Monument Police Department and the El Paso County Sheriff's Office are investigating what they're calling a "suspicious death." The body of a toddler was found in the basement of a vacant home in Monument.
According to Chief Jacob Shirk of Monument PD, the toddler's body was discovered by two contractors doing work on the vacant home. The body was found at 4:00 on Friday.
Police do not yet know a cause of death, but the circumstances surrounding the way the body was discovered has them believing that it is a "suspicious death."
Investigators are now canvassing the neighborhood for any information.http://www.kktv.com/home/headlines/93827714.html

Well, there's always a chance the toddler "escaped" from a nearby home and fell through an open window, resulting in instantaneous death due to the skull impacting on the concrete floor.
I was going to end with a flippant remark, but the truth is, something like that *could* happen...and how terrible it would be for the parents.

Monument Police say the body was found in a home that was being remodeled. Contractors called police.

The home has been for sale for 52 days and has been on and off the market since 2008.
Investigators say they are treating it as a suspicious death at this point. If it is ruled a homicide, it would be the first ever for Monument. http://www.9news.com/rss/article.aspx?storyid=138973

Apparently, the home is currently empty. It's been on the market 52 days. What are the chances it's been occupied during any of those 52 days? If none, would they describe it as a toddler's body, or as a toddler's "remains"? And wouldn't any renter know that his/her name would be traceable?
If it's foul play, I'm leaning toward someone who lives in the community and knew the house was for sale and empty. I want to know if any windows/doors were forced, etc. If not, who had a key to the place?

Police investigate toddler's death as a homicide
MONUMENT (AP) - Monument police say the death of a toddler found in the basement of a vacant home is being investigated as a homicide.
It's not yet known how the toddler died and the results of an autopsy Saturday morning have not been released.
Monument Police Chief Jacob Shirk says police were called to the vacant home Friday afternoon after construction workers renovating the house found the body.
[...]
Shirk says the home was previously rented but it has been unoccupied for some time and is now for sale. Authorities say they are looking for the people who last resided at the home and trying to find out if they had a child.
Our partners at the Denver Post say the body appeared to have been "well-hidden" and could have been there a while.
Shirk says there are no missing-child cases in Monument.
The age and gender of the child was not immediately available. http://www.9news.com/rss/article.aspx?storyid=139016

I'd bet $1000 this house does not even have a basement. This is a slab foundation in west Texas, there are few if any houses with basements due to the soil makeup. (clay)
The longer I'm on DD, the more I see that news reports just can't be trusted any more. Most writers for major news outlets don't have a clue what investigative journalism is any more. Fact checking is a thing of the past.

What about a crawl space?
Any attic has areas that are not easy to access, and would be called a crawl space. Most times a crawl space is an area between floors too small for a full floor in large buildings.
I would imagine the child was stuffed away in an area of the attic that is not easy to get to. I wish there was some indication in the story of the body's condition. Based on the preliminary response from the ME and no estimate of age yet, it probably is in a very decayed state, but that is a total SWAG.

The "crawlspace" could describe a basement.
I live in 'The Granite State' and thanks to all of that granite, many homes either don't have basements or, like my house, they have a crawlspace basement. It is a 3 ft. high space under the house with a cement or dirt floor. It is only accesible through a small, basement type window on the outside of my house- the window has to be removed to climb in.
Also, knowing how dark, creepy and buggy a crawlspace basement is, I can't really see a toddler being tempted to climb in. Poor little thing, all alone in that dark, cold space- it breaks my heart. I'll be waiting for updates on this one.

In Texas, the soil is clay and moves a huge amount based on moisture content. I've lived here all of my 47 years and know exactly one house that has a basement.
I say again, I'd wager $1000. This one does not have one. The easy way to find out for sure, go to Keller Williams web site and look up the listing. There can't be many listed in a town that small.
EDIT: I take it all back. I read El Paso county and assumed it was in El Paso Texas. I still look at the slab structure and don't think it is a home with a basement. As always, I could be wrong.

Yeah, I'm originally from Texas and don't know of anyone with any type of below-ground space. Now I live in the Midwest in an old house--I have a full basement, but the newer additions have crawl spaces only. If we're talking "attic" when we say "crawl space," then that immediately strikes me as more ominous.

You said "form me." I'll form ya, buddy.
I can think of reasons to leave the child in the crawl space instead of taking him/her to the cemetery. For example, fear of being seen en route or at the cemetery, the amount of effort required to dig a hole and bury a body as opposed to leaving it in a handy crawl space, a "comfort zone" issue whereby whoever left the body felt some degree of confidence regarding the likelihood the body would not be found at the house (vs. the cemetery), and simple convenience: the kid died there, so the kid stayed there. Etc.

New Details: Child Homicide Investigation
The property owner spoke with 11 News about the case. He says he hasn't been there in about a year, and he's working with investigators to help track down anyone who may have had access to the house.
He told 11 News that a number of different tenants and owners have lived in the house. It's changed hands at least once, and with all the work done on the place, many people have been in and out of the home over the years.
[...]
"It's very troubling," said Monument Police Chief Jacob Shirk. "Anytime a child is involved in a death or seriously being hurt, it has an impact not only on the community, but also on the officers and law enforcement professionals that handle these cases."
The Monument Police Department and the El Paso County Sheriff's Office are gathering as much information as they can about why a toddler's body was found in a home on Century Place.
The owner of the property tells 11 News that contract workers uncovered the body while they were digging to fix a sump pump in the home's crawl space
As news of the discovery spreads, neighbors say they're shocked.
"We bought our house here in Monument because it's a small community, close-knit schools," said Julie, who lives just a block away from the crime scene. "You don't hear about things like that in Monument."
By Sunday evening, a small memorial for the unknown toddler had been placed on the doorstep of the vacant house.
Dede Laugesen brought plush toys for a child who will never play with them. "I know it's a sentimental act, this child is no longer here," said Dede. "But it's a statement that says this child's life should be honored." She added, "To think about what that child last saw as it walked in through that door, and was it with somebody who loved him?" While neighbors like Dede wrestle with their own questions, authorities are meticulously investigating one of the most shocking crimes the small town has ever seen.
Authorities are asking the community for help. If you have any information about this case, you're asked to call the El Paso County Sheriff's Office at 390-5555, or the Monument Police Department at 481-3253.http://www.kktv.com/home/headlines/93910604.html

Prospective buyers interested in a duplex in Monument may have walked a few feet above the decaying body of a dead child in a flooded crawl space.
A construction worker who was part of a crew draining the crawl space to install a new sump pump discovered the body Friday afternoon, according to Marilyn Longfield, who along with her husband, Robert, owns the duplex at 764 Century Place.
"It's just absolutely the worst thing that could happen," said Longfield, who lives in Mesa, Ariz., and contracts with a property manager to manage the rental property
The identity, sex, race and age of the child have not been determined, Shirk said. The child could have been anywhere from 1 to 7 years old, he said.
"It was evident that the body had been there for a while," Shirk said.
The apartment where the body was found has been vacant since November, when the couple evicted two men who failed to pay their rent. A woman may have been living with one of the men, Marilyn Longfield said. Authorities are trying to determine past occupants of the duplex. They will see whether any of them had a child.

