4-year-old Brooklyn girl weighing only 15 pounds found dead, tied to crib

A 4-year-old Brooklyn girl who weighed only a shocking 15 pounds was found dead this morning, with her arms and legs tied to a crib with twine, The Post has learned.

Cops are now questioning the mother of the severely malnourished little girl, Marchella Pierce, at the 81st Precinct station house in Bedford-Stuyvesant, law enforcement sources said.

The mom, 30-year-old Carlola Pierce, has told police she checked on her daughter at the family's Bedford-Stuyvesant residence at 4 a.m. and she was OK. She checked on her again at 6 a.m. and found her unconscious. She waited until 7:30 a.m. to call authorities, sources said.

When police arrived at the home at 823 Madison St., they saw that the living area was filthy, sources said.
Marchella, in addition to having her limbs tied to the crib, had trauma to her arms, ankles and wrists, sources said. Next to the bed was an oxygen tank, which was not connected to the dead girl's mouth.

Sources also said that Pierce has two other kids -- a 5-year-old son, and a 9-month old son.

Law enforcement sources said that the city Administration for Children's Services had twice previously investigated situations involving the family. Details of those cases were not available.

ACS spokeswoman Laura Postiglione would not confirm the existence of the prior probes of the Pierce family, but said, "We are investigating" the death of Marchella.

Sources said it appeared that Marchella appeared to have been underdeveloped with undeveloped lungs.
"Her legs are like sticks. You can see her ribs," said a law-enforcement source.

"It looks like she starved to death."

Her father, Tyrone Pierce, 30, said he found out about 9 a.m.
"My sister told me that my daughter had passed and I rushed over there," he said. "I tired ot go into the building ot see what was going on. The officers grabbed me and told me I had to come with them."

Pierce said his daughter was born prematurely weighing just 1 pound, 4.6 ounces.
She was released from the hospital only in February and had been in four hospitals since her birth.
"When they released her, they said that she was good," he said.

A neighbor, Tiffany Finney, 27, said the mother loved Marchella. "She couldn't wait to get her back" after her hospital stay, Finney said. "She was excited for her to come home."

I'm confused. If the girl was 4 years old, why are we hearing about her preemie experience? Had she been in the hospital all those years and just came home in February? Did the father never check on her?

Actually 4 yo and 15 lbs....still skin and bones.

The preemie reference because it takes up to 5 yrs. or more for extreme preemies to catch up to avg. weight for their age. My son was a preemie, 5 weeks and he is still pretty low on the scale for an almost 7 yo.

At no point during that childs life after her mother began neglecting/abusing her was she OK. Bound to a crib ffs! Marchella died confused, alone, hurting and unwanted. There is no easy way to put it other than this child was unloved.

Marchella needed special care and lots of love she got neither apparently. At 15 lbs and 4 yo she was dead before her last breath.

Marchella Pierce My heart breaks for you sweet child simply breaks, you had no mother in the true sense.
May the angels kiss and and hold you close whisper you are love.....

Yes, I agree completely. SO many dead beat dads breed them but don't stick around to raise them OR even be part of the childs life in any way.

Times we read so many cases mother is the primary caretaker or she is the ONLY caretaker, I forget to give the POS father the same lashing. There is no excuse for a child to die in this manner and say I didn't know.

How absolutely dead to appearances this POS is. Having the police or ambulance come out and the child still tied to the crib? Did she even try to resuscitate her? And why would she tie the girl to the crib? All four limbs? It sounds more like she was raising a veal than a child. This virus can have no possible excuse for that. . .

