Officials Investigate Possible Homicide Southeast Of Tyler

The Smith County Sheriff’s Office is investigating what officials are calling a homicide after a woman’s body was found on a rural road southeast of the Tyler city limits on Saturday.
Authorities said a passing motorist saw the body of a black woman on County Road 2191, also known as Oscar Burkett Road, and called 911 shortly after 3 p.m.
Lt. Tony Dana said the Sheriff’s Office is treating the case a homicide because of “the condition of the body” and evidence at the scene.
Investigators have yet to release any details about the cause of the woman’s death pending the results of an autopsy in Dallas that was ordered Saturday night.

The woman’s body was found at a location on County Road 2191 where a dirt trail splits from the roadway. Authorities said the location often is used by nearby residents as a dumping site for trash and brush.
Investigators are unsure whether the woman was killed at that location or brought there afterward. Her body is believed to have been at that location for no more than 24hours.

The Sheriff’s Office is searching through missing persons reports filed through its office as well as those in the Tyler Police Department and other law enforcement agencies throughout East Texas.

Cherry Diane Walker, 29, has been described by people who knew her as an "exceptionally nice young woman," said Smith County Sheriff J.B. Smith.
Authorities said a passing motorist saw the body of a black woman on County Road 2191, also known as Oscar Burkett Road, and called 911 shortly after 3 p.m. Saturday.

Investigators are not releasing any details on how she was killed or why she was killed. Walker's family saw the description of the missing woman on television Sunday night. They then called authorities to let them know their daughter was missing. Authorities said it took until today to identify her because they were waiting on medical records. They believe the murder was not random.
Sheriff J.B. Smith says the murder of Cherry Walker is a surprise.

Parents worst fears confirmed with the loss of their daughter

TYLER, TX (KLTV) - At Greater Love Temple Church, Pastor Gethry Walker delivers a spirited sermon with an unexpected eulogy. "Praise God, she's with the angels, she's with the Lord."

The reassuring words were for Walker's daughter, Cherry, who until last week was a front pew favorite.

"We have to swallow the bitter cup and all things work together for the good," said Gethry Walker.

But the good is yet to be seen in what appears to be foul play in the death of his daughter, whose disappearance began with a description.

"We knew her size and her age and it seemed like that was might be, could be, can't be..." said Cherry's step-mother Rueon.

The family's fears deepened the following morning when Cherry missed church. A phone call to authorities and 4 days later, Cherry was identified. The news even tougher with Cherry's recent progress with a learning disability.

"She was on the road to really being able to live like she wanted to live normally," said Rueon.

A new apartment, a past job at Opportunities in Tyler and the hope of a driver's license helped Cherry towards her goal until last Saturday. Few clues were left near her body, but in knowing their daughter Cherry's parent's believe they know the person responsible.

"I think it was somebody who knew Cherry and Cherry knew them and she got in the car with them," said Gethry, "She wouldn't have gone with a stranger, no she wouldn't have gone with a stranger. The Bible says blessed are the dead that die in the Lord so it was a blessing for Cherry to die in the Lord."

How sad a young woman with mental disabilities is finally learning to live on her own and have a "normal" life and someone takes advantage of it and snuffs her life out.

Kimberly Cargill trial moved back to May 7

The capital murder trial for the 45-year-old Whitehouse woman, scheduled to begin March 26, was moved back to May 7 during a pretrial hearing this morning.

Kimberly Cargill is accused of killing Cherry Walker, the mentally challenged babysitter of her 4-year-old son and setting her body on fire in June 2010. Ms. Walker, 29, had been scheduled to testify in a child-removal hearing in which state officials were to present police reports containing child abuse allegations against Ms. Cargill.

The defendant has a history of psychological problems, according to information provided by a court-ordered psychological evaluation, including "a tumultuous history of relationships with friends, family and co-workers."

This morning in court, defense attorneys said they had just received 1,400 pages of Cargill's medical records which needed to be reviewed. The request for more time was granted with the delay to May 7.

The Smith County District Attorney's Office is seeking the death penalty if Ms. Cargill is convicted of capital murder.

East Texas woman faces possible death sentence after conviction for baby sitter's murder

TYLER, Texas — An East Texas woman faces a possible death sentence after being convicted of capital murder for killing her mentally challenged baby sitter.

Kimberly Cargill of Whitehouse was convicted on Friday after several hours of deliberations by a jury in Tyler. The punishment phase of the trial was set to begin Monday.

