A UAB Health Systems employee is charged with capital murder after authorities say he fatally struck his girlfriend's 3-year-old son in the chest while at work early Sunday.

The blow caused Israel Owens' heart to tear, and he was dead within three to five minutes, said Birmingham police homicide Sgt. Scott Thurmond. Marcus Smith, 36, was questioned by detectives this morning and then charged in Israel's slaying...

Thurmond said the slaying happened between 1:40 a.m. and 2:36 a.m. Sunday at the UAB Health Information Management Department at UAB Hospital on Sixth Avenue South.

Smith, who works in medical records, took Israel to work with him because the Israel's mother was also at work, police said.

He struck the child, who then fell unconscious. Rescue workers were unable to revive Israel. He was pronounced dead at Children's Hospital at 2:36 a.m., according to the Jefferson County Coroner's Office.

An autopsy on Monday revealed the tear to his heart, Thurmond said. The examination also showed signs of prior abuse to the boy.
What the hell?, he hit this child so hard he tore his heart that he died almost instantly?! no surprise whatsoever that previous abuse was found. Taking the boy to work at 1 in the fuckn morning, little Israel was cranky 'cause he was tried you POS! was the mother aware of this? and the prior abuse? did these people not have ONE person, a sitter, family member to care for little one while at work? surely this situation happened before.

So sorry little Israel....you deserved to be loved and cherished, warm and safe in your bed at 1am.

This is why Dr Laura tells us not to have children till we are married, its usually bfs that are killing the kids (I know plenty of bio fathers and mothers kill the kids too) but usually someone not the kids parent is involved... a picture will come up soon, poor Israel was probobly getting hit by this fuck all the time.

Three-year-old Israel Owens' heart ripped open at the office where his caregiver worked, after the child's chest was struck with a force normally seen in car wrecks, testimony in a Jefferson County court hearing showed today.

A Jefferson County prosecutor contends Marcus Earl Smith committed capital murder Oct. 17 by delivering the fatal blow with his hand or a blunt object.

It was part of a pattern of abuse that left dozens of healing wounds on Israel's body, said the prosecutor, Carl Randall.

"This child was abused for a long time," Randall said in the preliminary hearing for Smith. "The state of Alabama argues this horrible pattern of abuse this poor child endured led him to this day, when he was killed."

But Smith's lawyer, Darryl Bender, argued there was no evidence that Smith ever harmed the child.

Bender said the death could have happened as Smith described: that Israel passed out and hit his head on a tile floor, and Smith tried to resuscitate him through assisted breathing and chest compression.

"He didn't kill this child intentionally," Bender said. "It was an accident from him improperly trying to administer a resuscitative effort."

Israel was with Smith at his overnight job as a data entry clerk at UAB Health Systems because neither Smith nor Israel's mother could get a baby sitter while they worked, testified Mike Allison, a Birmingham police detective.

Smith took the unconscious child to a security station about 2:45 a.m., saying the child had been hurt in a bathroom.

A county medical examiner ruled Israel died from a tear to his heart caused by a blow strong enough to compress the chest against the spine, smashing the heart, Allison testified. The pathologist told Allison he had not seen an injury that severe caused by compression during CPR.

I hope based on the pathologist assessment he won't be getting off to a lesser charge. And there was on going abuse....I want to know IF the mother had a part on this and IF not why she didn't do something about this asshole beating on her baby.

Still haven't found a picture of little Israel, I bet he was precious.

his story of causing the damage to the boys heart during cpr is total shit. even doing cpr correctly is likely to break ribs, which is probably what would happen if you were doing it incorrectly, you wouldn't tear someones heart. damage like that is typically seen in car accidents when someone is forced against the steering wheel, or are injured in a twisting motion, like being t-boned in an intersection, which can rupture the aorta. even if the child did "pass out", why wouldn't he call for help immediately? 3 year olds don't just pass out, lying sack of shit. i'm not sold on the mothers' innocence in this either. if it was a long pattern of abuse as the medical examiner has said, she would have seen something, anything to alert her to it. more likely that she was involved and just didn't care. personally, i believe that, because when she couldn't get a sitter for her son while she worked, she left him with this monster. she should have taken the responsibility for him and called out of work. i hope this bastard (and possibly the mother) both spontaneously combust.

A Jefferson County judge declared a mistrial today in a capital case over a 3-year-old child's death, with the split jury favoring an acquittal, Marcus Earl Smith's defense lawyer said.

No new trial date has been set for Smith in the Oct. 17, 2010, death of Israel Owens, which a county pathologist attributed to child abuse.

Defense lawyers Darryl Bender and Debra Weston-Pickens argued Smith was innocent and Israel died of improperly applied CPR during rescue efforts after the child threw up and passed out.

Israel also had 47 wounds outside his body and internal tearing that all were old enough to have healed and formed scars, testified a county pathologist. The defense said those wounds predated when Smith entered the child's life.