A 4-year-old Brooklyn girl who weighed only a shocking 15 pounds was found dead this morning in her mother's bed, The Post has learned
Cops tonight charged Carlotta Pierce -- the mom of the the little dead girl Marchella Pierce -- with drug possession after searching the family's Bed-Stuy home and finding an undisclosed type of narcotics, law enforcement sources said. Police are holding off deciding on any possible charges related to Marchella's death pending an autopsy Friday.
Sources also said that Child Development Support Corporation, which was brought in to work with the family, visited far less than the required 2-3 times per week. CDSC executive director Marcia Rowe-Riddick strongly denied that her agency had failed to comply with requirements for monitoring the Pierce family, and noted that after the agency's contract lapsed in June, ACS had sole responsibility for the family.
The mom, 30-year-old Carlotta, has told police she checked on her daughter at the family's Bedford-Stuyvesant residence at 4 a.m. and she was OK.
She found her unconscious about 6:30 a.m. and began trying to revive her. After about 45 minutes, she called 911.
When police arrived at the home at 823 Madison St., they saw that the living area was filthy, sources said.
While she was found in her mother's bed, there was a smaller bed nearby with rails on it that had twine tied to them at the top and bottom. Marchella had marks on ankels consistent with her being tied up, cops said.
Pierce has two other kids -- a 5-year-old son, and a 9-month old son -- who are now in ACS custody, sources said.
Law enforcement sources said that the city Administration for Children's Services had twice previously investigated situations involving the family. One case stemmed from a positive drug test result on Pierce's youngest son right after his birth last November, and the other stemmed from an incident in which Marchella's tracheal breathing tube came out and she was rushed to the hospital, sources said.
ACS spokeswoman Laura Postiglione would not confirm the existence of the prior probes of the Pierce family, but said, "We are investigating" the death of Marchella.
Sources said it appeared that Marchella appeared to have been underdeveloped with undeveloped lungs.

The only good thing about this is that Pierce was so stupid that it will probably make the prosecutor's job easier. She claimed that she tried to resuscitate Marchella for 90 minutes, yet when police came, the poor child was STILL bound hand and foot to her crib. Even if one were to ignore the fact that Marchella was FIFTEEN POUNDS at age FOUR when she died, the fact that the poor baby was bound to her crib pretty much screams that Pierce made NO EFFORT WHATSOEVER to help Marchella.

I hope that the "proud parent" enjoys "partying" in prison.

The child was not tied to the bed when the cops got there. She was in her mom's bed with ligature marks on her wrists and ankles and twin on the corners of her toddler bed.

I think the child had been tied there when she died and crack head untied her at some point before calling for help because she knew tying the kid to the bed was WRONG.

A Brooklyn woman whose malnourished 4-year-old daughter was found dead in their apartment was slapped with assault charges yesterday after bruises covering the girl's body were found to contradict her claim that the child had suffered them in a fall, police said.

Depending on autopsy results, Carlotta Brett-Pierce, 30, could face stiffer charges in the death of Marchella Pierce -- who weighed just 15 pounds and had rope marks on her ankles when her body was found Thursday.
[...]

She denied any guilt as she was walked in handcuffs out of the 81st Precinct station house yesterday.

"I didn't kill my baby!" she declared, as a crowd of about 15 onlookers jeered her. One shouted: "They should fry you for what you did!"

News of the arrest came as little shock to Brett-Pierce's former neighbors, who had the woman and her mother, Loretta, evicted from the rough-and-tumble Marcy Houses for violent behavior and drug abuse.

"They are both crazy and deranged," said Elizabeth Soto, a resident of the complex. "They were troublemakers . . . They would always open the door and throw things at you. You had to duck."

"All they would do was go out and buy drugs. Crack. You could smell it. They fought with a lot of people," she said. "The way they were living in that apartment, they would open that door and you'd get sick."

Soto and another Marcy resident, Evelyn Rizzo, said neighbors eventually started a petition to have the city Housing Authority boot the mom and daughter.

Carlotta once threatened to "slash" a neighbor's 2-year-old child because of a "clicking radiator," Rizzo said.

Records show Brett-Pierce pleaded guilty to assault after a July 2003 arrest for attacking a fellow bus passenger who intervened when she ignored the driver's request to step behind the white line in the coach.

The Administration for Children's Services launched a probe into the family after Brett-Pierce's son was born last November and tested positive for narcotics.
[...]

Born just 1 pound, 4 ounces, Marchella had spent most of her short life in hospitals. The girl, who had required a tracheal tube to breathe, was released from the hospital in February.

ACS has placed Brett-Pierce's two sons in foster care.

Yet the cause of her death was a mystery, and police were unsure if they were investigating a horrific case of child neglect or the tragic death of a sickly child who spent most of her life in the hospital.