Coroner Says Girl Found Dead Was 7 To 10 Years Old
MONUMENT, Colo. (CBS4) ―
An autopsy has revealed more about a body that was found in the basement of a vacant duplex in Monument on Friday.
The El Paso County coroner said on Monday the child is between the ages of 7 and 10, and that the child is female. The cause of death is unknown, as well as the child's identity. Initially police said the body was that of a toddler.
[...]
Two construction workers made the shocking discovery late Friday afternoon when they went in the duplex, located on Century Place, to do some work on the plumbing in the basement.
Neighbors say no one has lived in the propery since Christmas, and that some long-time residents say they don't ever recall seeing a child living there. The last residents to live there were in their late teens or early 20s, neighbors say.
The autopsy began on Saturday with minimal information about the body.
"Any time it involves the death of a child, naturally or through a crime scene -- a homicide -- it's very disturbing," said Police Chief Jacob Shirk. "(Many of us) are parents and it greatly saddens us to have to be involved in something like this."
Police are hoping someone will come forward with some information to help them in their investigation. They also say no missing children have been reported in Monument. They are working with the El Paso County Sheriff's Department in the case.
Monument is located about 45 miles south of Denver.http://cbs4denver.com/local/monument.body.girl.2.1698705.html

Glad Harley mentioned the no basements in that are of Texas as we don't have them here either.
This neighbor lady again. I agree Liz, her other comment on not being concerned is odd maybe she just meant she doesn't feel like she or others are in danger.
"It was, like, young college kids or something that lived there, but I don’t recall any young child living there," said neighbor Tanya Grinnell.
However, neighbors said it is a kid friendly community.
"It’s a tight-knit neighborhood. We know of all the kids in the neighborhood, and we watch out for all the kids," said Angela Robbins. "Me and some of the neighbors have been going through our heads. OK, we don’t know of any missing kids. We haven’t known of any missing kids."
Monument police confirmed they have not received any missing children reports. However, they said they are checking the surrounding jurisdictions.
An autopsy was scheduled for Saturday. The results have not been released.
But then some children are never reported missing, especially if it involves a case of abuse. Hide and do away with a child as if they never existed. Breaks my heart.
EDIT: just saw whisp's update.
The El Paso County coroner said on Monday the child is between the ages of 7 and 10, and that the child is female Not a toddler after all. I am kind of relieved, to be wrong about it being Emanuel Guzman, I would like to believe his parents were wrongly accused, that it was all an accident, they ran because it would be easier than proving their innocence and they are all living happily and lovingly somewhere out there! But, now, there's a little girl, to search and find her identity, surely there is a family, grandparents, aunts, uncles or maybe even parents or siblings looking for this little one. It's hard waiting for a sketch of the deceased, especially a child, but hopefully, we won't have to wait too long. I wish they had told us the color of the childs hair, at least.....

Child found dead in Monument older than first thought
MONUMENT, Colo. - The body of a child found inside a townhome in Monument was a girl between the ages of seven and ten, authorities revealed Monday.
[...]
Neighbors told FOX31 News that they are almost certain the victim is an African-American girl who lived in the condo for only a matter of months, who they knew only as " Genesis."
They say that girl, and then her family, disappeared about 18 months ago.
Stuffed animals, flowers and other items covered the porch of the home at 764 Century Place in Monument Monday.
Neighbors told FOX31 News that soon after her family moved into the townhome from New Jersey a few years ago, they suspected the little girl was being abused, and some called police.
"A child was beaten on the trail and they called (police)," said neighbor Kristin McCollam. "And another time they heard a kid screaming and they called (police)."
They say cops visited the home at least three times.
"We told them we hadn't seen her in a little bit," said McCollam, "We were worried about her. She disappears for a while and then she comes back," they told police.
Monument Police will not comment on the specifics of their investigation, or whether "Genesis" might be the victim.
"This is a potentially horrific crime that's occurred in our neighborhood," said Monument Police Chief Jacob Shirk. "We take it very seriously we understand the impact it's having."
But neighbors say their fears hit a peak when the girl suddenly disappeared about 18 months ago.
"We asked (the family) one day why -all of the sudden- she was gone," said Caroline Dinwiddie. "They said 'Oh, she was our problem child. We shipped her off to New Jersey to go live with her aunt.'"
Shortly after that, the family moved out without telling anyone.

forgive my lack of understanding how they system works... but since a body was found, would they not do a police check on the house, any domestic violence calls, child abuse calls to this house??
I hope they give this little girl a name and can finally lay her to rest.
Then I hope they get the bastards that put her in a crawl space to rot!

MONUMENT, Colo. -- Investigators are still trying to determine the identity of a young child left in the crawlspace of a Monument home. On Monday, an autopsy revealed the child is a young girl between the ages of 7 and 10.
A source told TARGET 13 the body was found under a dirt mound in the crawlspace of the home off Century Place. According to the source, a plumber was hired to put in a sump pump and noticed the mound.
When he poked it, it moved, the source said. After digging it up, the plumber discovered it was the body of a young child; he immediately called police.
The home, which is a duplex, has a crawlspace the size of the building. A landlord familiar with the layout told TARGET 13 that you had to access the crawlspace through the kitchen. A firewall was installed between both buildings not allowing one tenant to gain access to another tenant's crawlspace, according to the landlord.
[…]
Police Chief Jake Shirk said his department is looking into all leads, including the story of a family from New Jersey who moved into the home in Dec. 2008. According to neighbors the family had two children, a 12-year-old boy and a 7-year-old girl.
“She was so sweet, she would always give you a hug,” said Kristen McCollam, a neighbor.
McCollam said one day the little girl just disappeared. “When we asked where did she go? They said, ‘we shipped her off to New Jersey; she was our problem child,’” said McCollam.
Another neighbor claimed the parents abused the child and got physical with her while they were on a trail behind the home. Police were called the neighbor said, but nothing was done.
So that clears up the question of the crawl-space.

Couple Sought For Questioning In Child's Body Case
MONUMENT, Colo. (CBS4) ―
A national bulletin has been issued for the couple being sought for questioning in connection with the discovery of a child's body in a vacant duplex in Monument last week.
The El Paso County Sheriff is looking for Hanif Sims and Monique Lynch.
The couple used to live in the home where the body of a child was found May 14.
Neighbors told CBS4 the couple had a daughter named Genesis who suddenly left Monument. They were told she had been sent to live elsewhere.
Records show Sims and Lynch left Monument in April 2009 and moved to East Orange, New Jersey.
Police and prosecutors there have been assisting in the search for the couple.
The El Paso County coroner said on Monday the child is between the ages of 7 and 10, and that the child is female. The cause of death is unknown, as well as the child's identity. Initially police said the body was that of a toddler.
Both Sims and Lynch have outstanding warrants; Sims for a weapons violation and Lynch for narcotics.

MONUMENT, Colo. -- The El Paso
County Sheriff’s Office has issued a
nationwide "be on the lookout"
alert for a couple who lived in a
Monument home where a young
girl's body was found buried in the
crawl space last week.
Investigators do not consider
Monique Lynch and Hanif Sims
suspects, sheriff's spokeswoman Lt.
Lari Sevene. But investigators want
to speak with the couple, as they
have with other former residents of
the now-vacant duplex where
workers found the body while
renovating the home at 764
Century Place.
"We reached out to them so we can
get some questions answered,"
Sevene said.
The law enforcement bulletin says
the couple, who had young children
including a daughter, is sought for
questioning in the "suspicious death
investigation." The couple is also
wanted on outstanding New Jersey
warrants: Lynch for violating
probation on a dangerous drugs
conviction and Sims for a weapons
violations, Sevene said.
KRDO, citing unnamed sources, said
the couple was last seen in New
Jersey, and police there have been
asking relatives questions in the
case.
Sevene said her agency has spoken
with New Jersey law enforcement
to confirm the couple's warrant.
She said she knew nothing about
the couple being sighted in New
Jersey.
Hanif Sims' half-brother, Hassan
Sims of New Jersey, told
TheDenverChannel.com the couple
has moved to Long Beach, Calif. He
added that he has not spoken with
Hanif in three months and does not
know how to reach him.
Originally from New Jersey, Sims
and Lynch moved to Colorado in
August 2008 and the next month
rented the home where the body
was discovered.
Neighbors told KRDO the couple
had a 7-year-old girl, Genesis, and a
12-year-old boy, Davon. Hassan
Sims said the couple also has an
infant son.
An autopsy on the remains found in
the basement crawl space revealed
it was that of a 7- to 10-year-old girl
of unknown race. The El Paso
County Coroner's Office said the
remains were so badly decomposed
that the girl's cause of death and
identity could not be determined.
Coroner's officials may seek the
help of an anthropologist to
pinpoint the dead girl's age and
race. The coroner is also awaiting
the results of further tests,
including toxicology, that will take
weeks to complete, she added.
Neighbors told TheDenverChannel
the couple's daughter, Genesis,
disappeared one day and the
couple told them she had moved
back to New Jersey to live with her
aunt.
Hassan Sims said that Genesis did
not come to live with relatives on
his side of the family. But he could
not rule out that she was living with
relatives of Hanif's father.
A Monument neighbor said others
had called police before about
possible abuse at the home.

