PUTNAM COUNTY, Fla. -- Authorities believe a 15-year-old girl at the center of an amber alert issued Thursday night may be riding in the truck of a homicide victim. Investigators believe 15-year-old Morgan Leppert, from Putnam County, may be with her boyfriend, 22-year-old Toby Lowry. They were seen riding in a Toyota Tacoma registered to James Thomas Stewart.

Investigators said 66-year-old Stewart's body was found at his Cherry Laurel Drive home in Melrose Thursday morning, about 20 miles east of Gainesville. Stewart was found by Putnam County sheriff's deputies who responded to a call from persons concerned because they had not heard from him in several days.

The Putnam County Sheriff's Office said they then discovered Stewart's telephone number was found on a cell phone belonging to Leppert. Leppert had been reported missing to the Putnam County Sheriff's Office on April 22, 2008 by her mother. At that time she was believed to be in the company Lowry.

Investigators said they learned that Stewart's vehicle, a silver in color 2003 Toyota Tacoma, extended-cab, long-wheel base, two-wheel drive pickup truck, was missing. The vehicle's Florida tag, 193KLR, was entered into the Florida and National crime information system, which caused the sheriff's office to receive several "hits" where the tag had been run by various law enforcement agencies prior to it being entered. Those responses came from several locations along Interstate 10, with the last response occurring at approximately 12:30 am on the morning of the 1st of May from Katy, Texas, investigators said.

Warrants have been issued for Lowry, charging him with Grand Theft of the vehicle and Interference with Custody of a Child. Officials also call him "a person of interest in Stewart's death."

An Amber Alert has been issued, nationwide, for Leppert.

Kelly said Leppert and her boyfriend, Toby Lee Lowry, 22, had stayed in the woods behind Stewart’s home for two nights before she went to his door and asked to use the phone. Leppert called her own cell phone and disovered that Stewart was hard of hearing and disabled.

Stewart was beaten with two metal rods, stabbed multiple times and suffocated with a plastic bag that night, Kelly said. Detectives had traced the call after finding Leppert’s cell phone at Lowry’s residence in the Palatka area. Stewart’s body was not found until later.

The man accused of a Putnam County homicide and Amber Alert survives a suicide attempt today.

Inside of his Putnam County Jail cell, 22-year-old Toby Lowry attempted to hang himself Friday morning.

"A bedsheet tied around his neck into a make-shift noose," says Major Keith Riddick with the Putnam County Sheriff's Office. "And Lowry tightened the noose a little bit and stepped off of his bunk."

But Riddick says Corrections Officer Jason Grennan witnessed the suicide attempt, and helpd Lowry up through the cell bars as he called for help. Additional officers went into the cell and cut Lowry down.

"He kept saying I'm sorry. He was crying as they took him off and kept saying I'm sorry," says Riddick.

Lowry is doing okay and will now be under 24-hour supervision in an isolation cell. He'll also be seen by a mental health evaluator.

A confessed murderer details how he and his teenage girlfriend beat, stabbed and suffocated a man to death. On Thursday, police released Toby Lowry's taped admission.

He told the investigator the motive for the slaying was money. He said Leppert was pregnant with his child and they needed not only cash, but also a car so they could get away.

Then, he said it was Leppert's turn.

"I hear, whack, whack, whack. I turn around and Morgan is beating the (expletive) out of him with this (expletive) pipe," Lowry said.

He said they tied a garbage bag over Stewart's head to suffocate him.

In his video taped confession, Lowry told the investigator he killed Stewart and knows he'll be spending the rest of his life behind bars.

"I'm never going to see the light of day again, man," he said.

Teen Murder Suspect Back In Court
Girl Accused Of Killing Disabled Man

PUTNAM COUNTY, Fla. -- Shackled and chained murder suspect Morgan Leppert walked into a Putnam County courtroom on Friday for one of the last times before she goes to trial. Morgan Leppert is charged with first-degree murder.


Now 16, Leppert faces the potential of spending the rest of her life behind bars for her alleged involvement in the slaying of 66-year-old James Stewart, a disabled man found slain in his Melrose home in May of 2008.

Toby Lowry, Leppert's boyfriend at the time, is serving a life sentence after pleading guilty to murdering Stewart. As part of his plea deal, Lowry agreed to testify against Leppert.

Friday's hearing centered on statements given by Leppert to detectives who traveled to Texas, where the teen and Lowry were found along with Stewart's stolen truck. The pair was found following a nationwide Amber Alert that had been issued because police thought Leppert was in danger.

Now, police believe she is just as guilty as Lowry.

What happened after Leppert and Lowry were found in Texas that was the subject of the argument in court on Friday. An interview done with Leppert by detectives from Putman County is something the defense said should not allowed.

"You understood that if she began to make incriminating statements, that you would stop the interview?" Leppert's attorney Chris Smith asked a detective in court.

The detective replied, "Yes."

Smith said Leppert's interview with detectives was done without proper authorization from her mother or attorney. He said when Lowry implicated Leppert her attorney should have been by her side.

However, the state said Leppert's first attorney, Teresa Sopp, opened the door by saying it was OK to interview Leppert as a witness.