Cops were questioning the girl's mother, Carlotta Pierce, 30, her father, Tyrone Pierce, 30, and her grandmother, Loretta Brett.
[...]

"My wife is a wonderful mother. I've never seen her hurt her kids," said Tyrone Pierce, who is separated.

He said Marchella was born prematurely at barely more than a pound. Her lungs were underdeveloped and she was in hospitals from birth until this February.

Doctors gave her a tracheotomy, making a hole in her neck so she could breathe with a tube.

Her father said a plastic insert for the hole was too small, causing problems, and that Marchella only recently began eating solid food through her mouth.
[...]

Tyrone Pierce said he knew nothing about his daughter being restrained.

"Maybe it was to hold the bed together," he said. (about the twine on the bed???)

A malevolent mom lashed her 18-pound daughter to a bed after the morbidly malnourished girl made a mess while grabbing a midnight snack, authorities said Saturday.

Carlotta Pierce, after tying down the frail 4-year-old, force-fed her sleeping pills to halt her "wild" behavior - raiding the family fridge, said Brooklyn prosecutor Tracey Downing.

"The mother tied up the child because she would get up in the night and eat food ... and make a mess," Downing said at a hearing.

A witness told police that Pierce had battered tiny Marchella Pierce with a belt and a plastic video case, drawing blood from the helpless girl, according to a criminal complaint.

On Sept. 1, the day before the little girl's death, Pierce grew angry with Marchella and tied her down on the bed over the late-night snacks.

The witness told police that Pierce "repeatedly beat the child" - and a bloody video box was found in the garbage at the apartment.

New York City authorities have filed charges against the mother of a 4-year-old girl who weighed 15 pounds when she was found dead in her family's Brooklyn apartment.

Detectives found lengths of twine attached to the headboard of a bed inside the home, and the rope was consistent with bruises on Marchella Pierce's ankles, suggesting the little girl might have been tied to the bed, The New York Times and local media reported.

Police were called to Marchella's mother's apartment on Madison Street in the Bushwick neighborhood at about 7:15 a.m. Thursday to investigate a report of an unresponsive child. Officers arrived to find tiny, malnourished Marchella unconscious on a bed. She was pronounced dead at the scene.

Authorities have charged Carlotta Brett-Pierce, 30, with assault, endangering the welfare of a child and drug possession. Brett-Pierce allegedly told police she had discovered her daughter at 6:30 a.m. and attempted to resuscitate her. Why she waited nearly an hour to call 911 remains unclear.

Before Brett-Pierce's arrest, Marchella's father, Tyrone Pierce, told the New York Daily News that his estranged wife is a "wonderful mother."

"I've never seen her hurt her kids," he said.

Brett-Pierce has two other children, ages 6 years and 9 months. A MySpace page in her name describes her as a "proud parent."

Pierce told the newspaper that his daughter had been born with underdeveloped lungs. Doctors inserted a tube in her trachea to help her breathe. She had been in hospitals for much of her life, the father said.

When asked about the twine that was allegedly found on the headboard, Pierce said he had never witnessed his daughter being restrained. "Maybe it was to hold the bed together," he said.

According to the New York Post, Brett-Pierce has been the subject of two probes by the Administration for Children's Services, and a private child development company had been hired by ACS to work with the family.

Alas, it appears the Dad and several others are still stuck in denial mode that this bitch did what she did to her own daughter. It's not unusual for parents to abuse one child while the rest are healthy and cared for.
Wake up dad and defenders, this little girl's own stupid grandmother saw some of the abuse, and there is NO way to explain away all the injuries this little girl receivied in her short tortured life than to admit, that yes, Carlotta is a evil monster.

Two Brooklyn ACS workers assigned to visit a severely malnourished 4-year-old were suspended without pay for not properly monitoring the child before she died, according to an agency statement.

Officials at the city's Administration for Children's Services found that a supervisor and another worker failed to make the minimum number of visits to Marchella Pierce - who weighed just 18 pounds when she died on Sept. 2, the statement said.

The workers were let go after a probe that began when the case files for the Bedford-Stuyvesant family were found empty.

e death of an emaciated 4-year-old Brooklyn girl found dead in her home last month has been ruled a homicide.