The El Paso County Sheriff sat
down one-on-one with KKTV 11
News Friday and revealed that
they've narrowed their investigation
into the body found in Monument.
Investigators have issued a national
bulletin to all federal, state and
county law enforcement officials,
asking them to be on the lookout
for Monique Lynch and Hanif Sims.
Both are 29 years old and are being
called "witnesses to the case."
Sims and Lynch were former
tenants of 764 Century Place in
Monument, the house in which the
body of a 7-10 year old girl was
found last Friday. The couple had
two children at the time they were
living at the home, a 12-year-old
son and a 7-year-old daughter.
Maketa says neighbors also
reported that Lynch gave birth to
another child after they moved out
of the home, saying a neighbor
received a text from Lynch about
her newborn.
The 7-year-old girl was a student in
School District 38. Sheriff Maketa
says she was pulled out of school to
be home-schooled in October of
2008. That's the last record they
have of her.
Sheriff Terry Maketa says
investigators are in the process of
talking to all other former tenants
who lived at the house, except for
this couple. The El Paso County
Sheriff's Office has flown two
investigators to New Jersey and two
to California to look for Sims and
Lynch, and to talk to their families.
They're in the process of collecting
DNA from other family members to
see if it's a match for the girl's body
found.
Lynch is wanted on a drug charge in
New Jersey and Sims is wanted for a
weapons violation. Maketa says
they're certain the two are not in
Colorado and believe the two may
be in California.
The body of the young girl was
discovered in a crawl space of the
vacant home Friday by contract
workers. An autopsy of the body
revealed the body was that of a
7-10 year old girl, but due to the
condition of the remains, the
coroner was unable to determine
the identity, the manner and cause
of death or the ethnicity.
Right now, investigators are still
calling this case a "suspicious
death." If this is in fact a homicide,
it will be the first ever in Monument.

But neighbors say their fears hit a peak when the girl suddenly disappeared about 18 months ago.
"We asked (the family) one day why -all of the sudden- she was gone," said Caroline Dinwiddie. "They said 'Oh, she was our problem child. We shipped her off to New Jersey to go live with her aunt.Like Genesis was an unruly pet. I can't imagine telling anyone this and not being looked at oddly. Even if this doesn't turn out to be Genesis, I sure am concerned about her well being.

So what's everyone thinking- maybe step-mommy finally beat poor little Genesis too hard & dear old daddy responded by tossing her broken body under the house? It wouldn't be the first time that we've heard that story!
And like murding your little girl and abandoning her body like forgotten trash isn't horrifying enough, the 'parents' add insult to injury by telling the neighbors that she was such a rotton kid that they had to send her away!
Yah, they sent her away alright, not to a nice family home like they claimed, but to a cold, dark crawlspace- and it wasn't because SHE was out of control, but because THEY were!!!
Genesis, you were such a beautiful little girl, the same age as my youngest daughter. Your name means the begining of life- sadly & unfairly your life was ended before it had a chance to really begin. RIP baby girl.

My daughter was diagnosed at 5 with ADHD, man she is a handful and there were times where I seriously thought about busting her butt. She went to her therapist and told him I was abusing her, when he asked her what it is I do to abuse her she said that I give her time outs in the corner. That is what her idea of abuse is, she doesn't even know kids in this world get their ass beat royally for what the parents think is a major problem.
I can't stand parents who "snap" and I use that word because I can't think of anything better to use, and beat their kids to death for some slight they perceive. Those are the people I would like to physically assault, if it wasn't against the law I would be some vigilante and take out every piece of shit that beats their kids.
My kids do get spanked but it is so rare because usually just the threat of a time out makes them stop. If you can't control yourself around your kids for fucks sake quit fucking having them!

After posting on the baby lollipops thread I was thinking about him all night. you know how tiny he must have been? I've only seen t-shirt with lollies for infants! thinking about him made me realize something about this investigation
This case at first they thought it was a toddler's body but now believed to be that of 7-year-old. going from a toddler to a 7-year-old is quite a leap and they have said they can't determine yet the cause of death.
thinking about Lazaro Figueroa made me think about 9-year-old Davontae Marcel Williams, his story is almost identical Lazaro's even down to the lesbian couple. when EMT's came and found him they thought he was three years old, he was only 35lbs. 5-year-old Charnae Wise was also left under the stairs in the basement to die. (No smell either)
Gauging on these stories I think it can be assumed she was systematically starved to death. The lack of smell could be from being so emaciated theres not a lot of flesh to rot away, in the wise case, If memory serves me right, she was just under some garbage and a detective didn't smell a thing standing right next to it.
(writing this just turned my stomach inside out)

New Jersey couple may have been investigated for child abuse
Mom awaits daughters remains for service
A New Jersey couple who police have been searching for in connection to the death of a girl found in Monument had been investigated in their home state for possible child abuse, according to the Denver station, KMGH.
According to the station, Hanif Sims and Monique Lynch had been on the brink of losing the two children in their care when the family moved to Monument. The case was passed to the El Paso County Department of Human Services which never opened a case, the station reported.
A woman who says she's the mother the young girl said she is waiting anxiously for the chance to bring her oldest daughter’s remains to Newark, N.J., so that the family can hold a memorial.
Jopetia Garretson, 30, said El Paso County sheriff’s detectives have offered their help in getting the remains of Gensis Sims, whom she plans to have cremated, back to her family.
Their offer, though, will have to wait until DNA tests, which required a sample obtained last week from Garretson and could take several weeks, are completed, she said.
“It’s scary because I have to wait a little longer to have the answer … for something that I felt was wrong for a little more than a year now,” Garretson said Wednesday. “It’s mind-boggling, it’s gut-busting. Literally, it’s killing me.”
[...]
Investigators, though, have focused much of their efforts on finding Sims and Lynch, who stayed at the house from late 2008 to early 2009.
They both had children when their relationship began. Lynch had a son, Davon, who is now about 13, and Sims had a daughter, Genesis, who born Jan. 19, 2001, from his relationship with Garretson,
[...]
Lynch and Sims left Monument abruptly in early 2009. The couple and their teenage and infant sons, turned up in March at a homeless shelter in Los Angeles, according to Andy Bales, who runs the United Rescue Mission. They left the shelter in December 2009, after the mission helped the couple get their own apartment and rent assistance.
Sims and Lynch are believed to be on the run without their children, who were left at a friends’s home and have since been taken in by relatives, Bales said.
Garretson said she met Sims on Super Bowl Sunday in 2000 at a Newark sports bar. He walked out on her, she said, soon after Garretson told him she was pregnant.
Garretson said she cared for Genesis until she was about 15 months old. Hanif was given custody of their daughter because of “unfortunate problems” Garretson was having. She did not elaborate.
When Genesis was 3, custody was awarded to Hanif’s aunt, Garretson said. Hanif’s aunt and uncle played a large part in Genesis’ life during custody battles between Garretson and Sims.
[...]
After Sims left New Jersey with Genesis, Garretson said tried unsuccessfully to regain custody. All she knew was that her daughter was in Colorado with Sims and Lynch.