"My understanding was that she was a victim of a crime -- that she had been kidnapped," Sopp testified.

The judge will review the tapes and transcripts from Leppert's interview before making a decision. He took the various motions under advisement, and is expected to hear more arguments June 19.

There was an Amber Alert issued for Leppert, then 15, in May 2008. She was found in Texas with her boyfriend Toby Lowry.

Both were arrested for the murder of Stewart.

Stewart was found in his home stabbed to death.

Lowry ultimately pleaded guilty and will now testify against Leppert. He received life in prison.

The murder trial has been moved to Bunnell in Flagler County due to pre-trial publicity.

During jury selection, prosecutor Chris France said the trial may wrap up by Thursday.

Leppert took notes during jury selection.

Her attorney, Christopher Smith, asked prospective jurors their thoughts on "guilt by association" and the defendant's right to remain silent.

The answers to both questions is yes. I do however wished that both of them would have gotten death for what they did to James.

FLAGLER COUNTY, Fla. -- Morgan Leppert has been found guilty of first-degree murder.

66-year-old James Stewart was found beaten, stabbed and suffocated in his Melrose home in May of 2008.

Leppert was taken into custody in El Paso, Texas after a cross-country trip with Toby Lowry.

Investigators say the couple killed Stewart so they could steal his truck and runaway together.

Lowry pleaded guilty in January and was sentenced to three consecutive life terms for the murder, burglary and robbery of Stewart.

Leppert faces a life sentence.

Flagler County jurors weren't swayed by 16-year-old Morgan Leppert's harmless looks this week as they reached a guilty verdict this afternoon in her role beating, stabbing and suffocating a disabled man for his truck.

They deliberated about 90 mintues in convicting her of first-degree murder and will serve life in prison. The jury could have opted for third-degree or manslaughter with lesser sentences.

Leppert was 15 when she and her then-22-year-old boyfriend Toby Lowry set up James Thomas Stewart last April by having her knock on the door of his Melrose home saying her car broke down.

Inside, the Putnam County man let her use his phone as she scoped out the layout and made sure nobody else was home. Her phone call was to her own cell, which investigators eventually traced to Lowry's home.

She left the residence, only to return that night with Lowry. They got in through an unlocked side door, and the unsuspecting Good Samaritan was easy prey after that.

Meanwhile a nationwide Amber Alert had been issued for the missing Leppert. They were caught a couple of days later in Texas.

Lowry already pleaded guilty to save himself from the death penalty. As a juvenile, Leppert doesn't qualify for Death Row.

Much of the trial focused on just how much control Leppert had in the sinister crime. Did she have any notion of what was going to happen to Steward, could she have prevented it, could she have left Lowry? But she showed little remorse and appeared naive to the ramifications of her role.

Jurors also found her guilty of burglary with assault or battery and robbery with a deadly weapon.

The trial was held in Flagler County to seat an unbiased jury due to the publicity in Putnam County.

Emotions stirred as 16-year-old Morgan Amanda Leppert stood Tuesday before a brimming courtroom, awaiting her final sentence for the 2008 slaying of a handicapped Melrose man.

After hearing testimony from the family of 66-year-old James Stewart, who was murdered by Leppert and her boyfriend Toby Lowry in April 2008, Judge Edward Hedstrom sentenced Leppert to a life in prison without parole - the highest punishment her age allowed.

She additionally received two counts of life in prison concurrent with the murder charge for burglary with assault or battery and robbery with a deadly weapon.

Defense attorney Christopher Smith argued that life without parole was cruel and unusual punishment, and should not be an option for a child under 16.

"She was not the perpetrator of the homicide, she was a 15-year-old girl acting under the influence of a 22-year-old man," Smith said. "She basically is a protected person under the statutes of Florida as a child, and to place her in prison for life without any opportunities redeem herself, receive treatment, proof - that concerns me."

Emotional testimony was heard Tuesday from the victim's family, who spoke of the Stewart's determination to overcome his disability.

"Every night when I go to sleep I pray that when I wake up this will all be a bizarre nightmare," Mike Stewart, the victim's brother, said with tears in his eyes.

He affectionately picked up a tennis racquet that had been modified for his brother, complete with a wrist strap, which served to substitute for his hand.

"The most important things I learned from my brother were determination, patience and never to accept the words no and can't."

David Stewart, the victim's nephew, stood before the court to express his pain.

"He was an inspiration to me and everyone that met him, except for the people that murdered him," Stewart said. "He was stolen away from us by two animals with no regard for human life."

Leppert was offered a chance to speak before the judge, but declined at the advice of her attorney.

Smith said he has filed an appeal in hope that she will receive a new trial or possible reversal of conviction.

"The main grounds have to do with her pretrial statements and the fact that he only allowed her to have six jurors for a capital case," Smith said. "There's some conflict in the case law on that, the Florida Supreme Court has not ruled on it yet."

Smith also is challenging the admission of Leppert's interview with detectives during the trial, which audibly portrayed her role in the murder.

Leppert is now the youngest female in the Florida Department of Corrections.