The city medical examiner’s office said Friday that Marchella Pierce died of acute drug poisoning, blunt impact injuries, malnutrition and dehydration. They said she had antihistamines, including Benadryl, in her system.

Her mother, Carlotta Brett-Pierce, has been charged with assault, endangering the welfare of a child and drug possession. Prosecutors say additional charges could be added.
[...]

The Administration for Children’s Services, subcontractors and others responsible for monitoring the girl are under criminal investigation. ACS has said it’s cooperating.
http://newyork.cbslocal.com/2010/10/29/m-e-rules-brooklyn-girls-death-a-homicide/

The drugs found in her body were diphenhydramine and desloratadine, said Ellen Borakove, a spokeswoman for the medical examiner’s office. Each drug is marketed under many names, including Benadryl for diphenhydramine and Clarinex for desloratadine. The term child abuse syndrome means that the abuse occurred over a period of time and was not a one-time occurrence, Ms. Borakove said.

Investigators have been awaiting the findings since the police found the girl dead in her mother’s apartment on Sept. 2. The mother, Carlotta Brett-Pierce, is facing charges that include second-degree assault, endangering the welfare of a child, unlawful imprisonment and reckless endangerment. Those charges are likely to be elevated sharply based on the medical examiner’s findings.http://www.nytimes.com/2010/10/30/nyregion/30girl.html

The mother of a frail 4-year-old Brooklyn girl who died of starvation and repeated beatings was charged with murder yesterday.

Carlotta Brett-Pierce, 30, already behind bars on assault charges in the case, now faces 25 years to life in prison in the death of her daughter Marchella, whose lifeless body was discovered on Sept. 2.

The new charge was expected after the city Medical Examiner ruled Pierce's death a homicide last month, but the indictment announced by Brooklyn District Attorney Charles J. Hynes spells out the extent of her drug addicted mother's alleged cruelty.

"Between July 12 and Sept. 2, 2010, Brett-Pierce tied Marchella to her bed, battered her with household items, deprived her of food and water and force-fed her over-the-counter medications, including Claritin (a cold medicine) and Diphenaydramine (an anti-histamine)," the indictment reads.

Marchella, who weighed just 18 pounds when she died and suffered from a variety of ailments from birth, died of "child abuse syndrome with acute drug poisoning, blunt impact injuries, malnutrition and dehydration," according to the indictment.

Good, and I hope she never sees the outside of a prison ever in her dirty life. What she has done is the most horrific way to kill a child. The hunger pains alone are unbearable. This bitch will never be remorseful. She is the Devil's turd. She needs to be banished from this earth by starvation, and nothing else.

Carlotta Brett-Pierce, 30, got a dressing down from the judge after the prosecution revealed Brett-Pierce violated a court order by sending letters to her surviving children, one of whom is a witness in the case.

Brett-Pierce told Brooklyn Supreme Court Justice Patricia DiMango she sent the letters to her kids – ages 1 and 5 – to “tell them I love them.”

DiMango was unimpressed.

If you violate that order of protection from today forward I will deal with it more harshly than you can think,” DiMango said.

An indictment charges Brett-Pierce killed Marchella last September and lists the cause of death as "child abuse syndrome with acute drug poisoning, blunt impact injuries, malnutrition and dehydration."

Brett-Pierce, whined that she hadn’t seen her other children in the five months she’s been held without bail.

“I’m starving for this trial to start,” she said, asking DiMango to impanel a jury immediately. “I did not hurt my baby. I did not kill my baby.”
[...]

Meanwhile, prosecutors said that a video cassette box and spatters on the wall tested positive for Marchella’s blood, but samples from a belt and buckle used to beat the child have not been analyzed yet.

Authorities said an Administration for Children's Services case worker failed to visit the Bedford-Stuyvesant home where 4-year-old Marchella Brett-Pierce was found dead in September.

The worker, Damon Adams, was also accused of falsifying records after the girl died weighing just 18 pounds. Adams' direct supervisor, Chereece Bell, was charged for not monitoring his work on the case.

The ACS workers both resigned a month after the girl's death. They each face criminally negligent homicide charges and were expected to be arraigned late Wednesday.

