Argentine Township police said Dominick Calhoun, 4, was found lying on the floor of a bedroom about 2:30 p.m. Sunday at Pinehurst Apartments, 9087 Harper Street, after the boy’s paternal grandfather reported the possible beating.

The boy appeared to have been beaten and had injuries on his entire body. Argentine Township Police Chief Daniel Allen said the boy was "beaten from head to toe." The beatings took place over two days, and injuries were inflicted by fists and kicks, according to police.

Calhoune was taken to Hurley Medical Center in Flint, and placed on life support. He was removed from life support and pronounced dead at 11:02 a.m. Monday.

Police arrested his 25-year-old mother, who was found next to her son and was trying to comfort him, and the mother’s 24-year-old boyfriend, Brandon Joshua-Frederick Hayes. The mother was later released from custody.

Police said the mother also had visible injuries to her head, face and body.

"She was definitely beaten," said Allen.

Both the mother and her other child, an 8-year-old son also found in the apartment were taken to Hurley Medical Center. The 8-year-old received no injuries, and was taken into Child Protective Services’ custody.

Hayes, the suspect in custody, is not the biological father of either of the boys.

A neighbor told Flint-area media that the 8-year-old indicated the mom’s boyfriend “was stepping” on Calhoun’s head.

“He was stomping on his head, and kicking him in the ribs, punching him in the face,” Patty Brown says the child told her.

Several neighbors reported hearing loud noises coming from the apartment, but no one called the police, Allen said.

I hope that haunts them. Poor baby boy should've been loved and cuddled not used as a punching bag. Too many people turn a blind eye "not wanting to get involved". :dong:

I feel badly for the other child that had to witness what happened to the four year old. No sympathy for the mother from me. If he were my child, the only thing that would stop me from getting him help would be if I were dead. I can't believe the things people subject their children to.

It's amazing. A friend of mine was at his son's baseball practice last week and had to break up a fist fight between a mother and father while their 5 y/o son was crying and begging for them to stop. If they can do that in public, makes you wonder what that poor boy sees at home!

ARGENTINE TOWNSHIP (WJRT) -- (04/13/10) -- Grandparents of a Genesee County child are calling on everyone to take action whenever abuse is suspected.

Police say 4-year-old Dominick Calhoun was beaten to death last weekend.

The beating happened in Argentine Township, according to police, at an apartment on Harper Street.

The child was taken to Hurley Medical center where he died.

The boyfriend of Dominick's mother is being held in connection with the beating death.

Dominick's grandparents say neighbors and friends should be aware of abuse situations and call authorities, if necessary.

"It's going to haunt me. It's going to haunt all of us, I guess, because we didn't make sure everything's OK," Dominick's grandmother Julie Baker said.

Grandfather Martin Baker said he was shocked when he arrived at the apartment last weekend to see Dominick and his mother beaten. "The best thing for people to realize is, you know, if you hear any noises or anything at all, you need to call somebody, especially if you suspect it."

Family members say the beating of Dominick was severe, officials at Hurley's Trauma Unit tell them they have never seen anything like this.

Both Dominick's mother and her boyfriend were originally taken into custody. The mother has been released.

Brandon Hayes, 24, the boyfriend of the 4-year-old boy's mother, has been in trouble with the law his entire adult life.

According to public records, Hayes was incarcerated in 2004 when he was 18 years old.

In 2007, he was sentenced to two years in prison for assaulting, resisting, obstructing a police officer and fleeing police.

Prior to that, he was on probation for a year beginning in 2005 for possessing a controlled substance. He was also on probation for a year and a half for fleeing police, assaulting, resisting, and obstructing a police officer.

A Mt. Morris woman filed a personal protection order against him two months ago, and he was in court for that just last month.

The police chief said there were signs of previous abuse on the 4-year-old boy. His 8-year-old brother showed no signs of injury and was temporarily turned over to Child Protective Services.

When asked what Dominick endured, the police chief said it was as if he had been tortured. “It went on for several days. He was beaten, kicked and burned. It was bad — really, really bad, he was beaten from head to toe. He had burns on his hands.”

The mother had visible injuries to her head, face and body; however, her injuries were non-life threatening, according to the police chief.

Mother looks bad in that picture but she's alive and she did not sustain life threatening injuries. I"m not saying she didn't try to protect Dominick, I am saying she didn't try hard enough. I do think it is all possible they were all being held captive, baby killer threatening to injure/kill the 8 yo if mom didn't comply. Real, real bad situation. Still, I think they would have found either baby killer dead or myself, fighting for my boy's life.

The grandparents say neighbors should have been more aware, I agree. ALL of them failed in being more aware. Family is forefront in lots of cases who feel something is amiss. Dominick had old injuries, abuse started likely 3/30 as mother moved in with this fucker. Hayes had a criminal record, violent one too. Mother should have walked away as she saw the first sign of abuse. She had family to support her, she should have walked away, children in tow never looking back.

"Dominick was found unconscious in his Argentine Township apartment with bruises covering his body and all of his teeth knocked out..... burns covered Dominick’s body and his brain was “bashed out of his skull.”

Mother of god, the utter horror he experienced those last days brings me to tears. What really gets me is he died with mom witnessing what was happening to him. She was there in arms reach! I wonder how many times he cried out to mama? how many cries of anguish? and still, the beatings continued. No, no how I could have witnessed that hell and not kill the vicious POS. I might have died trying to kill that fucker but he would not have been standing come the cops knocking at the door.

I'm sorry but in cases like this...I hate the fact we can't do mob justice. Put this guy in general population after broadcasting what he did on tv to all the inmates and let them do the rest. As for the neighbors that heard the beatings and cries and did nothing... you deserve all the scorn and contempt you can get.

"Little Dominick met his boogie man, and that was defendant Hayes," Genesee County Sheriff Robert Pickell.
Hayes was also charged with first-degree child abuse, assault with intent to do great bodily harm, two counts of felony murder and three drug charges, said Genesee County Prosecutor David Leyton. He was arraigned this morning, and faces up to life in prison without parole if convicted.

Pickell said the joint investigation between his department and Argentine Township police is ongoing "especially as it relates to the mother." The mother of the boy was taken into custody after the boy was found by police on Sunday, but was later released.

Sheriff Robert Pickell says the youngster endured "torturous beatings" beginning Thursday. All of it, according to authorities, came at the hands of Hayes, who was his mother's boyfriend.

Hayes, 24, faces nine charges, including premeditated murder and torture. That torture charge is not commonly issued, according to Genesee County Prosecutor David Leyton, but one that was absolutely necessary in this case, Leyton said.

"This was simply a vicious killing, as bad as anything you could possibly imagine," Leyton said.

Investigators say the beatings began Thursday when the boy urinated on himself as he sat on the couch, eating his breakfast.

That "torture" continued for days, according to authorities. They say the toddler's mother was beaten right along with him.

Pickell says Hayes often referred to Dominick as a "crackhead" and said in the days leading up to his death that the little boy "deserved to die."

Investigators say the boy and his badly-injured mother were discovered Sunday when her sister came to buy drugs from the couple. A grandparent was notified, and he contacted police. Dominick was taken to Hurley, declared brain dead and put on life support.
The mother and Hayes were arrested.

She's since been released.

Hayes is being held without bond for the torture and murder charges. A $5 million bond was set for the remaining child abuse, assault and drug charges.

As a mom I know when a child is hurt at home in a normal accident time is of the escessance to get that child to a dr/hospital.

Baker appeared on TV with two black eyes. She was briefly treated at the hospital and released.
"He kicked me in the face, burned me with cigarettes. I was screaming... Screaming at the top of my lungs. … I thought I was going to die. Every time I would go to Dominick he'd rip me off him and I would go back and try to protect him as best I could," said Baker.

Looks like the bitch isn't gonna be popping out any babies any time soon. Now let's pray that the D.A. will go ahead and charge her, she is no better than Brandon, and was probably too high on meth to adequately protect poor Dominick.

Ok, I am kinda split on this. I really want to feel disgusted towards the mother, but for right now I just can't. She really may not have been able to get out and get her son help, that dude looks like he could be a real total fucking psycho. And if she was trying to get to the boy to protect him and she does have the bruises to show she was beaten too. I don't know. I am still split on this.

My opinion:
If my baby were being attacked, I would have more than a couple yellow-ing black eyes (which look a week old) and a cut on my nose. She had no defensive wounds on her arms, and neither did he. Maybe she tried to fight...but she didn't try hard enough. She could have tried to seduce Brandon, taken in him the bedroom and bit his dick off before she ran for help. She could have broken out every window, or even jumped out the window herself.
The abuse went on for days, didn't Brandon ever go to sleep at some point? She was able to let the 8 year old out to play, couldn't she have whispered to him to go to the neighbor's and call 911? And when she did call her mom, before he threw her SIM card away, she said "I'll call you back". Tell the mom to call 911, or call 911 yourself!
I think that if you are a mother, you have a DUTY to protect your children, no matter what the cost. I've been beaten up worse than her in street fights, the injuries she suffered were minor and didn't even look new. If Dominick had been my child, I would either be gone because I had fought to the death to save him, or Brandon would have been the murder victim in this case.

Police say the nightmare started Thursday, April 8 as Dominick Calhoun ate breakfast. He had an accident and wet himself on a sofa.

Investigators allege 24-year-old Brandon Joshua Frederick Hayes flew into a rage and beat his girlfriend’s child.

When his girlfriend Corrine Baker arrived home Genesee County Sheriff Robert Pickell says the man then beat her.

“As he beat her he was yelling, ‘Who is going to pay for this?’ referring to the sofa,” says Pickell.





Friday, April 9:

Investigators say Hayes was still angry the next day, and wanted to teach the little boy a lesson.

He hit and kicked the 4-year-old in the head and genitalia to punish him for the accident.

