Albany, Ga--A 3-year-old South Albany boy originally thought to have drowned in the bath tub Friday morning...didn't drown at all. Now police are saying that the young victim, Shondarius Roney, was murdered...the suspect in the case is the boyfriend of the victim's mother.

Vincent Soilberry was the person who made the 9-1-1 phone call on Friday stating that the child had drowned...But the autopsy does not back up that claim and now police are treating this case a homicide.

This all began Friday morning when police and EMS units were called out to a home at 2216 South Jackson Street. It was here where 18-year-old Vincent Soilberry was caring for the son of his girlfriend, Shaquita Bell who was not home at the time.

Police say the 3-year-old was found unresponsive and pronounced dead 30 minutes after paramedics rushed the child to the hospital. Soilberry was arrested and jailed on Friday for a previous trespassing warrant. Autopsy results proved that the child did not drown and police reports indicate that the victim had bruises on his chin, thigh, stomach, and behind his ear.

Soilberry has not been charged in the case, he is only being named a suspect at this time. He remains in the Dougherty County Jail without bond.

So far, no warrants have been issued for anyone's arrest in this case.

ALBANY — The District Attorney’s office filed new charges Monday against the man accused of beating to death a 3-year-old boy over the weekend, who they say beat the child so badly that his liver was ruptured.

Warrants were taken Monday for Vincent Soilberry, 18, the boyfriend of Shondarius Roney’s mother, for felony murder, first degree cruelty to a child, aggravated battery and aggravated assault.

According to the warrants, Soilberry “did cause serious bodily injury by causing rib fractures and a ruptured liver” to Roney at a home on the 2200 block of South Jackson Street around 10 a.m. Friday. Soilberry was arrested on an unrelated criminal trespassing warrant late Friday.

Monday’s warrants state that Soilberry hit the child with a closed fist, causing “cruel and excessive physical pain,” and his eventual death.

Chief Assistant District Attorney Greg Edwards declined to say Monday the specific cause of death for the child, but generically categorized it as “death by bodily injury.”

Edwards didn’t reveal many of the details of the killing because he said he wanted to safeguard the information until it could go before a grand jury and eventually to trial.

“We must preserve the matter until it goes before the appropriate tribunal,” he said.

Edwards did confirm that Roney was under Soilberry’s care when the abuse occurred, but would not say whether there was a pattern of abuse against the child.

Initial police reports indicate that Soilberry called the incident in as a potential drowning. Soilberry told police that he was giving Roney a bath when he had to clean up a mess in another part of the apartment and when he returned, he found the child struggling for breath.

Emergency medical workers took Roney to Phoebe Putney Memorial Hospital, where he later died. The child had bruises all over his body, the report indicates.

Soilberry was being held only on the criminal trespassing charge Monday evening, a jailer said.

Evidence in the murder of a three year old Albany boy will be presented to a grand jury this week. Shondarius Roney was beaten to death in his South Albany home three weeks ago. His mother's boyfriend, 18 year old Vincent Soilberry is accused of killing him. Prosecutors have subpoenaed WALB-TV's uncut interview with the child's mother, Shaquita Bell. WALB-TV does not typically grant public access to raw video; however, in this case, the DA's office already has access to Shaquita Bell and there's nothing in our interview that they couldn't get themselves. Therefore, we determined that providing them with our video would not compromise our journalistic rights. It took jurors about 20 minutes Thursday to find 19-year-old Vincent Soilberry guilty of malice murder, felony murder, cruelty to children, aggravated assault and aggravated battery.

Prosecutors said Shondarious Roney died in May 2008. Testimony records showed the boy was severely beaten and suffered internal injuries.

A judge ordered Soilberry to serve life in prison plus 40 years.