The Brooklyn District Attorney's Office also announced Wednesday that the girl's grandmother, Loretta Brett, has been indicted for second-degree manslaughter for sleeping in the same room as the child "night after night as she lay tied in her bed with no food."

Ex-social worker charged with letting abused child Marchella Brett-Pierce die argues homicide charge

A former social worker charged with letting an abused child die under his supervision says the "repulsive" homicide case against him should be tossed.
The lawyer for Administration of Children's Services caseworker Damon Adams, 36, told a Brooklyn judge Wednesday that prosecutors failed to show evidence for a criminally negligent homicide charge.
After Marchella Brett-Pierce, 4, died last September of severe child abuse, her mother was charged with murder. Prosecutors later indicted Adams and his ACS supervisor for allegedly failing to watch over the family.
Adams' new lawyer, Anthony Grandinette, called the prosecution "repulsive" and "preposterous," and said there's no evidence the caseworker could have seen any injuries to the child.
He claimed the mother was never suspected of any mistreatment and came under ACS scrutiny only because she tested positive for marijuana.
Assistant District Attorney Jacqueline Kagan agreed to deliver five boxes with the "abnormally voluminous" medical history of Marchella, who had birth defects and spent most of her short life in hospitals.
Prosecutors contend Adams should have noticed the child's injuries and malnourishment and that he changed records after her death to make it seem like he visited her family.

I am surprised no one said this.
She waited 90 minutes to call 911 because she needed to untie Marchella, and hide her fucking drugs.
And the grandmother knew and did nothing. Fucking cow. I'm gald they are charging her too.
And the fucking social worker. I swear. They don't take the kids away from the people they should and they cause a lot of problems for the ones that do their best to be parents. I have seen it time and time again. They can't do their jobs correctly because they are ignorant, lazy ass frucking pieces of shit who are only in it for a paycheck.
Man, I don't have a college degree, but If I had a job like that, I would be damn sure I would check every one of these cases thoroughly. No stone unturned. I would have to have an officer with me though so I don't start pounding on Bitches when I find out they are abusing, starving, neglecting their children.

The ne’er-do-well father of Marchella Brett-Pierce – the Brooklyn child whose death sparked the indictment of her mother, grandmother and two ACS workers – is looking to cash in on his daughter’s demise, filing a claim against the city for $150 million.

Tyrone Pierce wants Marchella’s estate – of which he is the proposed administrator – to receive $100 million from the city for her bodily injury and demands another $50 million for himself “by reason of the loss of services of his daughter,” according to the notice of claim.

Pierce, who has a lengthy arrest record to complement his six-year prison stretch for robbery, filed a notice of claim in June, but needed permission from the Brooklyn Supreme Court to file a late notice of claim, according to recently published court documents.

Pierce is a potential prosecution witness despite the assertion from sources that he saw Marchella three times a week before her death.

He is also trying to gain custody of the two other children who were placed in foster care after Brett-Pierce was arrested.http://www.nypost.com/p/news/local/brooklyn/father_for_klyn_girl_whose_death_LGw7ZP8R6bo1FPzMF o65YI

The Brooklyn woman charged with beating and starving her emaciated daughter admitted to cops that she tied the girl to the bedpost because the child was “wilding out,” according to testimony yesterday.

At a hearing before the murder trial of Loretta Brett-Pierce in the death of her 4-year-old daughter, Marchella, Detective Matthew Lamendola testified that the mother told him she had tethered the 18-pound girl several times.

“Her words were, ‘She was acting crazy and her little ass was wilding out,’ ” Lamendola told Brooklyn Supreme Court Justice Patricia DiMango.

Lamendola also said he listened in on an interview of Brett-Pierce’s 5-year-old son, Tymel, who told another detective that his mother beat Marchella with a belt and stuffed her full of pills.http://www.nypost.com/p/news/local/brooklyn/slain_toddler_was_wilding_EtE8s9FEtoueMeNvy8ozwL#i xzz1imh5nX39

That little girl was just a check to her mother, and now she's just a source of cash to her father. His case should be thrown out of court, and he should NOT get custody of his two surviving children. It's obvious that he didn't give enough of a crap about Marchella to notice that she was way too light and thin for her age. And if he claims it was because of Marchella's health problems, well, that's just a big stinking pile of cow cookies, because if she had been seeing a doctor on the regular, her weight would be managed, probably by a nutritionist, and she would be getting nutrient-rich shakes or possibly even tube feedings.

