Warren man says while watching wrestling, devil told him to choke stepson

A Warren man has been charged with trying to choke his 3-year-old stepson to death.
Randall James Caballero, 35, told police that the devil told him to kill the boy, Warren Detective Lt. Michael Torey said Tuesday.
Caballero faces charges of attempted murder and first-degree child abuse, and is held at the Macomb County Jail in lieu of $1 million bond.

The bizarre incident began at approximately 10 p.m. Friday in the 3500 block or Arden, near 14 Mile and Ryan roads. The suspect said he was watching wresting on television when he claimed he heard the devil.

“He took the son outside, and chokes him out. After he chokes him out, he panics,” Torey said.
The accused stepfather then went to a home in Sterling Heights, just across 14 Mile Road, and told occupants that he had just killed his son, police said. The occupants — who are not acquainted with Caballero — phoned Sterling Heights Police.
Sterling Heights officers arrived and placed the suspect in a patrol car, and officers from both cities began checking the area near the suspect’s home. Moments later, the boy’s mother arrived home from work and called Warren police to report that her son was missing.

Within minutes, officials found the little boy around the corner and along the street, crying and dressed only in pants.

“We don’t know how long he was actually out there,” Torey said.

Sterling Heights firefighters treated the boy and transported him to William Beaumont Hospital, Troy. He was transferred to Beaumont Hospital in Royal Oak for treatment of hypothermia.

The boy had red marks on his neck but suffered no life-threatening injuries. Doctors have since discharged him from the hospital.
While in the custody of Warren police, the suspect confessed to the alleged actions, police said.

“He left the boy outside the home. He indicated that he thought he killed him,” Torey said.

Caballero was arraigned Monday before 37th District visiting Judge Sherman Faunce, who set bail and scheduled a preliminary court hearing for Dec. 28.
Police said the young boy’s twin brother, Caballero’s own three children and two other adults were inside the home on Arden at the time. The adults were sleeping, police said.

The boy’s mother said she had no prior indication that Caballero might harm her young son.

“This all came out of the blue, she claims,” Torey added.

Also on Tuesday, a Macomb County Circuit Court judge issued a personal protection order against Randall Caballero, according to electronic court records that were available Tuesday night. The PPO was requested by Spring Caballero, but that person’s relation to Randall Caballero was not immediately clear.

Court records also show that he divorced Nichole Caballero last May.

Maybe he did just a little bit because the child survived. Or maybe the voices are as stupid as this asshat.

A mental evaluation was ordered today for a man who, according to police, claims he attempted to strangle his 3-year-old stepson based on orders from the devil.

Randall Caballero, 35, appeared in Warren District Court this morning for what would have been a preliminary examination on a charges of attempted murder and first-degree child abuse.

Waszak said Caballero has a psychiatric history and that Erwin wants him to "see a doctor as quickly as possible."

"(Caballero) understands that he needs to see some doctors," Waszak said.

In a personal protection order filed this week in Macomb County Circuit Court, Caballero's wife, Spring Caballero, 28, said her husband suffers from bipolar disorder and lists several medications prescribed for him.

Ethridge said Caballero will be transported to an Ypsilanti-based forensic center. The mental health facility will determine if he is competent and culpable to stand trial on the allegations. A review will take place in 60 days, Waszak said.

A 36-year-old man who said the devil told him to choke his 3-year-old stepson may claim insanity at his trial scheduled for later this month.

Randall Caballero, 36, is charged with attempted murder and first-degree child abuse, accused of attacking the 3-year-boy outside their home on Arden Drive, near 14 Mile and Ryan roads, nearly a year ago.

His trial was scheduled for Nov. 29 in Macomb County Circuit Court in Mount Clemens. But it was delayed because the defense’s expert psychiatrist did not submit his report in time. Visiting Judge Antonio Viviano ordered the report turned in by Tuesday, a week before the new trial date, Dec. 13.

The report is expected to say Caballero was insane at the time of the incident. However, defense attorney Kendall Sailler said, “I don’t want to commit to that,” because, “I haven’t seen the report yet.”

Sailler declined to provide the name of the expert.

Caballero’s behavior and comments during and after the Dec. 17 incident were bizarre from the start.

