Daniel Kerr faces three counts of lewd and lascivious molestation and is being held on no bond.
According to Palm Bay police, the child told her baby sitter on Saturday that Kerr "let" her touch him and perform lewd acts on him. Kerr faces a maximum penalty of life in prison without parole if convicted. The incidents occurred over the last three months while the child's adoptive mother was out of town for business-related meetings, police said.
Detectives interviewed the child who claimed she was allowed to touch Kerr, who said if she told anyone, he wouldn't "allow" her to touch him anymore, police said.
