Josue Robles Fraga killed his 2 yr. old niece while raping her

WORTHINGTON — A grand jury indicted Josue Robles Fraga, 34, of Worthington, on a charge of first-degree murder on Friday. Fraga is accused of killing his two-year-old niece while committing criminal sexual abuse.

Originally charged with two counts of second-degree murder and one count of first-degree criminal sexual conduct, Fraga is now charged with first-degree murder and two counts of second-degree murder.

He was arrested March 26, several days after he and his wife brought two-year-old Samantha Fraga to the emergency room at 5:35 a.m. with no pulse and a body temperature of 84 degrees. She was pronounced dead at 6:18 a.m.



An initial exam revealed evidence of trauma to her head and perianal/rectal area. Autopsy results showed multiple contusions of the extremities and trunk of the body, as well as peritonitis and rupture of the stomach.

During an initial interview, Fraga claimed he had gotten up early and saw Samantha’s 3-year-old brother jump on her stomach, something the autopsy doctor said would not have caused the stomach rupture. He said he did not see any injuries other than small bruises on the girl when he diapered her before bedtime.

Fraga has an appearance before Judge Jeffrey Flynn at 2 p.m. today. Check Tuesday’s issue of the Daily Globe for more information.

The Worthington man arrested and charged with the death of a two-year old says the girl's three-year old brother caused her injuries.

Thirty-four-year-old Josue Fraga and his wife brought the girl to the hospital last week, where she died.

Court papers say the couple claims they heard the kids fighting in the bedroom and found the brother jumping on the girl.

But an autopsy showed the girl died of injuries to her head, body bruises, a ruptured stomach and trauma to her genitals and rectum.

The doctor who did the autopsy says those injuries are not consistent with the couple's story.

He also says she was likely dead before 2:30 a.m., which the court papers say is significant since Josue Fraga was the only adult home with the children at that time.

He's being held on $500,000 bond.

But once Samantha Fraga came to live in her uncle's mobile home, something terrible happened. While police say Josue Fraga is to blame, Jose says that doesn't sound like the brother he knows. He says, "I'm just hoping that the justice system works."

Jose Fraga says his brother was an interpreter for the court system and worked hard to support his family. But tonight, Josue Fraga remains behind bars in Nobles County, held on $500,000 bond.

Squeaky that is exactly why you would make a good foster mom. It is very difficult to give the kids back knowing the abuse will likely start again. Every child deserves to feel safe and loved and a foster parent many times is the only person these kids ever feel that from. The system is far from perfect that's for sure but giving a child a loving safe enviroment is always a good thing even if you can't do it forever.:hug:

There are lots of different foster situations out there. You can try to let them know what type of kid you're looking for: age range, gender, race, likelihood of returning to family, etc. There are so many kids needing a safe home, that most foster systems will work with you if you're looking like a good placement.

My sister took in a foster just around her 14th birthday. I watched her graduate college last week. :) Her bio mom, sister, and cousins were there to celebrate with us, as well, and that was awesome. But my sister is the one she looks to for guidance, advice, and love, because that's been the only consistent source she's had for that stuff in her life.

Obviously, there are no guarantees, but there *are* some kids out there where it's pretty damned unlikely they're going back to the parents. Some are specifically designated as "foster-to-adoption" track, too, if that's what you'd like to pursue.

I cannot help but wonder: In Europe a lot of foster homes have the children part of the time. It is supposed to lighten the burden of parenthood on a single parent family or a family that has other difficulties, - say a disabled child that takes up an inordinate amount of the parents' time.

Ok, I bit the bullett and read the graphic details. I will put it in nicer terms for you all. The wife was at work. The kids noticed that the little girl was not in her bunk. So he obviously took her into his own bed to do this. Everyone said they heard nothing, So I think he laid her face down or with a pillow over her face to do this. Autopsy says he compressed her stomach and that is what ruptured it. He was just to large and smooshed her. She was 2, for Christs sake!

I read the court docs as well. This is such a sad story. My daughter is close to her age too. I can't help but think he held her down with such force that he ruptured her stomach. No doubt what her little mind was thinking and how scared she was. In a small defense towards the wife who diapered her in the morning. The oldest was interviewed and said he woke up to go to the bathroom at 4:30am. The aunt & uncle said they were in bed by then sleeping when interviewed. They both lied because the boy said his mother was doing laundry at when he got up and Samantha was NOT in the room she shared with the other 5 kids.

On top of that this little girls intestines were protruding from her anus. The aunt says she turned the light on and changed her diaper before they left for the hospital. There is no fucking way she did not see the damage that had been done. The best we got from this kind of thing, was forever ago, when we had an honest to goodness debate about whether assaulters of this nature should BE subject to the death penalty. Lately, however, it seems that most really agree that men and women who are responsible for this, should be destroyed.

He's usually pretty stoic, but even he was flabbergasted and appalled, and just said sadly, "She's so close in age to our kids. She was every bit as precious a child as our kids are. The best we got from this kind of thing, was forever ago, when we had an honest to goodness debate about whether assaulters of this nature should BE subject to the death penalty. Lately, however, it seems that most really agree that men and women who are responsible for this, should be destroyed.

I don't get it, really. How these people can be multiple offenders, so many of them, and be out on the streets. This is clearly a disease, that has no cure, pedophilia. Since this cannot be cured, at the very LEAST, we should have mandatory life sentences for these men. It's like asking me to be sexually attracted to a dude, instead of women. It can't happen. It's not in me, and with these guys, they can't either. They're flat out attracted to children. Some of them truly aren't evil, I'm sure, some of them probably hate their addiction. That being said, they have the pedophilia disease, and the best thing they could do is eat the barrel of a shotgun and pull the fucking trigger.

I don't, honest to fucking God, see why our laws haven't changed already, to cater to the victims of these crimes and not the protections of the attackers. I wish we could just kill them and move on.

There is no cure and I don't understand how people who are intelligent enough to become judges, lawyers and politicians (OK some of them may not qualify as intelligent) cannot "get it". How many victims do one of these pedophile have to rape or kill before the light bulb comes on in someones head? Innocent children deserve protection much more than pedophile deserves a second chance.

He was in court this week. Bail is set at a million so it seems he is staying locked up. Oh and he says he didn't do it. Yeah...we know, it was the 3 year old, you stick to that story.:smokin:

WORTHINGTON, Minn. (AP) - A grand jury has indicted a Worthington man on murder charges in the death of his 2-year-old niece.

Samantha Fraga (FRAH'-guh) died March 20 in Worthington. Thirty-4-year-old Josue Robles Fraga (HOH'-soo ROH'-blis FRAH'-guh) was arrested six days later.

Fraga made his first court appearance on the indictment this week in Nobles County District Court. He's charged with first-degree murder while committing sexual assault and two counts of second-degree murder.

Fraga's attorney says he denies the charges.

Bail for Fraga is set at $1 million.

A medical examiner reported that Samantha died of head injuries, body bruises, injuries to her genitals and rectum and a ruptured stomach. Fraga's brother, who lives in Texas, had turned over custoy of Samantha and her brother to Fraga and his wife.