“He said he was tired of raising a little crack addict, and that Dominick deserved to die,” says Sheriff Pickell.

Investigators say Baker tried to protect her son, and covered his body with her own. She then was also beaten.

Saturday, April 10:
Genesee County Sheriff Robert Pickell says Hayes dragged an unresponsive Dominick out of bed by his arm.

Investigators believe the boy was unconscious as Hayes continued to beat him throughout the day.

“He even took his fingers, and pushed in on the boy’s eyes,” says Pickell.

Dominick now had suffered injuries to his entire body.



Sunday, April 11:

Baker’s underage sister came to the apartment to buy drugs in the morning, and saw the battered 4-year-old and his mother.

I am outraged and homicidal toward this cornholio, Brandon! As I understand it, he had his girlfriend and her kids move in at the end of March; got tired of her youngest boy; and decided to beat the life out of him -- and his mother -- before the month was half over. Just how can it have been a surprise to him that parenthood wasn't a cake walk?! And, if it was too much trouble for him, what sort of brain fart made it more expedient to kill the kid in front of his mother and brother, than to send her and her children packing? The monster is a psychopath.

I visited the mom's Myspace site, and she was so excited about this guy (before the date she moved in). His must have been a real Jekyll and Hyde transformation. What a nightmare come true. If he was already referring to her youngest son as "crackhead" (amazing hypocrisy and a misplaced epithet) in front of her, she should have taken it to heart and moved out quick. That's a bad sign. Just too bad she had no idea BEFORE she moved in. No doubt she felt she had nowhere to go, having given up her former home to move in with Freddie Kruger. I feel sorry for her. I think she was unable to fight . . . not evidently being able to even think that way or maybe not having had brothers or something . . . so she couldn't bring herself to do more than defend. I also wonder if cornholio was not sleeping while in his meth-fueled rage. So there would have been no opportunity to escape with her children. I can understand debilitating fear, but not failing to take an opportunity to run like hell when the monster left or slept.

I don't have an ounce of sympathy for this so called mother. Truth be told, I'd like to give her a beat down my own self. Sure, she was beaten but she walked away still breathing. SHE didn't get her brains beat out of her head. SHE made the decision to subject her kids to that big dumb vicious ox. SHE put them in harm's way, so fuck her. SHE should have gotten those kids away from him when he started his verbal abuse. How fucking ignorant do you have to be to call a little kid a crackhead? If SHE just had to have that monster in her life she should have found someone to take her kids in. Someone who could and would have kept them safe and allowed them to be kids.. But hell no, she left everything to chance. Verbal abuse and selling drugs from the home were not red flags to her? Unbelievable.

I have made plenty of mistakes as a mother but one thing I NEVER did was let anybody hurt my kids, in any way. I lived by the creed: You fuck with my kids and I will you fuck you up. Still do and my kids are adults. I've gotten myself in plenty of hot water through the years but it never bothered me because protecting my kids was/is MY JOB.

Yet again the smallest and most defenseless person is the one who got the worst of it. Paid for the sins of his mother with his life. And what about the older brother? He will be forever haunted and his life colored by what he witnessed in that house of horrors.

I'm sure many of us know about the case of Baby P in England, a boy who was tortured to death. Recently in prison, he got scalding water thrown in his face and now has scars. It was said he suffered in pain for several days. One can only hope that will happen in this case.

Authorities say the 4-year-old boy was tortured and ultimately killed by her boyfriend, Brandon Hayes.
Calhoun was taken off of life support one week ago.

A petition filed by the Department of Human Services asks for a court order to remove Dominick's, older, half brother from their mother's care.

Sorry, but I have no sympathy for the "mother" in this case. The fact the abuse was discovered when the boy's aunt came to buy drugs from them says all I need to know about the environment these boys were living in and IMO why mom didn't come foward with the fact her child was being beaten. It was fear of being found out as a junkie, not fear of her penis.

Drug fucked 'parents' should not be around young children. Children can be testing and need nurturing and loving to aid their developement.

IMO, her arrest now confirms to me why she didn't stop her son from being beaten to death. Not out of fear of her penis but out of fear of going to jail for violating her probation. She had a chance to save her son and chose to put drugs over her child. She deserves to rot in prison as well.

A judge arraigned her later in the day Wednesday. He set her bond at $50,000 cash.

Her drug charge carries up to a seven year prison sentence, which theoretically a judge could impose at later sentencing.

Her next court hearing is scheduled for April 29, 2010 at 8:30 a.m. in Livingston County.

The Genesee County Prosecutor's office says her arrest will not affect their investigation.

Meanwhile, charges against the neighbors (some of whom heard the child’s cry, “Mommy, make it stop.”) who say they heard the abuse but failed to call police are not expected to face charges.

I feel ill. What kind of neighborhood do they live in that no one nearby, no one who came by, no one could call the police because they all had something to hide? I've been wondering, why the 8 year old didn't tell anyone or make a call (because we sometimes read about them doing this), and I now know why. Because he was raised by people who believe the cops are the enemy and who would never tell him to call 911 in an emergency. They probably also never told him where or to whom he might be able to look for help if he were lost, being chased, alone. And now I have to wonder, if he had asked for help, would he have gotten any?

If I was one of those neighbors who didn't bother to call for help I wouldn't be talking to anybody N*O*W. My head would be hanging so far down from shame and guilt I'd most probably drown in a mud puddle. How do you ignore a little kid's cries for help??? And I understand being afraid and not wanting to get involved but COME ON. How can you not make an anonymous call to the police? I'm sure none of those neighbors knew the extent or the brutality of what was happening to Dom, but they knew something was going on. They didn't bother to speak up then so why are they speaking out now? They need to just STFU. What they say now DOES NOT MATTER ONE DAMN BIT.

The reactions of the LE involved tells me almost more than I want to know. The raw emotion these guys have displayed has made me go cold inside. I feel for them.

 LACASA is an acronym for Livingston Area Council Against Spouse Abuse. It is an all-encompassing support organization and shelter for abuse victims, and their families.

After watching and reading all of the news reports, Schrandt does not doubt that Baker was also a victim of abuse by her boyfriend. Schrandt said it is difficult for victims of abuse to think rationally. “It’s trauma,” she said. “It’s extraordinary stress and that stress shatters security.”

 Not knowing exactly what Baker was experiencing, Schrandt could only say that abused victims tend to feel overwhelmed and alone because of their circumstances. They have trouble acting. She said Baker likely felt shock and shame. Schrandt suspects that this was not the first incidence of abuse, due to the extent of the injuries.

 Oftentimes, abusers will tell their victims that if they leave or tell anyone, they will kill them or their children. “The most dangerous time is when she does leave. The consequences can be so severe,” said Schrandt.

 “Women have fear because they don’t have a place to go. They have no money. They’re likely to abuse alcohol and drugs,” Schrandt said.

 “Alcohol and drugs don’t cause the violence. Many people use alcohol and drugs and don’t beat up people.” Abusers, however, have tendencies for power and control and the drugs can exacerbate the problem, said Schrandt.

 One of the reasons women stay in an abusive relationship is for financial reasons. Schrandt said if they remain, more times than not, they have more money than if they were to leave.

 From her years of experience and research, Schrandt said our society blames the victim for not leaving an abusive relationship even though the abuser is the one committing the crime. “We blame her, but she’s a victim. The victim has to leave or escape, while the abuser gets to stay in the home.”

If she could speak directly with Baker, Schrandt said she would advise her to get domestic violence service for victims, as well as legal assistance and housing.

 Acknowledging there is little support or compassion for Baker right now, Schrandt said it reminds her of a phrase attributed to Jesse Jackson. “Don’t ever look down on anyone unless you are helping them up.”


Sorry Schrandt, the only helping up I'd give Corrine Baker is walking into jail. Her son was crying out for help... and she did NOTHING. People told her to get help for her son,and she did NOTHING. Her son was beaten to death over four days and she did NOTHING to help him. She moved in with a convicted felon,was dealing drugs with him and doing drugs etc. She is NOT a victim.
The only victims here are four year old Dominick Calhoun, his older brother and their loved ones.

You know, this story really just messed me up. It has been days since Dominick's murder and still... I just don't get it!

My 8-year old son is hugging me right now as I type this. The warmth of his cheek against mine, his loving arms around my neck 'a touch' too tightly (he's in my box!), and he says, "What are you doing, Mommy." "Typing," I say. "Okay. I love you, Mommy." "I love you too, Crazy."

I really, really, really hate Corrine Baker to death! We get thousands of pedophiles, murderers, and child killers, but I have never been so messed up over a story as I have been with this one. I never wanted kids, but from the day both of mine were born, I wanted them. Instant love. I could not go a day without their hugs, smiles, or crazy shit they do to purposely put me in the nut-house. And I would kill for them. Without a doubt.

Of all the piece-of-shit mothers we have featured here on DD, (to me) Corrine Baker is the queen of them all. She took the love of her sons, but never reciprocated it. She just decided to use it when she realized her ass was in the frying pan along with her waste-of-skin boyfriend. I couldn't even FAKE sympathy for Corrine if I had to in order to save my own life. She wasn't too scared or too traumatized to take her own sorry ass to the doctor. She could have told that doctor what was happening to her child. He could have alerted the authorities and SAVED Dom's little life. I can see it all, the SWAT team swooping down on the apartment, saving the two boys and possibly even killing Brandon in the process. But only one little mangled body was carried out of that place. The smallest and most defenseless.

I'd like to make Corrine MY victim. I so hope she gets the same treatment that Nixzmary Brown's mother got from the other prisoners. Oh how she cried and wailed when the other prisoners spit on her and called her names. Oh how I laughed when I read about it.

Hayes' attorney, James Piazza, said Hayes was diagnosed with paranoid schizophrenia in March.

The Saginaw attorney said during his meetings with his client, Hayes sometimes forgets why he is in jail and that Dominick is dead.

