Convicted felon flees after arrest for child abuse
Cody Don McDaniel was arrested for allegedly injuring a toddler so severely that he had to be air lifted to St. Francis Hospital in Wichita on Sept. 13, 2008.
An affidavit by Oklahoma State Bureau of Investigation Agent David Sauls provided the following information. McDaniel, 21, and his girlfriend, Shayna Lauren Collier,17, were staying with a friend, Tasha Beeler, 18, on the 400 block of 8th Street in Alva.
Collier and Beeler were absent from the home, but when they returned Collier noticed her son, Darrion Shawn Murrow, born Sept. 23, 2007, was crying and had thrown up on his blanket. McDaniel claimed the child had fallen and hit his head while swinging on the front door while McDaniel was doing laundry. She was concerned because she knew her son did not throw up very much so she took him to Share Medical Center. A ‘CAT’ Scan revealed Darrion had a serious head injury that required he be flown to St. Francis Hospital, in Wichita, Kan.
At Share Medical Center, McDaniel again provided the account that he was the sole person providing care to Darrion and that the child had fallen from the door. This account was given to Joel Ormsby, P.A. at Share Medical. The tests and scan that were examined by a radiologist indicated to Ormsby that the injuries were not consistent with the supposed events described by McDaniel.
Ormsby felt “in his medical opinion” the injuries were due to child abuse. There were also “old bleeds in the brain” and bruises that were not typical to a child of that age. Also McDaniel’s behavior was not usually the kind seen by Ormsby for people when a child is accidentally injured.
After signing an OSBI rights waiver form, McDaniel provided the same explanation to Agent Sauls concerning the events leading to Darrion’s injuries. McDaniel recanted the original account and stated he had dropped Darrion on Sept. 13, 2008 and stated he had dropped him about a week and one half earlier and he fell and hit the floor on his head.
This was McDaniel’s explanation of the “old bleed” described by P.A. Ormsby. Now McDaniel stated he was playing with Darrion on Sept. 13, 2008 and as he tossed him up in the air, the dog caused McDaniel to drop the child on his head.
McDaniel maintained that he had not lied and that the child had fallen by the screen door. He did not take the child to the hospital because he did not have any car keys. McDaniel also claimed the child threw up a lot. Concluding the interview, McDaniel was allowed to leave. Beeler was also interviewed and her comments were that she had seen bruises on Darrion for about three weeks and asked McDaniel what had happened. She stated McDaniel’s comments were “I wish he would stop f------- crying for five minutes.”
On Sept. 16, 2008. Dr. Kathryn Melhorn, M.D., St. Francis Hospital, reported to Agent Sauls that she had examined the injured child and reported he had sustained “trauma to head face, trunk and thighs” and that the “bruising is consistent with at least two events.” Radiologist Thomas J. Flynn provided a report consistent with Dr. Melhorn’s findings.
On Sept 17. 2008, Dr. Melhorn told Special Agent Shane Vore, OSBI, that she was the doctor on the child abuse team that was treating Darrion and the child did receive a non-accidental injury to the head but was expected to fully recover. Dr. Melhorn also stated in her opinion, “the bruise on the inside of Darrion’s ear was caused by a blow to the head and that other bruising and injuries had occurred within a three-week time frame.”
Dr. Melhorn further stated on Sept. 23, 2008, “the bruises on Darrion’s face, cheeks, temple, ears and back are all signs of abuse. The child had a small subdural hemorrhage of the brain and this type of injury is not caused by a fall but is caused by abuse.”
“This injury was caused from a blow to the head also referred to as an inflicted closed head injury or abusive head trauma.” Dr. Melhorn stated, “there is no doubt this was child abuse.”
During a post Miranda interview on Oct. 9, 2008, a Spencer Waggoner stated that McDaniel confessed to him that McDaniel did indeed injure the baby and was not going back to prison. McDaniel had been convicted on two counts of second degree burglary and claiming property as his own in a pawn in 2006. McDaniel was on a five year suspension of his sentence for that conviction. McDaniel also told Waggoner that he planned to jack a vehicle and run to Oklahoma City to stay with his homies, and that McDaniel was due for a follow-up interview with the OSBI officer and did not want to be interviewed because he was guilty.
Since that time, McDaniel appears to have disappeared from the Alva area. There was a vehicle reported stolen in Alva on Oct. 9, 2008, and a report of a man identified as McDaniel driving a vehicle matching the stolen vehicle’s description.
