court dressed in an orange prison jumpsuit, had been staring at the floor during the proceeding, briefly looked up an over at the Smith family, then returned to staring at the floor.

Herlihy then announced he also found Taye guilty of manslaughter, first-degree assault, reckless endangering, leaving the scene of an accident and driving with a suspended license.

Hurley said his client would be appealing the ruling.

As Taye exited, a family member shouted, “Love you Joe,” and “Ain’t nothing but another fight.”

Outside the courtroom, prosecutors Sean Lugg and John Downs said they were pleased with the result.

Dave Carpenter Jr., a spokesman for the Delaware City Fire Company, praised the ruling as a landmark. “It sets a precedent for defining a fire fighter,” he said, and can now be used to help protect others.

This happened when I still lived in the area and it's very sad because she had a young daughter, the victim. He only got 1st degree murder because she was a firefighter. If you're an EMT it's not the same charge?? Crazy.
As a firefighter, we are ordered in our By-Laws to NOT physically respond to the scene. for insurance reasons. So she violated the by-laws and that led to her death. This guy has actually been wronged by the justice system. And if you doubt me, i have the by-laws, and I am in law school. So start your battle, but this will be overturned in appeals. A man was arrested Friday in Williston on accusations that he molested a 2-year-old, while the man's girlfriend was arrested on accusations that she neglected the same child, who is her daughter.

According to the Levy County Sheriff's Office, Alexander Merida, 32, of Guatemala, was charged with lewd and lascivious molestation of a child. His girlfriend, Christina Morales, 28, of Williston, was charged with child neglect.

The case began when an investigator for the Florida Department of Children and Families went Wednesday to a home to investigate a complaint of child abuse. The investigator reportedly saw injuries on the child's face.
[...]

In one of the incidents investigated by the authorities, a 15-year-old who also lived at the home told Morales that, while she was at work, Merida was bathing the little girl and the teen heard a noise that sounded like the child had been slapped, the Sheriff's Office reported.

Morales reportedly asked Merida about the incident, but he denied doing anything wrong. Morales told investigators she allowed Merida to move into her home and care for her children while she worked the night shift.

Detective Roger Bell said that when he questioned Morales about marks on the child's face between her nose and right ear, Morales initially claimed the little girl had been playing with a 3-year-old relative and fell while struggling over a toy. Morales late recanted her story, Bell said, and told him that the child had defecated on the carpet. To punish the 2-year-old, Morales said Merida grabbed the child and rubbed her face in the carpet similar to how some discipline animals for soiling the floor.

The medical exam also turned up scars on the little girl's buttocks and feet. Morales told Bell the scars were the result of an incident about two months ago. According to Morales, the girl had come into the house with feet dirtied by playing in the yard. The 3-year-old relative was directed to take the girl to the bathroom and help her clean up, but she was scalded when the 3-year-old turned on only the hot water, Morales allegedly told Bell.

Morales said she realized what had happened when she heard her daughter screaming but did not seek medical care because she was afraid the children would be taken away from her.

The medical exam also turned up bruising and marks on the 2-year-old's inner thighs and what appeared to be a bite mark near her navel.

Merida, through an interpreter, told Bell he had caused the marks with his mouth, the Sheriff's Office reported.

Police arrested a man Friday they say robbed a bank and then had a dye pack explode on him while using a bus to escape.

A tip led police to a room at the Landmark Motel. Police said they knocked on the door, and Thomas John Castro, 54, answered with a bag of crack cocaine.
[...]

Police say Castro is the man who entered a Wachovia branch and gave a teller a threatening note asking for money. That man was wearing a disguise.

The robber then attempted to escape on a public bus, police say. That's when a red dye pack hidden with the stolen money exploded, which police say is very loud and noticeable. He then exited the bus and was last seen fleeing on foot.

Castro's arrest record is 16 pages long and shows past arrests for trespassing, burglary and grand theft.

It is unknown whether Castro was covered in red dye at the time of his arrest.