If so, why was he out and about, dealing dope and beating babies?

From my limited experience working at a medical center, a new diagnosis of paranoid schizophrenia got a patient time in a psych unit until an effective treatment regimen could be determined. Once the patient was released, he would have to strictly adhere to his regimen of medicine (usually Haldol injections) and outpatient counseling.

Whereas I might trust someone with a diagnosis of paranoid schizophrenia and years of effective treatment to watch my cat for a few hours, there's no way that I would let someone with a fresh diagnosis watch my cat, much less my daughter!

His illness is usually kept in check and fairly obvious when he needs a med adjustment. (He calls the FBI on people and once reported me to the cops for having him followed LOL)

Schizophrenia, by itself, is no more dangerous than being "normal" (most violent crimes have nothing to do with mental illness). You do tend to notice when a schizophrenic "loses it" because it is so far out of the realm of normal, that it is hard to fathom.

This guy may have not told her about his illness. It really doesn't matter. There is no excuse for his behavior and even less for her's.

Yeah, I realize that schizophrenia, if controlled, allows those suffering from it to lead fairly normal lives, as long as they stick to the treatment regimen. I dated a guy with paranoid schizophrenia for almost a year. I still don't know that I'd trust him to take care of my daughter, even though he had an effective treatment regimen and graduated from our local mental health facility's treatment program. The way he was with children made me uneasy, though. If your relative is good with kids, that's great.

According to his lawyer, though, Hayes was just diagnosed in March, which means that if he was following his doctor's orders and getting treated, he may have still been having his medication dosage tweaked, which wouldn't make him all that fun to be around.

It bothers me a lot that mental illness is used to excuse crimes. My family has a history of mental illness ranging from chronic depression to PTSD. The only thing we've used it to excuse is our lack of success in life, though. :tongue2:

Just six to eight weeks ago is when he was diagnosed with paranoid schizophrenia," attorney James Piazza told Judge John Conover in Genesee County’s 67th District Court Tuesday.

Piazza says a social worker at a jail where Hayes was lodged in March for domestic violence requested he be admitted for involuntary psychiatric treatment. He was then ordered to receive at least seven days of treatment at a psychiatric hospital where he received the diagnosis.

Piazza says doctors wrote Hayes a prescription when he was released from jail, but he could not afford to fill it. He says someone should have followed up on his condition, given the diagnosis.

Family members of 4-year-old Dominick Calhoun reacted with visible surprise. They say it seems as if there should have been follow-up.

Hayes’ defense attorney agrees.

“He's diagnosed like that, and then just released,” says Piazza. “You know, somebody dropped the ball somewhere."

The defense asked that Hayes be given a forensic exam to determine whether he is competent to stand trial. The prosecution agreed that was necessary.

Genesee County Prosecutor David Leyton says the public should know, this evaluation will help make sure a future guilty verdict is not thrown out.

“I think it is in the interest of the justice system, as well as in the interest of justice for Dominick Calhoun that we take necessary steps and make sure everything is covered," said Leyton.

The forensic exam could take up to two months to complete.

This family is working to make sure Tyler knows he is the most important thing to them.

They say while Dominick's dad was involved in the boys' lives, Tyler's father has never really been in his life.

16-year-old Christine moved her belongings out of her room, and into another sister’s bedroom, so Tyler could have his own room when and if he comes home. She doesn’t really know when Tyler will be able to come home from foster care, but she says it will help her heal.

“”I need him probably just as much as he needs me,” she says of her nephew. “I lost one. I can't lose another.”

Folks from the community have donated toys and clothes. The family can’t help but smile through tears when they think of the 8-year-old checking out his “Transformers” toys in a room of his own.

Poor Tyler. No relationship with his bio dad, brother is gone, mom will be too. At least his grandparents love him.

Yes. I don't think I'm explaining my position too well. I know plenty of people who suffer from a gamut of mental illnesses, and they manage to go through life without murdering anyone or using their illness to escape responsibility for their actions.

There are people who have committed violent crimes who are mentally ill and didn't know what they were doing or were clearly not in their right mind. This POS IMO is simply a child hating drug user.

You're explaining yourself fine. And that's exactly my point. There are plenty of UNTREATED mentally ill people that survive just fine and plenty of people with treated mental illness that do more than just "survive".

Mental illness is no predictor of violence. People see the mental illness diagnosis and assume that had something to do with it. And then apply the assumption that mental illness = violence. Mentally ill people are most often dangerous to themselves.

Are there violent mentally ill people? Of course. But there are are also violent "normal" people.

Certainly drugs can induce a psychosis with symptoms being like that of schizophrenia, i.e.; paranoia, hostility, distorted reasoning skills, etc.! My personal opinion, this was hayes' problem and the mental health experts recognized that, of course his lawyer isn't gonna add the term "Drug induced" and I am sure, it wasn't that hayes couldn't afford the prescribed meds, it was because he didn't want to take them, the meds would interfere with his "street pharmecutical" high, meth most likely, but pot can also bring on these awful behaviors. No way should this excuse hayes and his heinous act! I hope his withdrawals are so extreme that he claws at his juggular vein, rips it open and bleeds out before anyone notices.....
I, also, have a family member that was diagnosed with paranoid schizophrenia, at a very young age, it is truly sad, the meds he has to take, make him unable to feel or show emotion, which he says is the hardest part, but he realizes that to function somewhat "normal", he must.
I, also, have a nephew that was diagnosed with drug-induced schizophrenia from smoking pot, he started smoking pot when he was ten years old, sold it at fourteen so he could supply himself, arrested at sixteen and again for violating probation seven months later, went to jail and suffered withdrawals (a hair follicle test showed pot was the only drug) and went to the psychiatric unit where they diagnosed him. He now takes 50 mg seroquel and another drug (I am unable to recall) he is nineteen and disabled...............
Neither of these relatives have harmed anyone!!

I have faith that Brandon and Corrine will reap what they have sown, a thousand fold, I'm just not sure that I have the patience to wait on it to happen.......:lollypop:

While it all does nothing to lessen the loss of Dom and what he suffered it does help to know that those MOST responsible are going to pay. Let them pay hell for the hell they played on the young child. If Hayes's father was there saying Dom needed medical help why did he not take him himself? He could have called for two ambulances, one for Dom and one for his own son, who would need it after he beat the living shit out of him.

I really don't know how any of these people who knew what was going on can hold their heads up. That being said, these investigators and the prosecutor are my heroes. I can already see those heads on a stick. It doesn't make me happy like I thought it might. I'm relieved but that's it. The thing is nothing will bring Dom back. Nothing can undo or erase what happened to him the last four days of his life. It should be Corrine and Brandon 6ft under and rotting away. Dom should still be here, eating his 'ogurt" and driving his little red viper.

"That's gonna haunt me, haunt all of us, I guess. That we didn't make sure everything was OK," Dominick's grandmother Julie Baker said.

Neighbors heard Dominick's screams for days as he was hit, burned, kicked and punched again and again.

"In the end, the one he trusted most let him down - his mother," Pickell said.

It started when Dominick wet his pants.

"He wet on the couch and wet on (his mother's boyfriend) Brandon himself," Allen said.

That's what Brandon Hayes told police made him so mad that he started beating the 55-pound little boy.

It began Thursday, April 8.

Brandon told police he was mad about the mess on the sofa and the fact that he was broke and was supporting Corrine and her two little boys without child support from either of their fathers.

Dominick's dad was still involved in his life, that's why, investigators believe, Brandon took out his rage on the four year old.

"She took in a drug addict and a guy that was selling drugs, and her apartment became a drug house," said Pickell.

Investigators learned Dominick's mom left the apartment two times. But she was on probation and had violated it by moving out of Livingston County, so she alerted no one.

She went to a doctor's appointment with her parents the morning of Friday, April 9.

Later that day, Corrine, Brandon, Dominick and his brother would go to the dollar store with Brandon's father, who noticed severe burns on Dominick's hands and bruises on his head.

"He says we've gotta get this little guy to the emergency room," Pickell said.

Investigators say he then called Corrine's mom, who called Corrine repeatedly on Saturday, April 10, urging her to get Dominick to the doctor. Although he is vomiting and bleeding, she doesn't.

"Maybe someday she can admit she didn't do everything humanly possible to save that little boy's life," Julie Baker said.

Police say the abuse continued, and neighbors heard it.

"It just tears your heart apart to think about what that little child went through. We're talking about a four year old, and a four year old can consciously ask for help. I just can't see why somebody wouldn't call. It puzzles me," Allen said.

Investigators believe Corrine tried to stop Brandon on Sunday by lying on top of her son as he was being kicked and punched.

According to police, Corrine's sister and three others came over that day to buy marijuana and saw Dominick, battered and bruised, lying in his room. Corrine had bruises on her face and arm, and told them not to bother Dominick - he was sleeping.

Her sister would call Dominick's paternal grandfather, Rick Calhoun, who rushed over to help. "I knocked on the door. They answered and I got in there and seen what was going on, and got through them. Went into bedroom and seen my grandson laying here. I thought he was beat up, and honestly, at that point, thought he was resting. He was laying there with no clothes on. I thought he had taken a bath and was sleeping, but he wasn't. He was dying."

Dominick would never dance again. His favorite blankie was found, blood spattered.

Rick Calhoun did what police say his mother failed to - he contacted authorities.

All this time, police had been just three blocks away.

Calhoun said he did the only thing he could think to do at that point. He punched the man investigators say killed his grandson. "What are you supposed to do? I just wish I could have saved them."

When I saw, really, the full scale, the amount of violence inflicted on him, that's etched in my mind now. I couldn't find a spot. There was no, every spot on his body was badly beaten."

And a look back at the final hours, days and years of his short life reveals several people knew he was in danger, and someone, somehow could have made a life-saving difference.