Authorities continue to search for ex-Monument couple
New Jersey couple who police have been searching for in connection to the death of a girl found in Monument had been investigated in their home state for possible child abuse, according to the Denver station, KMGH.
According to the station, Hanif Sims and Monique Lynch had been on the brink of losing the two children in their care when the family moved to Monument. The case was passed to the El Paso County Department of Human Services which never opened a case, the station reported.
A woman who says she's the mother the young girl said she is waiting anxiously for the chance to bring her oldest daughter's remains to Newark, N.J., so that the family can hold a memorial.
Jopetia Garretson, 30, said El Paso County sheriff's detectives have offered their help in getting the remains of Gensis Sims, whom she plans to have cremated, back to her family.
Their offer, though, will have to wait until DNA tests, which required a sample obtained last week from Garretson and could take several weeks, are completed, she said.
"It's scary because I have to wait a little longer to have the answer for something that I felt was wrong for a little more than a year now," Garretson said Wednesday. "It's mind-boggling, it's gut-busting. Literally, it's killing me."
19, 2001, from his relationship with Garretson,
Sims and Lynch also have a child, which was born in April 2009.
Sims and Lynch are believed to be on the run without their children, who were left at a friends's home and have since been taken in by relatives, Bales said.
Garretson said she met Sims on Super Bowl Sunday in 2000 at a Newark sports bar. He walked out on her, she said, soon after Garretson told him she was pregnant.
Garretson said she cared for Genesis until she was about 15 months old. Hanif was given custody of their daughter because of "unfortunate problems" Garretson was having. She did not elaborate.
When Genesis was 3, custody was awarded to Hanif's aunt, Garretson said. Hanif's aunt and uncle played a large part in Genesis' life during custody battles between Garretson and Sims.
"They're grieving hard now," Garretson said.
After Sims left New Jersey with Genesis, Garretson said tried unsuccessfully to regain custody. All she knew was that her daughter was in Colorado with Sims and Lynch.

Chilldren need help to process these things. Someone to listen to them, and help to explain what happened.
I have no understanding of why some parents work so hard to get custody of children that they then seem to hate or go on to abuse. What is in their heads? Some weird and useless concern over appearances? Some crazy romantic idea that their child is all things wonderful, which bubble gets burst when reality sets in? What?! It's so heartbreaking when I think of these poor children, tugged into a new home, hoping and expecting love and care, only to get strife and abuse and ultimately death.

MONUMENT, Colo. - A 9-year-old found dead at a Colorado construction site in May was identified yesterday as Genesis Sims, the young girl who a Newark woman believes to be her daughter, authorities said.
Since construction workers made the grim find inside a vacant Monument, Colo. home nearly 2,000 miles from Jopetia Garretson’s Newark residence, the woman has feared the dead girl is her daughter Genesis. She hadn’t seen the nine-year-old since losing a custody dispute several years ago with the child’s father, Hanif Sims.
The El Paso County Sheriff’s Office apparently confirmed the woman’s fears yesterday, announcing that both a private lab and the Colorado Bureau of Investigation had identified the body as Genesis Sims, Lt. Lari Sevene said in a statement.
Authorities are still searching for Sims and his companion Monique Lynch, both 29, who lived in the townhouse in late 2008 and early 2009, according to Sevene. The pair are both wanted on unrelated warrants in New Jersey. Lynch is being sought for a drug-related parole violation and Sims on a weapons charge.

Isn't that a bitch?
The courts placed sweet Genesis with her killers "in her best interests". Whatever was wrong with the mom, maybe the kid wouldn't have ended up dead if she had gotten her.
Prayers for the mom and Angel Genesis, as well as swift justice for those responsible for this.

Tragic! And they're away, apparently scott free, the parasites. I hope that someone out there does not forget them, and when they make a mistake or surface into the public eye again, they're caught for good. They should not get bail. They should not get public assistance. They should not get parole. They should not get another chance to live in public without looking over their shoulders.

Sims and Lynch said they want their side told before turning themselves into police. The couple called TARGET 13 Monday afternoon explaining what happened the day Genesis died, and why the couple buried the body in the crawlspace of the Monument home they rented. We confirmed that the couple that called us was Hanif Sims and Monique Lynch because of information they told us that KRDO had uncovered in our 2 month investigation and have not released. Authorities have also not released that information to the public.
“She was just lying there,” Lynch said about a December day she and Sims, returned from a visit with their neighbors. “We were at a neighbor’s house 10 minutes tops, and I’m seriously saying 10 minutes tops,” said Lynch.
She said the water in the upstairs bathroom was running, and at first it didn’t seem unusual. “I just realized the water was running and she should be out of the shower,” said Lynch.
Lynch said both she and Hanif went upstairs to check why Genesis was still in the shower. “There are two doors to the bathroom, one in my room and one goes to the hallway,” said Lynch. “I just went through the hallway,” and she said Sims went through the door from the master bedroom.
Lynch remembers opening the door first and seeing Genesis laying in the bathtub, unconscious and blue. “She wasn’t under any water or nothing like that, the shower was still running and she was lying there,” said Lynch,
She said the couple moved the body to the bed in the master bedroom and tried giving her mouth-to-mouth resuscitation. “When we found Genesis we stayed with her and we were just so shocked,” said Lynch. She said there was no blood in the showers and Genesis had no bruises. She added that they waited two days before deciding to bury her in the crawlspace of the home.
“We put flowers, we prayed; everything. The only thing is, what society says we (should) have to inform or call the police and tell them something happened to our child,” says Lynch.
“We don’t know what the hell happened to her,” said Sims. “I didn’t kill her,” he said over the phone with TARGET 13. (We’ll have more with our exclusive interview Wednesday night on NEWSCHANNEL 13 at 10)

Couple: We Buried 9-Year-Old Girl In Basement
Father, Girlfriend Says They Found Genesis Sims Dead In Shower
MONUMENT, Colo. -- A couple has admitted to a local television station that they buried their 9-year-old daughter in the basement crawl space of a Monument home, saying they found her dead in the shower.
The sheriff's office on Tuesday confirmed that the body found in the home on May 14 by workers renovating the vacant home is Genesis Sims.
Genesis' biological father, Hanif Sims, and her stepmother, Monique Lynch, gave an exclusive telephone interview to KRDO reporter Tad Landrock on Tuesday, saying they wanted to share their side of the story before turning themselves in to police.
"I don't want to be labeled as no murderer," said Lynch. "I just want to be able to get a fair chance to tell my side of the story."
Lynch said she and Sims are currently in Los Angeles.
El Paso County sheriff's detectives have issued an arrest warrant for Sims. He is wanted for child abuse causing bodily injury and assault with a deadly weapon.
Lynch said she found the girl lying in the running shower after the couple returned home from dropping by a neighbor's house for about 10 minutes.
“She was just lying there,” Lynch said about that December day.
"She wasn't under no water or nothing like that. The shower was still running and she was just lying there," the girlfriend said.
"If she slipped in the tub, I would've saw something --- a knot or something. I didn't see anything. All I saw was Genesis lifeless," Lynch added.
The girlfriend said they couldn't find a pulse and the girl had turned blue.
"My husband tried to give her mouth to mouth…but she was blue," Lynch said.
They laid the girl's body on a bed in the master bedroom.
"We just sat there and stared at her for at least two days," Lynch said, describing their state as "just totally unbelievable shock."
Then the couple decided to bury the girl in the basement.
"We put flowers. We prayed," Lynch said of the basement burial.
"The only thing ... is really that society says we have to inform you or call the police and tell them that something happen to our child or whatever."
The station said it interviewed Hanif Sims, too. But only Lynch's recorded comments were aired Tuesday night.
KRDO said it will air the couple's explanation for why they didn't call authorities at 10 p.m. Wednesday.
The station said investigators are interested in KRDO's interviews with the couple.

