View Full Version : DeMontrell Miller killed a 2 year old that belonged to his girlfriend.

Tyler Police have arrested DeMontrell Lamar Miller, 21, in connection with the death of two year old Kelynn Pinson yesterday. The man was arrested on a capital murder warrant after he was interviewed by Tyler Police.

Miller is the boyfriend of the child's mother. Pinson died of blunt force trauma to the head.

Pinson was found unconscious at Hidden Springs Apartments around 12:45 pm yesterday afternoon. The mother wasn't at home at the time, and the mother's boyfriend was in charge of watching Pinson and Miller's five month old son, who is now in the custody of Child Protective Services.

Miller was taken into custody at the Tyler Police Department around 5:00 pm. Miller is in the Smith County Jail, held on a one million dollar bond.

Surprised he left the 5 month old alive.

TYLER, Texas — An East Texas man is charged with capital murder in the death of his girlfriend's 2-year-old son.

Tyler police arrested Demontrell Miller on Monday in the death of Kelynn J’Davion Pinson, who authorities say suffered blunt force trauma.

Tyler police said Miller was watching the boy and his own 5-month-old son Sunday when authorities received a call about an unconscious child.

Authorities say the toddler's mother was at work at the time.

Bond for Miller was set at $1 million.

Looks like he was quite the football player and maybe could have made something of his life. He also was shot at in 2007 from what I have found.

And Mom knew ahead of time that boyfriend was violent. Either she's so stupid she can't wipe her own butt, or she didn't care if that child died. Book 'em both.

Well this excuse is creative at least. He claims the boy almost drowned in the complex swimming pool and that he was just trying to save him. :blah:

KLTV 7 has now learned how 2 year old Kelynn Pinson died. 21 year old Demontrell Miller of Tyler was cuffed and arrested yesterday afternoon, charged with capital murder in this case.

Kelynn was found unconscious Sunday at the Hidden Springs apartment complex on Shiloh Road in Tyler, and later died.

Yesterday, before he was arrested, Demontrell Miller spent a great deal of time with police, telling him his side of the story - that Kelynn died after almost drowning the apartment complex pool.

He said he took both boys (his five month old, and Kelynn) to the pool and briefly left Kelynn there while he ran upstairs to put the baby in the apartment.

Miller then told police he saw Kelynn floating in the pool, and he pulled him out of the water and hit the boy's chest with the palm of his hand, causing the boy to regain consciousness.

He went on to tell police that he brought Kelynn upstairs and that not thirty seconds later, Kelynn because unconscious again, and that's when he called the boy's mother.

The autopsy showed that Kelynn died specifically from blunt force trauma to the stomach. The doctor who conducted the autopsy says that Kelynn Pinson's injuries were from hitting or some type of blow to Kelynn's body, going on to say Kelynn would have been in severe pain from the trauma.

The doctor also told police Kelynn suffered internal bleeding, and that it took around three hours for the little boy to die. The autopsy also describes other signs of physical abuse, including numerous bruises on his body, his foream, back, right eye, and stomach.

An important note - Miller told police the incident all happened in a matter of minutes, not three hours - between the near drowning, Kelynn becoming unconscious and police arriving on the scene. According to the arrest affadavit, Kelynn's mother had to call police after she got to the apartment, even though she told Miller to call 911 before she left work to head home.

An autopsy shows a toddler from Tyler died of abdominal force trauma in an attack allegedly by his mother's boyfriend.

Bond remains at one million dollars for Demontrell Miller, who was arrested Monday and charged with capital murder.

The case involves Sunday's death of two-year-old Kelynn Pinson.

Autopsy results indicate the boy had bruises and suffered internal bleeding from abdominal force trauma which caused him to slowly die, in severe pain, over three hours.

Tyler police say Miller had been watching the toddler and his own five-month-old son.

Miller told authorities that he found the two-year-old boy in the apartment complex swimming pool -- as a possible drowning -- and called his girlfriend.

Tyler police say Miller did not call 911, even after his girlfriend told him to do so.

Update on old case that went to trial..

TYLER, TX (KLTV) - It has been an emotional trial, dragging on for over a month now, but late Monday afternoon, a jury sentenced Demontrell Miller to the death penalty. He was found guilty of capital murder in the beating death of two-year-old Kelynn Pinson.

In court, moments of grief and anger going over Kelynn's violent death last year.

"Can you imagine the pain when his shoulder was hurt or his back or his arms or his hands?” said April Sikes, the Smith County Assistant District Attorney. “Can you imagine when he did all he could do and put his hands up and only to be kicked and hurt again? Can you imagine?”

Next to his picture, prosecutors hung-up the toddler's blood-stained shirt, hoping the jury would not forget or forgive.