According to an arrest report, Karolyn Gail Minor, 28, left her 7-year-old and 18-month-old children at home alone about 10 hours — from about midnight Wednesday to about 10 a.m. Thursday — while she went out. She went first to a bar and later to spend the night at the home of a friend whose name she “could not or would not give” to an officer, the report stated.

A neighbor told police she saw the 7-year-old waving from the Minor home about 8 a.m. Thursday and then alone in the home’s driveway about 25 minutes later.

The boy told the neighbor his mother had been “kidnapped,” and the neighbor called Minor’s brother, who came to the scene and called police, the report stated.

When Minor arrived about 10 a.m. Thursday, she told police she had left the children in the care of a friend, police said. But the friend told police she left Minor’s home shortly after 11:30 p.m. Wednesday, while Minor was still at the house. The friend’s sister confirmed the friend’s story, according to the report.

IT WAS after midnight in mid-April, and Greg Harlen would not stop screaming in his room at the Cardinal Krol Center.

Harlen, 52, a resident of the Philadelphia Archdiocese-run home for mentally handicapped men, was lying in his bed, writhing in pain.

Both of his hips had been shattered.

Later that morning, staffers decided to call 9-1-1. Harlen, who had Down syndrome, was taken to Springfield Hospital - nearly 20 hours after he is believed to have suffered a mysterious trauma that broke his hips.

He died in the hospital about a month later of complications from his injuries.

"I can't imagine the pain he was in," said Harlen's sister, Sheila Phelan. "I don't understand why they didn't send him to the hospital long before they did."

Harlen's death has renewed scrutiny of the center's operations, five years after the state Health Department released a scathing report that said the 131-bed home in Delaware County had failed to protect its residents from sexual abuse by another resident - and other serious violations.

"What's happening out there?" Phelan asked. "Is this normal, that people scream?"

Archdiocese spokeswoman Donna Farrell said she couldn't comment on Harlen's case because the investigation was ongoing.

"Greg's death was a real loss and hit everyone here very hard," she said.

It remains unclear how Harlen was injured, whether he was beaten by another person or fell. He was unable to speak afterward.

Harlen's family believes that he was assaulted by a caregiver there, but police are awaiting the neuropathology results from his autopsy before deciding whether to proceed with a criminal investigation.

Philadelphia's Department of Behavioral Health and Mental Retardation Services determined last month that Harlen, formerly of Northeast Philadelphia, should have been taken to the hospital sooner.

The department found that, "given the intensity and duration" of Harlen's crying on April 16 and 17 and other indications that he was in pain, "more timely action should have been taken by the agency to assess Mr. Harlen for injuries and necessary medical treatment."

Records show that the center, in Marple Township across from Ss. Peter and Paul Cemetery, has repeatedly been cited by the state in recent years for a range of violations, some of which are recurring.

Over the past year alone, the center's state-issued certification of compliance was temporarily revoked twice due to "serious substandard conditions" there.

"Many of them are very serious violations," said Jacqueline Beilharz, of the Disability Rights Network of Pennsylvania, a federally mandated nonprofit that seeks to protect the civil rights of people with disabilities.

Health Department inspectors have found that the center has failed to maintain complete medical records, properly train its staff, protect residents from physical abuse by other residents and conduct full background checks on some employees.

Kathy Perry, of the Arc of Delaware County, an advocacy group for people with disabilities, said her office has received several complaints about the center.

A woman and her 6-year-old daughter found dead in their Perris home Saturday were strangled, sheriff's officials said today.

Michael Barbar, 52, the husband and father, who was arrested Sunday in connection with the killings, is awaiting extradition from New Mexico, said homicide Sgt. Dean Spivacke of the Riverside County Sheriff's Department.

Spivacke said investigators suspect Barbar was upset because he learned recently that he was not the child's biological father.

Deputies found Maysam Barbar, 43, and Tamara Barbar, dead about 8 a.m. Saturday in their bedrooms. The Barbars' 10-year-old daughter was found in the home, unharmed.

Spivacke said autopsies performed this week showed that both mother and daughter had been strangled and the child had "multiple areas of blunt-force trauma."