Neither of these parents cared about Marchella--all they cared about is what they could get out of her. If her father actually cared enough about her to justify the kind of award he's asking the court for, Marchella wouldn't be dead right now.

A 6-year-old boy called to testify Thursday against his mother and grandmother in the trial over his sister’s starvation death told jurors he didn’t see anyone mistreat the 4-year-old girl.

During an emotional day of testimony in the Marchella Pierce trial, prosecutors called her brother Tymel Pierce as a key witness expected to describe abuse he saw in the months before her death. Marchella’s emaciated and battered body was found on Sept. 2, 2010, inside an apartment in Bedford-Stuyvesant, Brooklyn.

Prosecutors have charged Carlotta Brett-Pierce, 31 years old, with murder and the girl’s grandmother Loretta Brett, 57, with manslaughter in Marchella’s death. The two are being tried at the same time before two separate juries in Brooklyn State Supreme Court.

Dressed in a black vest and a tie, Tymel testified for a little over 30 minutes over a closed-circuit, two-way video feed from a nearby room in the courthouse, a measure taken so he wouldn’t have to face his mother. Prosecutors and defense attorneys were in the room with Tymel, while the judge, jury and defendants remained in the courtroom.

The boy had previously told investigators that he saw his mother beat Marchella with a belt, force-feed her pills, according to prosecutors. He had also told investigators that his grandmother had tied Marchella to a bed.

On the witness stand, however, Tymel didn’t recall any of those details.

Both Brett-Pierce and Brett shed tears during the testimony as prosecutors showed Tymel crime-scene photos of Marchella’s bed and his mother’s skull-faced belt.
[...]

The grandmother’s attorney, Julie Clark, briefly cross-examined Tymel in hopes of proving her argument that prosecutors are placing blame on the grandmother instead of the father, when care for the children was responsibility of the parents.

“The government has been trying to portray that the father did not live in the house. And clearly this father was an involved parent,” Clark said. “He clearly, from the words of his own son, was living in that house.”

The mother’s attorney, Alan Stutman, said he came prepared to cross-examine Tymel but declined to do so. “I think the testimony speaks for itself,” he said. Stutman has argued that Marchella’s death was caused by incompetence instead of cruelty.http://blogs.wsj.com/metropolis/2012/04/19/marchella-pierce-trial-6-year-old-testifies-in-sisters-murder-trial/

Tymel Pierce didn't give Brooklyn prosecutors much to work with as he testified in Carlotta Brett-Pierce's horrific murder trial, saying he never saw his little sister bound with a jump-rope to her SpongeBob bed.

"No," he answered as prosecutor Perry Cerrato gently asked him if his mom tied her to the bed.

The 6-year-old boy, who is set to turn seven on Monday and wore a tie and vest for his turn as a witness, referred to his mother as "my old mommy" but said he saw none of the sickening acts she's accused of committing against little Marchella Brett-Pierce.
[...]

On the day of her death, Tymel said he awoke to "detectives, cops and somebody else" in the family's Bedford-Stuyvesant apartment and an explanation from his mom on what happened to his sister, who he called "Chella."

"When I woke, my mom said she fell down the stairs," he said.

He said his mom would get "angry" when his sister would wet her bed, but said he never saw her lay a hand on the girl.

"What about if Chella got in trouble, would anything happen with that belt?" Cerrato asked the boy, as he held up a photo of his mom's skull belt.

"No," Tymel said, adding that he only saw the belt being worn around his mom's waist.

Prosecutors had said Tymel would provide key information "that no one else can offer," but the little boy fell back on "I don't know" or "no" as an answer to many of the questions he faced.

The boy testified in another room of Brooklyn Supreme court. Questions and his dramatic answers were shown to jurors on three screens.

When Tymel was seated, he pointed at the camera and said: "What's that, people are looking at me?"

Jurors this week were shown pictures of Marchella's stick-thin body, with all of her ribs visible and bruises all over her back and face.
[...]

