EAST MILLCREEK, Utah (ABC 4 News) - A man known to police as “Boy Diaper” is back in jail.

31-year old Barton Bagnes was arrested yesterday accused of showing a diaper he was wearing to children.

But authorities said it is not the first time Bagnes has been involved with this kind of crime.

In 2000, he was convicted for a similar crime, served jail time and was placed on the Utah Sex Offender Registry. His alias on the registry is listed as “Boy Diaper.”

And in February, he was charged with 11-counts of lewdness for exposing himself to young boys in Holladay.

Melissa Rideout and Etienne Brasher claimed it was their sons who were victimized by Bagnes in February.

"He always had a big bag on him with diapers in it and he would ask the kids if they wanted to see it and he would pull his shirt up and pull his pants down to show that he was wearing diapers,” said Bagnes.

Yesterday, sheriff investigators said Bagnes came to the Evergreen Rec Center in East Millcreek where he allegedly exposed his diaper to children.

An employee spotted him and called 9-1-1.

"We're frustrated because we've arrested him numerous times and it seem like he's back out on the street," said Lt. Paul Jaroscak of the Salt Lake County Sheriff’s office.

The 31-year old Bagnes lives with his parents in Holladay.

I lived in Salt Lake for a year between 1996-1997 when my employer transfered me there. It is the ultimate wackiest place EVAH! I thought, though, that the Mormon Undergarments were worn against protection from tempation and evil...I didn't know they included a leak-guard core.

Seriously though, this man has some severe mental disability. He probably sees the kids and is like, "hey! look what we have in common! You just got out of diapers and I'm still in mine!" It could be like a PSA for potty training.

It mentioned that he still lives with his parents. I wonder if he is just weird or if he has mild retardation.

I agree is is sick and twisted, but I see more on nightly television. I'm sure it comes for wording in the law along the lines of exposing something "for the purposes of sexual gratification". Those folks that are kinky about rubber suits are probably safe to expose those, though. :)

An East Millcreek man with a history of dropping his pants and showing children a cartoon-character diaper is at it again.

Barton Jason Lewis Bagnes, 31, walked by a driveway on Tuesday (March 3) where two 4-year-olds and a 6-year-old were playing, according to Salt Lake County Sheriff spokesman Lt. Don Hutson.

Bagnes asked the children if they wanted to see his diaper, then dropped his pants and showed them a toddler diaper with the Sesame Street character Elmo printed on the outside. His diaper was fastened together with duct tape or other adhesives since it did not quite fit him.

One of the children told his mother of the incident the following day, and she called police.

The Sheriff's Office does not plan to arrest Bagnes, and the Salt Lake County District Attorney's Office is unsure whether they'll have a case against him. Similar past cases against Bagnes have been dismissed -- usually because he does not show any genitalia or further bother the children.

"There has been no behavior on his part to suggest that he has any intention of hurting anybody or engaging in any sort of sexual behavior associated with children," Hutson said, adding that Bagnes has offered no rational explanation as to why he exposes his diaper to kids.

"It appears relatively harmless at this point," Hutson said. "Even though it certainly is shocking and of concern to law enforcement and the neighborhood in general."

The Sheriff's Office received three reports of Bagnes exposing his diapers to children in 2008, including an incident during which he exposed his diaper to a young girl at the East Millcreek Recreation Center.

They nabbed Bagnes back in 1999 for a similar diaper - exposure incident. In that case, he was charged and pleaded guilty to one third-degree felony count and one class A misdemeanor count of lewdness involving a child, landing him on the sex-offender registry. Hutson said it was unclear what made that case so different from the recent charges that have been dismissed.

i'm sorry, but how in the fuck is a grown man going around wearing a diaper and exposing it to little kids NOT crossing any lines? there's a lot of stupid stuff said daily in Utah, but this must be some kind of record.

i don't see how he didn't get arrested for this. CLEARLY this is a fetish to this guy. he goes around WEARING A FUCKING DIAPER and EXPOSING that diaper to KIDS. and he has done this REPEATEDLY. it is not ok to involve kids or unwilling participants in your fetishes in any way, which is what this fuck is doing. this perv is fucking disgusting and weird. they were taking this seriously before, and i don't see what changed here.

if the SLPD isn't taking this crap seriously, i can only hope that the next time he tries this, some parent or concerned citizen will see him doing this and kick the living crap out of him. i know that's what i'd do if i saw this creepy fuck going around my neighbourhood showing his diapers. unfortunately, people are a little too nice in Salt Lake City.

Whoa... I was checking to see if he had a myspace and I came across a profile for "boy diaper" ,who is probably not the same person b/c it says he lives in Denver but, if you scroll down to the friends list you will find pictures of adults wearing diapers and pull-ups.... WILD !

