Silvestre Luna, 27, faces two counts of first-degree assault of a child. Clark County Superior Court Judge Roger Bennett set bail for Luna at $150,000 and appointed attorney Michael Foister to represent him.
Luna was booked in jail Monday after his son was taken to Southwest Washington Medical Center with a subdural hematoma, or bleeding in the brain. The baby was transferred to Legacy Emanuel Hospital and examined by a physician, who also found older, healing injuries, including multiple rib fractures and a broken right arm, according to court records.
The physician told investigators the injuries didn’t look accidental.
When questioned, Luna admitted to investigators that he got frustrated Saturday evening because the 5-month-old wouldn’t stop crying so he shook him, according to an affidavit filed by Clark County Sheriff’s Detective Kevin Harper.
He also said that “some days or weeks ago he squashed (the baby) because he was crying,” according to the affidavit.
However, Luna had earlier told a doctor that the injuries came after the baby fell off a bed.
Luna cares for the 5-month-old in the evening when the baby’s mother is at work.
Investigators don’t believe the mother, Luna’s girlfriend, was home at the time of the alleged assaults.
