Months before she was slain, Desarie Saravia couldn't wait to start kindergarten.
Her paternal grandmother, Marina Jovel, bought her a Hello Kitty backpack that the 5-year-old excitedly wore around the house, and even took to bed.
But her cheerfulness disappeared in late July 2004, when her mother, Debby Saravia, reclaimed Desarie and her brother from a two-year stay at Jovel's Northridge home. Desarie was dragged out of the house crying and screaming, her uncle said. Other family members later noted that the kids soon became quiet, sad, scared and even underfed.
Less than four months later, Desarie was dead – the victim of a horrific rape and beating.
Now, nearly six years later, her accused killer is scheduled to go to trial.
Antonio Rodriguez, 29, Debby Saravia's boyfriend, is charged with capital murder, along with torture, assault on a child causing death, forcible lewd act on a child, child abuse and corporal injury to a child.
Prosecutors plan to seek the death penalty if he is convicted.
Rodriguez's attorney, Jack R. Stone, declined to comment on the case.
Saravia, 32, will be tried separately on murder, child abuse and corporal injury to a child. Prosecutors added the murder charge in 2005, calling Saravia an "aider and abettor" to her daughter's abuse and slaying.
According to court documents, including investigative reports and transcripts of Rodriguez's preliminary hearing, Desarie's death was the culmination of months, possibly even years of abuse.
Desarie needed glasses, but her mother didn't get them for her because she was "clumsy," "fell down a lot" and would break them, Saravia told an investigator.
At the time of her death, Desarie weighed just 42 pounds, what a child a year younger than her should weigh.
She "had thin, sticklike arms, (and) her ribs stuck out," medical examiner James Ribe testified during Rodriquez' preliminary hearing. "There was no fat on her. She was way, way underweight."
The night before Desarie died, Brian was told he was going to be punished for eating an apple he wasn't supposed to, according to court records. Rodriguez told Brian that Desarie was also going to be punished for throwing a tantrum, an investigator testified.
The next day, Rodriguez dropped Saravia off at a housekeeping job in Castaic and took the kids to nearby Hasley Canyon Park. Investigators testified that they believe Desarie was raped and beaten in the women's restroom.
A witness testified that she heard Brian urging her, "Wake up, niña," as Rodriguez leaned over her in the backseat of the car while they were still at the park.
By the time Rodriguez took her to Saravia's workplace, Desarie was unreponsive.
Rodriguez tried to perform CPR on Desarie on the lawn of the home Saravia was cleaning. Neighbors called police, and paramedics responding to the scene found Desarie in convulsions. She later died at a local hospital of multiple blunt-force trauma.
After her death, Rodriguez told Brian that "their life would be better without Desarie," Los Angeles County Sgt. Kent Wegener testified.
Desarie would have been 11 in November, Jovel said in a phone interview from Reseda.
"When I remember, I get cold," Jovel said. "I didn't see her as a grandchild, I saw her as a daughter."
Jovel had called the Department of Children and Family Services when Desarie once returned from visiting her mother with bruises on her buttocks.
But the DCFS failed to respond. It wasn't the first time that social workers acted inappropriately in the case, according to an internal report released following an investigation after Desarie's death.
The case was opened in September 2002 when a report was made that Desarie and her brother had been abandoned at their grandparents' home while Saravia was in prison for possession of a controlled substance, according Michael Watrobski, deputy inspector general of the department.
Two other reports were made in 2003 and 2004 and were not fully investigated, Watrobski said. While social workers found a "very high" risk of abuse for the children, it left the kids at the home while referring the family to services in the community.
As a result of the case, department policies have since been changed to never close cases in which children are deemed at high or very high risk of abuse without manager approval, officials said.
Desarie's dath could have been prevented if social workers had made frequent home visits, investigated reports of abuse or neglect, and assessed Saravia's substance abuse, the report said.
For Jovel, who had sought custody of the children but failed because she couldn't prove she was their grandparent, it was too late. Court records show that Brian had been placed into a foster home following Desarie's death, although Jovel said he was in El Salvador, where his father resides.