It's just highly odd and they seem to think he is not doing it for sexual gratification. I suspect he's a bit "touched" and most parents keep their kids away from him without the diaper thing going on.

If he is so proud of his diapers, why not go around showing everyone? Why just children? If he was pulling down his pants to show them his Elmo swimtrunks I would be just as disturbed. If he was walking down the street sporting only them or his diaper, well thats just being weird. IMHO

Does it? I would not find it 'relatively harmless' if some freaktard pulled his pants down to show my kids his fucking diaper! I would shove them down his fucking throat and hope the absorbent beads swelled up and choked him!

And what if he sees the fact that he is getting away with it, and no longer being arrested for it, as a green light to take it a step further? He is clearly very disturbed, so the fact that the cops are leaving him to get on with it might just tempt him to see what else he can 'get away with'. Fucking perv!

His mother claimed her son suffers from dyslexia and was a victim of bullying during school. She says he never recovered.

"Maybe his happiest times were when he was a child and so he has this fixation with children,” said Mari Bagnes.

In regards to the diaper he is seen wearing, Mari Bagnes said “that's another problem, that's a physical problem."

there is a reason that is not being told that they keep releasing him. I don't know what it is but the courts seem to think that it is harmless. I wasn't there to know what their logic is so can only assume.

i worked with a man who was mentally challanged and he only acted up to the kids. talking to them about monsters. thank goodness no diapers. he didnt mean it sexually, he just sort of identified as a child more - he was the youngest of his siblings, he was sort of permanently 11 years old. and he loved monsters. he woulda been a good demonite in the movie threads if he had learned to type. the problem was he was really 35 and big and loud and had a speech impediment and insisted on wearing the Olivia Newton John Lets Get Physical look at all times. kids were scared of him.


and judging from diaper mom's responses, probably the physical problem with urination is that she never really potty trained him.

I'm betting that he's already getting it. That is probably the major influence in their belief that it is not sexual in nature. Controlling behavior can sometimes be difficult on mentally challenged people... especially with parents in denial or challenged on their own.

My 4-year-old grand son takes great delight in the characters on his nightly pull-ups. He has to show us which ones he has on each night. Personally, I couldn't care less about which of the Cars cars he is going to piss on. But I have to smile and nod at his childish effort to boast about which one it is.

I wonder if that is all Boy Diaper is doing... showing off his Elmo. I don't know and the media and courts are not saying. His mom should buy him Depends instead.

A man known by law enforcement as "Diaper Boy" because of his history of showing off his diapers to young children, was arrested again by Salt Lake County Sheriff's deputies Thursday.

Barton Jason Lewis Bagnes, 31, has been arrested several times in the past for allegedly showing the baby diaper that the 5-foot-3, 100-pound Bagnes wears, to young children. He is also a registered sex offender due to a lewdness involving a child conviction in 2000.

In the latest incident, deputies responded to a call just before 7 p.m. Thursday. of an adult showing his diaper to children.

"Several witnesses and young children said he had pulled his shirt up to his upper chest, exposing his torso with his shorts down to his knees, exposing his infant diaper that he had taped on his groin area, to children as he leaned his hips forward," according to a Salt Lake County Jail report.

What made Thursday's incident unique from the others was that Bagnes was passing out fliers for a website that shows children in diapers, said Salt Lake County Sheriff's Lt. Don Hutson. Some of the children appeared to be older than what would be considered the normal age for a diaper-wearing child. The sheriff's office kept one of the fliers as evidence, Hutson said.

Bagnes was booked into the jail for investigation of felony lewdness involving a child and disorderly conduct.

Despite his 2000 conviction, very few of Bagnes' subsequent arrests have stuck.

In 2008, Bagnes was charged with 11 misdemeanor counts of lewdness involving a child for a 2007 incident. That same year, he was charged in August for thee felony counts of lewdness involving a child in a separate incident.

All charges were eventually dismissed because the crime did not fit the criteria of the charges. Part of that was due to the fact no genitalia was exposed. (Maybe they should look at changing the law?)

Despite his recent releases, Hutson said the sheriff's office would continue to arrest him everytime he displays his diapers to children.

"We've been instructed by the DA to bring each case to them," Hutson said.

Some argue that what Bagnes is doing is no worse than a teen who wears his pants really low, exposing his boxer shorts. Hutson and the sheriff's office disagree.

"The shock value is what's different. A person with saggy pants is indiscriminately showing it to everyone. (Bagnes) is not wanting to show it to everybody. While I think there is a whole lot more to this story, I am curious why this guy keeps getting away with it.
Why has he not at minimum been ordered into counseling of some sort?
Why haven't they enacted a "no showing your diaper" ordinance?
Why tell the cops to keep arresting him if they are not going to bring charges?
