A 66-year-old Haskell man is charged with child abuse by injury after a 2-year-old girl he was guardian of was raped and was developing a genital deformity.

Alfonso B. Smith of Haskell failed to seek any medical attention for the toddler, who had contracted a sexually transmitted disease from being raped and her genitalia seriously bruised, the charges state.

An affidavit filed in Muskogee County District Court states the child victim contracted hepatitis, vaginal warts and vaginal trauma while in Smith’s care.

He did not seek medical treatment for the toddler’s symptoms during an approximate seven-week period, according to Muskogee Police Investigator Shannon Crary.

The affidavit states Smith denied the child’s biological father visitation with the child.

Smith is jailed in the Muskogee County/City Detention Facility in lieu of $50,000 bond.

What the hell is wrong with people?! First of all why rape a baby ( I still consider a 2 year old a baby)? And second of all what kind of person doesn't take them to the hospital after that? That poor little girl. There are so many more details that haven't been covered yet. Like who raped the little girl, why was this man the guardian, where are her parents, and where is she now? I hope this gets more updates and the little girl is safe and doing well.

There is 3 of them. Dad, son, grandson who is 23 all have the same name. Dad was busted in Lawton in the 90's for dealing coke. Grandson just got out of prison and has a hearing later this month for some kind of parole revocation.

A physician of the Muskogee Women’s Clinic has been subpoenaed to appear before the court at 10 a.m. today with all information or medical files regarding the toddler. He is set to testify and present medical records to the Department of Human Services, along with cooperating with DHS, the subpoena states.

A Muskogee County jury deliberated four and a half hours Wednesday before finding Alfonso B. Smith of Haskell guilty of child abuse by injury.


Smith, who will be 67 Friday, was the guardian of a 2-year-old when she was raped and was developing a genital deformity, according to court filings. Smith was charged with failing to seek medical attention for her.

The toddler had contracted a sexually transmitted disease from being raped, had a seriously bruised genitalia and genital warts, evidence reflected.

Prosecutors could not present evidence as to who raped the child.

Muskogee Police Investigator Shannon Crary said Smith did not seek medical treatment for the toddler’s symptoms during an approximate seven-week period.

The child had to undergo surgery for genital warts, jurors were told.

Jurors recommended Smith be sentenced to one year’s probation.

“He was earlier offered probation, but rejected it,” said Assistant District Attorney Nikki Baker Dotson, who prosecuted.

The child went without medical attention from Sept. 1 to Oct. 7, 2007, Dotson said.

Smith could have faced up to life in prison, according to court documents. He has been free on a $50,000 bond since June 9, 2008, according to jail booking records.

I agree. I hope they're continuing the investigation -- doing DNA matches on the HPV strain like Imp mentioned or *something* to try to determine who is responsible for the rape. Seems they could have used the threat of life in prison before his sentencing to get grandpa to talk. How did he just end up with a year of probation? What a joke.