CALL7 Investigator John Ferrugia uncovered in late May that New Jersey authorities had previously investigated a complaint that Hanif Sims was physically and emotionally abusing Genesis. Sources confirmed that New Jersey child protection authorities filed a neglect and dependency case against Genesis’ father.
Sources told Ferrugia that the father was putting the child's own feces and mouse droppings in her backpack before sending her to school. The father told authorities it was to “teach her a lesson.”
New Jersey officials were about to take Genesis away from the couple, but they moved to Colorado. The details of the New Jersey actions were reported to El Paso County, but it is unclear why El Paso County did not act.
There was also an Oct. 2, 2008, complaint of abuse against Genesis’ father in El Paso County. According to sources, a child protection worker went to the house and interviewed two children there. Genesis told the worker she wasn’t supposed to talk about her parents and her brother also said nothing.
The complaint was deemed “inconclusive” and El Paso County officials did not open a case.
Sims and Lynch eventually left Colorado for Southern California, where officials have said they've become homeless. Investigators have been unable to locate them.
KRDO said it confirmed that the couple that called the TV station was Hanif Sims and Monique Lynch, because the pair knew information the station has uncovered about the case that authorities have not made public.http://www.thedenverchannel.com/news/24170439/detail.html#

Thing is . . . not reporting your dead child and burying her in the crawl space under the house suggests intent to hide the death. Sure, you could argue that body preparation, rites, and burial are matters of religious freedom, family matters, whatever (despite all legal considerations to the contrary), but when people get all folksy about burial, they put the body in a graveyard, not under their house. Not under their rental house.
So, I say, you were hiding something. Hiding the body, hiding the death, hiding your handiwork. Moreover, you had something to gain or maintain by doing so. Maintaining your freedom, maintaining your social standing, maintaining your family's good will, maintaining child care payments, perhaps. Maintaining your hold over each other, maintaining a reign of terror over your other child.
So, if I accept your story, that she was lying dead of nothing noticeable in the bath, what then might have caused her death? Starvation? Malnutrition? Exhaustion? SIDS?! There are a world of things we may not be able to test anymore -- like a strangulation or asphyxiation or ruptured organs. I just hope there is more evidence about what happened to that little girl. You both are highly suspicious and lacking any kind of demeanor of integrity.

Couple Arrested In Connection With Girl Buried In Crawl Space
MONUMENT, Colo. -- The father and stepmother of a 9-year-old girl whose body was found buried in a vacant Monument home were arrested in Nevada Wednesday night.
El Paso County Sheriff Terry Maketa said Hanif Sims and his girlfriend, Monique Lynch, were arrested at a motel in Henderson, Nev., 15 miles southeast of Las Vegas.
Sims is the father of Genesis Sims, whose body was discovered May 14 buried in the basement crawl space of the town house by construction workers doing renovations
Authorities said Tuesday that tests confirmed the body was that of Genesis, who had lived in the town house with Sims and Lynch. The cause of death hasn't been determined.
Investigators had been hunting for the couple, who moved out of the home early last year. An arrest warrant was issued for Hanif Sims on child abuse and second-degree assault charges on June 4 as part of the investigation, sheriff's Lt. Lari Sevene said. The warrant was sealed, and Sevene said she couldn't provide further details about it.
Maketa said El Paso County investigators flew to Nevada on Wednesday night to talk to Sims and Lynch about Genesis.
"The value in making contact is to be able to hear their side of the story and find out why they didn't contact us in the first place," Maketa said.
Investigators believed that Sims and Lynch lived in the Union Rescue Mission homeless shelter in Los Angeles from March until December 2009.
A couple claiming to be Hanif Sims and Monique Lynch told KRDO-TV in Colorado Springs that they found Genesis unconscious in a running shower and hid her body after having a ceremony with prayers and flowers.
KRDO-TV reported the couple called the station Monday, saying they wanted to give their side of the story before turning themselves in. The station said it confirmed their identities through details the couple knew about the case that KRDO-TV learned during its investigation. Those details had not been previously made public.
"I don't want to be labeled as no murderer," Lynch told the station, saying the couple was calling from Los Angeles. "I just want to be able to get a fair chance to tell my side of the story."

Facebook Message Led To Arrests In Child's Death
COLORADO SPRINGS, Colo. (AP) ― A Facebook message led investigators to a couple suspected in the death of a girl whose body was found in a vacant Colorado home, authorities said Thursday.
Hanif Sims and his girlfriend, Monique Lynch, both 29, were arrested Wednesday in Henderson, Nev. The El Paso County sheriff's department issued arrest warrants Thursday for both on suspicion of child abuse resulting in death.
The two were being held in jail on $500,000 bond each. The sheriff's office has started extradition proceedings to return them to Colorado.
Investigators had been looking for the couple since the body of Sims' daughter, 9-year-old Genesis, was found May 14 in the crawl space of a town home in Monument, about 50 miles south of Denver. The cause of death hasn't been determined.
El Paso County Sheriff Terry Maketa said detectives tracked a Facebook message, which the couple wrote to a Colorado Springs TV station, back to a motel. He said the two were sleeping when Henderson police arrived.
An arrest warrant was issued for Sims in June for suspected second-degree assault and misdemeanor child abuse. Deputy Teresa Murphy said the warrants issued for the pair were sealed.
Lynch had been arrested on a probation violation out of New Jersey, and it's unclear if she would be sent to that state first.
Maketa said the couple have cooperated with investigators.
"We're getting some good information that helps us fill in the blanks in this case," he said.

Monique Lynch was charged Wednesday with first-degree murder in the death of Genesis Sims. Lynch faces a possible life sentence.
Lynch and the girl’s father, Hanif Sims, were arrested in early July after months on the run. Both initially were accused of child abuse resulting in death.
Sims still faces that charge along with concealing a body and tampering with evidence and faces up to 51 years in prison. Lynch also has been charged with child abuse resulting in death, concealing a body and tampering with evidence.

According to the El Paso County Sheriff's Office arrest affidavit, Monique Lynch allegedly beat Genesis with a belt because the girl had soiled herself, then the couple let her linger for two days without getting her medical help. Genesis may have still been alive when Sims and Lynch placed her in a plastic bag and buried her in the basement, the affidavit states.
The affidavit gave the following account of Genesis’ death:
“Hanif Sims told sheriff’s Detective (Ralph) Losasso that on the day of her death, Genesis had soiled herself and Monique Lynch became upset and began beating her with a belt. Hanif said he told Monique to stop, she had disciplined Genesis enough.
"Monique then took Genesis upstairs to clean her up.”
Sims then left to buy cigarettes returning about a half hour later to find Lynch in the bathroom with Genesis in the tub.
“Hanif Sims said Monique Lynch was yelling at Genesis, telling her to get her ass up and quit faking. Hanif said he picked Genesis up and took her to the bed and gave her mouth to mouth because she didn’t seem to be breathing. Hanif said it appeared Genesis was breathing, but shallow.
“According to Hanif Sims, he told Monique to call 911, but that Monique told him no because she was wanted on a warrant for her arrest and she was pregnant with another child and could not afford to go to jail. Hanif admitted to detectives that he believed that if medical had responded when they should have called, Genesis would be alive today."
Hanif told the detective that he and Lynch stayed in a bedroom with a shallow-breathing Genesis for two days before placing her in a bag, digging a hole and burying her, the affidavit stated.
[...]
Cassandra Lynch said her sister, formerly of Newark, N.J., has been with Sims for about three years, though the two never married while living in New Jersey.
They both had children when their relationship began, and eventually had a child together after moving away from Colorado.
Monique Lynch entered the relationship with a son, Davon, who is now about 13. Hanif had Genesis, whose mother, Jopetia Garretson, still lives in New Jersey.
They moved to Colorado around December 2008, she said, to “start a new life and give her son a better chance of growing up because things in the neighborhood were getting out of control and too violent,” Cassandra Lynch said.
While living at the homeless shelter in Los Angeles, Monique Lynch was featured in a promotional video for the shelter holding her and Sims’ newborn son. Both the older son and infant were left with friends and then placed with relatives after the couple left the homeless shelter and went on the run.
“The only thing I have to say is I’m hurting right now,” Garretson said Wednesday. “I was expecting that they would be saying that about her (Genesis’) dad right away, not so much her (Lynch).”
“If they say she’s guilty of that, then I have to go by that,” Garretson said. “But I think they both have something to do with it one way or another.”
Garretson said she still hasn’t received Genesis’ body and wants it back soon.
“I don’t think it’s right for them to be holding on to her like that, I don’t think it’s right,” she said. “Me and her sisters have to suffer because we can’t have her.”