Tymel said he was allowed to go into the fridge whenever he wanted, but said he never saw his sister go in there. The little boy said his mom would feed him chicken and rice, and that his dad would take him to McDonald's for Chicken McNuggets with sweet and sour sauce.

But it was a different story for his little sister.

"Did anyone ever feed Chella?" Cerrato asked.

"Nope," he said.

"Did she ever eat?" Cerrato asked again.

"Nope," Tymel responded.

Every rib visible and tied to her SpongeBob SquarePants bed with a jump rope: Jury hears how 18lb girl, 4, 'was starved, beaten and drugged to death by her mother'

A four-year-old girl who weighed just 18lbs when authorities found her starved, beaten and drugged body tied to a bed was so emaciated that every rib was visible, a jury has heard.
Marchella Brett Pierce was tied to her SpongeBob SquarePants bed with a skipping rope when she died in September 2010, prosecutors in the case against her mother and grandmother said.
Her dehydrated, starved body contained just a single kernel of corn when she died, they added.
The girl's mother, Carlotta Brett Pierce, is on trial in Brooklyn, New York for her murder, while her grandmother, Loretta Brett, has been charged with manslaughter for failing to prevent the death.
Prosecutors recounted the grim details of the heartbreaking case that could also have been prevented by childcare workers, police have said.
The jury was shown photos of the girl, who weighed just 18.8lbs on her death - nearly half the weight of an average four-year-old - in which every rib could be seen, the New York Daily News reported.
Images projected on a screen in the court room also showed open wounds on her limbs from where she had been restrained, as well as bruises seemingly caused by a blunt force.
Restraining items, including brown twine, string and jumping ropes, were found tied to the bed. The filthy apartment was strewn with plastic bags, empty alcohol bottles and trash.
Empty containers of Claritin and Benadryl were in bins; prosecutors said the girl had up to 60 adult doses of Claritin and 30 doses of Benadryl in her system when she was found.

NEW YORK (CBSNewYork/AP)
– The 6-year-old brother of a New York City girl found drugged, beaten and starved testified Thursday in the murder case against their mother, saying that his little sister was rarely fed and was tied to the bed before her death.
Tymel Pierce spoke from a closed-circuit TV in another part of the Brooklyn court as his mother and jurors watched. He could not see them. Wearing a crisp white shirt with a vest and tie, Tymel sat with wide eyes, often sucking his fingers while answering prosecutors with short, soft-spoken sentences.

With his testimony, prosecutors were trying to show that the girl was singled out for abuse while her siblings were cared for. Tymel also testified that he saw his mother give adult sleeping pills to Marchella. One of the toughest moments in the courtroom was when the prosecutor asked the boy about life now, with his “new mommy,” as he called her, referring to the boy’s foster mother, versus life before with the woman he called his “old mommy,” Guzman reported.

I know I'm way behind on reading this since you posted this a long time ago but wanted to reply.

I know if your spouse is killed you can sue for loss of service which means things like mowing the lawn, fixing the car, doing repairs ect. Basically it means that since that person is no longer there to provide those services you can sue for the money you now have to pay for those things because had they not been killed you would not have incurred those expenses. I have no idea what services a child could provide to a father though that would warrent such a suit.

I wonder why he didn't sue for emotional distress.

A Brooklyn jury needed all of one hour today to convict a mouthy monster mom of beating, starving and drugging her 4-year-old daughter, Marchella, to death.

Carlotta Brett-Pierce showed no reaction as she was pronounced guilty, then popped off as a judge ordered her to have no contact with her two surviving kids.

"I've been charged falsely," Brett-Pierce whined, as she was led out in handcuffs.

Asked by Justice Patricia DiMango if she understood the order, Brett-Pierce remained petulant.

"I heard what you said," she said.

The 32-year-old mom was quickly convicted after prosecutor Jacqueline Kagan made an impassioned plea to jurors to make her pay for Marchella's September 2010 death.

"We are satisfied with the verdict," Kagan said after the verdict was announced. "We are gratified that Marchella got some justice."
[...]

The four-week trial featured graphic photos of the little girl's naked, skin-and-bones corpse - which Kagan contrasted with photos of her looking robust and happy when she left an upstate clinic at nearly 30 pounds months before she died.

