Boyfriend gets 3 years in accidental death

OAKLAND -- When Amanda Hunter was found shot to death inside her West Oakland apartment in July, suspicion immediately turned to her boyfriend, convicted felon Jonathan Ho. After all, Ho owned the SKS assault rifle that fired the shot, and the couple were the only people there.

But Ho, 25, maintained his innocence, telling police that Hunter had thrown the weapon at him during an argument over the gun. The rifle spun in the air, and when the butt hit the ground, it discharged, hitting the 23-year-old mother of three in the head, he said.

The evidence from the crime scene and ballistics tests proved that Ho had been telling the truth. The killing was ruled accidental.

He's one lucky bastard.
I am trying to envision this gun spinning in the air. Did she toss it butt first?
Was he showing her fun tricks he learned as a Color Guard in high school?
What's Ho doing with an assault rifle anyway?

Let this be a lesson that guns are not toys ::sigh::

Holy crap. What the hell are the odds of that. He's a convicted felon too, prior record and all. Who wouldda thunk it?

To hit someone in the head in that bizarre scenario is really rare.

The type of riffle it is, I can see it happening. It's a semi-automatic assault riffle. The pin was left it in, loaded, and they were tossing it around? Apparently he knows nothing about taking care of guns. How much you wanna bet she was arguing with him to leave it unloaded and the pin outta it when she tossed it to him?