"The neighbors weren't duty bound by law to call, but morally, it's the right thing to do. It's something they're going to have to live with," said Allen.

"I know they gave her way too many chances," Calhoun said.

"At some point, you've gotta draw the line and say is this the best place for children?" Allen said.

"All they kept coming back is they can't find any reason that warrants taking the kids out of her care. Well, they sure know now, don't they? They know now," Calhoun said.

What this revealed to me is that grandma, Julie Baker, also had an opportunity to do more. Sure she tried to persuade her daughter to do the right thing, apparently without going to check out the situation in person. And the father of the murderer, also had a chance to do something, having seen the burns on the child, but left it at telling his murderous kid and Corinne to take the kid to the emergency room. At least he called grandma. Not to diminish the fact that these two cared and did make arguments to their worthless spawn, but they could have forced the issue and didn't. Either one of these two could have made a report to the police, asked for a welfare check, called 911 themselves or just said, "Screw it, I'm taking the kid in myself. Just try and stop me." And I still want to horsewhip all the neighbors who failed to make that call, or walk down the street to the station.

Calhoun said he did the only thing he could think to do at that point. He punched the man investigators say killed his grandson. "What are you supposed to do? I just wish I could have saved them."

Grandpa was this little boys saviour, as best he could anyhow.

AND he managed to do what we would have all loved to do, he at least got one punch into that murdering asshole. Go Grandpa! You really are our hero.

All I can say is, Grampa, I don't blame you. I would have killed the bastard. I guess we know where he got those lumps now. This little boy is so heavy on my heart. I see his face everytime I look at my son. He is haunting me. How can we, that never knew him, be more affected by this than his own mother? I don't understand it. I guess it tears at old wounds for me... I want these people to hurt. I don't want them dead. Not for a long time. But I want them to suffer, and I want them to think of Baby Dominick every moment of it.

A hearing to determine whether a former Livingston County woman violated probation by living with a known felon, whom police say killed the woman's child, was adjourned Wednesday.

Corrine Baker, who is charged with second-degree murder in connection to the brutal beating death of her 4-year-old son, Dominick Calhoun, was scheduled to appear in Livingston County Circuit Court for a probation violation.

However, it was adjourned to July 22 while Genesee County authorities await a report on whether she is competent to stand trial for her son's death.

I read this yesterday,, the mother is pathetic excuse for a human. I read that she had "a moment" where she tried to protect her baby, which I am sure her defense attorney will mention more than once, but this is just another case of a stupid bitch that chose her penis and the drugs he was supplying over here own baby. She deserves the DP. I think all states should bring back hanging for child killers. Cruel and unusual? Fuck them!

As far as mental illness, violenct is extreamly rare with schizophrenia a novice DA should be able to handle disproving it as the cause of this animals behavior. Being an sick evil fucker is not an mental illness!

The injuries to a 4-year-old Argentine Township boy who was beaten to death were so severe and “unusual” that seasoned medical staff treating him sought counseling, a doctor testified Monday.

Dr. Brian Nolan, director of pediatrics at Hurley Medical Center in Flint, testified Monday in Genesee County’s 67th District Court that Dominick Calhoun was beaten and bruised on his head, back, buttocks, chest, abdomen and legs. The boy’s left hand was burned through the skin and his head was beaten so severely that his “brain was coming out of his skull,” the doctor said.

“What was unusual about the exam is the extent of the injuries to the genitalia,” Nolan said, noting that doctors and nurses sought counseling after treating the boy. “They were so swollen and bruised, and I’ve never seen those injuries in a child.”

Assistant Prosecutor Marcie Mabry announced that she intends to add a seventh charge — first-degree child abuse — against Hayes, who also allegedly beat and kicked Tyler during the four days of terror.

When asked exactly what she did, Christine Baker replied: “I walked into the apartment and Brandon yelled at me and said, ‘I don’t sell to minors.’

“I looked at him and I said, ‘I’m not here to buy your drugs. I’m here to see my sister and my nephew. So he did his thing and I sat my sister on the couch,” she said. “I looked at her and said, ‘What happened?’ ”

Christine Baker was prohibited in court from giving her sister’s reply. Christine Baker said, however, that her sister got up from the couch, went into the bedroom and lit a cigarette.

Christine Baker testified that Hayes told her “Dominick got beat up by friends,” but she didn’t know what friends and assumed it was someone in the apartment complex. That was a story, she said, “I didn’t believe.”

Christine Baker said she looked in the bedroom and saw her nephew — his face bruised and his body covered by a blanket.

“He looked like he was sleeping, but he didn’t sleep like that,” she said, noting that Dominick slept with his posterior in the air. “I had a feeling he was dying.”

Christine Baker said she told her sister and Hayes that she was going to call police.

The judge stopped her from saying how the two defendants reacted after the defense objected to the statements as being hearsay.

Christine Baker left her sister’s home and called Dominick’s paternal grandfather, Rick Calhoun, who went to the apartment, saw his grandson’s condition and called police.

I knew it was bad, really, really bad but to know medical personal treating Dom needed counseling puts things in a new category altogether. As the true horror of all Dom endured emerges there will be more people needing counseling. Brandon Hayes has victimized so many people with his mad dog behavior. He doesn't deserve a trial, he doesn't even deserve a name, he only deserves death. I'd like the honor of killing him, I could do it with my bare hands. I'd like to choke the life out of him. I'd like to watch life leave him, and see his eyes go blank as he slumps lifeless to the floor. I just know rainbows would break out all over and angels would be singing at the precise second of death.

I'm sorry, there is NO excuse for why his "mother" didn't get help. Every day, we hear more and more about the horrible injuries this boy suffered,injuries bad enough that the people who treated him have to get help...and she did NOTHING.
With all due respect to battered women advocates and others who have tried standing up for her (no one here thankfully),there is nothing that anyone could say that will change my mind on the feeling this bitch should be hung right next to the baby beater himself. I don't ever want to see those injuries. What this guy did was torture. Mom should have been the one on the receiving end of all that rage and insanity. I'll never in my life believe that she is innocent. I've seen battered women, one in the mirror. There is no justification for how she handled this situation.

She did not value her own life. If she was scared for her own life like she says, she would have high-tailed it outta there the first second she could. She didn't. She didn't even hint to the trouble she was in. She wasn't in fear of loosing her life, she was in fear of what would happen if she lost her dick or pissed him off. No, she did not value her own life, Therefore she did not value Dominick's. She put more value on the reactions of this monster, than her own actions. That is not a crime. Her crime was purely and numbly allowing the systematic torture, maiming, and killing of a child. Her own child at that. No one has that right.
The above line will stick with me for a very long time. I don't remember reading that before. I guess he was jealous of poor little Dom, and decided to make him disappear.

Patricia Green, a contract social worker for the Department of Human Services, was the first witness to testify on Monday. She has been a social worker for approximately 27 years and has been seeing Dominick’s 8-year-old, half-brother, Tyler Baker, since Dominick’s death.

 Green has been helping Tyler cope with the grief and loss of losing his little brother and being removed from his home. She said even though Tyler is a strong little boy, he is experiencing a lot of anxiety.

 The social worker’s testimony was sought to determine the best way for Tyler to testify in court against Hayes. . . .

 Tyler witnessed the incidents that led to his brother’s death. In addition, assistant prosecuting attorney Marcie Mabry said the prosecutor’s office is prepared to file additional charges of first-degree child abuse against Hayes, based on bruises that those involved with the case observed on Tyler.

 Mabry said Tyler is not only a witness, but a victim, as well.

 Green said Tyler has indicated that he wants to tell the judge what happened. “I think he’ll be able to do it (testify),” said Green. “But, we’ll have to keep him safe.”

 Dr. Brian Nolan, director of pediatrics at Hurley Medical Center in Flint, testified. Nolan is a well-known and respected expert in his field. He is board certified in multiple areas, including pediatric child abuse.

 Nolan testified that he saw Dominick on April 12, the day after he was brought to Hurley. Dominick was on life-support, following brain surgery. When asked what condition the little boy was in, Nolan said he was “critical, in a coma. He expired that same day.”

 Because of his “hopeless” condition, the family made the decision to remove him from life support.

 The doctor said Dominick’s injuries were consistent with torture. He added that what made this case so unusual was the extent of damage done to the genitalia. “He was so swollen and bruised,” said Nolan.

 The prosecution submitted 12 photographs taken of Dominick in the emergency room.

 In addition to the bruises and swelling over his entire body, the doctor said Dominick had a severe burn on the back of his left hand. It was dry and dark purple. “It’s the most severe burn you could have.” He said medical attention should have been sought on the very painful burn.  

 Christine Baker, 16, the younger sister of Corrine Baker was the last witness to testify on Monday. Christine and three of her friends went to Dominick’s Argentine Township apartment on April 11. She testified that two of her friends wanted to go to the apartment to buy marijuana from Hayes and that she wanted to see her nephews. She said it was well known that Hayes sold marijuana and vicodin and that she witnessed her friends buy marijuana from Hayes on April 11.

 She was unsure how long her sister, Hayes and her nephews had been living at this apartment. The sisters and young boys had lived together previously, until Corrine was evicted from the trailer park for not paying her rent, said Christine.

  When asked why she was no longer living with her sister, Christine said, “I was sick of her, her lying and manipulating.”

 Tyler was outside playing at the time of Christine’s visit.

 . . . Christine proceeded to close the bedroom door and attempt to leave. “I was scared. I saw his face. I could feel it in my stomach.

 “I tried to leave, but Brandon yelled at me. I was staying calm until I got out of there,” said Christine. She said she told Corrine she was going to call the “cops.”

 “I had a feeling he was dying,” she said. Once outside the apartment, Christine called Dominick’s grandfather, Rick Calhoun and told him he needed to get to the apartment immediately.

