View Full Version : David W. Johnson gets coma lovin' from his wife

Johnson's wife was admitted to the nursing home after suffering a stroke, unable to speak or sit up. Nursing home staff members fed, cleaned and turned her, checking on her at least every two hours. Prosecutors say she was comatose.

Christopher Kelly, Johnson's attorney, said his client visited the woman he married in 1988 every day, reading to her from the Bible and moving her arms and legs so her muscles wouldn't atrophy. The woman's sister, who is now her legal guardian, is upset prosecutors brought charges against him, Kelly said.

"She believes her sister's husband was merely expressing his love for his wife and was trying everything he could to bring her back to consciousness," Kelly said.

But nursing home staff members feared she was in danger because they suspected he was having sex with her and tipped off police. Police got a search warrant to videotape the room and installed the camera, which ran for three weeks. Johnson, who is free on bail, was charged based on that evidence in 2005.

Sauk County Circuit Judge Patrick Taggart, who heard the case out of Columbia County because of a request for a substitute judge, tossed out the videotape evidence last year, ruling it was an illegal search. Prosecutors appealed, arguing Johnson had a right to privacy when he visited his wife to care for her but not when he used the room for intercourse.

The appeals court affirmed Taggart's ruling. Johnson believed he could spend time alone with his wife in private, was lawfully on the premises and took precautions to seek privacy such as closing the door, the court said.

The court rejected the prosecution's argument that Johnson forfeited his right to privacy when he illegally had sex with his wife, noting proof of the assault "has not been admitted."

"The salient inquiry is whether Johnson's claim of privacy is consistent with historical notions of privacy involving a visit between spouses in a room in a nursing home," the court wrote.

"We conclude that it is."

State Department of Justice spokesman Bill Cosh said prosecutors are evaluating whether to ask the state Supreme Court to review the case.

Kelly said he believed prosecutors would be forced to drop the charges without the evidence on the tapes. He said the appeals court made "a pretty obvious call."

"I think anybody who is visiting a spouse in a nursing home who is told, 'You can have a private visit and we won't disturb you,' has reason to think he has privacy in the room," he said.

If the case goes to trial, Kelly said he would argue that intercourse didn't amount to sexual assault. Family members believe she "would be perfectly happy to feel the love of her husband in that situation," he said.

I am strongly in favor of two consenting adults doing whatever rocks their boat in private. However, when one adult is comatose there are NOT two CONSENTING adults there!
The comatose spouse is unable to make her wishes known. Even if she were unable to speak but within her right mind, she COULD communicate in order to make her wishes known. But, from what I am reading here, this is NOT the case.
Thus, this is sexual assault, pure and simple. He needs to be stopped!
Oh, and the woman's sister, she's a fucking nut! She should be protecting her sister not presuming to give consent for her! WTF?? I really doubt that they had a conversation about this BEFORE the woman became comatose.

...now I'm going to have to actually write up a living will for legal cover beyond what's generally been verbally agreed. "Spouse may have sex with my comatose body, but may not videotape it for posterity. Or the internet." Crazy.

That's really disturbing! But hey it was his wife and perhaps she did enjoy it? Maybe he was gettin' more action than he ever did when she had all her facilities?

Sorry folks, not entirely sure I agree here. Three short years ago, I spent endless hours at the bedside of my beloved SO while he was on life support. My darling had a stroke at 51 (doctors say he had a weakness in his brain since childhood and they were amazed he lived as long as he did) god how he loved me and how I love and miss him.

Had the shoe been on the other foot, and I was the one in a coma and if my beloved wanted to make love to me again--for whatever reason--a need, out of love, possibly hoping for a miracle, or just one last time? He would have known he was welcome, no matter what condition my body may have been in. Damn the rules and administration.

My SO would have been like this man, coming daily, seeing to my comfort making a difference where and if he could, praying that in doing or saying just the "right" thing would bring me around to him again.

I'm not sure I can condemn this man for his actions. I don't know where his heart was at --but, her sister seems to feel the same way and I can't feel he wanted to harm her.

Gotta say I agree with JMLS. Personally, I find the idea rather revolting but I find it difficult to believe that the man was "assaulting" her. I suppose you could argue implied consent since they were married (yes I know I just opened a huge can of worms with that statement). Either way, I think this man was simply trying anything at all that he could think of to bring his beloved wife out of her coma. Just because he chose a way that disgusts most "normal" folks shouldn't necessarily mean that charges should be filed.

I checked in on this thread a few times before posting. Wasn't sure what to say--I keep remembering holding my beloved's hand and saying over and over --if only, if only we could have one last moment together, one last embrace, one last kiss, one last toast, one last anything...Honestly, I'd give all that I have, for just one last day with him--I didn't deserve him.

Bless his big ol' good heart--he put up with me.
