SAN FRANCISCO -- A man who hit his elderly father in the head with a hammer is facing nine-months in jail.

58-year-old Jayantibhai Patel struck his father twice because he thought the 81-year-old had to be hospitalized before a nursing home would accept him, according to authorities.

Patel was originally charged with attempted murder in the October 2007 incident. He could have faced up to five years in state prison after pleading no contest in August to elder abuse.

The judge, who declined a defense request for home detention, also placed Patel on three years of probation and ordered him not to harass his father and to attend counseling sessions for domestic batterers for a year.

Patel lived with his father in Foster City and wanted both of them to return to India, but his father didn't want to, prosecutors said. The father is partially paralyzed, uses a wheelchair and needs care, and Patel thought the only way to get him admitted to a nursing home was if he was injured or ill, authorities said.

He told investigators that a doctor had given him that incorrect information, said his attorney, Bill Fazio.
According to a police report, Patel said he wanted to hurt his father only "a little bit." Police said the father needed seven staples to close two head wounds.

A San Mateo County Superior Court judge also ordered Patel to attend domestic counseling for a year. Patel will begin his sentence in January.

Fuck this, please hit him in the head so his dad would be accepted into a nursing home. Oh, but the Dr. told him that, BULLSHIT :argh: They should have kept it as attempted murder!