The judge overseeing Brandon Hayes’ preliminary hearing has ordered that Hayes be removed from the court when the 8-year-old brother of Dominick Calhoun testifies — a decision that Hayes’ lawyer believes violates his right to face his accuser.

“Just because prosecution wants to coddle somebody, when it violates my client’s rights of confrontation, it shouldn’t be done,” said Hayes’ attorney, James Piazza of Saginaw.

Genesee District Court Judge John L. Conover ruled that Hayes be placed in a room outside of the court when the boy testifies. Hayes will be allowed to watch by video and will be able to interact with his attorney.

“I think this is the right thing to do,” said Conover.

Piazza said his client has a constitutional right to a face-to-face confrontation with his accuser and doesn’t think there should be an exception because the witness is a child.

“The Constitution doesn’t help the government bury my client,” said Piazza, who intends to challenge the decision if the case is eventually bound over to Circuit Court for trial.

Prosecutors say this procedure will protect Dominick’s brother from further trauma while preserving Hayes’ constitutional rights.

Genesee County Prosecutor David Leyton said it is becoming more common for children to testify in court, and in this case the court has to strike a balance between protecting the child and protecting the constitutional rights of the defendant.

“We’re doing what the child needs, we’re doing what the state needs and we’re able to protect the rights of the defendant,” he said.

Leyton said he doesn’t believe Hayes’ rights will be violated because he can still see the testimony and talk to his attorney as though he was in the courtroom.

He said before children testify investigators interview them “very carefully” to determine what happened. Interviewers determine whether the child knows the difference between the truth and a lie and ensure he or she feels safe.

On the stand, prosecutors question the child witness delicately and in a friendly way to avoid further trauma, said Leyton. After the testimony, there are programs in place to ensure the child receives services he or she needs.

Uh no Mr. Piazza, it's trying to prevent further trauma to a child who saw his brother get beaten to death. There is precedent for this so his blustering to the press is doing nothing more than making the bonfire people want to ignite under his client's feet grow even stronger.
And while I don't claim to be a lawyer, I do know most lawyers try to get the best possible verdict they can for their client.
If Mr.Piazza uses the same tone in the press on a child who saw his brother get beaten to death, the jury may convict his client solely on the fact his lawyer looks like a bully.

client’s rights of confrontation He'd better watch his choice of words. This just connotes intimidation and violence. This guy can interact, view the proceedings, and "know" his accuser over the TV. Since they use this technology in many court hearings anymore, for pleadings and such, to better protect the court and the people from violent criminals, I see no difficulty. Hell, I'm not sure he should even be allowed out of the jail for any of the proceedings, much less for this one very vulnerable witness. He can attend the whole trial and all the hearings from miles away over CCTV, and never get out of the jail to ride in a van, see the outside, smell the fresh air, see his girlfriend in person, for all I care.

His 'accuser', his rights of confrontation? we are talking about a child that was abused by this fucker and witnessed the brutal murder of his brother that lasted for days. His accuser. He's the survivor. And IF we were not talking about a child I'd be all for a confrontation, one that would include beating this baby killer's head in.

This is one of those instances when I see the law so assbackwards. I am so very glad the judge sitting there saw the same thing and didn't allow it. Poor child is destroyed. He might not show all the trauma inflicted on him from this incident yet but it will come. Keeping this living nightmare away from him is priority for this childs well being.

Confrontation. The sleazebag can see what's going on, confer with his lawyer, and know who is "accusing" him, if he wants to call it that. The court can also set it up so the court can see the sleazebag. The only thing he can't do is come out and say something to the witness, which is what he has a lawyer for anyway. So, what we're doing is making sure his right of creating an outburst is contained and he cannot make faces or gestures in such a way as to intimidate the boy. If I had my way, he'd never set foot in the courthouse while that boy was there and he'd be forced to wear clown makeup while on the video screen.

As for him feeling "raw" over spending $100 at the store for four people, that is pathetic. I have a saying about money, it comes, it goes and as long as you have a job or some income there will always be another pay day. WTF was his money for if not to run the household that he had which contained four ppl?

FLINT (WJRT) -- (06/28/10)--Brandon Hayes will stand trial in the beating death of his girlfriend's son, 4-year-old Dominick Calhoun.
Genesee County District Court Judge John Conover made that ruling at the conclusion of Hayes' preliminary hearing.
Hayes is accused of beating, torturing and killing Calhoun during a period of days in April after he wet himself and the couch inside their Genesee County apartment.
The shear number of injuries and how serious they were was really the determining factor according to the judge. The doctor who performed the autopsy says he stopped counting when he got to 100.

On top of that there was heart-wrenching testimony from Calhoun's older brother. The boy witnessed what happened during the last days of Calhoun's life."He was puking and everything, puking up blood," Calhoun's brother said.
"I think his leg was broken because he couldn't walk. He was like walking crooked and everything. Every time he'd stand he dropped right back down."
That was how Calhoun was acting after repeatedly being "smacked around" and "punched" in the genitals after having his head smashed into the wall, according top Calhoun's brother.
Calhoun's hand was badly burned.

"He (Hayes) hated us," Calhoun's brother said.
The doctor who performed the autopsy says Calhoun's injuries were the worst he's ever seen on a child or an adult.
A Genesee County detective read a portion of this letter Hayes wrote. It's dated one day after Calhoun was taken off of life support.

"Dear judge: I am so sorry for what I have (done) to Dominick and Corrine. My heart hurts so bad for them and for the family," said David Dwyre.

"I will never do anything like this and never had the intentions of doing what I have done. I am sorry. Judge, I am a drug addict."

One additional charge of 1st degree child abuse was added today. Calhoun's brother testified that he was also abused by Hayes.
Hayes now faces 10 charges. One of his drug charges was replaced with a less serious charge.

Hayes attorney says he is disappointed all of the counts were bound over. He says he doesn't believe elements to support some of them were met.
Hayes' attorney will file motions in circuit court to try and get some of the counts dismissed.

He says he'll also file a motion to strike Calhoun's brother's testimony, as his client was placed in a separate room while he was on the stand. He will ask for a new preliminary hearing.

Tyler told the court Brandon had hurt him and his brother before, but described escalating violence in the days before his brother died. The prosecution asked whether he told anybody about the abuse in an effort to get help.

“Brandon said if I told my mom, he would lock me in my room for a long time,” the boy explained.

He said his mom eventually figured it out. Corrine Baker then confronted Brandon Hayes who Tyler says then again became violent.

“(My mom) was pushing Brandon away so he wouldn’t hurt my brother, then he smacked my mom on the head.”

The beatings continued, and Tyler told the court he knew his neighbors knew what was happening.

"His (Dominick’s) head was smashed into the wall. That’s what was making the banging noise, and the neighbors heard it.”

“How did it end with Dominick?” asked Mabry.

“Dominick had bruises from his head to his toes,” said Tyler as he described the last time he saw his brother before he died.

After testifying at the hearing that will determine whether Hayes goes to trial, Tyler returned to his foster family. He has been in protective custody since his brother’s death in April.

This case and Baby Peter's case tear me up..literally. I have had dreams about them; and my rage for those who witnessed, heard or suspected abuse seems to grow daily. How could any human being know or suspect and not report it? Hell, go over and knock the door down and see if what you're thinking is true. Jail for malicious mischief would be a small price to pay, and might have saved his life!

There are no words to express my contempt and disgust for the bio-unit. I would love to torture her to the point of death, then revive and heal her and start over again. I wonder how long I could keep the pig alive? She could have saved him; instead she let him be tortured to death. Scared for her life? Shit on her. I took the worst beating of my life when I was 11..and curled over my baby sister to protect her. Prosecutors Filing New Child Abuse Charges Against Mom's Boyfriend

On Saturday Dominick lay in bed in a listless state until Hayes dragged the little boy from his bed by his arm. Hayes then allegedly once again started beating Dominick. “He hit and kicked him again and again,” Pickell said, even though the boy was in an unconscious condition.

On Sunday, April 11, when Christine Baker, Corrine’s younger sister, dropped by to buy drugs, she realized what Hayes was doing to Corrine and Dominick. Christine informed Richard Calhoun, Dominick’s paternal grandfather, who brought in the police.

When Dominick arrived at the hospital, he was pronounced brain dead and was placed on life support. On Monday, April 12, he was removed from life support and Dominick passed away.

Doctors said that Dominick had repeatedly been kicked in the genitals and head over and over again. They told Sheriff Pickell that Hayes had poked at the boy’s eyes with his thumbs and fingers. Doctors had to remove a portion of Dominick’s skull because his brain was swollen so badly.

“This case goes beyond torture,” said Pickell. For the police officers involved in the investigation Pickell said this has been gut wrenching.

Genesee County Prosecutor David Leyton said, “This was simply a vicious killing, bad as anything you could imagine. The pictures are indescribable.”
I'm shaking from this. Tears I cannot have as my boys are here, but my heart weeps, simply weeps. I cannot imagine someone so filled with rage to do such horrors on a child. I cannot fully wrap my mind around this. I keep telling myself, Dominick suffers no more, no more pain, anguish, shattered heart. He was broken in every way. There is no fear, no suffering like the child who suffers as the one who he adores does nothing. Kisses Dom....

I have to remind myself, Dominick lights the heavens with his glorious, soulful eyes.

Dominick's father posted something on facebook about this today. He said he didn't hear about many of the things that happened to Dominick until today. He is really hurting. I can't imagine the pain he and Tyler are in. I didn't know this little boy and my heart breaks everytime I hear something about him.

Oh my god are you serious? I think a part of me just broke forever. When I first read this story I wept like a big ol' pussy. I'll never forget "gouged his eyes". To just be hearing about it all now just opens and salts the terrible festering wound that will never heal. I had said before that I really hoped the 8 yo didn't actually witness his brother's murder, but that was a fantasy I will never enjoy again.

