CALGARY — Calgary police have charged a young woman with murder in the death of her infant son.
Daniel Herchak was just 26 days old when he died Aug. 9 after being admitted to Alberta Children's Hospital.

An autopsy revealed the cause of death to be blunt force trauma to the head.
Because of the nature of his injuries, hospital staff contacted the police child abuse unit, which then contacted the homicide unit.

Daniel Herchak was 26 days old when he died 10 hours after being rushed by paramedics to the Alberta Children's Hospital on Aug. 9.

The baby was killed by blunt-force trauma to the head, which an autopsy indicated was not accidental, police said.

Homicide detectives arrested Herchak on Tuesday afternoon and police announced the murder charge Wednesday.

"We believe the injuries were caused by one or more impacts with a solid object, or against a solid object," said Acting Insp. Doug Andrus.

I want her locked in a jail cell for the rest of her life. I want there to be a happy mother with her beautiful baby, similar in age to Daniel, to walk by and spend a few minutes before her with that child every day. OOOOH you have a 12 day old? Is she your first? How cool... and exhausting! Congrats. Besides being exhausted when my son was 26 days old, I was so in love with him, kinda hypnotized in a way. The idea of hurting him never entered my head. God they're so tiny. And I was wondering about the baby too, the arm looks skinny and hairy which could mean he was a preemie, so he may have been fussy.

When my babies were a few days old their arms looked like that too, they filled out after a week though.

Why was she at a night club drinking? She is 18..... On top of it, if I had a newborn, I wouldn't leave it with anyone when that young. Especially if it was in fact a preemie.

Judge Paul Mason determined Thursday, following a four-day preliminary hearing at provincial court, that there was sufficient evidence to commit Shelby Anna Herchak to face trial on Thursday after Crown prosecutor Julie Morgan called her final witnesses.

Among the witnesses called in the hearing were Herchak’s parents, with whom she lived at the time.

Herchak was arrested shortly after her baby was rushed to Alberta Children’s Hospital from the family’s Lakeview home in the city’s southwest. He died later the same day.

An autopsy determined the cause of death was blunt-force trauma to the head. The baby’s father, whom police said at the time was estranged from Herchak, was not a suspect.

Herchak was previously granted bail, but it was rescinded by her parents after she was charged with seven counts of breaching conditions of release — mostly for not abiding by a curfew.

“I am satisfied that you should be committed on the charge of second-degree murder,” Judge Paul Mason told a crying Herchak.

The bleary-eyed accused was then returned to cells wiping tears from her eyes as she left court, pending her next appearance on Jan. 13, when it’s expected a trial date will be set.

At Ross’ request, Mason imposed a publication ban on the evidence called by Morgan during the preliminary hearing.

While she is charged with murder, Herchak has also undergone psychiatric testing to determine if she qualifies for a finding of guilty of infanticide.

Results of the testing, which was requested by the Crown, have not been made public.

If convicted of infanticide instead of murder, Herchak would be facing a much less severe sentence.
