The case against a former Ulster County corrections officer facing child porn charges continues to make its way through the local court system.

Livingston resident Harold W. Rugar III was arrested May 28 by the New York State Police for allegedly forcing an 8-year-old girl to take a lewd photograph of a nude 7-year-old girl.

Rugar was charged with one count each of promoting a sexual performance by a child, a class D felony; possessing a sexual performance by a child, a class E felony; third-degree criminal solicitation, a class E felony and endangering the welfare of a child, a class A misdemeanor.

The charges cover alleged crimes related to both the 8-year-old and the 7-year-old.

Rugar has yet to have his case brought to the grand jury. According to the District Attorney’s Office, the case is still in negotiations.

The defendant appeared briefly in Columbia County Court before Judge Paul Czajka Wednesday to deal with an issue concerning an order of protection.

An order is in effect for Rugar to stay away from both alleged victims in the case.

He is currently out on bail and is being represented by attorney Sean Lally.

Harold W. Rugar III, 29, of Livingston was arrested by the New York State Police in Livingston after an investigation revealed that he allegedly forced an 8-year-old girl to take a lewd photograph of a nude 7-year-old girl.

The 8-year-old is a relative of Rugar’s and the other victim was known to him, said police.

Police said the investigation began with what they are calling a “bus stop conversation” involving several children.

“A person came to the parent of the child victim,” said State Police Inv. Kelly Taylor.

The incident occurred at the Maple Lane trailer park in Livingston.

At the time of the alleged incident the suspect was a corrections officer with the Ulster County Sheriff’s Office.

Police said that Rugar resigned his position after his arrest Friday.

A call from the Ulster County Sheriff’s Office was not returned to the Register-Star by press time.

Rugar has been charged with one count each of promoting a sexual performance by a child, a class D felony; possessing a sexual performance by a child, a class E felony; third-degree criminal solicitation, a class E felony and endangering the welfare of a child, a class A misdemeanor.

The charges cover crimes related to both the 8-year-old and the 7-year-old.

He was arraigned in Livingston Town Court and remanded to the Columbia County Jail in lieu of $25,000 cash or $50,000 bail bond.

Rugar is scheduled to re-appear in court June 10.

Police returned to Rugar’s trailer after his arrest with a search warrant signed by Columbia County Judge Paul Czajka and additional charges are pending based on the search, said authorities.

The Columbia County District Attorney’s Office assisted the State Police in the investigation.

HUDSON — A former Ulster County corrections officer facing child porn charges was in court Tuesday for an Integrated Domestic Violence conference; this court hearing provides an opportunity to address the variety of family issues in court along with collaborating with other agencies such as the Columbia County Department of Social Services.

According to federal law, on the National Center for State Courts website, any person with a restraining order is not allowed to possess a firearm or ammunition. Rugar has had his pistol license in the past.

“Based on the allegations of the criminal complaints, does Mr. Rugar still possess a suspended pistol license?” Columbia Count Court Judge Jonathan D. Nichols said at the start of the conference.

“My client said he thinks it’s been revoked,” said Rugar’s attorney, Sean Lally.

“You may want to check on that status, given the alleged misuse of a handgun,” said Nichols.

Lally did not understand what the judge was referring to, so Nichols explained that Ruger had misused a handgun in the presence of his child.

The child victim that was relatively close to Rugar has been in foster care, and Rugar has not been permitted to see the child, or the other child victim, under an order of protection granted, initially, by Columbia County Court Judge Paul Czajka.

The Department of Social Services was present at the court hearing and said the child is scheduled for permanency in foster care.

Regarding the placement of the child, “For the third time in a year, this child has been moved to a home that is outside of the home and not known by my client,” Lally told Judge Nichols, claiming that the child was not supposed to be moved according to Judge Czajka’s ruling.

Nichols reminded Lally of the order of protection and said he will provide a copy for his client, while he looks into the matter of ruling on the child victim’s movement.

DSS said that the child was moved “at the request of the foster parent.”

The 8-year-old child is a relative of Rugar and the other victim’s relation with Rugar was brought up in court on Tuesday.

Judge Nichols asked Lally if he was aware that the other child is a relative associated with Rugar.

“No,” Lally said.

“Review the association,” said Nichols.

In a sexual abuse case, the victims are protected and their names and specific relations are not made known in order to conceal their identity.

According to Nichols, both victims are related to Rugar. “Is there a reason why the other child is not named in family court?” Nichols asked Assistant District Attorney Tracy Lindauer.

“I cannot say why that child was not named,” said Lindauer.

“It will have to be modified again,” said Judge Nichols, with the other child also included in the family court proceedings.

Ruger will return 9:30 a.m July 18 for more court proceedings.

I am the girls uncle (her name is *** by the way) and can tell you for a fact she did it on her own with the camera she got for Christmas that year. They found nothing on his computer because he had done nothing. Thankfully **** eventually told them she did it herself because ****** was showing her pictures and wanted more like that. He was a friend of my brothers and was staying on the couch as he was evicted from his apartment. Shows what kind of gratitude you get for helping someone out.