You can tell tat Tyler wanted very much to tell his story. He was very articulate too. He didn't even sound nervous more like he was in a rush to make sure he got everything said. Tyler being the voice for Dom is so touching. I feel very, very proud of him for being such a big boy. I think I might have tears in my eyes.

On the other hand, watching that goober from hell lurch across the floor at the beginning of the video made me want to throw up. I was just watching him thinking how good it would feel to hit him with a cinder block right in the middle of his back. Then as he falls backward from that mighty blow I would pick up the cinder block and drop it on his groin while shouting " Dominic sends his love FUCKER."

I had a nightmare last night that my oldest son of 5 died of some kind of brain clot or something, some medical condition that was unheard of in my dream. It was the worst nightmare that I can remember having in my life. I just remember crying and crying and wondering what I could have done to prevent his death. How could this so called mother stand there for 4 FUCKING DAYS and watch her son die and NOT try to prevent his death. I wish I could beat the piss out of her to the point of near death and then find the closest person to her (maybe her 8 year old son) stand over her and tell her that she can't go to the dr because it's closed. Then ask her how she feels to have help right in front of her but not given to her by the one person that she feels the most love for.
Ok, I feel better now...I don't usually go off like that, but damn...I am so aggravated and hurt by this story!

i have not read this whole thread yet, but my kids just got home and i am about to get distracted and forget what i was going to say. my senile musings must see the light of day!

Aside from the fact that there appears to be plenty of evidence that bio incubator had many chances over those days (and probably in the weeks leading up to this) to save herself and her child, the double black eyes are a POSSIBLE sign of a closed-head injury more severe than just a couple of shiners.

many posters have commented that a few punches and scratches wouldn't stop them from saving their baby... fuck yeah, i agree with that... but she may have been rendered unconscious for many hours. And upon regaining consciousness, she may have been extremely disoriented. just wanted to mention for argument's sake.

but yeah, she wasn't unconscious long enough for me to give her a pass on this. when the penis kills baby, i never consider the mom equally guilty of the crime as the evil murderer who kills, but she failed her adorable boy, a heinous crime in itself.

I gotta say, I have had black eyes worse than this before. But no one beat me. I was throwin' up real bad with a bout of ulcers. When I stood up, I passed out and knocked myself a good one right on the forhead. I hit the sink dead on but I never hit my eyes. Over the next few days the blood from my forehead drained down my face and I would up lookin' like someone had beat the shit outta me. My husband and I went through hell, cause no one believed he had not hit me. Hell I wouldn't have believed me either. That's why I had to say that. Doctor who performed autopsy, grandmother of Dominick Calhoun testify in Corrine Baker hearing
FLINT, Michigan — The doctor who performed Dominick Calhoun's autopsy testified this morning in Corrine Baker's preliminary hearing.
Baker, 25, is facing second-degree murder and child abuse charges in the death of her 4-year-old son.
Baker's boyfriend, Brandon Hayes, 24, is accused of torturing and beating Dominick to death in April.
Baker cried as Dr. Brian Hunter described bruising and burns found all over Calhoun's body.

He said severe head trauma was the likely cause of death.


"When we removed some of the gauze from around the head, you saw that there was massive swelling of the brain," he said.

Hunter also described burns, some that may have been caused by cigarettes and others in which the cause is unclear, on Dominick's head, abdomen, arm, genitals, and most severely on the back of his left hand.

Julie Baker, Corrine Baker's mother, also testified Monday morning.

She said Hayes' father called her on April 9, three days before the boy's death, telling her about the burn on Dominick's hand.

Baker said she attempted unsuccessfully the next day to contact her daughter and arrange to take her grandson to the hospital to treat the burn.

She began to cry as the prosecution and defense attorneys questioned her about her efforts to contact her daughter after learning about the burn.

Mother to stand trial for little boy's death
FLINT (WJRT) -- (07/19/10) -- Dominick Calhoun's mother, Corrine Baker, will stand trial on second-degree murder and second-degree child abuse charges.

Genesee County District Court Judge John Conover made that ruling late Monday afternoon after testimony ended in her preliminary hearing.

The testimony today took the court through three days in April; a weekend of terror, according to the prosecutor.

During the last days of 4-year-old Dominick's life, he was beaten, burned and battered.

The first witness today was a doctor who described the manner and cause of Dominick's death. "Abusive head injuries and other blunt force and thermal injuries, that was the cause of death. The manner of death was homicide," said Genesee County Medical Examiner Dr. Brian Hunter.

Prosecutors say Baker's inaction is led to the charges against her. This afternoon, we heard from a number of witnesses who saw the bruises, a big black burn on the boy's hand and did not call for help, either.

The officer who was first on scene that Sunday when the call for help went out was the final witness today. He took pictures, and said what he saw was devastatingly shocking.
His emotions took over when, after he arrested Hayes, he was alone with Baker and the boy.

Brandon and Michael DeLong, uncles of Dominick who live nearby the Argentine Township apartment where the boy was beaten and tortured, said they saw Hayes walk to a gas station for a short period of time on Saturday, April 10, two days before their nephew would die from injuries believed to have been inflicted over several days.

Conover said Baker should have taken that opportunity to seek help and get her children away from Hayes.

“She did absolutely nothing," Conover said. "If that's not willful and wanton, I don't know what is."

Baker’s mother Julie Baker, Hayes’ uncle Rodney Keen and Hayes’ father Arnold Hayes each testified that they saw or were notified of Dominick’s burned hand on Friday, April 9, but all failed to convince the boy’s parents to take him to a hospital.

"They said they couldn't do that because they had warrants for arrest and they didn't want child services involved," Keen said.

Keen had gone to the home with the intention of buying marijuana, but said he didn't buy it after growing upset over Dominick's hand.

"He was so mad that he didn't buy the marijuana that he wanted," said Conover about Keen's testimony. "What reasonable, responsible, intelligent human being would walk away and not do anything?"

Keen notified other family members but did not take further action.

Bobby Everard, a neighbor who lived on the floor beneath Baker and Hayes, said he heard on that Sunday morning a child yelling "Mommy, stop him!"

Everard, who testified while wearing blue plastic gloves and had a long white beard and mustache that entirely covered his mouth, said he had been hearing banging on the walls in the days leading up to the discovery of Dominick's abuse.

Just thinking about those sissy- marys who did nothing to intervene inspite of what they heard and saw it makes my blood boil. How do you ignore the sounds of a child in agony? Corrine Baker. . .was sentenced this morning to 55 months to seven years for violating probation on a Livingston County drug case.

Circuit Judge Michael P. Hatty said the sentence, which far exceeds the recommended guidelines of zero months to three months, was not an angry response to the events surrounding the murder of Dominick Calhoun . . .

Hatty said that if it hadn't been for Baker's actions — violating her probation by cohabiting with a felon and living in a home where a large quantity of drugs were present — her son would still be alive.

"You did not protect that child and that child ended up dying a long and torturous death," the judge said.

"I am very sorry for my violation. I understand my actions have caused other things to happen," she said. "I will be judged on that matter. I'm very sorry."

Baker's attorney, Steven Dodge, argued she should be judged on charges related her son's death by a Genesee County jury and not Livingston County.

Former Tyrone Man Seeking Separate Trial In 4-Year-Old's Death


9/13/10 - A former Livingston County man accused of beating a 4-year-old boy to death is now requesting to be tried separately from the mother of the victim.

24-year-old Brandon Hayes is charged with ten felonies including first-degree murder, torture and child abuse in the beating death of Dominick Calhoun.

His attorney had previously filed motions for a change in venue and an independent psychological exam, but has now also filed to have Hayes case separated from that of his girlfriend, 25-year-old Corrine Baker, Dominick’s mother.

Baker is charged with 2nd degree murder and child abuse for not doing more to protect her son.

Their cases were combined in July with plans to have them stand trial together as co-defendants. A hearing on all three motions is set for September 20th.

Hayes allegedly beat the child in the couple’s Argentine Township apartment over the course several days. Dominick was found by a relative April 11th and died the next day after being removed from life support at a hospital.

He also charged with a separate count of 1st degree child abuse for allegedly assaulting Dominick’s 8-year-old brother. (JM)

Let's get back to the fact the NO ONE did ANYTHING! For Frick's sake, people, call the ambulance yourselves! Call the police yourselves! Take the child and run hell for leather out of the apartment and to the hospital! Let the chips fall where they may -- just DO IT.

Hearing this is like watching the bad parts of a movie over again, hoping something will change. . . .

It is a difficult decision to make of when to get involved and when to mind your own business.......... My neighbors routinely get drunk and have loud arguments, with the accompanying sounds of crashing furniture and drunk people falling down etc. There have been many times when I sit there holding the phone with the 9-1- just waiting to press the other one. Sending my husband over to make sure that no one is actually hurt hurt, but just drunken stupidity ensuing.

This past weekend when we were leaving to go out - I very clearly heard my neighbor tell her husband 'to take his fucking hands off of her' followed quite clearly by audible sounds of slapping/and or punching. I got in my car away from the windows and I called the police.

I like my neighbors and I didn't want anyone to get into trouble. But all I could think about is how many times have we read the stories on here where people heard what was going on and did nothing? What if he kills her? Puts her in the hospital? How could I walk away from my home and go and enjoy myself wondering if my friend might be dead when I returned?

Officer O'Brian called me later that evening to let me know that they did indeed have to take her husband away because he was beating the crap out of her and they could visibly see him through the window choking the ever loving crap out of his wife.....

He spent three or four days in the pokey and then he came back home. She is still with him, and she is not talking to me, because even though they won't tell her who called them, she believes I am the one responsible and told me that I should have minded my own business.

Did I do the right thing? I thought so at the time. And should I hear those two going at it again, I will not hesitate to call the cops again. Just because she is willing to take the ass whooping - doesn't mean I am willing to sit in my apartment and listen to it.