"When that first kick came to him, what did he think?” said Sikes. “’Stop hurting me. What did I do wrong? I'm sorry!’ Can you imagine the type of character it takes to let a two-year-old baby lay in the floor until he dies? My God! What kind of person does that? And, I don't care if he's mannerable or not. That's what makes him a monster. That's what makes him sinister. He's a baby killer."

The defense has always argued that Demontrell Miller loved the little boy and his mother. And, his death was an accident. Monday, his attorneys asked for mercy.

"I would also submit to you that this is Demontrell Miller's day,” said LaJuanda Lacy, Miller’s attorney. “He, too, is seeking justice in this case. No matter what we do as it relates to this case, no matter the outcome of this case, it will not give Kelynn Pinson new life.”

"Don't you dare let them put that guilt on you,” said Sikes. “You know who affected lives in this court room? He did it. He did it to his own sorry self and to every other person in here. He did it. It is his conduct. He beat that baby to death."

Miller will be killed by lethal injection. Kelynn's father wrote a victim-impact letter, calling Miller a coward. When the verdict was read in court, there was no reaction from Miller or anyone else in the court room.

Heartbreaking testimony:
Kelvin Arterberry, 22, Kelynn's biological father, began crying when he saw the photos of his son's body in the hospital, which had been bruised extensively. On several occasions, he held his head in his hands and was unable to answer attorney's questions immediately.


Arterberry testified on the morning of May 30, 2008, that Kelynn woke him up around 9:30 a.m. and the two began playing with Arterberry's cell phone while lying in bed. "He took pictures of us, and he was running around, laughing and playing," he said. Arterberry said the child did not appear to be in any pain or distress at that time.


He said after purchasing breakfast for his parents and Kelynn at a McDonald's, the two returned home, where the family ate and watched cartoons. Kelynn continued to play at Arterberry's house throughout the day, never complaining of pain, or having trouble eating.


When Arterberry bathed Kelynn before taking him home on the evening of May 30, 2008, he said the bruises visible in the photo of his child's body were not there. He did tell the jury that the child said his right shoulder was hurting, and had trouble raising his right arm above his shoulder.


The most emotional part of the trial came when Arterberry told the court that he was supposed to pick Kelynn up early in the afternoon of June 1, 2008, after serving as a pallbearer at his great uncle's funeral.


He said he began visiting with relatives, lost track of the time, and did not go back to Ceola Pinson's apartment to pick up his son as he told the boy he would.


"If I had, I would still have my son today," he said through his tears.

There was also testimony from neighbors that overheard the domestic violence between Ceola Pinson And Demon Miller!! Ceola knew how capable Miller was of hurting Kelynn but let him babysit anyway!

Doctors that testified also said that it took about 3 hours for Kelynn to die from the injuries sustained and he would have been in immense pain, Demon didn't even try to get him help.

This is the type of shit that I hate. I understand unconditional love from a parent, or really from anyone. I never blame people for loving someone even when that person is evil. I don't blame them for WISHING or hoping that things are not true.

But I do blame people for being purposely blind to facts. I feel for this woman because she is feeling a very real pain as a mother to someone who will now hopefully die for his actions. But her inability to accept the facts and allow herself to grieve for her son's actions rather than grieve over what she feels is a system of persecution against her son is disrespectful to the baby who was murdered.

TYLER (KYTX) - A Tyler jury has condemned Demontrell Miller to death by lethal injection. Tonight, his mother is pleading for his life. CBS 19's Anthony Austin sat down with Miller's mother Tuesday to talk to her about her son's crime - and her grief.


"My son is innocent, he loved Kelynn, we all loved Kelynn, he would never do anything to hurt that baby." That's why it's so hard for Julia Jordan to comprehend why her son is convicted of beating to death his girlfriend's two year old son. "If they just knew him, there wouldn't even been a trial."


On Monday, a jury decided that Demontrell Miller should die for his actions. During the trial, witness after witness testified to the violent nature of Miller, but Jordan says her 22 year old son is a good man, and had been a father figure to his brothers and sisters.


"He made sure the kids were fed, he made sure thesure they wenty were in bed, he made sure that when he had to go to school, he would make to school, he would then run back to the bus stop to get to school."


As Jordan looked over pictures of Demontrell as a toddler, and glances at the memories of a son who won awards in high school, she admits her son is not perfect. "Nobody [is] perfect, everybody has made mistakes, the little mistakes he has made, he never a mistakes like this...killing nobody, never."


Jordan has now turned to her faith in hopes that someone will hear her plea and spare her son's life. "If it wasn't for God, I don't know where I would be right now."


As in all death sentences in the state of Texas, Miller is entitled to an automatic appeal. Jeffrey Haas has been appointed to represent Miller in his appeal.
