A former Shelby Township woman serving a 25-year prison term for the attempted murder of a child will now face a first-degree murder charge in connection with the same crime.

After a brief preliminary examination Nov. 23, Melissa Memmer was ordered to stand trial in Macomb County Circuit Court for the 2004 assault of then-2-year-old Tyler Korte.

Tyler's hands were bound and his face pushed into a pillow, and the attack left him in a vegetative state. Tyler was the son of Memmer's fiance.

Memmer was previously convicted of attempted murder and child abuse, but prosecutors brought the additional, more severe charge after the child died last December at age 8.

He never recovered from his original injuries.

Melissa Memmer, 30, was convicted on one count of first-degree child abuse during a jury trial at Macomb County Circuit Court in March 2004 for an incident the previous year. She was sentenced to 25-50 years in prison for the original crime, and now faces a life sentence without the possibility of parole if convicted of the new charges.

According to Shelby Township Police Chief Robert Leman, the department was notified Dec. 26 that Memmer's son - about to celebrate his ninth birthday Dec. 28 - had died.

"The medical examiner ruled that it was as a result of the abuse that was inflicted by Ms. Memmer," Leman said.

Police indicated the boy was being taken care of by his paternal grandmother when he died, and that he had suffered lung damage and possibly some paralysis from the injuries he sustained from the abuse.

"He was doing fairly well, considering, for a while," Leman said. "But he was deteriorating."

I hate to hear the old "sentences to run concurrently" bullshit. If I were a judge I'd make all sentences for anyone convicted on more than one count run consecutively. Keep their nasty asses in prison as long as possible. And yeah, I'd pay the extra taxes to do so.

In responding to "wheres the mom?" I was very involded with my son. I had shared custody with the father. Every other week I would pick my son up and he would have bruises and be very scared at times. I did report this to CPS and the police. But since they said it was a custody case they refused to help him then this happened. All I got was a "Im sorry we should of investigated" Bull shit!! I hope she never gets out of prision! By the way she has a son of her own and did not lay a fucking hand of him! :angry:

Obits are sent in to the paper by family. Looks like the dads family sent that one in. So they can omit whoever they want.

Also, papers make mistakes. I did my brothers obit and they still got my daughters name wrong.

Memmer was caring for Tyler, her boyfriend Anthony’s son, and her own son.

She told township Detective Terry Hogan in a video recorded interview shown to the jury that her son was “being upset” and Tyler “was not listening to me” and climbed a dresser. She admitted she tied his hands behind his back with a pillow case and placed him on a bed to show him the effects if he fell off the dresser and broke his arms.

Servitto said she gripped the back of his neck and smothered his face into a “doggy pillow.”

She denied putting the bandana in his mouth, but DNA testing found Tyler’s salvia and blood on it.

After the incident, she tried hiding the items, Servitto said.

Servitto contended Tyler was “an easy target” for her to take out her frustration toward a boyfriend and situation she no longer desired.

In the video, she said, “I am stressed. I love Tyler to death but he’s not my son. I don’t want the responsibility of watching him.”

Concurrent sentences and credit for time served? Why? What's the point, do multiple convictions add to the length of her incarceration? Delay eligibility for parole? I think each conviction should add that much time to her prison term AND her eligibility to apply for parole. Evil cow.

Derp. Missed that on first read. OK, she's locked up and I'm glad. BUT! I've read many stories where defendants have been convicted on child abuse inflicting serious injury, neglect of a dependent, denial of entitlements, failure to protect...I may not have the legal wording correct, and all the charges run concurrently. Down here you are eligible, unless you are given a minimum of time served before you can apply to be heard, is 1/3 of your sentence. And it's usually granted, given the overcrowding in prisons. A sentence of 5-10 means you can apply after 2 years, and so on and on. It has always puzzled me.