I couldn't ignore the cries of a grown woman who should freakin know better than to live with the asshole she lives with. How these people could ignore the cries of a child over the course of SEVERAL DAYS, is beyond me.

I am going to miss my friend. I pray she comes to her senses before it's too late and her story ends up here.

sorry, just had to vent my frustration over trying to do the right darn thing..............:argh:

I agree it can be tough under many circumstances -- like the ones you mentioned. You did the right thing, and the question of whether to do it again (for her) is even tougher since she is so ungrateful.

As an adult, I find it harder to feel any real sympathy for her situation. She chose it. She chastised you for interfering. She took him back in. On another occasion, you could be forgiven for just ignoring her.

Or you could continue to call because your own inconvenience, being forced to listen to the disruptive goings on there, is considerable. You have a right to some peace and quiet in the night. Maybe you could petition for their eviction.

But I believe in the cases involving kids, everyone has to agree that those kids can't do it for themselves and they don't get to choose the circumstances they live under. Calling, over and over and over would be imperative.

I made that post right after reading about what happened to Dominick in the last days of his life,so my thoughts on what should happen to this POS were very raw.
In retrospect, him getting prison justice will be bad in the way that it will give him sympathy he doesn't deserve and take focus on the real victim of this case, little Dominick, who was failed by neighbors,family and his own worthless mother.

Tell your older child to go find help. There are many things this Bitch could have done to save the life of her son, but she didn't. I realize it's hard to think in certain situations, but damn. One of those options had to have entered her mind at some point. Poor sweet angel. He was so precious. I hate reading stories like these. It hits me so hard. I always put myself in the child's shoes. What they were probably thinking, how they were feeling. And it just makes this whole thing worse. I could never have a job dealing with these kinds of situations. A hearing was held Wednesday in Judge Duncan Beagle’s courtroom regarding Corrine Baker’s parental rights of her son Tyler Baker. Child Protective Services of Genesee County has petitioned the court to terminate her parental rights.

 Baker’s parental rights case remains on hold as the court is waiting to hear the results of her criminal case. In the mean time, Tyler remains in foster care.

  Baker violated a condition of her probation on a previous offense in Livingston County when she failed to notify the county she had moved. She was convicted and sentenced in August and is serving up to seven years in prison on this, minus credit for time already served.

 The next hearing on this case has been scheduled for Feb. 15, 2011 at 1:30 p.m.

Piazza wants a Circuit Court judge to strike Tyler's testimony from the record and send the case back to District Court for new testimony — this time, with his client sitting at the defense table and not in another room watching via closed-circuit television. The officer said Hayes told him that he continued the assault April 10 and again April 11 when Dominick began vomiting and bleeding from the nose. Hayes also admitted striking Dominick's mother, Corrine Baker, when she confronted him about her son, he said.

Hayes is charged with six counts relating to Dominick's death, including premeditated murder and child abuse — charges Piazza will argue should be dismissed because there is not enough evidence to support the allegation.

"To charge child abuse, they have to prove my client was the parent, guardian or authority over the child; it was his girlfriend's child," Piazza said. "They can't establish child abuse, first-degree, as well as the felony murder (charges). ... Did he have a pen and paper to make notes and then was there a break during which his lawyer was allowed to go communicate with Brandon before he questioned Tyler?

I really hope that poor kid doesn't have to testify AGAIN with Hayes in the room and if he does I hope that he is strong enough to pound those nails into that fuckers proverbial casket.

This one makes me sick; I imagine he'll have something to answer for when he meets his maker. I don't care WHAT he thinks was broken in the way of laws; we're talking about an EIGHT YEAR OLD who has been traumatized ENOUGH in his life, all the way up to having to watch this man MURDER his own little brother. He gets to walk around with that for the rest of his life; can this "human being" of a lawyer even consider for a minute what he's trying to do, what it will do to this child if he should succeed??

Child Protective Services took Dominick’s 8-year-old brother Tyler Baker, a child who told police he witnessed the abuse that killed his sibling, into custody. He’s been there ever since.

From the perspective of Tyler’s grandparents, it is an atrocity.

“Does he know we haven’t abandoned him? Does he know we want him?” asks Julie Baker, Tyler’s grandmother.

She says she and her family have written him letters telling him they love him, but they never get a response. They fear the letters aren’t reaching him.

“We just want him to know that we love him,” says Martin Baker, Tyler’s grandfather.

The couple says they have gone to numerous hearings, but a judge has decided not to take away their daughter Corrine Baker’s parental rights at this time.

“She deserves due process,” says Baker’s criminal defense attorney Fred Meiers.

He points out she has not been convicted of child abuse or murder.

However, her parents point out that she is in prison serving a minimum 4-year, 7-month sentence for dealing drugs. The sentence was handed down in August. It stems from the fact she was on parole for the crime when Dominick died, and violated parole by living with a felon in a home with drugs.

“He will be a teenager before she gets out,” says Julie Baker. “Tyler should be home with us.”

The Bakers say fighting Corrine for custody is nothing new. They say they petitioned for custody of both Tyler and Dominick years ago, because Corrine struggled with drugs and was an unreliable mother. She often left the boys with them for long periods of time and they wanted to provide a permanent home. The court did not allow them to do that then.

They say the courts failed Dominick at that time, and are failing Tyler now.

Dominick Calhoun’s paternal grandfather Rick Calhoun says he witnessed the home the Bakers provided for Dominick and Tyler. He says it is a miscarriage of justice that they aren’t allowed to bring the boy home.

“This is where he was happy,” says Calhoun. “This is where he smiled.”

From the family’s research they say Corrine Baker could sign her rights over to them, but she refuses to so far. They have started a letter writing campaign aimed at convincing her to do so.

It shouldn't matter to family court. She is in prison for at least four years, two years longer than they can justify leaving the child hanging waiting for a permanent placement. I'm not terribly concerned that he is given to the Baker family, but social services should be addressing the need for permanent placement and moving to remove the child from the mother's custody. I wonder if they find the Baker family unacceptable. Seems likely, with one daughter in prison over drugs and the other also a drug user.

2/8/11 - A trial date has been scheduled for a former Livingston County man charged in the murder of a 4 year old boy. Brandon Joshua-Frederick Hayes, who used to live in Tyrone Township, will head to trial March 29th on various counts including first-degree murder, first-degree child abuse and torture in connection with the beating death of Dominick Calhoun in Argentine Township last April. Hayes’ Attorney James Piazza is still waiting for dates to be scheduled on a variety of motions he filed. He’s seeking to quash or reduce some charges and wants earlier testimony from Dominick’s 8-year-old half brother Tyler Baker to be thrown out. Piazza also requested that several drug charges be tried separately from the murder case and that his trial be held separately from that of the boy’s mother, Corrine Baker. She’s charged with 2nd degree murder in her son’s death after authorities say she didn’t do enough to stop the beating. Her trial is also slated to begin March 29th in Genesee County Circuit Court. Genesee County Prosecutor David Leyton tells WHMI that they would prefer to try the cases together and that a cut-off date for motions to be filed in either case has been set for March 7th. (JK)

A judge will consider whether to allow into court a confession Brandon Hayes made to police about beating a 4-year-old boy to death last year in Argentine Township.

ayes was in court today for the hearing about his statements. Genesee Circuit Judge Richard Yuille said he will review the confession and determine whether or not to admit it into evidence.

Hayes' attorney, James Piazza, argued in court that his client was going through heroin withdrawal and was a diagnosed schizophrenic and thus not able to understand his rights or what was going on.

Assistant Prosecuting Attorney Tammy Phillips said Hayes was competent because he was responsive to questions from police.

Investigators Sgt. David Dwyre of the Genesee County Sheriff's Department and Arch Ravert of the Argentine Township Police Department both testified that Hayes was responsive.


"I was scared," he said when he was asked about the interview with Dwyre. "I just remember him telling me what I was arrested for. I don't remember much (about the interview)."

In the interview, Hayes is alleged to detail how he beat Dominick over a four day period because the boy wet the bed.

You know, my 15 month old grandson is cutting 2 teeth at once and is cranky and whiny all day. Today he stuck two finger up my nose and his little fingernails scratched me pretty badly. My nose started bleeding and my eyes watered. I was pretty aggravated, but as I sit here with cotton balls up my nose, not once did it occur to me to hit, punch, choke or kick him. I put him in his crib and took care of my nose and cleaned up. He's squalling nonstop right now, so I'm going to pick him up, offer him a snack and cuddle him. Where the hell do these sewer rats come from?

I will say the same thing here I said on Facebook: If he was able to detail what he did to the baby over FOUR days of beating he was sane enough to understand his rights. He was able to communicate effectively so I feel that he was able to understand.

The mother of murdered four-year-old Dominick Calhoun took the stand Wednesday during a motion hearing.

Baker’s attorney Fred Meiers asked the judge Wednesday to throw out statements she made to police about her son's death just before she was charged.

“I felt intimidated,” said Baker on the stand.

She says the prosecuting attorney and a detective pulled her aside and questioned her in a locked room at the courthouse. She was there to see Brandon Hayes face a judge. She says they never read her her rights.

“At the time, I talked to her she was the mother of a deceased child and a victim of domestic violence,” said Marcie Mabry, who retired from the Genesee County Prosecutor’s office last year. “I wasn’t talking to her as a suspect.”

Defense Attorney Fred Meiers said any statements made during this questioning should be inadmissible. He said the rules of professional conduct call on prosecuting attorneys to make sure the accused are aware of their right to get an attorney.

