LIBERTY TWP., Ohio -- A 20-year-old Liberty Twp. man has been charged with the rape of a 21-month-old girl he was caring for.

James A. Fitzhugh was arrested Wednesday morning by Butler County sheriff's deputies. He was charged with two counts of rape and two counts of felony endangering children, officials said.

The arrest came after a girl was taken to Cincinnati Children's Hospital Liberty Twp. branch by her mother on Tuesday evening, Sept. 9, with questionable injuries, officials said. The child was later transported to Cincinnati Children's Hospital for additional treatment and observation.

Fitzhugh, who is known to the mother of the child, cooperated with the investigation, said Capt. Katie McMahon. Fitzhugh had been providing care for the child at his residence when the abuse had taken place, McMahon said.

Fitzhugh was being held in the Butler County Jail Wednesday on a $70,000.00 bond, officials said.

The child's injuries were reported to be non-life threatening and she has been released from Cincinnati Children's Hospital and it is believed to be recovering at home with her mother. There are no additional persons believed to be involved -- or expected to be charged -- in connection with this offense at this time, officials said.

They don't get enough jail time, they survive jail & molest again, and they're difficult, if not impossible, to rehabilitate. They probably create another generation of molesters, they damage these children so much. When I was young I was against capital punishment. Now I'm over it. I resent these sick bastards getting 3 squares a day from my tax dollars, and I'm pissed off that I have to worry about them regaining their freedom and preying on the innocent. Forget the lethal injection though - the tattoo would take care of everything...

it won't always be covered if it's tattooed across their chest/back/buttocks/face (not the forehead) pedo on the left cheek and phile on the right cheek. :) AND their eyelids..they have to shower some time.

A 21-year-old Liberty Township man was sentenced to 13 years in prison today for beating his girlfriend’s 21-month-old daughter last September.

But James Britton Fitzhugh avoided spending the rest of his life behind bars when Judge Andrew Nastoff of Butler County Common Pleas Court refused to convict him of two counts of rape.
Nastoff, however, did find Fitzhugh guilty of two charges of felony child endangering.

Fitzhugh chose to present evidence directly to the judge instead of a jury on Monday. Nastoff rendered his verdict at 9 a.m. today.

Authorities said Fitzhugh dropped, squeezed and shoved the child Sept. 8, causing skull and leg fractures and other injuries.

He also was accused of molesting the child with his finger, but his attorney Richard Goldberg has said it happened by accident while Fitzhugh was changing the girl's diaper.