Smith, who has been in jail awaiting trial since his arrest, was tried last week on a capital charge that he intentionally killed a child. The jury also was allowed to consider lesser charges of felony reckless manslaughter and misdemeanor criminally negligent homicide.

After deliberating nearly 15 hours since late last week, the jury told Circuit Judge Teresa Pulliam this morning it was hopelessly deadlocked.

I don't understand. Misdemeanor? Acquittal? What the hell evidence was produced that the jurors apparently believed this guy was mostly innocent of wrong-doing? What we hear is that child died -- in a hospital -- of a torn heart while in this a**hole's care. I'm not buying that it was a fall that did it. We are told Israel suffered prior abuse and plenty of it. So . . . what? The abuse and death blow came from someone else maybe?

I think it was the fact that some of the injuries pre-date when Smith entered the child's life. Reasonable doubt. Mom could have done it.

yeah, if the defense are telling the truth about the wounds predating when Smith entered the child's life (could they really date the injuries from scar tissue?), then the mother could have been abusing the poor child too. But Israel died of a torn heart which killed him ''within three to five minutes'', caused by a severe blow to the chest while in the sole care of Smith.

Even if the mother was responsible for some or all of the prior abuse, she was not responsible for the death-blow. Smith was.

I don't see how. I get with the prior injuries, obviously he was well abused before the incident that killed him but this.....

....this happened at the time he was with Marcus Smith. Not like child would live for days after the incident as his heart was smashed against his spine.
I don't see how he can just be acquitted. Not guilty of prior abuse, fine, but the abuse that killed little Israel, he should have to answer to that I would think.

Who's going to answer to the ongoing abuse?? I'd imagine the mom has some questions to answer.

I couldn't find a picture anywhere of little Israel and fb of Marcus Smith I found can't be sure it's his.

Rest in peace little Israel Owen. Breaks me to know there is not justice for you yet.

I can't find anything on what was presented at the trial. I think it's pretty safe to assume that it was very heavy in the medical stuff. Neither the prosecution nor the defense is going to win a case by just saying what the articles have said.

I did find a journal article titled "Pediatric Injuries From Cardiopulmonary Resuscitation".


STUDY OBJECTIVE:
To assess the type, rate, and severity of unanticipated complications of CPR (external cardiac compressions and ventilation) in a pediatric population.

RESULTS: Two hundred eleven children (mean age, 19.0 months) met the inclusion criteria and were entered into the study. The most common cause of cardiac arrest was sudden infant death syndrome (56%), followed by drowning (8%), congenital heart disease (7%), and pneumonia (4%). Mean duration of CPR was 45 minutes (range, 3 to 180 minutes). Fifteen children (7%) had at least one injury as a result of CPR; 7 (3%) had injuries that were considered medically significant. These included retroperitoneal hemorrhage (n = 2), pneumothorax (n = 1), pulmonary hemorrhage (n = 1), epicardial hematoma (n = 1), and gastric perforation (n = 1); in spite of prolonged resuscitation performed with variable degrees of skill, only one patient was noted to have rib fractures.

CONCLUSION: Significant iatrogenic injuries are rare in children who receive CPR; they occur in approximately 3% of cases. Recognizing the possibility of a complication may help in the management of children who survive cardiac arrest. So we see "bad things" can happen during CPR on a child. Whether or not it happened in this case, I can't say without hearing the evidence.

BUT something happened that Israel needed CPR in the first place. Even if I buy the cause of death was "CPR gone wrong", what happened to Israel that caused him to stop breathing in the first place?


This article from last Friday as the jury deliberated.
Dr. Greg Davis, a Jefferson County pathologist, concluded that Israel's death stemmed from child abuse. A blow or sustained pressure to Israel's chest compressed his heart against his spine, causing a rupture that would kill him within minutes, Davis testified. Bruising to the child's buttocks and along one thigh also indicated he had been beaten.

Israel already had endured child abuse during his short life. Davis found 47 wounds outside Israel's body that were old enough to have healed and formed scabs. Tearing from an internal injury and the premature loss of two front teeth also indicated prior child abuse, Davis testified.

Those wounds were not caused by Smith, Bender argued. Smith had brought stability to Israel's life when he moved Israel and his mother in with him to a house he had inherited, and the defendant was trying to save the child's life that night, Bender said.

Bender told jurors that police and the pathologist rushed to conclude abuse led to Israel's death, due to the older wounds. Improperly applied chest compressions -- administered by Smith and officers at a security station where the defendant took the child -- caused Israel's death, Bender argued.

But prosecutors Ashley Patterson and Kylie Jernigan argued that Smith spanked Israel and inflicted the fatal blow that night because he was mad when the child wet himself. Whether jurors believe Smith's actions were intentional, the result of reckless behavior or of negligence, he should be punished for his role in Israel's death, Patterson told jurors during closing arguments Thursday.

Video surveillance tapes indicate that Israel was dead when Smith carried him from a bathroom near his work space to the security station. Agree. Even if some damage occurred while administering CPR something happened prior for Israel needing it to begin with.