So they found her dead in the bath and sat by her body for 2 days. Then, they buried her in the crawl space. It's just society has these stupid rules, you know?!
Not a very believable story. So, now we hear one we can believe and no doubt it is a horror story. A nine year old soiled herself and was deserving of a beat down. A severe beat down. An unsupervised beat down into a coma. Then, a two day vigil, wherein she did not recover from her beat down. Oh, well. Let's just put her in the crawl space. If she recovers down there, she'll find her way out, right?
I'm sure it could have been worse, somehow. I certainly hope we don't have to find out exactly how much worse during the trial. Probably will have something to do with how a nine year old comes to have soiled herself in the first place. Rape? Molestation? Punishments she was designed to fail at, thus earning more and more punishment? Where will the story go from here?

Seriously, have you been in therapy before? I'm asking this as someone who saw a therapist for several years regarding a relationship issue. It seems like most people look on "therapy" with great distaste, like the therapist is going to laugh at you or make you eat your own shit or something. And to those who equate therapy with "being called crazy," I roll my fucking eyes and call horseshit. You know next to nothing.
I suppose I was fortunate, because (a) I wound up with a therapist I ultimately truly liked, and (b) I went into therapy already very self-aware and ready to do the "work" that was needed. (When I say "work," I mean the willingness, away from the therapist, to look honestly at myself and my life and to accept whatever pain, regret, and shame that may arise from such an honest examination.) Sometimes what you need is a different perspective and someone able to provide you with guidelines on how to turn your eyes toward such a different perspective.
A person who reads the stories on this site and feels no grief and/or disgust is seriously flawed. But on the flip side, coming here, reading the stories, and finding yourself incapacitated to the point that you cannot actually make some sort of difference to those who touch your own life is equally unhealthy and, to my eyes, alarming.
Let me put this another way. The vast majority of us on this site share something: the disgust and horror at what one human can perpetrate on another (usually vulnerable) human. HOWEVER, if reading stuff on this site makes you question fundamental things about yourself or your ability to handle hearing about the awful fucking things that happen in this world, then consider doing this: DO. NOT. READ. THEM.

I guess perhaps I have a phobia that I wasn't aware of before. I can say I was totally caught off guard on this particular story. I know nothing should surprise me anymore but it was just a gut shot to read that she may have been alive when they buried her in the crawl space. I had had a couple of drinks when I read that and coupled with the fact that I find that manner of death to be perhaps the most terrifying just made me freak out for a sec.
I think that every victim deserves to have their story told when they do not have a voice of their own to tell it, but damn, I just wasn't prepared at that moment in time, and frankly I was also surprised in a good way how fast this case has been able to be solved. When I first read about Genesis, before they even knew it was her, I figured this would become a cold case for awhile. Thanks to some hard work and diligent efforts by LE they were able to quickly find the truth and the asses responsible for such an awful crime.
I think it is a really good thing that there are people that are qualified and available to help others who are ready to help themselves when something is really bothering them. In this case, I do wonder how it has effected investigators and if they have had to reach out for that help. I know that in many cases we read about the investigating agencies make counselors available to personnel after a really shocking case. It's a very good thing and it is something I may get to utilize of I end up on a path to work with a team that works cases like these in the future.

I'm finally getting back to this case and it is worse than I thought it might turn out.
Monique Lynch allegedly beat Genesis with a belt because the girl had soiled herself, then the couple let her linger for two days without getting her medical help. Genesis may have still been alive when Sims and Lynch placed her in a plastic bag and buried her in the basement....People like this are void of any humanity, they serve no purpose but to serve themselves. They are the epitome of the soulless shit that manifests in humanity. It is hard to read this and know that others like them are out there and live amongst us.
I was looking for a better picture of little Genesis, I found the bio-mom's myspace, sad not to see other pictures of Genesis.

Lynch and Sims make first court appearance
Monique Lynch and Hanif Sims made their first appearance in court on Aug. 4 for charges related to the death of Sims’ 9-year-old daughter, Genesis Sims.
Genesis’ body was discovered by contractors working in the crawl space area of a Monument home located at 764 Century Place, Unit A on May 14. The body was buried 30 inches below the ground.
[...]
According to the El Paso County Sheriff’s Office arrest affidavit in interviews with El Paso County Sheriff’s Detective Ralph Losasso on July 7, Sims said “on the day of her death, Genesis Sims had soiled herself and Monique Lynch became upset and began ‘beating’ her with a belt. Hanif said he told Monique to stop, she had disciplined Genesis enough. Monique then took Genesis upstairs to clean her up. Hanif then left the residence to go buy cigarettes. Hanif said when he returned ... about a half hour later, he went upstairs and found Monique in the bathroom with Genesis. Genesis was dead.”
In a second interview, the following day, Hanif Sims said that when he arrived back at the house Lynch was yelling at Genesis to get up and “quit faking” and that he took her from the tub and tried mouth to mouth on her in her bedroom, where the couple kept her for two days, before burying her together underneath the house.
Also in the affidavit, “According to Hanif Sims, he told Monique to call 911, but that Monique told him no because she was wanted on a warrant for her arrest and she was pregnant with another child and could not afford to go to jail. Hanif admitted to detectives that he believed that if medical had responded when they should have called, Genesis would be alive today.”
In interviews with the detectives Lynch told them that she didn’t contact 911 because the Monument Police Department is “racist” and that she “didn’t trust them.”
In addition to previous charges that had been filed, Lynch is now facing a life sentence and being charged with first degree murder on a victim under the age of 12. She is still being charged with Child Abuse causing death, tampering with physical evidence and concealing death.
Sims is charged with Child Abuse causing death, tampering with evidence and concealing death. He faces a possible 51-year sentence.
[...]
“The D.A. will follow a motion to see that Lynch will be held without bond over the first degree murder charge,” Kathleen Walsh, spokesperson for the 4th Judicial District Attorney’s Office, said.
The next court appearance for Lynch and Sims is set for Aug. 12 in Division 16.http://www.coloradocommunitynewspapers.com/articles/2010/08/12/tri_lakes_tribune/news/11_mo_nws_lynch_court.txt

I know, But there are no missing toddlers in the area so whoever this baby is, he was never reported so it was probobly his parents who did it, so sad for this unloved lost baby... We dont even know if the child was a girl or a boy...

Investigators testified Friday that they have no physical evidence to determine who killed Genesis Sims before burying the 9-year-old girl’s body in the muddy crawlspace beneath a Monument home.
But they do have the statements of the two suspects in the murder, each of whom have implicated the other.
The testimony came during a preliminary hearing to determine if prosecutors have enough evidence to try Monique Alisa Lynch and the girl’s father Hanif Zarif Sims in her death. Lynch, 30, is accused of first-degree murder. Sims, 29, is charged with second-degree murder.
[...]
One of the men testified that they found the body in a triple-ply plastic and nylon bag buried about two and a half feet deep in the wet sandy soil.
The body was in a fetal position, said El Paso County Sheriff’s Sgt. Robert Jaworski, who oversaw the investigation. He said an autopsy was inconclusive as to the cause of death, but that it was a homicide.
The girl was dressed in jeans and a T-shirt. She was wearing a friendship bracelet. As photographs of the body were shown during the hearing, Lynch turned to face the courtroom wall, looking at a court document. Sims stared down at the floor.
Under cross examination, Sims’ attorney Matthew Werner asked Jaworski if “the only evidence you have that Sims’ hand caused the injury is from Mrs. Lynch?”
“At this point,” Jaworski replied.
[...]
Jaworski also testified that while investigators were searching for the couple, he interviewed Hanif Sim’s aunt in New Jersey. He said she told him of seeing bruises on Genesis and provided him a photograph she had taken of the injuries in July 2003.
Under questioning by Lynch’s Deputy Public Defender Cindy Hyatt, Jaworski acknowledged that occurred before Lynch and Sims became a couple.