That poor baby looks so unhappy in her memorial picture. Her life with these monsters must have been MISERABLE. What a horrible and cruel way to take the life of a 5 year old-no 5 year old should have their life cut down. I pray she is peaceful and running playing with the angels now-and that she has found a happiness, warmth, safety and love she so deserved in life. RIP. As for these 2? Nothing here on this earthly plain will ever be enough to satisfy me for their monstorous ways-I would love to be front in line to inflict upon them what was inflicted upon this angel-but even then it would never be enough-no amount of their "suffering" would be enough to satisfy me...

Whisp, thank you for posting this case, I'm familiar with it and glad to see this update!
Smith said both Rodriguez and Saravia have criminal records, but would not provide details of their past crimes. And CPS saw it fit to place them back in the home of the deadbeat mother? and how about this baby killer, as they are required to do, did they not do a criminal check? it wouldn't be hard to find he shouldn't be allowed around children.
Desarie's life was uprooted and thrown in to chaos that ended in her death. I want to see the dp on the one who took her life. Even with justice, life will never be the same for her brother who lost his sister and the grandmother who lost a granddaughter who was much a daughter to her.
My heart goes out to Desarie and the ones who loved her and still find their hearts aching with the loss of her. A sweet child who had a life just beginning only to be taken from her. There are more than the one who killed her that needs to answer to that.

This is so sad. All I did was cry while reading this story. What the hell is wrong with you that you would rape and kill a precious 5 year old?!?!???????

I agree! living breathing, sure in an 8x8 but still, he lives!
on an aside. My 6 1/2 yo son is 42.2 lbs and hardly starved, he eats ALL the time, can't shovel it in quick enough! very little fat on his body as he eats pretty healthy foods.
In Desarie's case sounds like they were starving her. Poor sweet child. Her misery has ended but justice is yet to be served.

Antonio Rodriguez could face the death penalty for the murder of Desarie Saravia.
VAN NUYS -- A Van Nuys man could face the death penalty for the brutal sexual assault and murder of his girlfriend's 5 year old daughter in Castaic six years ago.
Jurors found Antonio Rodriguez, 29, guilty of eight of 10 counts Thursday, including first-degree murder, torture, sexual penetration with a foreign object, child abuse and corporal injury to a child. He was acquitted of two other counts.
The penalty phase of the trial begins on Monday when jurors will decide whether to recommend the death penalty or life in prison.

Convicted murderer attacks 'Grim Sleeper' suspect at county jailA day after he was convicted of sexually assaulting and killing a 5-year-old girl, Antonio Rodriguez attacked the alleged "Grim Sleeper" serial killer while the two were in custody at county jail, a sheriff's deputy testified Wednesday.
Rodriguez had just finished meeting with his attorney at Men's Central Jail on Friday and was being uncuffed from his seat when he broke away from the deputy and punched Lonnie D. Franklin Jr. twice in the head, according to Deputy Ignacio Gracia of the Los Angeles County Sheriff's Department.
Franklin, who was arrested July 7 and is suspected of raping and killing at least 11 people over the last 30 years, was seated near Rodriguez in the attorney meeting room and was handcuffed to his seat when Rodriguez struck him, Gracia said.
Gracia, who restrained Rodriguez after the blows, said the attack appeared to be unprovoked. Rodriguez apologized to him after, Gracia testified.
"I was shocked," said Rodriguez's attorney, Robert A. Schwartz, during a break in the testimony. "I think he may have scored some credibility points with the other inmates."
Franklin and Rodriguez are both "K-10" or "high-powered" inmates which means they are kept away from the general prison population because of the notoriety of Franklin's alleged crimes and because of Rodriguez's tendencies toward violence.
Rodriguez, 29, said he felt "he had to" attack Franklin based on allegations that the 57-year-old man raped
nd murdered almost a dozen women, Schwartz said.
The testimony about the alleged attack came during the penalty phase of Rodriguez's trial as the prosecution seeks the death penalty.
Rodriguez has been in custody since Nov. 13, 2004, the day after his girlfriend's daughter, Desarie Saravia, died of multiple blunt force injuries. The jury last week convicted him of eight counts including first-degree murder, sexual penetration, corporal injury to a child and child abuse.
He has also served three other stints in prison.
Jurors also found Rodriguez guilty of abusing Desarie's brother, Brian, and are expected to recommend next week whether Rodriguez will spend life in prison without parole or face Death Row.