If Brandon was beating the shit out of her and Dominick and she was such a victim, the last thing she would have been worried about right then would have been legalities. I would think you would be more worried about/grieving for your dead child with maybe a splash of relief that you were finally liberated from the hell you claimed you were enduring. This legal wrangling sickens me. Everybody has rights, oh hell yeah, but NOBODY ever has any responsibilities. These baby killers are always the victim of somebody or something....or so they claim. We are to believe they are all saints and just victims of society, and we should weep and wail for their sad pathetic asses. Until the day one of these dead babies appears in front of me to tell me specifically that the he/she/it responsible for his/her death is truly not guilty my unbridled hatred will continue for all child abusers. I truly wish I was mobbed up because this thread would have a completely different tone. These two (and many others) would be history. I would have done sent some big goon out to do to these two the EXACT same thing to them as was done to Dom. Right before the death blow I would ask them: "How intimidated are you now fuck-wit?"

Trial Date Set For Two Charged In Argentine Boy's Death


5/19/11 - A September trial date has been scheduled for the two individuals charged in the beating death of an Argentine Township boy. 25-year old Brandon Joshua-Frederick Hayes is charged with 1st degree murder and child abuse in the April 2010 death of his former girlfriend’s son, Dominick Calhoun. Dominick’s mother Corrine Baker is facing 2nd degree murder and child abuse charges for allegedly not doing more to protect her son. Genesee County Prosecutor David Leyton tells WHMI that they anticipate the trial will begin in September to provide some closure to families of the victim. However, he says there are still a number of outstanding issues left to address before it begins. Several defense motions are pending. Hayes’s attorney James Piazza is looking to suppress statements he made to police and argues he was released from a mental hospital a few weeks before the incident and is a diagnosed schizophrenic. He says Hayes was in jail and going through heroin withdrawals when police decided to interview him. Prosecutors have argued Hayes was competent because he was responsive and answering questions. Meanwhile, Baker’s attorney has filed an order for an appointment of a battered woman syndrome expert as well as a number of motions including one for a change of venue and another to suppress Baker’s out of court statements made during an alleged unlawful interrogation.

To define intimidation is to make timid; fill with fear.
Did she not see her son, her young innocent child inflicted with this very fear??
was she then too intimidated to do nothing even as he screamed for mommy for days?! ....even as she had opportunities to do something, tell someone. but did nothing?! I, give her nothing.
She might yet learn what that raw fear was like as her dying son as he begged for mercy...
Even then it will not be the same.
She as adult with a possible winning chance to defend herself---she cannot use this excuse as she stands living and breathing today, ffs! she watched his horror but did NOTHING!

It's a sicking feeling to read that even now she is asking for leniency. What did she offer to her son? Not her protection, not her duty, not her love. She dare say she was intimidated. She was his mother and she failed Dominick, failed in the worst way a mother can. If she had any decency. She'd ask to be punished to the full extent. As much as I despise her I could respect that.

Two things come to mind; one, sure people have rights... as long as they have the money to pay the high-end lawyers who will do or say anything for a buck. And two, I don't give a shit HOW crazy/schizphrenic/ whatever he was, he killed a child, he needs to go to J A I L. Not a nice comfy mental institution where he has a hope of getting out when he's no longer "mentally unstable", but imprisoned with nothing for the rest of his miserable, nasty, disgusting waste of a life.

Judge Duncan Beagle terminated the parental rights of Corrine Baker on Wednesday, June 1. This action opens the way for placement of her 10-year-old son Tyler, who has spent the last 14 months in foster care. . . .

 Since Dominick’s death, Tyler has been living with a foster family. Family members have had no contact with him. Because of the circumstances, Genesee County Child Protective Services petitioned the courts to terminate Baker’s parental rights.

 Baker’s attorney requested that the case be adjourned until after Baker and Hayes’ criminal trial, however, the judge denied that request. Baker, who was available via telephone, then pleaded no contest in the matter during the hearing. The court found that terminating her rights was in the best interest of Tyler.

 A post-termination review hearing is next in the process and family members, or even the foster family, could express interest in adopting Tyler. This decision will be made through the attorneys and the Department of Human Services.

 Baker will be granted one last visitation with Tyler in the next couple of weeks, most likely at the facility at which she is incarcerated.

 Rick Calhoun, the biological grandfather of Dominick, was in court Wednesday when the judge terminated her parental rights. He said he and other family members are saddened that they have not been allowed to see Tyler since he was placed in foster care.

I keep thinking about Tyler, her other son, how much his life has changed over loosing Dominick. Not only losing his brother but his mother and family he was used to. In some respects it's far, far better, but still, hard on such a young child and so life changing.

On April 12, 2010, Corrine Baker woke up in jail.

She was covered in bruises, her hair was matted with blood, and her eyes were nearly swollen shut. Argentine Township Police had arrested her while they investigated the torture and beating of her 4-year-old son Dominick Calhoun.

While she sat in a jail cell, her little boy died.

She was released from jail for a short time before being charged with child abuse and second degree murder.

“The last thing I wanted was for my little boy to die,” she said at the time.

She said she had done everything she could to save her little boy from the brutal beating handed down by her boyfriend, then 24-year-old Brandon Hayes. She said Hayes was abusing drugs and flew into a rage when the child wet himself on the sofa in their Argentine Township apartment.

Corrine Baker defended her actions. She said she had screamed for help, but neighbors ignored her. She said she had fought Hayes, but he beat her. She said people saw what was happening to her and her son, but turned a blind eye.

One year, 4 months, and 19 days after her little boy’s death, she stopped defending herself.

“The underlying theme was: she did too little, too late,” said Argentine Township Police Chief Dan Allen.

Police had presented to her evidence that she had opportunities to get help for her helpless son, but didn’t.

They presented witnesses who claimed Corrine said she didn’t get her son medical help because she feared getting in trouble. She was on probation for a drug crime, and was not supposed to associate with anyone with a criminal record. Her live-in boyfriend, Brandon Hayes, had a record.

Baker's family members testified that she had opportunities to get help from them, but hid the fact that there was what would become deadly trouble in her home.

“She didn’t intervene as a mother should,” said Allen. “Putting a time-line together of that weekend left her no wiggle room to get out of the charges. The case against her was strong.”

Baker told Genesee County Prosecutors she will help them put Hayes away. She will testify against him when he goes on trial.

You know I feel for any mother in a violent relation, sincerely do. I won't say I know how it feels to be there as a mother but I do know how it is to be beat by your man. Having a kid in the mix must have been a fucking nightmare.
It comes down to life and death in a situation like this. This fucker went out of complete control, lost it all together and took his
rage out on her son. At some point she must have realized the only thing to stop it was to put a gun to his head as he slept.

Flint, MI –*The mother of 4-year-old Dominick Calhoun, the boy who was tortured to death over the course of four days, will spend the next 13 to 30 years in prison after she pleads guilty to second-degree murder. I know a lot of you are familiar with this case, but for those of you who are not and don’t feel like reading our original article, let me ruin your morning a bit. Last April, 4-year-old Dominick was sitting on a couch eating cereal when he accidentally wet his pants. His mother’s boyfriend, 24-year old Brandon Hayes, became enraged and began beating the boy. Over the course of four days Hayes would punch, kick, and burn Dominick. He would even stick his thumbs in the little boy’s eyes. Dominick’s mother, Corrine Baker, would also become the recipient of some of Hayes’ abuse, but at no time did she ever alert anyone that Dominick was being severely beaten even though she had multiple chances to do so and her friends were urging her to call police. It wasn’t until Baker’s younger sister came to the apartment to buy drugs that anything was done to save Dominick, but by then it was too late. Corrine’s younger sibling saw signs of abuse and immediately called her grandfather who in turn called police pleading for someone to go check on the boy. Officers would find Dominick in his bedroom unconscious and moaning. He was admitted to the hospital where doctors had to remove a piece of the boy’s skull to accommodate his swollen brain. He was pronounced dead the next morning and Hayes was then charged with his murder. Baker was later charged with second-degree murder and second-degree child abuse for her actions, or inactions, that led to her son’s horrific death. She had allegedly told friends she couldn’t contact police because she feared they’d think she abused the boy or arrest her for violating her probation by moving without notifying officials. She didn’t take her son to hospital for fear of Child Protective Services getting involved. Both Baker and Hayes were to be tried next Wednesday in a combined trial, but Baker has decided to save a little bit of her skin and plead guilty to both second-degree murder and second-degree child abuse. By doing so, she is no longer looking at a possible life sentence. In exchange, she will still be at the trial on Sept 7, but now as a witness against Hayes. Baker will be sentenced on October 24th where she can get anywhere from 13 to 30 years in prison. I’m going to assume that her performance during Hayes’ trial will factor into the judge’s decision. The prosecution says that this is not a plea deal and that can choose to use Baker’s testimony or not. The family are behind the deal because it means Dominick’s older brother, who was present during the beatings, may not have to*testify. Judge Denies Moving Murder Trial & Excluding Testimony



9/8/11 - Jury selection begins today for a former Tyrone Township man charged with the murder of a 4-year-old boy. 25-year old Brandon Joshua-Frederick Hayes is charged with 1st degree murder and child abuse in the April 2010 death of his former girlfriend’s son, Dominick Calhoun.
Two days have been set aside for selecting a jury, with opening statements expected to begin next Tuesday in Genesee County Circuit Court. In court yesterday, Judge Richard Yuille rule on several defense motions, denying requests to move the trial to a different venue, exclude testimony Hayes made to police after his arrest, prevent testimony from Dominick’s older brother and to sever the drug charges against Hayes from those directly related to the death of Calhoun.
The judge did, however, dismiss a count of Assault with Intent to do Great Bodily Harm Less Than Murder. Hayes would still face an automatic life prison sentence with no parole if he’s convicted on the murder count. It’s unclear whether the boy’s mother, 26-year-old Corrine Baker, will actually take the stand against Hayes, although she has agreed to do so if called on by prosecutors.
That was a condition of her plea last week to 2nd degree murder and child abuse charges. In exchange for being available to testify, prosecutors will recommend she serve between 13 and 30 years in prison when she is sentenced October 24th.