Jurors also heard tapes of jailhouse phonecalls in which the monster mom spewed filth about her dead daughter, calling her "that bitch."

"The words she chose to describe her show her disregard for her child's life," Kagan said during her closing.

She was acting crazy and her little ass was wilding out

I'd hoped by now the bitch would be crying and feeling remorse (I know, I'm hopeless), that she would be punishing herself more than death itself would punish a mother who murdered her own baby. Alas, she is making excuses and speaking this way about her?

I can't articulate what I'm trying to say. I can't believe this woman.

She’s truly a monster.

The Brooklyn mom who beat, drugged and starved to death her defenseless little daughter blamed everyone but herself yesterday as she was sentenced to 32 years to life in prison — and it emerged that the tragic girl’s 5-year-old brother, heartbreakingly brought food to her funeral so she could be “fed” in heaven.

Carlotta Brett-Pierce brazenly shirked responsibility for the death of her 4-year-old girl, Marchella, who weighed just 18.9 pounds and had a single kernel of corn in her stomach when she died, portraying herself as a “loving and caring mother” overcome by poverty and a lack of smarts.

“I do not accept responsibility for the actual death of my daughter, because in fact, I did not kill her,” Brett-Pierce said defiantly, blaming jurors, the press and her own lawyers for her predicament. “This is a tragedy.”

Brooklyn Supreme Court Justice Patricia DiMango disgustedly trashed the monster mom as a “self-centered, volatile and belligerent woman” whose guilt was so overwhelming that a jury needed only 90 minutes last month to convict her of murder.

“What kind of person could do this to a child, let alone her own child?” thundered DiMango, who also sentenced grandma Loretta Brett to five to 15 years in prison for manslaughter in the death.

“Food, water and basic human parenting would have kept her alive,” DiMango said.

But “neglect and apathy” at the hands of her loved ones doomed Marchella — who was a 26-pound “flourishing little girl” when she left an upstate clinic months before her death to go live with her mom in Bedford-Stuyvesant.

Once there, the sickly child was force-fed cold and allergy pills and battered, often in front of her brother, Tymel.

Prosecutor Jacqueline Kagan also revealed that a now 7-year-old Tymel was deeply traumatized at having to testify against his mom and continues grieving for his little sister.

“He witnessed her conduct atrocious, despicable behavior toward his sister, who he loved,” Kagan said.

The prosecutor said the boy sweetly tried to help the little girl even as she was being laid to rest.

“He brought with him food because he knew she didn’t get enough,” Kagan said. “And he told his foster mother, ‘I hope that she gets enough food and water in heaven.’ ”

DiMango spared no venom in reminding Brett-Pierce, 32, of the horror she unleashed on her own flesh and blood.

“This child, at her tender age, was subjected to a hell that no one should have to endure,” DiMango said. Yet, her murderous mom refused to drop the bravado, showing up in court in a suede miniskirt to beg for mercy.

“By no means am I a malicious or a vicious person,” she insisted.

“I’m not perfect,” Brett-Pierce whined, saying she lacked the education and money to “care for such a sickly baby.”

Cry me a river. There are plenty of parents below the poverty level who are functionally illiterate and STILL manage to do right by their kids with special needs. While they may lack money and education, they do not lack common sense, and they actually LOVE their children enough to fight for them and put their pride in the pockets and ask for help if their children are "sickly."

NO EXCUSE. NO SYMPATHY.

“He brought with him food because he knew she didn’t get enough,” Kagan said. “And he told his foster mother, ‘I hope that she gets enough food and water in heaven.’ ”

It sounds like there may be some hope that Marchella's brother will grow up to be a good, compassionate man. Here's hoping that his foster parents are able to nurture that goodness and compassion in him for the rest of his life.

The woman convicted of beating and starving her bedridden 4-year-old daughter to death was sentenced to 32 years in prison last week, but Carlotta Brett-Pierce still claims that she is a doting mom.

“I want people to see I’m a loving and caring mother of three,” Brett-Pierce told a judge right before she was sentenced. “By no means am I a malicious or vindictive person.”

It took a jury about an hour to convict Brett-Pierce for the death of her child Marchella.
