DE SOTO — Taking a toy from his half sister led to one of what police are calling many "torture" sessions for a 2-year-old who died Monday, allegedly at the hands of his father's girlfriend.

Brandy Jean Mabery, 23, was charged Tuesday with felony abuse of a child resulting in death and armed criminal action for striking a child with a stick in the death of Stacey Tolbert-Wyatt.

Paramedics found the toddler in cardiac arrest about 3:30 a.m. Monday at the couple's apartment in the 400 block of North Eighth Street. He was pronounced dead at Jefferson Memorial Hospital.

Autopsy results showed multiple bruises over Stacey's body, swollen and bruised genitals and head injuries.

Dr. Mary Case, St. Louis County medical examiner, classified the findings as torture. The abuse allegedly occurred between June 21 and Monday and included the beating over the half sister's toy.

De Soto Police Chief Ernie Paul said the child's father, Stacey Tolbert, 23, came home from his job at a nearby fast-food restaurant about 1:30 a.m. Monday to find his son beaten and struggling to breathe. He told police he thought the child was in a coma and tried to wake the child by pouring cold water on him.

Although court documents say Tolbert made two calls to his mother for "advice," police say two hours passed before Tolbert called 911.

Jefferson County Prosecutor Forrest Wegge charged Tolbert with endangering the welfare of a child. Police believe he did nothing to report the abuse.

Alandgra Pittman of St. Louis, Tolbert's mother, said Mabery beat the child while her son was at work. She said Mabery favored the 1-year-old daughter she had with Tolbert over Stacey, his child from a previous relationship.

According to court documents, Mabery said she threw a basketball at Stacey on Saturday, hitting him in the face and causing him to hit his head on the ground. That same day, the child wet himself, and Mabery said she hit him with a belt, according to documents.

On Sunday, Mabery allegedly told authorities, the child fell in the bathtub, which caused more injuries to his face and head, and she hit him with a stick on his legs and buttocks. She also said she pushed the child and he fell face first onto the ground and into a wall, according to court documents.

Mabery is in the Jefferson County Jail on $1 million cash-only bail.

What a bitch. I can't even fathom such rage at a child. If she doesn't understand the actions/motivatins of a 2-yr old, she has no business being a mother in the first place.

Her comment on his MySpace:
Baby, I love you, and tell these trick ass girls to stop trying to holla at you on myspace because you are not going anywhere. You and I are always and forever. Love you babooskey
Her "always and forever" is going to happen without him and her kid. Sick cunt. Serves her right.

Hope she always and forever has sleeping and awake nightmares about this. Maybe some Bubba-ette will do her always and forever in a bad bad way.

I think a lot of it was the fact that Stacey wasn't her child....he was just a reminder that her man had a previous life and previous relationships before her. Very fuckin selfish and self centered....

I would seriously like to bash her face in with a tree branch. Him too...for not reporting the bitch in the first place.

He was the other child, I think that is clear. She probably was mean to him for awhile.

I can't imagine that amount of rage at a 2yo even if he was a stranger that I had never seen before... much less one I had in my life. I may care less for him than my own but he's still only two with a brain to match.

She has to have a serious thought disorder... not mental illness... just no common sense much less anything beyond that.

I'm in agreement with you. My son, when he was roughly 3 and half? busted a glass top coffee table, at a friend's house. he was laying on the floor and kicking the underside of it. I kept telling him to stop, and he wouldn't so I made him stand in the corner for 5mins. Then let him out. I went into the kitchen, and I heard >crash< OMG RUNNNNNNN to the livingroom. He was laying on the floor under the coffee table, the glass shattered all over him, my youngest daughter standing there screaming because a sliver of the glass had cut her. I looked at her, looked at him and my friend came in, and pick up my daughter and took her to the kitchen to clean up the blood and get the sliver out. My son, rolled over, and got up on hands and knees and stood up. I looked him over, not a scratch.. how? I have *no* idea... friend's wife got out the vacuum and cleaned up the broken glass. I had to replace the coffee table, but holy crap, I'd never beat my son for breaking the damn table.. EVER... even if he were my step-child..he was being a kid.. It didn't occur to me to spank him, or anything.
I don't have step-children but I do have 'adopted' children.. one stayed with us for ...11 months when she was 16. she pushed the very limits of my patience, and then pushed me beyond them. I never once considered beating her an option..

I don't understand why people think it's ok to beat a child....let alone beat the child to death.. :(

If my kid broke a glass coffee table by kicking it after he was repeatedly told not to do that I would beat him! At three and a half he knew better, and could have seriously injured himself. You are more patient and forgiving than I.

it never even crossed my mind that i should beat him... i was more worried about him being shredded from the broken glass, or finding slivers in his scalp or something.. my friend who was an emt at the time, looked him over, and said he was fine...scared the hell out me though..

Nell, I don't believe you would beat your kid! You would whoop his ass 'til he cried and then your tender heart would overcome you :)
Of course, if Trashcat was nearby, you might get in an extra lick or two for show (just so Trashcat wouldn't think you are a pushover) I would believe you'd do a verbal tongue lashing until his ears bled...

Wow, so many days, so many injuries and a man sees his son struggling to breathe and HE FUCKING DUMPS COLD WATER ON HIM..................DROWN THAT MOTHER FUCKER! What parent seeing THEIR baby struggling to breathe doesn't know what to do, how sad, he suffered and he looked into daddy's eyes but he knew there was no love there for him -he knows, its only for daddy's hoes...

I hope she becomes some big dykes' play thing, (love that bitch) and he hopefully will lose everything, his life, his obsessive problematic ghetto hoe, his daughter, his family, his myspace page, and may the image of his beautiful son forever shine in his eyes AND WAKE HIM UP EVERY NIGHT WITH BUBBA!

I just don't understand how people can be so brutal to such an adorable two year old. Who cares if the child isn't hers, she should love the child because the child is a part of his dad, whom she claims to love. I think the biological mother should send them an almond chocolate cake to their jail cells laced with Arsenic from a different state under an alias.

His MySpace has a blog that will allow "anyone" to post comments, should there be any interest.