"With me, he's always concerned," Esquivel testified after being called to the stand by the defense. "When I was pregnant with twins - it was a high-risk pregnancy - he sent me letters (from prison). He gave me motivation to keep on going."
Esquivel, a mother of three, said she never saw Rodriguez mistreat her children.
Rodriguez is one of seven siblings who always took the blame in a home that was terrorized by a drunkard father who beat their mother, Esquivel said.
Their father hit the children with a belt, made them stand for hours in time-outs or had them kneel on bricks, Esquivel said.
"(He was) an animal," said Esquivel, sobbing. "He was mean to us. He was verbally abusive to us. He never took us anywhere. He never told us he loved us."
Rodriguez, wearing a light blue shirt, grimaced as he fought back his own tears while his sister cried on the stand.
The abuse was eerily similar to testimony heard earlier in the trial that Rodriguez hit Desarie and Brian with a belt or cord and made them stand facing the wall in hours-long time-outs.
The family moved around the San Fernando Valley often and the father would disappear for months at a time, Esquivel said. Their mother supported the children on welfare and by cleaning houses or recycling cardboard. Their father eventually disappeared for good.

Well, this is a first for me. One PC attacking another for their crime. So for Rodriguez it's ok to rape and beat a child, just not a grown woman. Sounds like he feels children (like him in childhood) can be treated like he was, but treating a woman(like his childhood mother) is not ok. This is IMO, one guy that has become like this because of the 'nurture' portion of the nurtue-vs-nature debate. Although it could be a case of both. I'm sorry but it is very sad to me that this guy wasn't saved when he was a child. He is still guilty as hell and needs the needle, but it maybe could have been prevented.

The prison population especially abhors those convicted of killing or sexually assaulting children, viewing them as "lower than pond scum," said attorney Robert Schwartz. Gang members may put out a "green light," or contract killing, on Rodriguez, 29.
"The extra (stigma) that he's covered with for the rest of his life ... adds to the severity of his punishment," Schwartz said. "For what he did, he's a marked man. He's a dead man walking."

During the trial, about to enter its fifth week, jurors have heard of a history of violence dating back to March 1997, when Rodriguez made threats to school officials during a pre-expulsion hearing at Littlerock High School in the Antelope Valley. The most recent of nine incidents was July 9, when Rodriguez, a day after his conviction, attacked the Grim Sleeper serial killer suspect in prison.
That attack likely gave Rodriguez a few credibility points with the other inmates, Schwartz said last week.
"He can't get any additional punishment," Sedgwick told the jury, adding that it would be an incentive for even more violence. "He enjoys it. It's status."
Medical experts for the defense have testified that Rodriguez has a brain abnormality that makes him unable to control his impulsiveness as a result of being hit in the head with a brick and tire iron in 2001.
PET scans of Rodriguez's brain showed reduced activity in the frontal lobe, and a neuropsychologist testified that Rodriguez has a child's ability to plan and understand the consequences of his actions.

A San Fernando jury deliberated for just 2 1/2 hours Monday before recommending that Antonio Rodriguez be sentenced to death for the sexual assault and murder of his girlfriend's 5-year-old daughter.
Rodriguez's eyes were cast downward at the table as the jury of four men and eight women were polled. His lips were pursed as each juror answered "yes" in response to whether or not they had voted for the death penalty.
"My guess is they weren't able to get beyond the horrific nature of the violence that was perpetrated on the children in this case," said defense attorney Robert Schwartz. "We assembled a lot of background information about my client that could have made a difference, but it obviously did not."

"I'm very grateful I was able to obtain justice for Desarie and Brian," prosecutor Mary Sedgwick said. "I want to thank the jury for working through a very emotionally difficult trial."
Sedgwick will be separately prosecuting Debby Saravia, 32, for murder in her daughter's death. Saravia also faces two counts of child abuse and two counts of corporal injury to a child. If convicted, she faces up to life in state prison.
Rodriguez is scheduled to return to court for sentencing on Sept. 2.

Could this guy's attorney be more out of touch w/ reality? Credit w/ other inmates??? Dead man walking??? That is grounds for him to argue down the road that he is unsafe in general population and have him secluded where he can live a nice comfy life... a luxury that beautiful little girl does not have. I hope the death sentence holds up and he gets thrown to the wolves right before it's carried out, just long enough for him to feel a tremendous amount of pain before the final curtain. AND I think his lovely attorney should hold his fucking hand for the encore!