The Tyler Morning Telegraph reports (http://bit.ly/KhVkfs) prosecutors told jurors that Cargill killed Cherry Walker in 2010 to keep the baby sitter from testifying against her in a child custody hearing regarding Cargill's 4-year-old son.

The 45-year-old Cargill testified in her defense, telling jurors she panicked after Walker died from a seizure and she dumped her body and set it on fire.

An East Texas mother now awaits her execution date for capital murder.

Thursday night, a jury recommended 45-year old Kimberly Cargill be sentenced to death by lethal injection. On May 18, Cargill was convicted of the 2010 murder of her mentally challenged babysitter, Cherry Walker. Prosecutors say Cargill dumped Walker's body and set it on fire because Walker was scheduled to testify in Cargill's child custody hearing.

Kimberly Cargill knows her fate. The verdict was something Cargill and her attorneys didn't want to hear, but said they wouldn't criticize either.

"A lot of decisions she has made for the last two decades have been fueled by her personality disorder. We're not trying to excuse anything she's done for the last 20 years, just put it in context," said one of Cargill's defense attorneys, Brett Harrison. Kimberly Cargill was also represented by Jeff Haas.

Throughout the trial, jurors heard Cargill's family testify to heartbreaking stories of abuse. Three of Cargill's four sons testified that Cargill would frequently choke, kick and hit them. They told jurors they often feared for their lives. Her sons testified that Cargill had the locks changed on their bedroom doors so she could lock them inside.

Cargill's ex-husbands also took the stand. A couple of those ex's told the jury Cargill would have them wrongly arrested by making up stories of assault. One of Cargill's ex-husbands testified that, though she never admitted to it, Cargill set his apartment on fire.

Cargill's sister testified that Cargill was clever and manipulative. She told jurors Cargill was, "the devil." But, when Cargill's sentence came down, Cargill's sister closed her eyes.

Cargill's mother testified that Cargill sometimes lost her temper and liked things to be her way. Cargill's mother said she once heard that Cargill wanted to kill her. Though, despite their rocky relationship, Cargill's mother clearly still loved her daughter and wanted to see the best in her.

"I've never come across another defendant like Kimberly Cargill," said Smith County District Attorney Matt Bingham. Bingham says for more than 15 years he has been prosecuting people who have done horrible things to others.

"To have someone so narcissistic, someone that is so manipulative and cunning... she is the first and hopefully the last."

It's a case prosecutors say will always be close to their hearts.

"When the issues at hand are something that I have worked my whole life to try to stand up for, people who don't have a voice, then it's passionate. It's the best part of my job to speak for victims who can't speak for themselves and it's been a real honor, a real pleasure," said Smith County First Assistant District Attorney April Sykes.

The Smith County District Attorney's Office says despite everything that has happened, they feel like they're making a difference.

"She didn't get away with it. The victim and the family got as much justice as we can give them under the system. She's not going to get out and hurt any of her children again and Kimberly Cargill will hurt nobody else and that's what makes it all worth while," said Bingham.

When Cargill's verdicts were read, she stood in the courtroom emotionless. For most of the trial, Cargill silently sat next to her attorneys. She cried at least twice; once when one of her sons was on the stand and again when the State showed jurors photos of the crime scene.

Cargill did take the stand once, in the first phase of the trial, when the jury was deciding on her guilt. She testified that Walker died of a seizure, Cargill panicked, dumped her body and set it on fire to destroy evidence.

Cargill wasn't able to destroy it all. Investigators found a coffee creamer at the crime scene that had a profile matching Cargill's DNA.

Though a mechanism of death was never determined, the pathologist who conducted Walker's autopsy told the jury Walker died of homicidal violence. The pathologist said she thought she found evidence of asphyxiation, but couldn't be positive because Walker's body had already begun decomposing.

Smith County District Attorney Matt Bingham says Cargill is the first Smith County woman convicted of capital murder in at least 17 years. Because Cargill received the death penalty, her case will automatically be submitted to the Texas Court of Criminal Appeals.

why does she get any right to appeal? She obviously has a history of manipulating people and I don't believe for a second that Cherry had a seizure and died. Is there ANYTHING in her (Cherry's) medical records to show that she had seizures? She had a learning disability but I don't recall reading where there was any mention of seizures. Though Cargill has apparently a lengthy history of abusing those around her, including setting fire to someone's apartment? C'mon.. save the tax payer's money and put this beast out of her misery. Give peace and justice to Cherry's family. For real..


For Cherry's family: I am so sorry for your loss. Cherry sounded like someone I would have loved the opportunity to get to know. Her daddy was right, she is with the angels now. No one else can harm her. My prayers are with your family.
