One year old Elaine Keene of Fort Smith, AR died yesterday after being shot in the head in Oklahoma on Saturday.

According to reports, Elaine was in the back seat of her mother's car when her mother drove two teenagers to a home near Roland, OK to commit a robbery. There the teens; 19 year old Michael Clemente and an unnamed 17 year old male, robbed and beat 21 year old David Jeremiah. After the crime, the two jumped back into Elaine's mother's car and the woman drove away from the scene. As they were fleeing, David Jeremiah opened fire on the vehicle...shooting baby Elaine once in the head.

I believe there definately should be some charges filed against the mother of the child! She knowingly put her child in harms way that ultimately caused her death.

i think the mom should get charges, not the victim...victim didnt expect a baby to be in the getaway vehicle...not only that the poor guy was prolly running on adreniline and acted on instinct....theres 2 victims...the guy that got jumped and the baby...all three crooks need to pay for it! JMHO

I think the mother should be charged she willing took them to commit a crime. and she knowingly put her daughter in that situation.

I am troubled -- deeply troubled -- at Jeremiah's firing at the robbers as they fled. Had he shot them as they were in the act of robbing or beating him then I would not have any qualms about the matter; however, once the threat to his safety ended so did his justification for the use of deadly force.

I am troubled -- deeply troubled -- at Jeremiah's firing at the robbers as they fled. That is exactly how I felt about this situation too, Al.

Another question I have, did he have the gun on him, or did he go get it from somewhere?

In this article, Jeremiah's first name is reported as Devin. They've updated the previous article as well.


At the residence, Clemente and the teen held Jeremiah down, beat him and robbed him of firearms and possibly narcotics, Lockhart said.

As the suspects fled in their vehicle, Jeremiah retrieved a .22-caliber rifle and fired. One of the shots broke through a window of the suspect's vehicle and struck the baby, Lockhart said.

Upon discovering the baby had been shot, Lockhart said, the suspects dumped the stolen items and drove toward Fort Smith.

Along the way, they made contact with a Roland police officer and told him the baby had been shot.

The officer said he would call for an ambulance, but the suspects
decided to drive the baby to Sparks themselves, according to Lockhart.




Jeremiah knew the suspects prior to the robbery, Lockhart said, but the nature of their relationship has yet to be revealed

Baby Elaine's mother Heather Jones tells us if she had any idea what was actually going on the day she took her one-year-old to Devin Jeremiah's home, she would have never have gone. "She was the happiest baby. I'm gonna miss her."

Heather Jones says she didn't know what was going to happen when she drove two teenagers and her one year old baby to a friend's house. "They were just going to play pool with one of their friends. That's what they told me," she said.

But things did not go as planned.

Jones says her nephew and his roommate, 19-year-old Michael Clemente beat and robbed 21-year-old Devin Jeremiah while she stayed in the car with Elaine.

She says her nephew came running to the car, yelling at her to go.

That's when she says Jeremiah started shooting at her car, hitting Elaine in the back of the head. "The shots were fired and Mike started saying "Oh my God, Oh my God" and Aaron said "Go to the hospital" and I turned around and she was bleeding. I handed her over and he kept her alive until the hospital and he was breathing for her. I knew she was dying, but I still had hope," said Jones.

Elaine stayed on a ventilator throughout the weekend and was pronounced dead Monday morning. "If I had known about them going up there and robbing him and beating him, I never would have put myself, my baby's life in danger. I'm pregnant now- so the one I'm carrying," said Jones.

Jones says she blames more than just the man who fired the gun for Elaine's death. "I love my nephew to death but right now I despise him. And Michael- I have nothing to say to him. Because if he never would have hit him, if he had never gone in and started any trouble, this would have never happened," said Jones. I don't know if I buy mom's story. Plausible? Sure. But if they were going over there to play pool as she thought, why would she be waiting outside in the car?