Despite the strange behavior, Sailler would appear to have an uphill battle in proving insanity since the prosecution’s expert psychologist would counter the insanity claim and say Caballero attempted to fake craziness, assistant Macomb prosecutor William Cataldo.

“This expert will not only say he wasn’t insane but also that he was faking it,” Cataldo said. “There will be lay witnesses to testify to that effect and to support that. His claims are not consistent with those of someone suffering from long-term or short-term delusions.”

One of the key witnesses will be his wife at the time, Spring Caballero, the mother of the victim. The couple has since divorced.

Sailler said if he discards insanity as a defense, he will fight the charges that he called, “ a little excessive.”

A jury could consider the lower charge of assault with intent to commit great bodily harm, which carries a maximum penalty of 10 years in prison compared to life for attempt murder.

He is being held in the Macomb County Jail in lieu of a $1 million bond.

A suburban Detroit man who told police that the devil told him to choke his young stepson has been convicted of attempted murder and child abuse.

The Macomb Daily of Mount Clemens reports a jury on Tuesday returned its verdict in the case of 36-year-old Randall Caballero of Warren.
Sentencing has been scheduled for Feb. 22.

The jury rejected an insanity defense.

Michigan Man Gets 16-25 Years for Choking Stepson

MOUNT CLEMENS, Mich. (AP) — A suburban Detroit man who told police the devil instructed him to choke his young stepson has been sentenced to 16 to 25 years in prison.

Macomb County Circuit Judge Mary Chrzanowski ordered Randall Caballero to serve 200 to 300 months. The Macomb Daily reports Caballero receives 433 days of credit for time served.

During Wednesday's sentencing hearing in Mount Clemens, Caballero said he was "very sorry for what happened."

Caballero was convicted in January of attempted murder and child abuse by a jury that rejected an insanity defense.

Authorities say Caballero attempted to choke the 3-year-old boy in December 2010, then told neighbors he'd killed the child. Police found the boy crying along the street.

Oscar Brummitt of Madison Heights told Caballero in court Wednesday that Caballero, who was the stepfather of Brummitt’s son, picked on the boy because he had a conflict with Caballero’s own young son and stood up to Caballero.

“I know the real reason why you selected my son over any of yours that were there,” Brummitt said. “It wasn’t the devil. It was his defiance. Well, he survived, and I’m happy to say he’s doing just fine. He’s doing his best to be a thriving, happy, curious 5-year-old little boy as he ought to be.”

Caballero, who on Wednesday was dressed in jail clothes that indicate he was being housed in the mental section, apologized.

“I’d like to say I’m very sorry for what happened,” Caballero said. “God bless (the victim) and his family. And I love (the victim).”

Brummitt, who has joint custody of the child with Spring Caballero, scolded Caballero and asked for a 25-year sentence.

“I wanted to look you in the eye and remind you that where you’re headed there’s a special place for abusers and no one will have sympathy for you in the slightest,” Brummitt said.

Brummitt ended his statement by telling Caballero, “Go to hell.”

Spring Caballero did not attend the sentencing but wrote a letter read by Cataldo.

Randy Caballero, Caballero’s father, and other family members attended. Randy Caballero said he agrees his son has mental issues and needs help, not prison.

“What happened was awful,” he said. “We feel for the family.”

He said they plan to appeal.

He said Spring Caballero shouldn’t have joint custody because “she is not a good mother.” Spring Caballero has partial custody of the victim and his twin brother, seeing them three weekends per month and one three-hour evening visit per week. Spring Caballero divorced Caballero in March 2011 and is engaged to marry another man.

Dion Madden, Spring Caballero’s mother, defended her daughter, saying she is a “good mother.”

“She did not cause Randy to do this,” she said. “She may have some issues and insecurities, but where her children are concerned, she is stable.”

Madden said Caballero and her daughter were residing with her at the time of the incident, and Caballero previously showed no signs of violence.

“It was totally out of character for him,” she said.

Caballero was portrayed by the prosecution as faking insanity for the case and faking mental illness before the incident to obtain prescription drugs and Social Security benefits.

Madden said she tried to convince her daughter not to marry Caballero because, “He had nothing to offer.”