Calling it the worst case of torture he had seen in his 37-year law career, a San Fernando Superior Court judge sentenced Antonio Rodriguez to death Thursday for the sexual assault and murder of his girlfriend's 5-year-old daughter.
Judge Ronald Coen upheld a July 26 death penalty recommendation by a jury that took just 2 1/2 hours to come to the decision.
Rodriguez, who had grown hair during the trial to cover tattoos, shaved his head to hear Coen's decision, exposing "SF" and "69" tattoos. A defiant Rodriguez said he did not want to enter the courtroom with TV news cameras present, but the judge ordered him in.
As he heard Coen's decision, Rodriguez rested his elbow on the table, and placed his hand against his head, showing his middle finger to the judge and a TV camera.

The judge tells you that the state and a jury of your peers finds your actions reprehensible enough to warrant death, and you prove that you are a soulless, remorseless festering sore on the ass of society by flipping off the judge???? Good luck with your appeals, assbag!
I doubt this creep could find the generosity in his heart to save the state the time and money and just off himself, but I can dream, right?

A Van Nuys woman pleaded no contest today today to a child abuse charge stemming from the November 2004 death of her 5-year-old daughter, who was sexually assaulted, tortured and beaten by the mother's live- in boyfriend.
The child abuse charge against Debby Saravia included the allegation that the abuse resulted in the death of her daughter, Desarie, according to Deputy District Attorney Mary Sedgwick.
Saravia, 32, also pleaded no contest as an aider and abettor to one count of forcible sexual penetration with a foreign object involving the girl, along with an attempted murder charge involving her 6-year-old son.

Saravia knew the children were being physically abused by Rodriguez, but did nothing to stop him, according to Sedgwick.
Saravia is due back before San Fernando Superior Court Judge Beverly Reid O'Connell on Feb. 28, when the defendant is expected to be sentenced to nearly 29 years in prison.

The dp is what he deserves, but I want him to suffer far more than an easy way out. I want him beat and raped mercilessly, days, months, years on out as he awaits his day of death. I want him so miserable and broken he will beg for d-day.
What he took from Desarie is far more than we can ever know. Just starting her life outside in the real world, who know's what she might have become. He took her life, her hope her dreams of something more.

I hate the 'mother' for taking her children away from the very home they were loved. Desarie was taken kicking and screaming---only 4 months later to be brutally killed. It repulses my sensibilities. I don't care how tough he thinks he is in prison, his day will come, someone bigger and stronger, and more wicked than him. I cannot wait. Then Hell can have him.

The dp is what he deserves, but I want him to suffer far more than an easy way out. I want him beat and raped mercilessly, days, months, years on out as he awaits he day of death. I want him so miserable and broken he will beg for his death day.
What he took from Desarie is far more than we can ever know. Just starting her life outside in the real world, who know's what she might have become. He took her life, her hope her dreams of something more.

The woman facing charges in the murder of her 5-year-old daughter — whose naked body was found on a sidewalk in a quiet Castaic neighborhood — and nearly beating to death her son pleaded no contest to three related charges Wednesday.
Debbie Saravia, now 32, entered her pleas in San Fernando Superior Court to charges of sexual penetration with a foreign object and child abuse in relation to the death of her daughter, Desarie Elizabeth Saravia.
She also pleaded no contest to the charge of attempted murder in relation to her son, Brian, who is now in foster care.
Saravia begins serving her sentence Feb. 28, the day she’s slated to be formally sentenced. She has spent the last six years in Century Regional Detention Facility in Lynwood.
I hadn't heard about the son, but I'm not surprised.

I hope a real Mom shanks this bitch in the shower one day while she isn't expecting it. Not all women locked up in jail are bad Moms so I hope one of them get to this bitch. She deserves no sympathy for choosing her penis over her children. Sitting their watching him inflict countless horrors upon these poor defenseless children. I swear I will learn and do the Fudderwhacken the day that piece of shit Rodriguez finally gets a needle in his arm. I said are you fucking me when I read that he had given the judge the finger during sentencing and immediately regretted it once my 3y/o repeated me but thats how I honestly felt. Fucking scum of the earth.

I will agree with your statement that not all moms locked up are bad moms. Those that are locked up for defending their kids are excepted, the rest that left behind kids for drugs or stupid shit, are not. They are bad moms.
