Kevin Allen Sauter, 48, and his son, Marc Allen Sauter, 26, appeared in Justice County on Monday by video from the county jail. Kevin Sauter was charged with felony assault with a weapon and misdemeanor assault. Marc Sauter was charged with felony assault with a weapon and misdemeanor cruelty to animals.
Judge Larry Herman set bond for both men at $5,000 and ordered them to appear for arraignment Thursday in District Court.
According to court records, sheriff's deputies were sent at about 7:40 p.m. Friday to a report of a disturbance at 3235 Phillip St. When deputies arrived, they found five men in the street, and two of the men were holding large cans of bear spray. The deputies ordered all five men to the ground. An ensuing investigation determined that the incident began when a man said he saw the father and son near his dog, Duke. The man said Duke was leashed but had jumped a small fence. The Sauters were trying to get the dog back into its yard and claimed that Duke had attacked a child, the man said.
The man told the Sauters to leave his dog alone and that he would put it in the house.
The father and son are accused of charging the man and threatening him, prosecutors said. As the man retreated, Marc Sauter swung at him and the man punched him, court records state.
The man said he tried to gather his dog, but it got loose and in the commotion and Marc Sauter stabbed the dog. The man's brother got involved, and the melee spread. At one point, Kevin Sauter is accused of using a knife to threaten the man's wife and then hitting her several times on the back of the head.
The man said he ran to his house and armed himself with a knife, then chased the Sauters back to their residence. He returned to his house, put the knife inside and went back outside, where he and his brothers were hit with bear spray.
Duke suffered an inch-long knife wound and was taken to a veterinarian by its owner, court records state. Prosecutors allege that a knife with dog hair and blood on the blade was found during a pat search of Marc Sauter.
