A Lakeland man has been charged with animal cruelty after witnesses said he tossed several kittens out of his truck Wednesday morning, deputies at the Polk County Sheriff's Office said.

David Carl Arthur, 66, was driving his pickup truck toward Highway 98 in Lakeland when witnesses say he drove over one kitten and tossed two others out the passenger side window, deputies said.

Witnesses called deputies as they followed Arthur to the Tractor Supply Co. on Highway 98 , where they confronted him.

When deputies arrived, they found one dead kitten on Rockridge Road. One kitten survived and was taken to Animal Control for medical evaluation. The kitten will be placed in a foster home today, deputies said.

A third kitten is still missing.

Inside Arthur's pickup truck, deputies found a sign that read," Free Kittens - 1 Mile." He was taken to Lakeland Regional Medical Center after he complained of shortness of breath and chest pains.

Arthur has been charged with three counts of animal cruelty. He will be processed into Polk County Jail when he is released from the hospital.

The woman who made the 911 call to police, is now the proud owner of Hope.
Hope is one of the kittens thrown from the truck that lived.
She joined a household with two dogs ó a 6-year-old Jack Russel terrier named Petey and a 14-year-old cocker spaniel named Sidney.

Although Sidney has gone deaf, Pribe said, Petey quickly took to Hope.

When she's not jumping off the bed and onto his back, the two of them take naps together.

'Maybe she doesn't know she's a cat,' she said about the friendship developing between her two pets.

Pribe estimated that Hope is only 5 or 6 weeks old, and said she is as lively and playful as any other kitten.

'She's the queen of the house,' she said. 'It's like she's always been here.'

I hear you Brother. I don't know if I could have kept myself from beating this son of a bitch to death. My wife & I live with 8 cats (Harry, Max, Floyd, Smudge, Oliver, Queenie, Louis & Oscar) They're all either someone's unwanted strays that we brought in after weeks of making friends with them & days in the lost & found or adoptions from the local rescue organization. Max is Diabetic, and Oscar is FIV positive. Smudge spent so much time of his 1st year at the Vet that his medical folder is fatter than mine, and I've had 3 heart attacks *LoL*. He almost died twice, but he's 8 now and the smartest cat I've ever seen. So you can see that I'm the probably one of the worst people to fuck with when it comes to cats. We should hook up, go find Dave, and dress him up like a Kitty, and throw him in a cage full of pit bulls.

Driver Is Cleared of Throwing Kittens

Prosecutors will not charge a 67-year-old Lakeland man with throwing three kittens from a moving truck, concluding there is "insufficient proof" to support a charge of cruelty to animals.

Arthur was arrested in July on three felony counts.

Donna Wood, a Sheriff's Office spokeswoman, said detectives put together cases with the best information available and handed them over to prosecutors for review.

The State Attorney's Office released an evaluation of the case, based on investigative reports and witness statements.

"There is a significant difference between what was alleged in the arrest affidavit and what can be proven in this case," wrote Assistant State Attorney Michael Cusick.