Sims and Lynch to stand trial
After additional testimony was given during the second preliminary hearing for Monique Lynch and Hanif Sims, Judge G. David Miller ruled that there was enough evidence on all charges for the couple to stand trial.
Lynch will be tried for First Degree Murder, Child Abuse Causing Death, Tampering with Evidence and Concealing Death. Sims, meanwhile, will be tried for Child Abuse Causing Death, Tampering with Evidence and Concealing Death.
The first degree murder charge carries a mandatory life sentence and the child abuse causing death is a 48-year maximum prison sentence.
The preliminary hearing was continued on Nov. 5 after the initial hearing began on Oct. 30.
During the second hearing, testimony was given from several El Paso County Sheriff detectives that Sims and Lynch abused Sims’ daughter, Genesis Sims.
[...]
Sims claims that Lynch beat her to death. Lynch denies the claim, insisting that Sims beat Genesis.
After Det. Ralph Losasso finished his testimony Sims’ defense attorney Matt Warner said a criminal act has to be proven for his client to be found guilty at trial and that there was no proof that a criminal act had been committed. Warner added that no specific act by either Lynch or Sims was committed to cause Genesis Sims’ death. He said the most they could possibly be guilty of is how they handled her death.
Lynch’s defense attorneys Chad Miller and Cynthia Hyatt told the court that there is no evidence of any knowing or deliberate act by their client. They agreed with Warner that the guilt lies in the failure to act or respond to her death.
All three defense attorneys requested that bond be set for their clients.
Prosecuting attorneys Margaret Bellar and Sharon Flaherty countered that there is enough evidence to satisfy the child abuse resulting in death charge.
“Clearly there is evidence that the child was in a situation where she was left to be in danger,” Bellar said.
The prosecution requested that Lynch continue to be held without bond and Sims continue to be held on $500,000 bond.http://coloradocommunitynewspapers.com/articles/2010/11/05/tri_lakes_tribune/news/10_mo_nws_sims_lynch.txt

The couple accused in the death of the young girl whose body was discovered in a Monument home entered not guilty pleas in court Friday.
[...]
During the hearings, detectives with the El Paso County Sheriff's Office testified about how Genesis was mistreated by her father and step mother, according to neighbors and co-workers.
One of Hanif Sims' co-workers at Arby's told detectives his daughter was brought into work one time and had to sit in the back of the restaurant by herself for five hours.
Hanif Sims told co-workers she was not going to school because of disciplinary reasons and her step-mom didn't want her at home.
Neighbors told detectives they had seen Lynch hit Genesis on a trail behind their house yelling 'you're not wanted.'
One neighbor, who was friends with Lynch, told detectives access to the crawl space in the house was through a closet and Genesis was often put into that closet as discipline and told to do her homework.
Both suspects showed little emotion throughout the preliminary hearing. But when the prosecution showed pictures from the autopsy, they both turned away and did not look at the screen. The body was in a tarp and black bag in the fetal position.
Genesis' mother, Jopetia Garretson, was interviewed by KKTV 11 in July from her home in Newark, N.J. She told KKTV then that "I do want him (Sims) to suffer, and pay for what he's done, 'cause he walked away from her, whether he did it or not, he walked away from her."
The trial date has been set for May 31. The two will most likely have separate trials in court.

The couple accused in the death of a young girl appeared in court Wednesday. The defense argued that due to the condition of the body, an accurate manner of death could not be determined, and asked that coroner's "homicide" ruling not be allowed in the courtroom.
. . .
The judge ultimately sided with the defense and ruled that when the coroner takes the stand during the trial, he will not be allowed to tell the jury that he believes, in his professional opinion, that the manner of Genesis' death was homicide. I thought that was what experts were supposed to do. Give their considered opinions.
An 11 News reporter sitting in on the case says the prosecution was very upset with the ruling but they tell 11 News that ruling will not affect the charges, including Lynch's charge of first-degree murder.

This may be a point that can be brought up on appeal. It may not matter anyway, since the jury can decide for themselves if being abused to death constitutes homocide. I think most people would agree with the prosecutor that it does.

Woman accused in Monument girl's death takes plea deal
A former Monument woman accused of murder after the corpse of a 9-year-old girl was found in the crawl space beneath a vacant duplex has pleaded guilty to a charge of child abuse causing death, a court official said.
In exchange for her guilty plea, prosecutors agreed to drop the first-degree murder count against Monique Lynch.
According to a court clerk, the deal was approved Monday afternoon by 4th Judicial District Court Judge G. David Miller.
Further details about the plea deal were unavailable Friday, including whether Lynch, 30, will testify against the girl’s father, Hanif Zarif Sims, who is set for a May 31 trial on charges of felony child abuse.
A sentencing hearing for Lynch was set for June 30 before Miller. She faces 10 to 32 years in prison, prosecutors said.

Update: Lynch to testify against Sims
Monument residents are in shock over the news of Monique Lynch's plea deal that will drop her original charge of 1st degree murder. "It's totally inadequate to get a plea deal off of a murder charge of a child." says Monument resident Alan Stace..
The body of 9-year-old Genesis Sims was originally discovered in May 2010, by two contractors who were digging in the crawl space beneath a duplex where Lynch and Hanif Sims Genesis' father had once lived.
The El Paso County District Attorney Dan May tells News First 5 that in exchange for the plea, Lynch's charge will drop to child abuse resulting in death and she will face a sentence of 10 - 32 years. People we spoke to say that's not enough. "It should be very severe and that's not happening." says Stace.
In addition, the DA's office tells us Lynch will be expected to testify against Sims, whose charge will be upped to 1st degree murder. Even so, those we spoke with don't agree a plea like this should have been made. "If a girl is dead, for me it's life, not a plea issue." says Austin Fink, who was eating lunch in a grocery store parking lot. A woman we spoke to named Cindy agrees, "There should be no plea deal. It should be a closed case... Guilty."

For the second time in four months the trial of Hanif Sims — the father who allegedly beat his daughter to death and buried her in a crawlspace — has been postponed and rescheduled.
Jury selection was set to begin Oct. 11 but the trial is now scheduled for Jan. 30, 2012 to allow Sims’ attorney more time to prepare for the trial according to Lee Richards, public information officer for the Fourth Judicial District Attorney’s office.
Sims was initially charged with Child Abuse Causing Death, Tampering with Evidence and Concealing Death in the death of his daughter, Genesis Sims. Hanif Sims and Genesis
Father Returns To Court, Faces First-Degree Murder Charges
Hanif Sims, accused of beating his 8-year-old daughter to death and hiding the body, will be in court Friday.
He's accused of beating his young daughter to death, then burying her body in a crawl space.
Now Hanif Sims is one step closer to going to trial.
Sims stands accused in the death of his 8-year-old daughter Genesis, whose body was found by contractors while digging under the Monument town home where the father and daughter once lived.
Sims pleaded not guilty to first-degree murder charges last year. His girlfriend, Monique Lynch, accepted a plea deal to testify against him in order to receive a lesser sentence.
Lynch told detectives that Sims and Genesis got in an argument, which ultimately led Sims to grab his daughter by the throat and begin punching her. One punch caused Genesis to fall backwards in the bathtub, knocking her unconscious. When CPR didn't revive the child, Lynch said she and Sims started discussing ways to get rid of the body, ultimately deciding to bury the body rather than burn it, as Sims allegedly first suggested.
Lynch told a courtroom last June that she accepted full responsibility for her role in Genesis' death, that she stood by and did nothing while Sims killed his daughter. She was sentenced to 27 years.