I'm wondering if it was misconstrued or what...but it just seems kinda weird she said it like that and not "the one I'm carrying and Elaine" ya know...

This really bothers me. I agree that it seems weird she would wait in the car if they were going to play pool with a friend. A game of pool does not usually take 5-10 minutes and it would seem like she would be in for a long wait. Why not go in the house with them if it was so innocent?

This really bothers me too. Why would she not even mention putting her little girl in danger at all...I understand saying herself and her unborn baby, but its just cruel and downright odd not to say anything about the little one that got killed.

I really hope they come up with enough to charge the mom with neglect or endangerment at the very least. I think she knows way more than she is saying.

She looks like 15 yo, and way, way collected for having just lost a child. I'm not really believing her. I think she's lying to cover her ass. Just seems odd that she would be waiting in the car if she'd just gone to drop the them off to play pool.

I agree completely with Al, this person who was attacked shouldn't' have been firing out wildly as the threat was once gone. Also, this Devin is not an innocent victim, he brought trouble to him by engaging with narcotics and firearms.

Authorities in Sequoyah County have arrested Heather Jones, the mother of a 1-year-old baby who was killed during a robbery north of Roland on February 27.

Sheriff Ron Lockhart said investigators brought Jones in Friday and re-interviewed her about the case, then arrested her in suspicion of child endangerment and conspiracy to commit robbery.

"There was some problems with all the statements that she's given, plus her interview on Channel 5," Lockhart said. "It's not that we didn't think she was involved, it's just that we had had to get enough evidence to prove it."

In the exclusive 5NEWS interview Lockhart referred to, Jones claimed she had no idea the two teens she was with on February 27, 19-year-old Michael Clemente and 17-year-old Aaron Bowen, planned to rob and beat 21-year-old Devin Jeremiah at his home north of Roland. Investigators say Jones was driving the car Clemente and Bowen used to flee Jeremiah's home, and as they were leaving the victim fired a rifle several times at the car. One bullet struck Jones' one-year-old daughter, Elaine Keene, who later died from her injuries.

But investigators say other information gathered from sources including a Crimestoppers tip to Fort Smith Police this week convinced them Jones knew about the robbery.

"We confronted her and she was arrested after we interviewed her," said Lockhart. "I won't go into details about what she said, but we're giving the case file to prosecutors this evening (Friday) and they'll decide if they should file additional charges."

How old is this woman? She looks very young. NOt that is really matters, just curious why she was hanging out with teenagers. I know she was related to 1 of them but as a grown woman with a child and one on the way she shouldn't have had enough in common with them to want to hang out ya know?

Her original arrest was for child endangerment and conspiracy to commit robbery.
Authorities in Oklahoma have filed first-degree murder charges against 19-year-old Heather Jones, the woman whose one-year-old daughter was killed during a robbery in February north of Roland.

In the filing statement, prosecutors said Jones and the two others knew Jeremiah sold drugs out of his home, and went there so they could steal the controlled substances from him.

Clemente and Bowen were arrested in suspicion of first-degree murder shortly after the robbery, and Jeremiah was later arrested in suspicion of second-degree murder. Prosectors say Oklahoma's home defense law didn't apply in this case because the car was fleeing and Jeremiah was no long being threatened when he shot at it.

People 5NEWS spoke to in Roland said they fully expected Jones to be charged with murder.

"They knew what they were up to, and the fact that they brought a little kid to commit a crime like that was there was a chance there would be violence is pretty shocking in itself," said Jo Sparks.

"She knew what was going on," agreed Twana Carrillo. "I mean they could have lied to her and told her something different, but… she knew, I think she knew."

A Fort Smith man is sentenced to 15 years in an Oklahoma prison for his part in a robbery which ended in the death of a child.

Michael Clemente was sentenced to 10 years for 2nd Degree Robbery and five years for Conspiracy to Commit Robbery.