Dead Girl's Dad Wants His Charges Dismissed; Mom Got 27 Years
COLORADO SPRINGS, Colo. -- Defense attorneys for a father accused of murder want the charges dropped, but a judge is refusing.
The body of Genesis Sims was found by contractors working on a home in Monument in 2010.
Her father, Hanif Sims, is charged with first-degree murder. His girlfriend, Monique Lynch, pleaded guilty to child abuse causing death and was sentenced to 27 years.
Lynch had been charged with first-degree murder, but that was dropped after she agreed to testify against Sims.
Lynch told detectives that Sims grabbed his daughter by the throat and punched her in the chest, causing her to collapse. When his attempts to revive her failed, Sims allegedly told his girlfriend he wanted to dissolve the body in the tub with acid but changed his mind after learning he would need a special license to get the type of acid he needed, according to a detective's testimony.
Sims' trial is scheduled to begin Jan. 30.
However, Sims' attorney now wants the first-degree murder charges dropped, saying that a tape recording proved that detectives misrepresented what Sims said in a jailhouse confession, according to the Colorado Springs Gazette.
But the judge said dismissing the case because of improper police behavior would be too extreme and wouldn’t serve the interests of justice, the newspaper reported.

A former Monument man accused in the murder of his 7-year-old daughter pleaded guilty to a lesser count Monday, a week after a judge cited what he called “stunningly sloppy police work” on the case.
Slated to begin trial Monday, Hanif Sims took a last-minute plea to child abuse resulting in death, averting courtroom battles over a tape that proved Sims never made a confession that authorities said he did.
Sims, 31, faces 27 to 40 years in prison rather than the automatic life term he would have received with a murder conviction.
Prospective jurors were thanked and released from their subpoenas Monday — marking an unexpected end to a trial that was expected to last up to a month.
Whether “sloppy work” by the El Paso County Sheriff’s Office led prosecutors to sign off on Sims’ 11th hour plea deal wasn’t clear because prosecutors Margaret Vellar and Sharon Flaherty declined to comment, citing a gag order.
[...]
The case against Sims was weakened before trial by the revelation that El Paso County sheriff’s detectives made a series of false statements about a confession from Sims.
The proof came in December, when a missing tape turned up and established that regardless of what the detectives said, Sims didn’t confess to leaving his injured daughter to suffer for two days on a bed before she was possibly buried alive.
Sheriff’s detectives Ralph Losasso and Sgt. Robert Jaworksi, who conducted the interview after Sims and Lynch were arrested in Henderson, Nev., and who stood by their claims, were cited by Judge Miller for “stunningly sloppy police work.”
Confronted with the evidence, lead detective Losasso said on the stand he was sleep-deprived when he misinterpreted one of Sims’ answers.
Losasso and Jaworski had previously said they inadvertently destroyed notes of the interview and didn’t record it.
After Miller ordered a review of evidence-gathering practices by the sheriff’s office, a District Attorney’s investigator tracked down a copy of the interview from a Nevada police detective who was in the room at the time — even though Losasso said no one else was present.
After reviewing the record, Miller directed harsh words at the detectives but said he couldn’t determine if they were lying or mistaken.
Miller tossed out other evidence from the interview and ordered that Sims’ attorneys Matthew Werner and Tracey Eubanks would have “wide latitude” to question investigators over the errors.
Eubanks earlier this month offered a glimpse of what a jury might have seen as a result — by pushing Losasso on the stand until he was visibly shaken.

The mother of a little girl whose remains were found in the crawlspace of a Monument home said she doesn't believe justice was served for her daughter.
Jopetia Garretson's ex, Hanif Sims, was accused of murdering their daughter Genesis, but struck a deal with prosecutors Monday. Sims plead guilty to child abuse resulting in death, admitting in court that he could have saved the little girl if he had called 911. He'll be sentenced in April to 27 to 40 years in prison.
"I don't think 27 to 40 years is good enough," said Garreston."Part of me wishes it would have still went to trail."
Garretson said she believes Sims got off easy because of big mistakes by investigators. Garretson said prosecutors asked her about the plea bargain and she agreed to it, but said she was also told that mistakes by the El Paso County Sheriff's Office lead to the deal.
"I was told that police screwing up is the reason why a plea deal basically had to be offered," said Garretson. "And pray that Hanif would take it."
It's something District Attorney Dan May said isn't true. May said mistakes by investigators had nothing to do with the deal.
"No, this was a plea deal worked out by the parties that we felt was fair under the circumstances," said May.
[...]
"Thank you, detectives, for breaking the rest of what was left of my heart," said Garretson.
She said she had spoken with both investigators in the past and was confident they would help bring Sims to justice.
"From talking to them, I would think things would have been just fine," said Garretson. "So thank you, detectives, for letting me down. Thanks for letting my daughter's memory down."
A sheriff's office spokesperson said he still can't comment because of a gag order in the Sims case. There is no evidence that either investigator has been reprimanded. TARGET 13 is waiting for an internal affairs investigation to be completed by the sheriff's office.

(cough) Well, personally, I think 27 - 40 years is pretty damn good for a lesser charge. True, life or death would have been even better, but this sentence is pretty lengthy and I can only hope it doesn't get overturned. That would be my biggest concern at this point. If they did sloppy police work and the original charges didn't stick, are we certain this conviction on this charge can't be appealed with success?

He swore a man confessed to burying his daughter alive.
The record shows he was wrong or he lied — and now he’s no longer a detective.
The El Paso County Sheriff’s Office said Thursday that major crimes investigator Ralph Losasso will be transferred out of the unit — one of several course corrections announced in the wake of a troubled investigation.
Sheriff Terry Maketa said he also has ordered a review of supervisors over his major crimes unit, as well as an audit of the unit’s major cases — 23 in all. In addition, all 400 sworn employees will receive a refresher on evidence processing.
The changes came after a judge knocked lead detective Losasso and supervisor Sgt. Robert Jaworski for what he called “stunningly sloppy police work” in the case of admitted child-killer Hanif Sims. Maketa did not dispute the characterization.
Both were present for a jailhouse interview with Sims, and both repeatedly testified to a version of events that didn’t happen.
Whether the errors were the result of deception or a series of careless mistakes remains an open question, 4th Judicial District Judge G. David Miller said last month after conducting a review of court transcripts. Miller, however, declined to toss the case, saying “police misbehavior” wasn’t enough to counteract other evidence against Sims and the responsibility of the courts to see to justice.
Maketa said nothing in the men’s past suggests they are capable of a cover-up. Maketa said he was previously blocked from commenting by a gag order that no longer applies to him in the Sims case.
[...]
Losasso will go back to patrol this month because of known problems with two other cases involving missing audio recordings, while Jaworski has no such record, Maketa said.
The transfer was strictly an administrative matter, meaning it doesn’t affect Losasso’s pay or benefits.
Whether Losasso faces official discipline depends on an internal-affairs investigation initiated last month. Maketa will also determine whether action is warranted against Jaworski.
While pledging to hold his deputies to account, Maketa praised Jaworski’s work at the sheriff’s office and called Losasso a “tremendous employee” who until the recent complaints had a solid reputation as one of five major-crimes detectives.
Part of the sheriff’s review will be to determine if there were extenuating circumstances that might explain the repeated errors, Maketa said.
“It’s such out-of-character behavior,” he said, adding that Losasso has played a central role in many successful investigations.

A man accused of killing his 9-year-old daughter was sentenced to 40 years in prison.
Hanif Sims pleaded guilty in January to child abuse resulting in death, a class 2 felony. According to 4th Judicial District Attorney Dan May, Sims said he did not seek medical attention for his child which could have saved her life.
At his sentencing hearing on Tuesday, Sims said, "I'm sorry. I tried my best, but I didn't try hard enough. I wish I could go back and change things." He received the maximum possible penalty.http://www.krdo.com/news/30947407/detail.html
I like that sentence. I don't know what truth in sentencing may mean for him, but 40 years is a nice long stretch.