The Sequoyah County District Attorney’s office says as part of a plea agreement, a 1st Degree Murder charge against him was dropped.

Clemente, Heather Jones, and Aaron Bowen were charged with the shooting death of one-year-old Elaine Keene in March 2010. Jones is Keene’s mother. Jones and Bowen are awaiting trial on the murder charge.

Were there any repercussions for David Jeremiah? His life was no longer in danger as the car drove off so why wouldn't they charge him as well. Maybe they did and I missed it in the thread.

It was mentioned earlier in the thread (#9). Looks like he's still not to trial. The full article on Clemente's sentencing says:

Police say Keene was shot and killed as Clemente, Jones, and Bowen sped away from a robbery with the victim,Devin Jeremiah, shooting at them. Jeremiah, who reportedly fired the deadly shot, faces a 2nd Degree Murder charge.

In a plea agreement, Aaron Christopher Bowen pleaded guilty to second-degree robbery and conspiracy to commit second-degree robbery.

Bowen, 19, of Fort Smith is one of four defendants charged in a February 2010 robbery that left 1-year-old Elaine Keene dead. He is the second to opt for a plea agreement rather than go to trial on a first-degree murder charge and more in the robbery-related death of the baby.

Sequoyah County District Judge Jeff Payton sentenced Bowen to 10 years in the Oklahoma Department of Corrections on the robbery charge and five years on the conspiracy charge. The sentences run concurrently. Payton told Bowen he may have a review of sentencing hearing in a year.

Bowen became emotional during the hearing.

Co-defendant Michael Clemente, 21, of Fort Smith pleaded no contest to the same second-degree robbery and conspiracy charges on Oct. 18 and received 10-year and five-year prison sentences to run consecutively.

A Sequoyah County jury found Devin Andrew Jeremiah not guilty Thursday of second-degree murder in the February 2010 shooting death of 1-year-old Elaine Keene.

The jury of three women and nine men deliberated hours longer, however, on two shooting-with-intent-to-kill charges before finding Jeremiah, 22, of Roland guilty on one count and not guilty on the other.

They recommended a sentence of eight years in prison with four years suspended and credit for the time he’s already served in jail.

He must serve 85 percent of any sentence imposed before becoming eligible for parole.

An hour into deliberations, jurors sent a note to the judge, asking if charges could be dropped or reduced to involuntary manslaughter. Payton sent back a note telling them they must base their decision on their original instructions.

Two hours into deliberations, the jurors sent another note out, saying they’d reached a not-guilty verdict on the murder charge, but were undecided on the shooting with intent to kill charges.

In a response note, Payton instructed them to fill out the proper verdict form for the murder charge and to continue deliberations on the other two charges until they reached a decision. The jurors deliberated almost three more hours.

Jeremiah’s father, Kevin Jeremiah, declined comment after the verdict, saying he still has to process it. The trial lasted four days.

Jeremiah is one of four defendants charged in the Feb. 27, 2010, robbery and shooting that led to the March 1, 2010, death of the 1-year-old. He is the robbery and beating victim as well as the person who fired the fatal shot — one of seven shots he fired into the other defendants’ vehicle.

The child died of a single gunshot wound to the head, according to testimony by Medical Examiner Dr. Andrew Sibley of Tulsa. She was in the rear passenger seat behind the driver, her mother.

Assistant District Attorney John David Luton reviewed the testimony and physical evidence in his closing, asserting that the evidence shows Jeremiah was not acting in self-defense when he shot at the car.

Luton noted that in both oral and written statements to Sequoyah County Sheriff’s Office lead investigator Eric Helms on Feb. 27, 2010, Jeremiah said he fired at the car as it was driving down the driveway.

“They just got into their car and was speeding down the drive, leaving my driveway, and I fired a few shots into the vehicle,” Luton read from the written statement.

And Luton reminded the jurors that in Helms’ opinion, the car was moving when the shots were fired, and the immediate threat to Jeremiah was over.
